There’s a new constable in town, and you’ll be surprised how he views his new job

Forget everything you thought you knew about an Arizona constable’s work—Tempe’s new man in that job will tell you a far different story.
“I’m here to do this job in a spiritual way,” says Kent Rini, newly elected constable of Maricopa County’s Kyrene Justice Court Precinct. “And I want to encourage other constables to operate within that deeper awareness.”
Yes, you heard the word “spiritual” attached to the sometimes gritty work of serving the area’s Justice of the Peace and Magistrate courts’ subpoenas, evictions, and all. Rini, a Democrat, defeated incumbent Brandon Schmoll, a Republican, in the Nov. 6 general election.
But Rini, after a lifetime in security and law enforcement, came by his spirituality the hard way—by narrowly escaping death.
Basically, Rini says, “I died. Then I was transported to the spiritual dimension, where I talked to God.” This after sustaining multiple injuries in a car accident in 1973 and passing through a classic near-death experience.
“One of the injuries was that I suffered a broken jaw,” Rini remembers, “which in and of itself might have been OK, but the ER nurse misapplied the mouth tube, and when I threw up, I choked to death.” At this point, says Rini, other, more transcendent, awareness ensued.
“At the moment of choking, I started floating up, and then I continued floating up through the ceiling,” Rini says. “Finally, I began to experience something—it’s hard to put into words—something like universal consciousness. Within that, I actually met God.”
Such an experience was life-changing, says Rini, and ultimately caused him to make major changes in his life goals.
“As a college student, I got into acting, did radio and other shows for the public media networks,” Rini remembers, “and in general tried to incorporate everything I could within the area of my communications major.”
He received a B.A. in communications from Florida International University, went on to earn a communications M.A. from Arizona State University, and often worked as an actor, even landing a small part in “Jerry Maguire.” But his brush with death, Rini says, changed everything.
“There I was, engrossed in my communications studies, and then the accident,” Rini recounts. “With that experience, I decided to come back to this world and be of service.”
The rest of his life seemed to follow on in good order.
“I knew it was time to focus my studies in a higher vein, something that would help foster spiritual growth,” says Rini, and after receiving a doctor of divinity degree from Scottsdale’s Logos Center, he became an ordained minister.
He’s quick to add the work of a constable and the role of a minister pose no great conflict for him.
“I believe my spiritual beliefs will shape my professional conduct more than anything else,” Rini says, adding he hopes to change the approach to his area of law enforcement for the better.
“I’m not a redneck—I’m here to give constables a new idea,” says Rini, “one that’s pledged in its heart to truly protect and serve. I going to see that everybody is safe, and gets equal treatment.”
The new constable notes he will use his long experience in security to help him broaden the duties required of him by the courts.
“I owned and operated a security and alarm company for 18 years,” says Rini, “and learned a whole host of things that will help me be a better constable.”
With an awareness that the position of constable carries more direct individual citizen contact than any other law enforcement position, Rini says he wants his constituents to know his outreach to them will be a major effort.
“Anybody who wants my personal cell phone number will get it,” Rini says. “I’m even publishing my number in all my literature. And I’ll have a constable car—I want people to see me.” He plans to expand another area of community service as well.
“Not only do I want people to be able to phone in 24/7,” Rini says, “I also see myself as an educator—and I plan to offer safety seminars to the community as I have done in the past.”
Rini worked for 12 years with Maricopa County Sheriff Paul Penzone in the county’s Silent Witness program, and also offered safety courses for SEVRAR, the SouthEast Valley Regional Association of Realtors, where he is an affiliate director. He adds his time working with the sheriff’s office was especially instructive.
“Sheriff Penzone started a new and better policing philosophy of action, reaching out to the community, and initiating such things as shutting down tent city,” Rini says, “and I want to move in a similar direction in the work that I do.” Rini also has plans for neglected populations in the community.
“Yes, I want to serve the whole community, and I will certainly do that,” Rini promises, “but I will be especially protective of children and the elderly. The elder population in particular experiences abuse that sometimes goes unnoticed—I saw a lot of situations involving the elderly while working with Paul (Penzone).”
