“સમાજ” આ શબ્દ મગજ માં ���વતા જ એક ડર મગજ માં આવી જાય છે. રાક્ષસ કરતાં પણ ભયંકર છે આ સમાજ ના એ ચાર લોકો. આ ચાર લોકો વર્ષોથી આપણને જોઈને કઇંક કહી ન જાય એનો ડર તમામ લોકોને લાગતો જ હશે કાતો લાગ્યો હશે અને મન માં ધારેલું કામ નઇ કરી શક્યા હોય ખરું ને?. સમાજ ની વ્યાખ્યા મારા મત મુજબ સમાન ધર્મ, જાતિ, વર્ણ, સ્વભાવ, કર્મ, કે રહેઠાણ ની જગ્યા ના વ્યક્તિઓ નો સમૂહ. પરંતુ મને આજ સુધી એ ચાર લોકો નથી મળ્યા કે જે…

ભૂલી ગયા છે , એક બીજા ને ભૂલી ગયા છે , સૌ સ્વાર્થ ના સગા રહ્યા છે , પ્રેમ નો એ સહવાસ ભૂલી ગયા છે.

યાદ રહ્યા છે માત્ર બાળપણ ના મિત્રો , પણ ભૂલાય ગયા છે એજ બાળપણ ના ચિત્રો, ઘણી સ્મૃતિ રહી ગઈ છે હજુ મનમા , પણ એ સ્મૃતિ ને વાગોળવાનું ભૂલી ગયા છે.

ભૂલી ગયા છે , એક બીજા ને ભૂલી ગયા છે , સૌ સ્વાર્થ ના સગા રહ્યા છે , પ્રેમ નો એ સહવાસ ભૂલી ગયા છે.

માતા નો એ પ્રેમ યાદ રહ્યો છે, પણ માતા નો એ પ્રેમ થી ભરેલો હાથ ભૂલી ગયા છે, પિતા નો એ પરસેવો યાદ રહ્યો છે, પણ પિતા નો એ પ્રેમાળ ચેહરો ભૂલી ગયો છે, યાદ તો ઘણા લોકો રહી ગયા છે, પણ પોતાના જ માં-બાપ ભૂલી ગયા છે.

ભૂલી ગયા છે , એક બીજા ને ભૂલી ગયા છે , સૌ સ્વાર્થ ના સગા રહ્યા છે , પ્રેમ નો એ સહવાસ ભૂલી ગયા છે.

સુરજ ચાંદ સિતારા યાદ રહી ગયા છે, પણ ત્યાજ રેહતા ઈશ્વર ભૂલી ગયા છે, ઈશ્વર ને પામવાનો રસ્તો તો મળી ગયો છે, પણ તેન પર ચાલવાનું ભૂલી ગયા છે, કહ્યું છે ઘણું આ દુનિયા માં આવીને, પણ સાલું સાંભળવાનું જ ભૂલી ગયા છે.

ભૂલી ગયા છે , એક બીજા ને ભૂલી ગયા છે , સૌ સ્વાર્થ ના સગા રહ્યા છે , પ્રેમ નો એ સહવાસ ભૂલી ગયા છે.

રૂપિયા ની દોડ મા એક બીજા ને છુંદી રહ્યા છે, ભાઈ-ભાઈ કે ભાઈ-બહેન ના સંબંધ તૂટી રહ્યા છે, નથી રહ્યું કોઈ આ જગત માં પ્રેમ ના પડખે, પ્રેમ ની એ સુંદર ભાષા ભૂલી ગયા છે.

ભૂલી ગયા છે , એક બીજા ને ભૂલી ગયા છે , સૌ સ્વાર્થ ના સગા રહ્યા છે , પ્રેમ નો એ સહવાસ ભૂલી ગયા છે.

યાદ કરતા હતા જેને અમે રાત અને દિવસ, તેવાજ પોતાના કેહવાતા લોકો દૂર થઇ ગયા છે, એવી હોડ લાગી છે એક બીજા વચ્ચે, સાથ - સહકાર બધા પાછળ છુટી ગયા છે, યાદ રહ્યું છે સ્વાર્થી લોકો સાથે સેલ્ફી લેવાનું, પણ એક ક્ષણ પોતાના ભાઈ સાથે રેહવાનું ભૂલી ગયા છે.

