AI companies are acquiring content across the internet for a variety of purposes in all sorts of ways. There are currently very few regulations giving individuals control over how their content is used by AI platforms. Proposed regulations around the world, like the European Union’s AI Act, would give individuals more control over whether and how their content is utilized by this emerging technology. We support this right regardless of geographic location, so we’re releasing a toggle to opt out of sharing content from your public blogs with third parties, including AI platforms that use this content for model training. We’re also working with partners to ensure you have as much control as possible regarding what content is used.

Here are the important details:

We already discourage AI crawlers from gathering content from Tumblr and will continue to do so, save for those with which we partner. 

We want to represent all of you on Tumblr and ensure that protections are in place for how your content is used. We are committed to making sure our partners respect those decisions.

To opt out of sharing your public blogs’ content with third parties, visit each of your public blogs’ blog settings via the web interface and toggle on the “Prevent third-party sharing” option.

I got this comment on a story from my Other AO3 Account this morning.

(Info redacted because I prefer keeping these accounts separate but no one follows me on the side blog I have for that account.)

The story was posted almost a year ago and is relatively “popular” by my average statistics even though it has tropes and themes that are big turnoffs for a lot of people (hence separate accounts). This popularity is undoubtedly because it’s a Marvel Loki story and that fandom is massive.

So there is obviously an algorithm or a bot scrubbing ao3 statistics and leaving this comment on fics that meet a certain metric with the main character of the fic inserted into the comment.

I had a little time to kill this morning so I decided to investigate further. And y’all this is so predatory. Come on this journey with me. It made me mad. It may make you mad.

First, if you go to Webnovel’s website, you HAVE to choose between male lead or female lead stories before you can go any further. WTF?

And that’s weird, but this gets so much worse. This is basically a pay-to-read site that has different subscription models. Which… okay BUT! The authors don’t get paid! Look at that comment again. They’re promising a supportive and nurturing community, but zero monetary compensation. It’s basically, “post your stuff here so we can get paid and you can get… nice vibes?” I mean look at this Orwellian writing:

Using the phrase “pay-to-read model” in the same sentence as “qualitative changes in lifestyles for authors” deliberately makes you think that you can get paid and maybe even make a living on this website. But that’s not actually what it says and authors will not receive one red cent.

Oh but wait, the worst is still to come. In case this breaks containment (which I kind of hope it does) this is where I mention that I’m a lawyer in the US.

I don’t do intellectual property or copyright law but I do read and write contracts for a living. So I went to look at their terms of service. It was fun!

Highlights the first, in which Webnovel gets a license to do basically whatever they want with content you post on their site. This is how they get to be paid for people reading authors’ writing without paying them anything.

Highlights the second, in which Webnovel takes no responsibility for illegally profiting off of fan fic. This all says that the writer is 100% responsible for everything the writer posts (even though only Webnovel is making money from it).

Highlights the third which say that by posting, the author is representing that they have the legal right to use and to let Webnovel use the content according to these terms. So if a writer posts fan fiction and Webnovel makes money from people reading the fan fiction, and the House of the Mouse catches wise, these sections say that that’s ALL on the writer.

So that’s a little skeevy to start off with but the thing that is seriously shitty and made me make this post was that these assholes are coming to ao3. They are actively recruiting people in comments on their fan fiction. And they are saying they are big fans of the character you’re writing about and that they share your interests.

They are recruiting fan fiction writers and giving every impression that you can make money from posting fan fiction on their site and hiding the fact that you absolutely cannot but they can make money off of you while you try, deep in their terms of service which no one but a lawyer who writes fan fic and has some time to kill will read.

I see posts on here regularly from people who don’t understand how this stuff works, don’t understand that they (and others) can not legally make a financial profit from fan fiction. And there are tons of people who will not take the time to dig into the details.

Don’t deal with these bastards. Fuck Webnovel.

Valerius, standing up: Liar! I haven’t seen him since the masquerade

Julian, standing up again: Alright let’s not fight. I killed him, let me turn myself in..

Apprentice, pushing him back in his seat: No. Who killed him?

Asra, leans over: *whispering* Apprentice, the courtiers have been awfully quiet…

Courtiers, wife eyed: Really?!

Asra: Yeah, really!

Lucio, smirking, listening from outside the window: I’m alive. I just jumped out the window in my fursona while my room was on fire. I predict ten minutes from now, they’ll be at each other’s throats with warpaint on their faces and a pig head on a stick. Good. It was getting a little chummy around here

I have so much trouble making choices in Portia’s route. Like, we know now that reversed and upright ends are based on if you encouraged the bad habits of the characters or if you pushed them to grow and change and fix their mistakes.

Even before we knew that it always felt right to me to do that? Like Julian’s martyr complex was clearly unhealthy and I never encouraged his melodramatic bullshit because I just thought he was being ridiculous. And then that ended up that I was doing the right thing (in terms of seeking the upright ending) in helping him realize his own value. And same with Asra and Nadia, encouraging their bad habits seemed like a bad choice because those habits annoyed me. No I’m not going to tell Asra his behavior is okay because it wasn’t! No I’m not going to let Nadia take the world on her shoulders because that’s not healthy! And then that turned into upright endings because I was lucky with how I decided to play my character.

Now, we know the formula. If you want upright you help them form good habits, and reversed you let them carry on with their codependency or going on without changing anything. Picking choices for Muriel is so obvious because anything that either tells him the world sucks and he’s right to fuck off to the woods or anything that says it isn’t about his character or actions but it’s how you feel about him that matters isn’t good. His bad habit is isolation, and then by telling him “your past is okay because I love you anyways” doesn’t help him confront his past and forms an unhealthy dependency on your relationship. Lucio’s choices are even more obvious- if you think the answer is what he wants to hear (you’re flawless, they’re overreacting, don’t worry your past mistakes don’t matter at all and you deserve instantaneous forgiveness because you lifted a pinky in the right direction) then that’s the way to the reversed end. He needs to address that he is flawed, he did fuck up, and he does need to work really fucking hard to earn trust from the people he fucked over.

All that being said, I don’t know how to pick choices for Portia. Nothing she does seems remotely close to the others’ problems. My main issue is that any flaw she seems to have she seems to manage well. She’s a hard worker, but I don’t need to push her against her will to let others help her. She trusts easily, but is it a bad thing to think the best of people? Should I discourage that? She’s never killed anyone and doesn’t seem to be running from a tragic unknown past. She can be dishonest on occasion but doesn’t like to be and she comes clean as soon as she can, so in that regard she’s just being a human. Every choice I pick is just ‘eh this feels right for the moment’ because I can’t for the life of me find The Big Problem I’m supposed to be helping her fix.
