The 'why doesn't Batman kill the joker for Jason' situation makes exponentially more sense when you factor in Cassandra Cain. She is both more militant about the no kill rule and is loyal to the symbol of the Bat more than Bruce himself.
So yeah, if Bruce killed the joker he wouldn't be Batman for long. Cass would simply not let him. She would forcibly retire him and rip the bat symbol of his suit and next thing he knows Cass would be changing all the Batcave locks. Bruce would not accepted as Batman by her again until he apologises for violating his own code and swears off killing once again. She probably would be overruled by others but it would be undoubtedly be (yet another) massive conflict in the bat family.