ભૂલી ગયા છે , એક બીજા ને ભૂલી ગયા છે , સૌ સ્વાર્થ ના સગા રહ્યા છે , પ્રેમ નો એ સહવાસ ભૂલી ગયા છે.

યાદ રહ્યો છે સ્વાર્થી પ્રેમી નો સ્વાર્થી પ્રેમ, પણ ભાઈ-બહેન નો નિસ્વાર્થ પ્રેમ ભૂલી ગયા છે, યાદ છે બીજા ના માં-બાપ નો હાલ, પણ પોતાના માં- બાપ નો હાલ ભૂલી ગયા છે, ના જાણે ક્યાં જય રહ્યો છે આ સંબધ નો માર્ગ, સંબંધ નો પ્રેમ ભર્યો નિસ્વાર્થ માર્ગ ભૂલી ગયા છે.

ભૂલી ગયા છે , એક બીજા ને ભૂલી ગયા છે , સૌ સ્વાર્થ ના સગા રહ્યા છે , પ્રેમ નો એ સહવાસ ભૂલી ગયા છે.

ધર્મ ની ચાદર ના રંગ થી યાદ રહ્યા છે એકબીજા, માનવતા ના રંગીન વાઘા ભૂલી ગયા છે, ભાઈ - ભાઈ ની વચ્ચે દુશ્મની ના કળા રંગ યાદ રહ્યા છે, પરંતુ તેમના રક્ત નો એક સમાન રંગ ભૂલી ગયા છે, યાદ રહ્યા છે માનવસર્જીત ઈશ્વર રૂપી રંગ. પરંતુ એજ માનવ માનવ વચ્ચે ના પ્રેમ નો રંગ ભૂલી ગયા છે.

ભૂલી ગયા છે , એક બીજા ને ભૂલી ગયા છે , સૌ સ્વાર્થ ના સગા રહ્યા છે , પ્રેમ નો એ સહવાસ ભૂલી ગયા છે.

વાણી પરનો સંયમ આપણે ગુમાવી રહ્યા છે, સાચા ને સાચો સાબિત કરતા ખોટો કરી રહ્યા છે, ગર્વ થી દેશ વિરોધી સાથે એની કટુ વાણી બોલી રહ્યા છે, પણ ભારત માતા ની જય બોલવાનું ભૂલી ગયા છે, યાદ છે માનવસર્જિત ધર્મ ની ભક્તિ , પરંતુ દેશભક્તિ ના પાઠ ભૂલી ગયા છે.

યાદ રહ્યું છે સ્વાર્થ માટે લોકો સાથે મળવાનું, પણ બીજા ને મદદરૂપ થવાનું ભૂલી ગયા છે, ઉપકાર કરવાનું યાદ રહી ગયું છે, પરોપકાર કરવાનું ભૂલી ગયા છે, સાથે રહી ને સેલ્ફી પડવાનું યાદ રહી ગયું છે, પણ જરૂર સમયે પડખે ઉભા રેહવાનું ભૂલી ગયું છે.

Caste Base Reservation In Education / Career - A Divide Nation System

Reservation system and its history:

The idea of caste based reservation system was proposed by William Hunter and Jyotirao Phule in various forms in 1882 and implemented by Chatrapati Sahuji in 1901. The term was changed to "Depressed Class" in 1932 by Ambedkar and later to "Scheduled Caste/Tribes" during the framing of the constitution in 1950. The idea was that a vast majority of the poor were from a very small caste group and they needed a social net so that they can be accommodated into society as full-fledged members. It is important to note that this part of the reservation was for electoral rights first (to guarantee political representation - Poona Act ‘35) and a education/job rights issue second. Also note that education was made free in these early attempts so that poverty does not hinder their education by these early efforts. If not for Dr.Ambedkar's efforts, even this would not have come through during Independence. Ambedkar remains an icon for minority causes even today and is revered because of this. (Wiki Pedia)

