So I was asked to weigh in by a friend and a group of USNA grads on the Standage Case, Midn 1/c. Standage on leave under an online name, tweeted that Breonna Taylor got her ‘Justice.’ He is being disciplined by denial of his commission.

Here was my reply.

Thx for the Standage background. I have seen a few cases of military justice but have no legal background and took a while to dig into the issues.

It seems to me that the Orloff Case, SC 1953 prevails here. Orloff was denied a commission even though he was qualified; the court gave jurisdiction to the military, the UCMJ and other rules and regulations.

Constitutional rights may be limited but not eliminated in deference to the authority of the SUPT, institutional rules and policies. That’s a very broad authority conferred on the commanding officer that is difficult to defeat given the history of cases subsequent to Orloff.

Not saying that the Midn is guilty as charged, but it is a profound IRONY that Standage endorsed the summary justice to the victim of the shooting, Breonna Taylor, but for himself evokes the length and breadth of judicial relief.

Ultimately, there should be found an opportunity for a positive learning experience in the double tragedies of Taylor and Standage. Unfortunately that day seems to have passed.

So ultimately Standage will also receive ‘summary judgment. ‘

Standage can be given a significant consequence for his impulsive and racist tweets short of denying his commission.

In another sense it goes to the essence of the Midn’s character as seen by the Supt and his review team.

Personally I have seen both sides of the Supt’s wisdom and have tried to learn from my experience to be a better person.

Standage has a superior education and will have the opportunity to use it as a leader in a different setting. He should probably resign for the good of the service and to restart his life.
