PACO LARRAÑAGA’S CASE
The documentary of Rappler ‘Give Up Tomorrow’ shows the trail of Choing Sisters Case with their main suspect, Paco Larrañaga and six others. Where the justice system of the Philippines convicted Paco and six others of murder.
The Chiong murder case (People of the Philippines v. Francisco Juan Larrañaga et al.) was a trial regarding an incident on July 16, 1997 in Cebu, the Philippines, in which sisters Marijoy and Jacqueline Chiong were kidnapped, raped, and murdered. Francisco Juan "Paco" Larrañaga (b. 1977), a man of dual Filipino and Spanish citizenship was, along with six others, convicted of murder, and sentenced to death by lethal injection on February 3, 2004.
According to the prosecutors, at 10:00 p.m. on July 16, 1997, Larrañaga and six other defendants kidnapped the Chiong sisters near a mall on the island of Cebu in the Philippines, raped them, and then threw one of the sisters into a ravine. (This was later disputed as there was no formal identification of the body, and later thought not to be the body of one of the sisters.) The other sister was never found. In the said documentary ‘Give Up Tomorrow’ Chiong Sisters case were considered at that time the worst crime in Cebu City the Police were pressured to come up with the suspects and right there September 15, Paco called his parents and that Paco is surrounded by four men who introduced their selves as the police and were illegally arresting Paco. As they questioned the police why they were arresting Paco they answered that it was related to the Chiong sisters.
And it’s stated there that the alleged toward Paco happen on July 16, were Paco’s alibi were proven by the school record that Paco is at school when the crime happened especially that Paco is studying at Manila and the crime happened in Cebu City which are 350 miles away from each other.
Nevertheless, Paco were still arrested with other six guys and portrayed as the main leader of the gang and throwed behind the bars. The mother of the victim says Paco is admirer of her daughter Mary Joy and keep on tailing her in school, contrary on what Paco’s sister said, Paco was not an admirer of Mary Joy nor Jacqueline Chiong, nor did ever bring them to their house, nor did even know them.
When the case took in the supreme court a man named David Russia became the key witness about the Chiong Sisters that give high to the victim’s family, but on the other hand the witnesses who stand with Paco were dismissed by the assigned judge and says they were too many and sentenced Paco with the six other person a life imprisonment, which the latter opposes and seek for death penalty. Since Chiong sister family has a connection with the upper authority and the people media that made the supreme court came up to a decision, giving Paco a death penalty.
As the Larrañaga family know that they have no chance against the decisions of the supreme court, Paco being a Spanish citizen used his citizenship to seek for help but they cannot do anything since that the case were already reached the supreme court. When the Philippines supreme court rejected the second appeal, they applied to the United Nations Human Rights and Committee and agreed to take the case; insufficient evidence, amounted to denial of Justice, trial Judge was obstructed, a victim vilations of article 6, article 7; article 9, and article 14 of the Covenant by the Philippines, and Supreme Court failed to respond adequately.
November 2005, Jose Bono. The Spanish Minister traveled to Philippines to meet with President Arroyo and discussed relations between two countries and use this advantage to tackle about Paco’s case. The next year, June 2006 President Arroyo abolished Paco’s death penalty and both countries came up to an agreement about the transfer of the convict and finish his life imprisonment in Spanish Prison.
To this day, the Chiong Sister case speculations continues and with the documentary as the basis of this evaluations it shows how connections and people media affect a case that even with insufficient evidences, amounted to denial of justice lead to injustices and shows how some uses their authority, their power even if they lack evidences and put innocents behind bars. Upholding the wrong, and covering the truth can’t change the fact that injustices shows how the country’s (some) people how incompetent they work.