Real Objectives of Reservation as per law:

• Uplift lower strata of society • Ensure proper political representation of minority groups • Ensure that minorities are not discriminated in job selections and promotion The caste based reservation system is built around these three objectives. (Wiki Pedia)

Lets simplify the history of the law and objectives to implementing such law , what this perfectly means in law is:

• Identical opportunity : If a people of lower level applies to a job and has the right qualifications and is a better performer compared to other in same way, he should get the job. It means their caste/economic status should not qualification certificate for which jobs they apply/get selected to. • Identical independence : If a people of lower level wants to get higher qualification degrees like  scientist , engineer , doctor etc.., and has the brainpower and is willing to work towards this goal, there should not be any barriers to pursuing this goal. Ie, they should not be at a disadvantage when choosing their course because they were born poor and from particular caste.

These things encyclopedic great in Law. Opponents of caste based reservation have a valid opposing point, which nearly means: • Actual consequence of such Reservation: By helping people even though they are not have equal credentials or qualifications (reservation gives scope of 10 - 40% reduction for getting admission in good and reputed collages/schools just because of they are from certain caste people) it is not identical opportunity but it is an unfair practices and it turn into reverse discrimination and unfair between two particular caste or level of people.

The factual Effect of “Reservation”

The factual Effect of “Reservation” was to improve the conditions of the backward castes and communities of the society but the effects of reservation have been severe and damaging. The day a child starts his education by enrolling himself in a school, without choice he has become a part of the vicious circle of reservation. And this quota system doesn’t end here; it stays with us till our last breaths. And this fact created following major disadvantages and unfair practices with particular class of people.

 Discrimination of People

We are a secular country and equality is must for secularism to stay alive. Discrimination of the people on the basis of castes and religions has never done any good for the country. As per the quota system, Scheduled Castes (SC-with 15% Reservation), Scheduled Tribes (ST- with 7.5% Reservation) and Other Backward Classes (OBC- with 27% Reservation) are the main beneficiaries of the reservation system in education field.

Dejection of the Good Students

Students who put in the best of their efforts to make it in the merit are discouraged if they fail to get an admission in a good college due to a reservation. They get discouraged and depressed and such situations lead to frustration and suicidal attempts.

Migration of Qualities

When best performer students don’t get admissions in reputed colleges and respective jobs due to reserve seats, they prefer displacing themselves to other countries for better opportunities. This leads to migrate good talent go out from our country and use their intelligence for other country. There are various other impacts of this system that have affected the lives and careers of millions of people across the country just because of caste and religion base reservation or discrimination or unfair with open category and other reserve castes.

In the above, we saw that the laws are totally different for the caste base discrimination from the reality we all feel. I know everyone’s face this situation when they are applying for higher education in good/reputed colleges. Every time quota system creates unfairness with performer students who are not covered under such quota system. If someone having an only 35% to 50% and he/she covered under quota, she/he got an admission in reputed colleges. But on the other side those students who secured above 50% marks even though they are not eligible for the admission just because of they are note covered under such quota.

Yes I’m fully agreeing with government that they want to make India educated India and give such benefits to under privilege people. But this not way, you are served someone on the cost of others. And yes I’m not against the quota system but I am against on such kind of unfair practices with performer students. I have some suggestions for same, you provide free education to them and also give free books to them and yes give free accommodation to them but at the time of admission or job, selection will be done only on basis of merit not on the basis of his/her caste certificate. If we want make an India as a one India, we have to provide certain equality among all the humans. Because education is 1st priority and Right of all the Indians but this right is same as “*” (I.e. terms and conditions are applied) If you are from certain caste , you are eligible for higher education in reputed collage with lower percentages and if you are not you have to suffer such quota system. I know this blog or any other blogs regarding this, never affect the system but I just want to put my view, how feel when you are not selected for higher education in reputed collage just because of your caste and corrupted system. I think is this not fair with other caste or student, when you are applying quota system for increase and decrease a percentage of student just because of they are not born under such reserved caste. If such Quota student is passed out with 35% - 50% marks and getting an admission in medical/engineering course just because of they are from particular caste, do you think they are become a good doctors or engineers with such percentage of knowledge? I think main reason of failure of operation or treatment is just because of such knowledgeable Quota doctors! Same case will happen with engineers also. I am not saying all the doctors / engineers are same but I just want to draw your attention on such useless caste base reservation. I think Government should have to take some action and remove such useless reservation from education and job sectors. Government has to provide equal opportunity for all the students, and yes give such quota students, free education, free accommodation, free books, etc…but not give relaxation in percentage or different cut-off on the basis of caste. Give common platforms to all, those who are able to secure up to mark percentages of particular course or job, only those students are eligible for getting 1st priority.