But that’s the thing with Kent Rini: just when you think you’ve got a grasp on him as a committed law enforcement official, he shows you another vista into his motivations.
“Look. Everything is about higher consciousness—I want to always be drawing on that,” Rini reflects. “That’s what my death experience, and my involvement with Noetic Science, taught me.”
(In its modern practice, Noetic Science is dedicated to the study of, among other things, psychic phenomena, parapsychology and the Higher Mind, advanced in this country in the 1970’s by former NASA Apollo 14 Astronaut Edgar Dean “Ed” Mitchell.)
And Higher Mind is what Kent Rini is all about.
“For me, it always has to come down to this: Every day I go out into the world, and I judge myself according to my spirituality. I strive to do everything in a spiritual way—and that’s the way I will serve the people.”

Stop Right There! Brandon Squirrel Wins World Photo Contest
BRANDON, FL – What may be the most famous squirrel in the world makes his home in Mary McGowan’s back yard in Brandon, Florida.
McGowan has dubbed the squirrel Stanley Sir Fancy Pants-less. She figures he deserves a title after winning her international acclaim and a grand prize wildlife photography award that includes a safari trip to Africa.
"I’m an amateur photographer and take my camera everywhere," said McGowan.
One of her favorite subjects is the wildlife in her own back yard.
"I always feed the birds but was having a problem with the squirrels stealing their birdseed so I set up a little area just for the squirrels to come and get nuts," she said.
She was photographing the frenzy for nuts one day when Stanley did something unexpected.
"He was making these crazy gestures like a nut went down his throat the wrong way or something," said McGowan.
McGowan said she had only seconds to capture the moment on camera.
"I took just three shots, and one of them ended up a winner," she said.
In the photo, Stanley is holding his arms up as if to warn a fellow squirrel to stop invading his nut turf.
McGowan captured the photo: "Stop right there!"
It proved the be the "decisive moment," a phrase coined by French humanist photographer Henri Cartier-Bresson.
On a lark, McGowan decided to enter it in a photography contest.
To her shock, her photograph was a worldwide hit.
Last month, the Born-Free Foundation flew McGowan to London to accept the Overall award, Best on Land award and People’s Choice award in the foundation’s annual The Comedy Wildlife Photography Awards.
Her photo, which was among 41 finalists, beat out a picture of a polar bear looking through a telescope, hugging lizards and a hyena with "wings."
"I’m on Cloud 9," she said "My family and friends just can’t believe it. Out of thousands of entries, my photograph won."
The grand prize for the overall winner included a "trophy of a silly monkey," a camera bag and a luxury safari for two through Kenya led by Alex Walker’s Serian Creatures of the Land Safaris.
"I couldn’t believe it. I’ve always wanted to go to Africa," she said. She and her husband, Ed, are in the process of scheduling their dream trip.
Since winning the grand prize, McGowan’s famous photo has appeared on the "Ellen DeGeneres Show," the BBC and on the National Geographic website
Although McGowan said her photo of Stanley is probably a once-in-a-lifetime shot, she continues carrying her camera everywhere – just in case.

LP.org: Libertarians win local races, achieve ballot access, prevail on initiatives

The Nov. 6 election brought several significant victories for the Libertarian Party, including winning local races for public office in Florida, Kentucky, Minnesota, and Tennessee. Even in some states without a winning candidate, Libertarian vote totals were high enough to secure the party’s ballot access for future elections in Indiana, Massachusetts, New York, Oklahoma, Wyoming, and the District of Columbia, which will allow future candidates to focus on their campaigns rather than the costly and painstaking process of petition qualification. Libertarian-leaning ballot initiatives also passed in multiple states, including medical marijuana in Missouri and Utah and recreational marijuana in Michigan.
Cole Ebel, chair of the Libertarian Party of Tennessee, won his race for Carthage City Council on a platform of transparency, fiscal responsibility, and rigorous questioning of standard political assumptions. “I will always stand on principle above all,” Ebel said. “This is not a position I am running for to elevate myself, but a position I am seeking to represent the citizen. I cannot do this alone nor would I seek to. We must do this together.” He joins his wife, Smith County Commissioner Erica Ebel, in holding elected office in Tennessee.
