Strata Titles Act 1985
Do you own, or are you thinking of buying a duplex, townhouse or apartment in a small complex, a penthouse in a high-rise building, a shop at a local shopping centre, a factory unit in a large group, or office in a city tower, or a unit in a retirement village? Do you lease this type of property?
All these properties have something in common – they are all registered as Strata Titles or SurveyStrata Titles at Landgate, are all subject to the Strata Titles Act 1985 (the Act) and will all be subject to changes brought about by the Strata Titles Amendment Bill that is proceeding through Parliament. As an owner within a strata scheme, you own your lot and have shared ownership of common property with the other owners in your strata scheme in accordance with your unit entitlement. Under the Act, owners are subject to restrictions relating to their property. These restrictions are laid out in the Act and the strata scheme's by-laws. Each owner has rights and responsibilities that will be exercised in partnership with other owners. The rights and responsibilities of lease holders (tenants) are detailed in their tenancy agreements and in the scheme's by-laws.
What is the Strata Titles Act and why is it being reformed?
The Strata Titles Act 1985 (the Act) is legislation that sets out the processes and structure to manage mixed-use, high-density and shared living environments. The Act sets out processes and structure to manage and promote harmonious co-existence. The Act includes standard by-laws that aim to ensure standards of behaviour, building maintenance and management are maintained. Schedule 1 standard by-laws address rights relating to duties of proprietors/occupiers, proprietor powers, sub-meters, constitution of the council, election of the council, council roles, powers, voting and meetings. Schedule 2 standard by-laws address rights relating to parking, common property, floor coverings, general owner/occupier behaviour, appearance and maintenance of lots, decorating and the keeping of pets. Strata companies can adopt the standard schedule 1 or 2 by-laws or create their own.
Based on current trends, it is predicted that Western Australia's population will increase to more than five million by 2056. There is a need for more housing to cater for the projected population increase including providing more innovative housing options, while also meeting urban infill targets. It is logical to plan for a growing number of strata schemes, which means WA needs a more robust and updated legislative framework to support strata and survey strata schemes. Landgate has been asked to deliver strata reforms as a priority to reflect more flexibility in strata developments and provide for better community environments.

Let me repeat: No, no, no! Nein, Nix, Nada spells NO!

Let me ask different question: Would you let your child decide whether or not you should refinance your house? Why?
The same rules apply to the selection of a lawyer. They don't have your life experience.The old saying holds true: "Fathers know alot. Grandfathers know everything." As you age you build up experience, knowledge and most of all, wisdom!
Your child will be focused on the fact that he is “right” and the cop is “wrong,” but be completely oblivious to the fact that if things don't go well, his life could be permanently changed and forever impacted.
You, as parent, need to step in and tell him or her that you know what's best and need to participate in the selection of a lawyer as well as monitoring the case along with the child, even if he or she is 30 years old.
Of course you can listen to your child's input; but you need to be heavily involved. One other thing: this doesn't mean the child shouldn't bear the financial burdens associated with being charged with a crime. It just means they may need to borrow money and pay it back.
And there's an added benefit to the selection of a better (and often more expensive) lawyer: quite often a good result means lower costs and less inconvenience to the client. Think on it and regard your role as advisor and influencer.

Registered Disability Savings Plans
The Registered Disability Savings Plan [RDSP] is a Canadian savings plan. It is similar to the Registered Education Savings Plan (RESP). If an individual qualifies for the Disability Tax Credit, (for individuals that have a severe and long-term physical or mental impairment) and is under the age of 60, they may be eligible for a Registered Disability Savings Plan. The beneficiary will receive the money invested in the RDSP.
Anyone who has written permission from the plan holder can contribute to the RDSP. The person holding the plan can be one of several individuals of legal age who can enter into a contract legally. This could be a parent or guardian of the disabled individual. This could also be a public agency that is legally authorized to act for the beneficiary.
Contributions are not tax-deductible and can be made into the plan until the year the beneficiary turns 59. Payments to the disabled beneficiary begin when the beneficiary turns 60 years of age. There is no annual limit on the total amount contributed, however, $200,000 is the overall lifetime limit on the contributions made to the plan.
How do Government Grants and Bonds help with RDSP?
Contributions made into an RDSP are matched by the government of Canada through the Canada Disability Savings Grants (CDSG) and the Canada Disability Savings Bonds (CDSB). Both of these can be received until the year that the beneficiary turns 49.
The CDSG has a lifetime limit of $70,000 and an individual may get a maximum $3,500 of matching grants when there is a contribution amount $1,500.
The CDSB has a lifetime limit of $20,000. The bonds do not require contributions.
The rules are complex governing the withdrawal of funds from RDSPs. These rules mandate that the beneficiary may have to repay the government grant and bond money back if:
o The RDSP is closed voluntarily
o Deregistration of the plan
o A Disability Assistance Payment is made from RDSP
o The beneficiary is no longer eligible for the Disability Tax Credit
o The beneficiary dies
There are cases in which a Tax-Free Savings Account (TFSA) or a Registered Retirement Savings Plan (RRSP) may be more beneficial than an RDSP. This is because people who use these plans receive a tax break on income generated in a TFSA or when contributing to an RRSP. There are no such tax breaks for an RDSP. Instead, they have grants and bonds whereas the other plans don't.
Because RDSPs are more restrictive than the other plans, it is important to contact a reliable financial planner to assist you in determining which plan is most beneficial for the beneficiary.
RDSPs are an excellent option for disabled Canadians and their family members. They are not the only option. It is important to understand the pros and cons of each savings plan.
For family members of a disabled individual, setting up a trust for their disabled relative that utilizes grants and bonds may very well be a lucrative option to low-income taxpayers.
