Update on Jukin  Media
Well, MxR  Plays just released a video on YouTube, thanking everyone for the support and for the social media pressure that has been applied to Jukin Media in the last five days! They also said that Jukin Media has reached out to them and they have arrived at an agreement (the terms of which they were not at liberty to discuss) that should allow them to get back to the business of making funny videos and resume their normal lives. They also expressed their gratitude to everyone for showing there support on social media like Twitter, and for the Quartering’s and others immediate coverage and efforts to dig deeper into the story of Jukin's past legal issues (including a previous Court ruling in which Jukin basically destroyed their own case against a YouTube Channel by failing to present proper documentation in court to back their claims on the videos in question).

That's great news! They did however mention that they were saddened to hear that some individuals where online stalking or harassing individual employees and executives at Jukin Media (Come on folks, refusing to do business with Jukin or spreading the word on social media is one thing, but lets not go threatening and harassing people! Use your Big Boy/Girl words to affect change, not threats and scare tactics!) Ironically, less then an hour before Henry and Jeannie at MxR Plays released their video, The Quartering published a video which notes that other prominant YouTubers like Tyrone Magnus have come forward to say that Jukin Media have attempted to 'extract' money from them with the threat of copy right strikes in the past. The Quartering even shows an email sent to Tyrone Magnus in which they dangle the possibility of retracting the copy right strike claim if the YouTuber in question will purchase a 'Licencing Package' from Jukin Media. At the very least, Jukin Media has shown that they are misrepresenting the Fair Use and Copy Rights laws to frighten/intimidate YouTubers, Willfully abusing the Copy Right Strike system on YouTube to extract money from content creators, and are possibly guilty of unfair business practices. I so hope the social media pressure keeps up and at very least forces a positive change in the way they do business!

They Can’t Be Serious...
(Before I begin, I apologize to any of my friends and visitors who are not interested in such goings on, but I feel the need to dust off my Soap Box and rant when ever I see content creators getting abused on a "public" platform, and as some one who has considered creating a YoutTube channel in the past, I still find such things of interest) So, as I mentioned in a previous rant, I watch a lot of YouTube lately (no job and nothing to do most days will do that to you). One of the channels I watch is MxR Plays. There is just something funny and charming about a slightly pervy boyfriend searching the interwebs for videos and memes to creep out or otherwise disturb his wholesome girlfriend and watching them react. (I usually hate 'reaction' videos, but I find the pair of them funny and sweet) So they posted a video last night to tell a sad story... The current story... Their normal type of video...(also from yesterday) Apparently a company known as Jukin Media, which licenses viral videos from creators, with the promise that the original creators will get paid for them, has issued copy right strikes against MxR's channel in the past, essentially stealing the ad revenue from the video, because it contains all or part of a 10 to 20 second video clip or meme that Jukin Media claims to 'own' the rights to... And now they are flat out extorting money from this poor couple (MxR is literally paying his girlfriend Jeanie's way through medical school with the revenue from the channel) by sending them ridiculous bills in excess of $1,500 US for the license to the clip used in the video, claiming that MxR is at fault and could have just bought a license to the clip for $50 US from their site... A couple things about that... First, there exists a thing known as FAIR USE, it's a legal thing. You can use a video clip from someone else's work in your video or film as long as it is for the purposes of Comedy/Satire, or Commentary, and the clip does not represent more then a few seconds ( I forget how long, but less then 1 minute) of the unedited original work or does not claim to be an original work of the satirist... So you don't even have to ask permission first, let alone buy a license. If this wasn't a thing, there would be NO movie reviews or reaction videos on YouTube or anywhere else!!! Second, if the license for the video clip was only $50, then why are they sending bills of $1500 or more per use?! Shouldn't the bill be $50 per violation? Third, Why aren't they just filing a Copy Right Violation claim with YouTube, like they are supposed to? (Short answer is that YouTube changed their policies on these kinds of complaints so