Three Libertarians in Minnesota won their city council races, including Vince Workman in Burnsville, Olga Parsons in Crystal, and Nick Roehl in Plymouth. Four Libertarians in Indiana were also elected to public office, with Cheryl Heacox winning for Greensfork township advisor and Dean Hartley for Franklin township board both winning top-three positions, as well as two other candidates running unopposed, Terry Coffman for Liberty township board and Jamie Owens for Liberty township trustee. Libertarian Shannon Denniston won her race for Montgomery County magistrate in Kentucky. In Florida, Libertarian Shawn Elliott was elected to the Indian River Soil and Water Conservation District 1 with 68 percent of the vote. In South Carolina, Libertarian Artie Buxton won his race for school board in District 1, with 67 percent of the vote.
In a heartbreaking near-miss, Libertarian Bethany Baldes barely lost by only 53 votes in her race to upset Republican incumbent David Miller in Wyoming’s state House District 55. Before the absentee ballots were counted, she had been leading by 194 votes. There may be a recount, however, so it’s possible that this outcome could change. Her near-win was aided by a campaign strategy devised by Libertarian Party Campaigns Advisor Apollo Pazell, who brought Baldes from door to door on crutches in her district, despite her recent leg injury. They campaigned together with a team of six volunteers, knocking on every door in the district a total of three times each. That hardworking personal approach nearly succeeded.
Libertarian Jeff Hewitt’s race for the Board of Supervisors in Riverside County, Calif., is still up in the air. Preliminary reports show that Hewitt has 23,406 votes, more than 49 percent of the total, but is still short by 360 votes. Thousands of provisional and mail-in ballots have yet to be counted, however, so a victory in this race is still possible.
Libertarians in states without automatic ballot access have to spend an inordinate amount of time, money, and effort every year qualifying their candidates through petitioning. Fortunately, Libertarian Party vote totals in a few states have qualified them for future ballot access.
Oklahoma has some of the strictest ballot access laws in the country, which has historically made it a difficult state for Libertarians in past elections. Fortunately, Libertarian John Yeutter won nearly 25 percent of the vote in his race for Oklahoma auditor and inspector, which secures Libertarian Party ballot access until 2022. “Taxpayers in Oklahoma should have assurance that their state and local tax dollars are accounted for,” Yeutter said in his campaign.
In New York, Libertarian Larry Sharpe received an unprecedented 89,232 votes for governor, far in excess of the 50,000 needed to assure Libertarian Party ballot access in New York for the next four years. Sharpe ran an active campaign, with appearances throughout the news media and interviews on television and radio. In 2016, Sharpe was also only 32 votes short of being selected as the Libertarian Party’s vice presidential candidate.
Richard Brubaker, running for U.S. House from Wyoming, received enough votes to retain Libertarian Party ballot access for the state. Ballot access has also been assured until 2020 in Washington, D.C., thanks to the vote totals in Joseph Bishop-Henchman’s race for attorney general and his spouse Ethan Bishop-Henchman’s race for council chair. Mark Rutherford assured Indiana ballot access until 2022 with his race for secretary of state. In Massachusetts, Daniel Fishman has assured ballot access for two more years in his race for auditor.
For nearly a half century since its founding in 1971, the Libertarian Party has championed the legalization of drugs. Democratic and Republican politicians have long ignored the devastating and counterproductive effects of drug prohibition laws. Thankfully, voters in recent years have used ballot initiatives to override the politicians. Missouri and socially conservative Utah are the two latest states to legalize medical marijuana, allowing countless patients access to treatment that works for them. Michigan has gone a step further and joined the few states with legal recreational cannabis, allowing residents to make their own consumption choices.
In Florida, voters passed an initiative restoring voting rights to more than 1 million convicted felons who have completed their probation and made restitution for their crimes. Libertarians are pleased that most people who had been convicted of consensual “crimes” now have a path toward regaining their voting rights. Those who had been convicted of some violent crimes, however, like murder or sexual offenses, are excluded from this new law.
