According to Supreme Court of Canada, songwriters are entitled to just one royalty – not two – when their music is streamed or downloaded through an online service.
The top court’ clarifies the meaning of a Canadian copyright law provision dealing with communication of a work to the public online on Friday.
Canada made this provision after signing on to an international treaty that obliged member countries to protect on-demand transmissions and give authors the right to control when and how their work is made available for downloading or streaming.
The Copyright Board of Canada ruled the legislative provision meant that making a song or other artistic work available was a separately protected activity for which there must be compensation.
The board said this entitled rights holders to two payments when a work is distributed online: one when it is made available on a platform such as iTunes or Spotify, and a second when it is actually streamed or downloaded by a listener.
The Federal Court of Appeal tossed out the board’s decision.
The Society of Composers, Authors and Music Publishers of Canada and Music Canada, which represents major record labels, asked the Supreme Court to overturn the Court of Appeal’s decision and adopt the board’s interpretation.
Parties including Apple Canada and major telecommunications companies said the court should reject this position on the grounds copyright law does not require payment of two royalties each time a work is streamed or downloaded.
In writing for a majority of the Supreme Court, Justice Malcolm Rowe said the Copyright Act does not exist solely for the benefit of authors.
“Its overarching purpose is to balance authors’ and users’ rights by securing just rewards for authors while facilitating public access to works,” Rowe wrote.
“When this balance is achieved, society is enriched. Authors are encouraged to produce more works, and users gain access to works which they can use to inspire their own original artistic and intellectual creations.”
The court said the board’s interpretation undermined the purpose of copyright law, violating the principle of “technological neutrality” by requiring users to pay additional royalties to access works online.
“This principle holds that, absent parliamentary intent to the contrary, the Copyright Act should not be interpreted so as to favour or discriminate against any form of technology,” Rowe said.
“It protects authors and users by ensuring that works attract the same rights and give rise to the same royalties regardless of the technological means used to distribute the works.”
The Copyright Act provides authors with rights related to the reproduction and performance of their works.
“Similar to offline distributions, downloading or streaming works will continue to engage only one copyright interest and require paying one royalty – a reproduction royalty for downloads or a performance royalty for streams,” Rowe wrote.
Under the law, a work is “performed” as soon as it is made available for on-demand streaming, he added. At that point, a royalty is payable. If the work is later streamed by a user, no additional royalty is payable because the stream is part of a continuous act of performance that began when the work was made available.
The value of these rights was not at issue in the appeal, Rowe noted. Therefore, setting the appropriate royalties when these rights come into play is a matter for the board to decide.

No doubt America is the land of dreams and possible where you could be anything you want as long as you got the zeal! and willing to put in 100! Therefore, Atlanta teenagers who dream of becoming famous music producers and creatives get A-LIST help, for free!
”When I met him, I knew this kid is special,” said music producer, Will Hodge “Willy Will.”
Given the right nudge, an Atlanta 13-year-old is taking giant step to a great future in the music biz!
”The nonprofit is called Reaching Early Creatives. It is for students ages 13-18,” said Hodge.
”I love making music. I love the creativity of it. I love being in the studio. It is fun seeing rappers rap to your beats and hear what they can come up with,” said 13-year-old Tamaj Pullen “MAPA.”
”He is a treasure. He is one of those things, that, they don’t come around a lot,” said Hodge.
Music runs in Tamaj Pullen’s blood. His uncle is a famous music producer, Honorable C. N. O. T. E.
”My uncle wrote Signed Sealed and Delivered,” said C. N. O. T. E.
Tamaj’s mentors got trust in the 13-year-old as he is doing something uniquely his own. Tho' he got the vibe and spirit ti make t through - they also know he needs support. That is when Will stepped in.
”I spoke at a couple of churches and his mom caught wind,” said Hodge. Will has started a project called Reaching Early Creatives.
”My mission was to provide underserved youth with the tools they need to reach their full creative potential; just using music as a vehicle to do so,” said Hodge. The organization was built to be what music was for Will as a kid.
”It saved my life. Being from the inner city, a lot of my friends were into things they shouldn’t have been into. Between church and music, it saved my life. It kept me from bad situations,” said Hodge, ”I keep my feet on the ground in the community. I go visit churches. I visit schools.”
Kids have to write an essay about why they want to be in the program and Will takes it from there.
”All the important stuff with engineering, mixing, really helped with my creativity, all of that...for free,” said Pullen. This is a program for creatives, the go getters, the young, the dreamers!