that the complainant no longer takes 100% of the ad revenue, because so many people were filing frivolous complaints, just to steal money from creators that YouTube couldn't keep up with it...) Forth, the last time this company sent one of these threatening bills, MxR (fearing the lose of his channel or expensive legal action) paid it. And they filed a Copy Right Strike on the video anyway... Real Nice! Some of MxRs viewers referred the story to YouTube News and Advocacy channel, The Quartering in the hopes of helping MxR and Jeanie. The Quartering just released this video on the matter The Quartering's Response   And I'm happy to see the video get over 42,590 views and 6,788 likes in just one hour! This is just plain extortion! And if it is allowed to continue, Every channel that does reaction videos, movie or game reviews, comic and art reviews... pretty much any channel that shows clips from anything, images  or sound bites will be in danger from predatory companies looking to abuse YouTube's already faulty Copy Right Review system or just extort money from hard working but unwary content creators! And even scarier, if it works on one platform, you KNOW some Ass-Hat will try it on others. Imagine posting a photo, render or drawing and then being contacted because some weasel has claimed that the image is theirs because it contains a publicly available background image or asset and they demand that you give them all the money you may or may not have made from distribution of that image! If you've got a cute, funny, or weird home video, don't sign it over to Jukin Media!!! Any money you get will be money taken from from fellow creators! Send it to America's Funniest Home Videos or something, at least they don't promise you anything (except that to MAY win $10,000...) I guess Content Creators are never really safe online unless we all stick together and stay informed! To paraphrase a movie line, "Why are some mother fuckers always trying to ice-skate up hill?!"... (Blade, 1998) (Great, now I'll probably get a nasty letter from New Line Cinema!)

The FTC thinks YOU are a Child
Y'all ready for the rant of the month, well strap in, because here it comes! Apparently, due to some shady business tactics, used by certain YouTube Channels who were clearly pushing products aimed at children while pretending to be an unbiased review (the channels, I believe, where operated by the product manufacturers themselves but they paid a child presenter to host the channel and the review) Google/YouTube lost a $170,000,000 law suit to the FTC, because YouTube gathers analytic data on YouTube views, and thus illegally gathered data about minors without their parents consent and provided targeted advertisements and links (these only apply if you DO NOT use the YouTube Kids app/page, so for fucks sake, if you have kids who watch YouTube, have them use the kid friendly version!) Why am I so pissed about it? Because due to this whole issue YouTube and FTC are ganging up to start punishing any YouTube Channel that provides what they call "Child Attractive" content. So let's say you make a video about how you found your old G.I. Joe Mobile Battle Platform, or your original 1980's Barbie Dreamhouse, in your attic and how much you loved it as a kid, or how much it sucks in hind sight, if YouTube or the FTC flags your video or channel, you will no longer get Recommended to other viewers, you cannot earn ad revenue, viewers cannot leave comments, you may be banned from hosting live-streams, your video will not show up in searches... Essentially, your video is dead, and possibly your channel to. So if you've spent the last 10 years building a YouTube channel based on retro toys, comics,adult collectibles, etc. until it becomes so popular that it becomes your career, you're screwed. And it gets worse, if the FTC decides that a video/videos are in violation of the COPPA Act (Children's Online Privacy Protection Act) then YOU (not YouTube, YOU the video creator) face a fine of $42,000 per video... Are they insane?! Why should you care? Well, That's a good question Skippy, I'm glad you asked... Maybe you don't have or want a YouTube Channel... Maybe you think it's a silly way for an adult to make a living (well aren't you a ray of sunshine?!) Doesn't matter, from New Years onward, if you watch a video related to toys, vintage toys, actions figures, collectibles, Barbie, dollhouses, cartoons, etc. then YouTube, and the Federal Trade Commission will assume that YOU are a CHILD!If it wasn't bad enough your parents or co-workers judging you, now the Government has decided that no adult human being could possibly like cartoons (despite the four most popular animated TV shows of the last three decades all carrying a TV-MA rating), or Toys (Except half of all Hasbro and Mattel's business coming from adult collectibles),or Video Games (come on, do I even have to say it? GTA, Fallout, Assassin's