Libertarians have long maintained that price controls have negative unforeseen consequences that outweigh any benefits they might provide. Rent control may sound like a way to help lower-income residents find affordable housing, but controlling rental prices actually has the opposite effect — reducing the housing supply, lowering housing quality and maintenance, and shifting some of the high costs to opaque gatekeepers, additional fees, and even bribes. California voters fortunately defeated Proposition 10, a rent control initiative, by 23 percentage points. Also in California, a referendum for price controls on dialysis clinics has been defeated by a similar margin.
Several other Libertarian candidates attained significant shares of the vote on Nov. 6.
Gov. Gary Johnson received more than 15 percent of the votes in his bid for U.S. Senate from New Mexico. Nebraska state Sen. Laura Ebke received 42 percent of the vote in her re-election bid. Libertarian National Committee Chair Nicholas Sarwark received 11 percent of the vote for mayor of Phoenix. Libertarian National Committee Development Director Lauren Daugherty received 22 percent of the vote in her run for justice of the peace in McLennan County, Texas. Brian Luke received 27 percent of the votes in his run for U.S. House District 2 from Washington. Running for Washington state House in District 22, Allen Acosta scored a 30 percent vote total. Mark Fish received nearly 11 percent in his race for the Alaska state House in a three-way race that included both a Republican and a Democratic candidate.
A few Libertarian Party candidates California Assembly races achieved significant vote totals, including Justin Quigley with nearly 31 percent in District 21; LP California Chair Mimi Robson with more than 28 percent in District 70; Autumn Browne, daughter of two-time Libertarian Party presidential candidate Harry Browne, with nearly 28 percent in District 69; Brandon Nelson with more than 26 percent in District 4; and Christopher Stare with nearly 14 percent in District 51.

“More than 800 candidates gained invaluable experience running for office this year,” said Libertarian National Committee Chair Nicholas Sarwark. “After a brief respite, they’ll be ready to hit the ground running for 2020.”

Florida House District 58 results: Lawrence McClure nabs victory over Phil Hornback
Republican incumbent Lawrence McClure faces a challenge from Democrat Phil Hornbeck in state House District 58. With all 49 precincts reporting, Republican Lawrence beat out Democrat Phil Hornback by less than 5,000 votes. More than 53,000 votes were counted in the district, which stretches from Temple Terrace east to the Hillsborough County line, taking in Plant City, Thonotosassa, Dover and parts of Brandon.
Republican environmental mitigation consultant Lawrence McClure faced dogged competition in his race to hold on to his District 58 seat, but ultimately beat out challenger Phil Hornback by less than 5,000 votes on Tuesday.
McClure, 31, was sworn in to the D-58 seat on Jan. 9 after winning a whirlwind special election to replace longtime Republican Rep. Dan Raulerson, who resigned for health reasons.
The first-time candidate barely had time to settle in to his new job before firing up yet another campaign to keep it for a full two-year term. As a state representative, the conservative Plant City businessman and Hillsborough Farm Bureau board member also earns an annual salary of $29,697.
"I wish I would have gotten in the race earlier," his Democratic opponent told the Tampa Bay Times. "Had I done that I think we could have raised a little more money and covered more grounds."
District 58 stretches from Temple Terrace east to the Hillsborough County line, taking in Plant City, Thonotosassa, Dover and parts of Brandon. It was fertile ground for McClure, whose campaign promise to bring conservative principles to Florida earned an endorsement from the NRA.
Hornback, 53, is a former middle school science teacher who now owns a real estate business with his wife, Sara, in Ruskin. The Des Moines, Iowa native became a small business owner in college, when he left school to take over a family-operated masonry business when his father retired.
When the housing market began to turn in the early 2000s, Hornback enrolled in night classes at Upper Iowa University and sold his business in 2004 after obtaining a history degree and teaching certification. Hornback taught middle school for 9 years before leaving education in 2013 to focus on the realty company he began as a second job.
Hornback opposes moves in Tallahassee to take control away from local governments, and considers the environment a top priority. But the central issue for Hornback’s campaign was the state’s failure to fully fund public education. Hornback warned that education funding is quickly becoming a "state crisis" that must be reversed if Florida is to succeed in attracting new jobs.
McClure countered those concerns by pointing to his role in passing what he called "record funding" for public education. Instead, his campaign viewed transportation improvements and protecting the local agriculture industry as areas that should be top state priorities.
