Workers’ Comp class code 6217: Who Does It Apply To?

Workers’ Comp class code 6217 is assigned to specialist contractors who are engaged in general excavation. This includes ditch-digging, burrowing, filling, or backfilling, as long as these operations are not otherwise classified in the NY Workers’ Comp manual. Employers who are included under NY Workers’ Comp class code 6217 remove earth, small boulders, and rocks by power shovels, trench diggers, or bulldozers and piling it at the job site for backfill. The material can also be removed by dump trucks.
Workers’ Comp class code 6217 includes excavation done in connection with building foundations, swimming pools, landscape gardening and waterproofing operations. It does not include excavation done in connection with street or road construction, damn or lock construction, pile driving, shaft sinking, caisson or cofferdam work. Tree removal contractors who use mechanical equipment are also included under Workers’ Comp class code 6217. These tree removal operations involve the removal of one or a few trees on developed sites, not tree removal operations involving large numbers of trees in order to clear a right-of-way. Tree removal involving the clearing of right-of-ways is classified to code 2702, and tree removal performed by a risk also engaged in tree surgeon activities is classified to code 0106. NY Workers’ Comp class code 8350 also applies to dealers who distribute liquified petroleum gas by means other than mains or pipelines. It includes all employees of this operation, including store employees, drivers, installers, service and repairmen. In these operations, liquified petroleum gas is unloaded, stored, filled into bottled gas cylinders or tank trops and then delivered to customers. Bottled gas dealers who do not perform the filling are also included under NY Workers’ Comp class code 8350.

Rubber or plastic plating or coating of fabrics, metal vessels, containers and pipes is also included under NY Workers’ Comp class code 4410, as long as the work is performed by an insured whose business is that of rubber plating or coating. Similar operations that are not included under NY Workers’ Comp class code are rubber stamp manufacturing or assembly (class code 4299), rubber tire manufacturing (class code 4420), and synthetic rubber manufacturing (class code 4751).
