Although there are no federal caps on the fees or the percentage that may be charged, it is thought that state caps would likely prevent agencies from taking advantage of sellers by overcharging or undercharging the market price for the property. Real Estate Licensing Requirements in India

Hyderabad - On Friday evening, at approximately 10 PM, a 31-year-old male sustained multiple gunshot wounds at the office of his family's real estate agency on Jumraba Road, Hyderabad. He was pronounced dead at the scene approximately half an hour later. The deceased was identified as Pele Chikkerian, a resident of Hyderabad, India. An autopsy performed on the deceased showed that he had been shot multiple times, including in the back and left forearm. No weapons were found at the scene of the incident.
Police Inspector Vaskar Sahoo said, "The preliminary investigation reveals that the deceased was inside the real estate agency's office without any of the employees or management when he was killed. There are no witnesses available to us at the scene who can corroborate the fact that there was a fight between him and the deceased. Based on the information thus collected, we are investigating the incident as a case of murder and are waiting for the post-licensing course to be conducted on the deceased."
On Monday, the Telangana State Police had visited the house of the deceased and collected the body from the location. The forensic experts also took pictures of the body and thereafter communicated them to the Inspector General of Police. The body was sent to the Hyderabad Jewish General hospital for further processing. According to the investigator, the post-licensing course for real estate agents in Hyderabad was conducted successfully without any issues. He added, "We will be conducting a detailed enquiry into the circumstances of this incident and will submit it to the licensing board soon. We will also check whether the real estate agent was properly supervised when he was practicing."
According to the regulatory body, the real estate agents have to hold a 'fiduciary duty' and it is their responsibility to act in accordance with the rules and regulations of the real estate agency. Multiple listing service providers in India are bound by the rules and regulations imposed by the Central Board of Excise and Regulation (CBET) and they are responsible to inform the CBET of any default in compliance by their clients. For example, if they fail to forward the requisite fee to the broker in time, they are punishable by a fine. Similarly, if the broker fails to comply with the terms and conditions of the Multiple Listing Service, his license is subject to suspension until rectified. If the failure to comply continues after rectification, the license will be cancelled by order of the CBET like real estate agency Caledon.
The CBET formulated a Code of Conduct to govern the activities of real estate agents, and it includes several sections that are applicable to real estate agents in India. Apart, from being liable to pay the statutory fee as prescribed by the CBET, the real estate agent is bound to undertake proper disciplinary actions for each transaction. Any breach in honesty by the real estate agent results in criminal action.