McClure ran on his long history of working with local and state elected officials to help address policies that negatively impact Hillsborough’s environment, water supply and future land use.
The Tampa native played soccer and football at H. B. Plant High School before beginning his 8-year career at Streamline Environmental, where he works with local companies to address environmental mitigation, cleanup and petroleum tank removal. His wife, Courtney Newsome, also has family ties to east Hillsborough County’s agriculture industry, and currently works for Astin Farms.

Armed Robber Hits Brandon Credit Union, Makes Off With Money
BRANDON, FL — The Hillsborough County Sheriff’s Office is searching for a man who robbed a Brandon credit union Monday, Oct. 22 at 12:02 p.m.
According to the sheriff’s office, a man armed with a gun entered the MidFlorida Credit Union at 825 W. Brandon Blvd. and gave a note to the teller demanding money. The teller complied and the robber fled the bank with the money. The sheriff’s office said he headed southeast from the bank, climbed over a fence and disappeared.
He is black, about 5 feet 9 inches tall with a thin build, in his late 20s. He was wearing a wig with dreadlocks, a white T-shirt, orange safety vest, green cargo pants and black boots with distinctive gold detail.
Anyone who recognizes the robber is asked to call the Hillsborough County Sheriff’s Office at 813-247-8200. To be eligible for a cash reward, call Crime Stoppers at 1-800-873-TIPS (8477).

Can Brandon Drury take the next step with Yankees?
When the Yankees traded for Brandon Drury, short-term and long-term questions immediately arose.
The future of Yankees’ prospect Miguel Andujar, who was expected to be the favorite to break camp at third base before the trade, became a concern for those excited about the soon-to-be 23-year-old’s offensive potential. The Yankees claim that Andujar is still considered the future at the hot corner, but they believe he would benefit from honing his defensive proficiency while in the minor leagues rather the majors.
Barring injury or dreadful production, Drury is set to fill the void left from Chase Headley’s and Todd Frazier’s departures. What can we expect from the 25-year-old Drury?
Drury has grabbed just under 1,000 plate appearances in the last two seasons with the Diamondbacks, hitting .275 with a .323 on-base percentage, and a .453 slugging percentage (95 OPS+) in the span. He ripped 68 doubles, three triples, and 29 home runs during the time period.
When Drury gets hits, they tend to go for extra bases (40 percent of his career hits have gone for at least a double), which bodes well for a batter that will hit toward the bottom of the Yankees’ potent lineup.
Drury is not the most patient hitter – he owns a career 5.9 percent walk rate – while his strikeout rate (20.3 percent) hovers around the MLB average over his two-plus seasons (21.1 percent). In the field, he has played most of his major league games at second base, however, he played 81.7 percent of his minor league games at third base. In 300-plus innings at third base in his time with the Diamondbacks (small sample size alert), Drury turned in a -4 defensive runs saved mark.
So, the Yankees must believe there is something better coming at third base from Drury when the major concern with Andujar is his glove work.
The Yankees have been high on Drury for some time, and gave up two promising mid-level prospects for his services. This signals the team believes that Drury has the capacity to improve on his solid stat line at the plate with at least average defense. He is just now approaching his prime seasons, thereby, if we add hitting in the Yankees’ lineup and in the American League East to the equation, there could be a significant increase in his offensive production.
Some have compared Drury’s trade with that of Didi Gregorius, who came to the Yankees via Arizona in the offseason leading up to the 2015 season. The parallel with Gregorius may be more about the trading partner as the Yankees shortstop had enjoyed significantly less time on the field as well as success than Drury before the trade. That said, the Yankees would be extremely excited if Drury elevates his game as dramatically as Gregorius has the last couple seasons.
Expecting Drury to leap to another level is understandable, but there is also the chance that exhibits that he is exactly the player he was the last couple of seasons. Stable production might not be enough for fans to stop clamoring for Andujar, however, if Drury’s performance stays constant with the last two seasons, it would still be sufficient in the Yankees’ eyes provided the rest of the lineup is doing what is expected of them.
Finally, should Drury backpedal, all would not be lost with Andujar seemingly close to contributing on an everyday basis. Drury’s versatility – he has also played both corner outfield spots in the big leagues – would continue to provide the Yankees with value whether he loses a starting role for lack of production, or simply because Andujar pushes the envelope.