David R. Styles, popularly known as Styles P  has got the internet buzzing for him after putting his own freedom (and life) on the line while stepping in to assist a woman who had been detained by police.
The incident—which apparently occurred close to Yonkers, New York - the LOX members hometown —was captured in a clip that has gone viral. It begins with footage of a woman, who is believed to be on a deliverery job for Uber Eats, being taken to the ground in an aggressive manner and handcuffed by a pair of officers.
The woman can be heard repeatedly yelling that she’s not resisting arrest, and Styles P approaches the officers and begins denigrating them, referring to one of them as a “bi**h” and a “h*e” while attempting to console the woman and deescalate the situation.
As one of the officers is seen approaching Styles, the rapper threw his hands in the air, all visible and tells the officer “I’ma back up. Don’t touch me.” From there, the rapper can be heard directing the other woman filming the encounter, telling her to keep recording, as he continues to verbally lash out at the officer for his conduct. “You slammed a girl! For no reason!” Styles yells at the officer. The video continues as Styles remains on the scene until the clip abruptly ends.
In light of his selfless actions, Styles P has received an overwhelming amount of kudos from his local community, as well as those online, with many hailing him as a hero and a true protector of Black women.

A woman filed allegations against Tim Westwood, former Radio 1 DJ. The said woman says they had sex several times starting from when she was 14.
According to a report by the BBC, the woman has described Westwood as a “predator”, stating that he was in his 30s at the time. She is the latest to come forward after sexual assault allegations were hauled against Westwood by multiple women, leading him to step down from his Capital Xtra radio show.
Timothy Westwood  popularly known as Tim Westwood, 64, was accused of opportunistic and predatory sexual behaviour as well as instances of sexual harassment in incidents that are said to have occurred between 1992 and 2017. The accusations came to light in a joint investigation from The Guardian and BBC News, published on April 26. Westwood denies all allegations.
Seven women, all Black, narrated their ordeal to The Guardian about their alleged experiences with Westwood. They claimed to have met Westwood through his work. Some accused the DJ of abusing his power within the music industry in order to exploit women.
The alleged victims – whose names have been changed – also gave testimony as part of a new 30-minute documentary, Tim Westwood: Abuse of Power, which aired on BBC Three in April. It is available to watch now via the BBC iPlayer.
Likewise the woman that said she was 14 when she first had sex with Westwood, another has come forward to detail what she says was a “controlling” relationship when she was 16 and Westwood was in his 40s.

In addition, two other women have said they were sexually assaulted by Westwood when they were in their mid-teens. These testimonies and others will be included in a new BBC News documentary, Hip Hop’s Open Secret: Tim Westwood, which is available to watch on the iPlayer now.
In response to the initial BBC documentary, a spokesperson for the DJ said: “Our client confirms that there has never been any complaint made against him, whether officially or unofficially, relating to claims of inappropriate behaviour of the nature described.”
According to the BBC they received six allegations of misconduct against Tim Westwood earlier this month, one of which was handed over to police.
This is despite the corporation’s Director General Tim Davie saying in a statement made back in April that “no evidence of complaints” had been found.
Speaking on Tuesday (July 12), Davie said claims against Westwood would be investigated and a report published within two weeks. “We have an internal audit separate to myself working to the senior independent director, Nick Serota, going through now, responding to anything that is coming into us,” he commented.
“We have no objective apart from to ensure everything is flushed out and we understand exactly what happened with regards to the BBC and also to do the right thing and [ensure] any cases are looked at.”

