In fact the English parliament had passed the "Titulus regius" which declared the marriage between Elizabeth Woodville and Edward IV void, making their children bastards. It basically made Richard king. This was not democracy as we know it today, the evidence of the alleged secret engagement to Eleanor Butler was too flimsy at best. It is more likely that parliament made this decision because of the influence of Richard III, resentment of the Woodvilles and because they simply did not want a child king after years of wars over the succession. So technically Richard was elected king in the general election of 1483 with a landslide victory. It was not fair and square, the victorious opponent had a solid reputation gained in battles and governorship in the north of England, and his opponent was a 12 year old boy, currently locked in the tower.
"Henry VII stole the throne!" Ah yes who could forget Richard III's landslide victory in the General Election of 1483.