From this blog I want to just say that, please remove such Quota system in education and job sectors. WE NEED EDUCATION NOT RESERVATION. Give your answer on my blog: Is this fair with all Indian with such Quota system? (Yes/No-with reason)

5) Under Plantation Labour Act, 1951 a Welfare Officer is required to be appointed where the no. of workers is 300

6) Under Plantation Labour Act, Creches is to be set up where 50 women workers are employed or the no. of children of women workers exceeds 20

7) Under Plantation Labour Act, canteen is compulsory where 150workers are working

8) An adult worker under the Factories Act is eligible for leave with wages @ 1 day for every 20days worked during the preceding year

9) Under the Factories Act no worker is permitted to work for more than 9 hours in a day

10) Under the Factories Act, white washing of the factory building should be carried out in every 14months

11) Repainting or re varnishing under the Factories Act is required to be carried out in every 5 years

12) Certification of Standing Orders under the Industrial Employment (Standing Orders) Act, 1946 is mandatory where 100 workers are employed

13) In order to be eligible for maternity benefit under the Maternity Benefit Act, 1961, a woman worker should have worked for not less than 80 days in the 12 months immediately preceding the date of delivery

13-1) Under the Maternity Benefit Act, a woman worker is eligible for 12weeks leave with wages

13-2) In case of miscarriage, a woman worker shall be allowed 6 weeks leave with wages

14) Under the Payment of Wages Act, 1936 payment of wages of establishments employing not more than 1000 employees shall be paid within 7th day of the wage month

15) Under the Payment of Wages Act, payment of wages of establishments employing not less than 1000 employees shall be paid within 10th day of the wage month.

16) An employee is eligible to get bonus under the Payment of Bonus Act, 1965 if he had worked for not less than 30 days in the preceding year

16-1) An employee whose salary does not exceed Rs.10000 is eligible for Bonus under the Payment of Bonus Act.

16-2) The statutory minimum bonus is8.33%

16-3) Maximum bonus under the Payment of Bonus Act is 20%

17) In order to be eligible for Gratuity under the Payment of Gratuity Act, 1972, an employee should have a minimum continuous service of 5 years.

17-1) Under the Payment of Gratuity Act, the rate of gratuity is 15 Days salary for every completed year of service

17-2)A news paper employee is eligible for gratuity if he has 3 years continuous years of service

18) Employees who are drawing salary not more than 15000 are covered under the Employees State Insurance Act, 1948.

18-1) Employees��� share of contribution under the ESI Act is 1.75%

18-2) The employer’s share of contribution under the ESI Act is4.75%

26) Subsistence Allowance @ 75% shall be paid if suspension extends to a period beyond 90 days

27) The wages under the Minimum Wages Act, 1948 shall include a basic rate of wages and dearness allowance variable according to cost of living

28) Employees State Insurance Act absolves the employer’s liability under the Maternity Benefit Act and Workmen Compensation Act.

29) Any amount due from an employer under settlement or award can be recovered following the procedures laid down in section 33 (C) of the Industrial Disputes Act.