No doubt alot of folk may not have heard much about Symba, but this yungin' from Cali is now signed to Atlantic Records and has been making serious waves within the industry. After receiving co-signs from Fabolous, Dr. Dre and LeBron James, The Game brought Symba out to show him love during his Drillmatic album release party.
“I want you to pick up y’all phones because if you did not know who the fuck he was before you came in here,” The Game said. “I’m telling you. This is that n-gga.”
Symba gave his profound gratitude to Game for his kind words before diving into a brief acapella freestyle to showcase his talent. Game’s co-sign comes after Symba dropped his new track “Never End Up Broke” on Thursday (July 7). He had previously dropped off the braggadocious “GOAT” track in May, which found him reaffirming that he should be more a part of the rap conversation.
“They ask who’s the best MC? Biggie, JAY-Z or Nas,” Symba raps. “Aubrey Graham, Jermaine Cole, Kendrick Lamar, Weezy F, Eminem or Tupac Shakur, well I think it’s about time I make ’em mention the boy,” Symba raps on the track.
The 29-year-old lyricist has been on some big thins as over time has wowed hip hop big names such as 2 Chainz and Snoop Dogg since 2012. He dropped off his debut mixtape Don’t Run From R.A.P. in 2020 with Atlantic Records, which featured appearances from Ty Dolla $ign, Moneybagg Yo, OT Genasis and Too $hort, among others.
“I plan on becoming a household name in every way,” he said to Billboard at the time. “By being consistent with my music, consistent with my message, and touching the people. You can never go wrong when you create good music. But what’s more important than the music, to me, is making sure the people who are listening know that I’m just like them. I have the same ups and downs in life as everyone else on this planet. I am not any different, I just chose rap as my diary.”
As for The Game, he is getting ready to drop off his Drillmatic album, which he’s claimed for months will also make him a part of the GOAT conversation.
“I know my album gone be the best album of 2022, ’cause the energy feels like I just signed my deal,” he wrote on Instagram back in May. “You’ve never heard me rap like this, I promise you.”
He continued, “When it drops, I promise you that if you put your ear to it you will then understand why I’m the best rapper alive,” he continued. “My controversy has always stepped on my greatness, but that’s all about to change. This album has a strong hold on being the best album of my career.”

A couple days ago, report got to us that fans of the 39-year-old Onika Maraj "Queen of Rap" were so eager to see their fearless leader that they jumped over barricades and fences, pushing security to its limit as they attempted to contain and control the crowd.
After a successful stage performance on Sunday, the next day (July 11), Minaj hopped on Instagram Live to inform her followers that she would be hosting a surprise meet-and-greet in Camden Town, London, where hundreds of people quickly rushed to Cafe Koko and mobbed the "Anaconda" hitmaker upon arrival.
In one TikTok captured by a fan, the mother of one can be seen and heard begging those around her to "back up," though her pleas were ignored – including the cameraman, who threw up a peace sign and pursed his lips while trying to capture a video with the recording artist.
Seeing as he didn't listen to her request to move, Minaj appears to shove the Barb out of her way, which he also alleged in his caption. "Nicki Minaj literally pushed me omg," he wrote.
@theyluviish My fave literally touched me 😂😍#fyp#nickiminaj♬ original sound - IISH ♛
"My fav literally touched me," he continued, adding laughing and heart-eye emojis. In the comments, he added that he was "just happy Nicki touched" him. "Thank you, Nicki, for stopping by."
The crowd was so out of order that Minaj even jumped on Twitter to ask them to calm down. "Guys, if you don't get in a contained space they won't let me get out the cars. [Please] don't run in the streets. Please get in one place, one line," she wrote earlier today.
Camden Police ultimately had to cancel the event due to safety concerns. "Members of the public are advised not to travel to the area... Crowds are leaving and police remain on scene, no arrests," they wrote on social media.

In a recent appearance on Nick Cannon’s Wild ‘N Out, Juelz Santana was asked which Dipset brother he would save if either Cam’ron or Jim Jones were being stomped out in a prison riot, and he offered a hilarious response.
“That’s why God gave me two hands, I’m going this way and that way,” Juelz said punching the air.
The appearance on the long-running comedy series comes after The Harlem, New York rap legend was recently deemed a free man after being on probation following a two-year prison sentence. His sentence was in relation to a weapons charge that stemmed from a 2018 incident at New Jersey’s Newark Liberty International Airport in which a loaded gun and oxycodone pills were discovered in his carry-on bag.
Juelz has always been in good terms with both Cam and Jim, despite the latter pair’s rocky relationship over the years. But the duo have always shared a deep love and admiration for Juelz. Jim Jones told HipHopDX in 2021 that early on in The Diplomats’ career he and Cam’ron didn’t force Juelz to return to school, but instead created a learning environment to help teach him the tricks of the trade he couldn’t get in high school.
“He already dropped out of high school by the time he got with us,” Jim said. “But we tried to get him back in school, but he’s just a special kid. He’s one of them people they call like an idiot savant; When it comes to music, a person that’s a genius in what he does and is more or less on the terms of music and shit like that. He’s so much of a genius in what he does. That’s something that we need to curate and take care of it and make sure that he puts all his energy into that.”
He continued, “We chose to turn music into a school. I mean that by all means. Like Cam really had him inside of a musical school. It wasn’t just partying heartily and shit like that. If he didn’t have his shit together, he couldn’t go out with us to certain concerts. He couldn’t go out with us to certain clubs, and shit like that. He had to finish music and not just finish music, make music that could make us some money and put him in a different position and shit like that.”