Drury’s addition to the roster has made it easier for the Yankees to handle Andujar’s progression in the manner and speed they deem appropriate. At the same time, the team believes they have found a young experienced player within reach of high ceiling production.

Florida community redevelopment agency bills aim to restrict, end TIFs

Two bills now in Florida Senate committees offer different ways to do the same thing: Impose strict auditing, ethics, reporting and accountability measures on the state’s 222 community redevelopment agencies (CRA).
After that, the bills vary, with one phasing CRAs out within 20 years and the other restricting how revenues are collected and spent, effectively diminishing their utility as redevelopment tools for local governments.
Florida’s Community Redevelopment Act of 1969 created CRAs as conduits for directing tax incremental funds (TIF) directly into financing improvements in “blighted” areas. TIF is property tax revenue generated above a “base” year property values within the redevelopment area.
CRAs are created and managed by cities and counties. Often, the CRA board is the county or city commission or council. They have the authority to issue bonds, provide low-income housing incentives, prepare and adopt area development plans.
CRAs have come under fire since a February 2016 Miami-Dade grand jury report identified several South Florida CRAs as “slush funds” for “pet projects” controlled by county and city officials with little scrutiny or public input.
Florida House Speaker Richard Corcoran, R-Land O’Lakes, in a widely-published August op-ed, claimed CRAs extract millions of dollars from municipal budgets for projects that often don’t benefit the general public.
Citing a 2017 Office of Program Policy Analysis and Government Accountability’s (OPPAGA) audit, Cocoran noted that statewide, the agencies issued $1.35 billion in bonds between 2005 and 2016, and were collectively $715 million in debt.
“We literally cannot afford CRAs,” he wrote.
Untrue, local governments and redevelopment specialists maintain. Florida League of Cities (FLC) Assistant General Counsel David Cruz said CRAs have proven to be flexible and cost-effective mechanisms for revitalizing private investment in depressed areas and one of the best means to create affordable housing.
Dunedin Director of CRA Economic Development Robert Ironsmith said CRAs do not extract money from municipal budgets because their revenues are generated by property values within them.
CRA revenues are ”direct investments in the area generating the revenues,” Ironsmith said. “This public investment gets rewarded as performance improves — it is not a handout. It is a concentrated approach in turning areas around.”
The bills “effectively punish all of Florida’s municipalities, counties and special taxing districts that have played by the rules and achieved so much to benefit their communities,” Tampa City Councilman Mike Suarez said. “There’s no need for his heavy-handed legislation.”
“There are more than 200 CRAs,” Cruz said. Despite “the negative press for a couple,” the vast majority are effectively run and directly responsive to residents and businesses within them.
House Bill 17 Passed By House
Both bills — HB 17 and SB 432 — are similar to 2017 bills that withered in committees and are submitted by the same sponsors, Rep. Jake Raburn, R-Valrico, in the House, and Sen. Tom Lee, R-Brandon, in the Senate.
Both would increase audit, ethics, reporting and accountability measures for CRAs; require CRAs to annually submit additional reporting information to the state, including performance data for each CRA plan, number of projects started, total number of projects completed, commercial property vacancy rates, amount expended on affordable housing, etc. The bills require CRA procurement to be the same as city and county procurement procedures.
“At this point, we are very supportive of the accountability and transparency in each of these bills,” Cruz said, noting they provide enough oversight to ensure only CRAs that meet economic viability and community engagement standards will be sustainable.
Raburn’s HB 17 passed the House in a 72-32 vote on Jan. 12. It has been referred to the Senate’s community affairs, rules and appropriations committees.
HB 17 prohibits the creation of new CRAs after Oct. 1, 2018, except by a special act of the legislature. It calls for phasing out existing CRAs by Sept. 30, 2038, except those with outstanding bond obligations, unless reauthorized by a super majority vote of the body that created the CRA.
Raburn maintains CRAs are “redundant” and cites an OPPAGA survey of CRA board members that found 97 percent said similar projects could be funded by other local government entities, such as cities or counties, just as effectively.