પ્રેમ નો સંબંધ

મારી એ કલ્પના હતી કે એ વિસરી મને , કિન્તુ એ માત્ર ભ્રમ હતો થઇ ખાતરી મને , ભૂલી વફા ની રીત ના ભૂલી જરીકેય મને , લ્યો એમના લગ્ન ની મળી કંકોત્રી મને।

  કેહતી હતી પ્રેમ ની વાતો દિલ થી મને, ભૂલી ગઈ એ આ બધી પ્રેમ ની વાતો હવે, જોયો તો એમણે જયારે પેહલી જ વાર મને , થયો તો નજર થી પ્રેમ એને અને મને , ભૂલી ગઈ આ નજર નો સરવાળો અને મને , ભૂલી વફા ની રીત ના ભૂલી જરીકેય મને , લ્યો એમના લગ્ન ની મળી કંકોત્રી મને।

  કંકોત્રી થી એટલું પુરવાર થઇ છે , નિષ્ફળ બને જો પ્રેમ તો વ્યવહાર થાય છે , સાથ ના મળે તોય એક સદચાર થાય છે , નથી મળતો એમનો પ્રેમ તોય તહેવાર થાય છે , દુખ છે હજાર તોય અજુ એજ ખેદ છે , કંકોત્રી નથી આ એક હ્રદય નો છેદ છે , ભૂલી વફા ની રીત ના ભૂલી જરીકેય મને , લ્યો એમના લગ્ન ની મળી કંકોત્રી મને।

  કાગળ છે એનો એક ખીલતા ગુલાબ સમ , અક્ષર છે એના એક મોતી ના રૂપ સમ , નથી માત્ર એમનો સાથ હવે મારા સંગ , નથી રહ્યો પ્રેમ અને હર્ષ નો હવે એ સંપ , તેથીજ રહ્યો છે આ વ્યવહાર માત્ર લગ્ન સંગ , નથી મળતો એ વ્યવહાર હવે પ્રેમ ની વાતો સંગ , તેમ છતાય ભલે ભૂલી વફા ની રીત ના ભૂલી જરીકેય મને , લ્યો એમના લગ્ન ની મળી કંકોત્રી મને।

  થઇ કલ્પના ખુદ એની જ કંકોત્રી થી મને , ના મળી કોઈ વ્યથા કપરી આના સિવાય મને , થયું ઘણું દુખ સાંભળી ને આ મને , પરંતુ ખુશી છે ઘણી એની ખુશી માજ મને , ના પામ્યો એ પ્રેમ જે મળ્યો તો મને , ખેદ નથી પ્રેમ ની નિષ્ફળતા નો મને, કેમ કે ભૂલી વફા ની રીત ના ભૂલી જરીકેય મને , લ્યો એમના લગ્ન ની મળી કંકોત્રી મને।

  નિષ્ફળ બન્યો આ પ્રેમ ખુદ એના જ હાથ થી , પ્રેમ ને ના મળી મંજિલ આ તૂફાન આવવા થી , સરનામું મારું ભીનું છે ખુદ એનાજ અશ્રુ થી , તણાઈ ગયો હું આ દુખ ના વરસાદ થી , છતાં શ્વાસ ચાલે છે મારા માત્ર એક જ આશા થી , ભૂલી વફા ની રીત ના ભૂલી જરીકેય મને , લ્યો એમના લગ્ન ની મળી કંકોત્રી મને।

  એ પ્રેમ નો વરસતો વરસાદ હવે ગયો , સ્ટેશન ઉપર થતો હતો મેળાપ નો સવાંદ પણ હવે ગયો , નજીક નો સંબંધ દુર નો થઇ હવે ગયો , દુખ થી મારો સંબંધ થઇ નજીક નો હવે ગયો , ખુશી થી થતો હતો એ વ્યંગ પણ હવે ગયો , માનતો હતો જેમણે મારા એમનો સાથ પણ હવે ગયો, તેમ છતાં હું દુખી નથી અને ખુશ થઇ હવે ગયો , કેમકે ભૂલી વફા ની રીત ના ભૂલી જરીકેય મને , લ્યો એમના લગ્ન ની મળી કંકોત્રી મને।