Creed, BioShock all rated M for Mature) or comics (have you even tried to read a comic book in the last two decades? It's like a soap opera with super powers)! No YOU MUST BE A CHILD! Well to that I say... FUCK YOU FTC!!! Fuck you... Now as it happens, several of my favorite YouTube Channels deal with either vintage toys and cartoons from the 1970's and 80's or collectible action figures. These channels, like RetroBlasting, Toy Paloy, Toy Galaxy, Pixel Dan, etc., do not cater to kids, and never have. Half of them wouldn't really interest anyone under 25. But they are in the cross hairs with any other channel that talks about toys, and it's ridiculous. And what's scarier is that once channels like this are purged (more then a few YouTube creators have already jumped ship) there with still be kids on YouTube. Kids in need of something to watch, and Google is still gathering data... so in 6 months, we're gonna have to go through all of this again, except this time it could be Video Game reviews and Lore videos on the chopping block (If they take down Oxhorn, so help me, I'll riot!!!) or videos about things like 'Weird stuff you never noticed in classic cartoons" or "Details Disney didn't want you to see", and channels like Dorkly, What Culture, Looper, Nerdist, etc. are gone... But the kids will still be looking for something to watch... You get me? Marvel and the Avengers, Star Wars, Star Trek, Transformers,GI JOE, He-Man, MASK, The X-Men, My Little Pony, Strawberry Shortcake, ThunderCats, Silver Hawks... pretty much anything my generation grew up with (And pretty much ANYTHING ever mentioned on an episode of Robot Chicken) is in danger of becoming a 'buzz word' that will get a content creator in trouble for talking about it! Then what are we supposed to talk about, THE FUCKING WEATHER?! Well,(and it goes without saying, but all of this only applies to folks in the US) you can tell the FTC to fix the problem instead of blindly groping for a bandaid... The FTC has asked for comments on the matter (a sign that they KNOW this ain't gonna work) so you can go here to leave a comment or suggestion https://www.regulations.gov/comment?D=FTC-2019-0054-0001 Check Out this RetroBlasting Video for info on what to do about it!
Or you can check out this video by Retroblasting (in fact, if you grew up in the 80's check them out anyway) where Mike, one of the owners, explains the problem, and has links to a form letter you can send in (saves you from having to type a page full of "fuck off, fuck off, fuck off" and it was composed by a Media Lawyer. So it may actual get through to them... Either way, I suggest you do something, we've already had a ton of creators (adult artists mind you) get kicked off of Blogspot and then Tumblr because we got lumped in with perverts and pedos, now even lovers of old toys and cartoons aren't safe because the government has no problem making sweeping generalizations. Companies and even the government need to learn that the way to solve online problems is not to over react and punish everyone in sight (isn't that the online equivalent of saying "we all look alike"?) but to come up with a well thought out and reasonable response that actually addresses the matter at hand. Stan Lee (1922-2018) If the only true immortality a man can ever have is the legacy he leaves behind, then in many ways Stan 'The Man' Lee will out live us all... I remember the first Marvel comic I ever read was the Spider-man special issue that they handed out in school as part of the 'Just Say No' campaign. It was a terribly ham-fisted story, but it got the 'drugs are bad' message across in no uncertain terms. When I later learned that the U.S. Government had asked Marvel to do the comic, and that the Comic-Code Authority had refused to endorse the book because drug use of any kind was prohibited by the Code... Even though the story was obviously Anti-Drug... and Marvel (Stan Lee was at that time still president) had decided that if the Code was that antiquated it was time to remove the Code-Authority Logo from all there books and move on. So they published the book anyway, with out the Comic-Code Authority endorsement, for the first time (I think) since the company had been known as Timely Comics in the early '50's. Why do I relate that story? Because it showed a principal and integrity that made me proud to be a Marvel fan. Obviously, Stan Lee didn't run Marvel alone, he had a lot of help from fellow legends like Jack 'King' Kirby and Steve Ditko and so many others. But Stan, if not directly responsible for the creation of, definitely had a crucial part in the creation of some of the most legendary characters of all time.   While you can say what you will about comics books as art or anything else, it would be hard to deny that few other creative minds have had a bigger impact on the hearts and minds of the people for over half a century. 
So long Stan, and thanks for everything.