Raburn said greater transparency and broader citizen inclusion are needed because some CRA boards are exclusively comprised of local elected officials that are not held to the same accountability standards as city or county commissions are.
Corcoran describes Rayburn’s bill as “pure common sense” while others, such as Bill Peebles of the Florida Redevelopment Association, testified in committee hearings that it is “a nuclear option. That’s a death knell for these things.”
Cruz said the FLC is opposed to provisions in HB 17 that only allow state legislators to create new CRAs and require a supermajority vote of a county commission or city council to reauthorize an existing CRA before all are phased out in 2038. It should be a local decision to create one “since no state funds are used to create CRAs,” he said.
Veteran lobbyist Ron Book, who represents nearly 30 municipalities in Tallahassee, agrees, but pointed out that state legislators have the statutory authority to regulate all taxing entities, including CRAs. Therefore, he said, they can require CRAs only be created by state legislators.
“The Constitution of Florida says if you’re going to tax, you must have specific authorization from the state legislature,” Book said. “What the legislature giveth, the legislature taketh away.”
Senate Bill 432 Remains In Three Committees
Lee’s SB 432 has passed through the Senate’s Community Affairs Committee and is in the Senate Appropriations Subcommittee on Transportation, Tourism, and Economic Development.
Unlike the House bill, SB 432 does not impose a timeline for phasing out CRAs or require legislative approval of new CRAs, but it contains provisions that cap administrative spending at 18 percent, prohibits TIF expenditures on festivals, street parties, grants to promote tourism and grants to “socially beneficial programs.” The Senate bill would also change CRA board composition by requiring the appointment of two non-elected members.
Cruz said “there are a number of key differences” between HB 17 and SB 432 with the FLC objecting to the Senate bill’s proposal to cap administrative CRA spending, impose “a very restrictive list of TIF” expenditures and eliminate “social benefit” partnerships with non-profits.
Many CRAs seek opportunities to create partnerships with local non-profits, Cruz said. Since affordable housing is a key, common CRA objective, many often “partner” with organizations such as Habitat For Humanity. The Senate bill “specifically prohibits these types of partnerships,” he said.
What’s Next
With both bills in Senate committees, Cruz said there is still time for local government officials to lobby their state representatives to retain accountability and transparency standards in the proposals while doing away with provisions to phase out CRAs or restrict their spending and partnership capacities.
“The accountability and transparency [in each] can help with that in the future,” he said.
County and city elected officials had the opportunity to bend lawmakers’ ears about CRAs up close and personal during the FLC’s ‘Legislative Action Days’ on Jan. 30-31.
CRA advocates point out the agencies have spearheaded revitalizations of downtowns across the state, from Tallahassee to Key West, paving the way for St. Petersburg’s Dali Museum and Mahaffey Theater, the restoration of historic McCollum Hall in Fort Myers and the $3 billion investment in Tampa’s proposed Water Street district by Jeff Vinik and Bill Gates.
They note CRAs are created as a revenue stream that incentivizes investment in struggling areas that would otherwise not be attractive. The money “is going into areas where the private sector would not go,” Lakeland CRA Manager Nicole Travis said.
Without initial CRA subsidization, “I don’t know if these areas would get the dollars and resources they need” from general fund budgets, Fort Myers CRA Executive Director Leigh Scrabis said.
The CRA-related proposals are among at least nine bills introduced during the 2018 legislative session that the FPL and Florida Association of Counties have labeled as “preemption bills” that diminish local control on a range of issues, from tree-trimming to the timing of ballot measures to regulating short-term vacation rentals.
Cochran dismisses the preemption complaint, calling it “just government blame shifting. What [HB 17] instead is part and parcel of an attack on corruption and on those who would pass the buck with one hand and pass the plate with the other,” he wrote in defending the proposal.
The bills, particularly HB 17, are widely supported by a range of conservative groups and spending critics, including Florida TaxWatch and Americans For Prosperity’s Florida Chapter.
“We support more transparency and efficiency in government, especially where tax dollars are in play,” Florida AFP spokesman Andres Malave. “We’d like to see CRA be phased out for common sense regulatory reform that can empower the private sector take on development and redevelopment, and empower these communities to build a brighter future.”
