The Information Technology Act 2000 requires Digital Signature to be used for electronic document verification purposes. DSC provides authenticity to all electronic documents filed and sent online.
DSC is offered by a certifying body and ensures the security and protection of electronic data from unprecedented infringement. The certifying authority produces one category of the certificate, namely Class 3 Digital Signature Certificate. Previously, there were Class 1 and Class 2 DSCs in the market.
The controller of the Certifying body had revised the Class 2 DSC on November 26, 2020. The body has agreed on discontinuing the issuance of Class 2 DSC effective from January 1, 2021. The current Class 2 DSC holders would have to pay more money to get a new Digital Signature in 2021.
How will Class 2 DSC Discontinuance Impact Business?
·As discussed above, Class 2 DSC has been discontinued from January 2, 2020.
·The paper-based DSC would not exist from January 1, 2021.
·DSC should be downloaded within thirty days of approval.
·Class 3 DSC would be used in all the departments, and more guidance would be available on it in the future.
·Certifying Authority would issue Class 3 Digital Signature Certificates to applicants on tokens from January 1, 2021.
The Impact of these Changes
·All certifying authorities would be required to download all DSC from the system. Because the system would automatically reject all pending downloads.
·It includes rejection of DSC that has been previously approved but was pending for download before 31st December 2020.
·Certifying Authority would need to ask all their clients to update their Class 2 DSC because updating Class 3 DSC would become more expensive.
·All existing Class 2 certificates would be automatically updated to Class 3 Certificates without any requirement of manual work.
·Generated DSC pending for email, phone, video, or other verification before December 31, 2020, would be automatically rejected. Any amount paid in the process would be credited to the respective account of subscribers.
How does a Digital Certificate work?

As per the CCA,Class 3 Digital Signature certificate is going to replace Class 2 Digital Signature for all purposes like Income Tax filing, ROC filing, PF, tenders, GST, and others.

The overall modifications cover the following. –
1. The general guidelines to CAs have been categorized and organized under each topic. (1. Guidelines to CAs)
2. Email id of the applicant is mandatory for issuance of DSC based on the eKYC account activated by CA. Email id is optional for the eKYC accounts activated only for the purpose of sign. (1. Guidelines to CAs 1.8(1))
3. CA shall issue only class 3 individual signing certificate (both organizational & personal) to subscribers on tokens from 01.01.2021 onwards. The issuance of Class 2 individual signing certificate (both organizational & personal) to subscribers will be discontinued from 01.01.2021 onwards. The Class 3 certificate will have OID of Class 2 also (1. Guidelines to CAs 1.13 (1))
4. The PIN reset procedure for crypto token will be removed from 01.01.2021 onwards (1. Guidelines to CAs 1.13(3))
5. In general, Video verification has made mandatory for all categories of applicants including organizational. (1. Guidelines to CAs (11(1)). For banking eKYC mode, the video verification is not necessary.
6. Provided the option of acknowledgment along with the invoice to make sure the periodic reconciliation (1. Guidelines to CAs 1.14(1))
7. The key escrow of encryption certificate has made mandatory (1. Guidelines to Cas 1.19(1))

11. In order to make video verification unique, a new random number in each session of video has been included. (Annexure VI - Video Verification). The necessary guidelines for capturing the video have also been included.
Until recently, the Controller of Certifying Authorities (CCA) had provisions to allow three classes of Digital Signature Certificate(DSC). However, on November 26, it issued a notice stating that the Class 2 Digital Signature would be discontinued from January 1, 2021. It would be replaced by Class 3 certificates for all purposes of Class 2 DSCs, like income tax, GST, PF, ROC, tenders, etc. The CCA has also updated all Certifying Authorities (CA) on the guidelines for compliance with the changed rules for new applications and maintenance of e-KYC accounts. The order was passed to increase the level of digitization in application processes and reduce paperwork.
However, there is no reason to despair if you have recently bought a Class 2 DSC or renewed your existing one. The CCA has only mandated the termination of new issues or renewals of Class 2 DSCs from the beginning of 2021. This means that people who currently have a Class 2 DSC can continue to use it without any complications until its expiry. Also, Class 3 digital signatures have safeguards and fortifications to deal with security risks of greater magnitude than Class 2. A digital signature is a unique code assigned to an individual or organization that is used to authenticate documents and ensure untampered transfer to the receiver.
The basic principle of using digital signatures is that the sender holds a private key that they use to “sign” or encrypt an electronic document. The DSC contains all the credentials of the signer that prove their identity. The three main purposes served by digital signatures is to prove the authenticity of the document and its source, to ensure that the contents of the document have not been tampered with, and to verify the identity of the sender. Besides security, digital signatures also come with the advantage of reducing the cost, time, and effort expended in signing and sending back official documents.
