E Vapor Less Harmful - Says FDA Director of Tobacco Products

Recently in April, 2015, Mitch Zeller, the FDA Director of Tobacco Products stated that E-Vapor Products are vastly less harmful than tobacco cigarettes. So, the smokers who are looking for an alternative to conventional smoking can use it.

I Used To Think That E Vapor Products Are Safe, What Is The Truth?

This question is asked a lot by the consumer and now thankfully media sources are picking up. When we first came to market and again Nicmaxx brand was one of the first brand to come the market in 2007 and since that time we've done a lot of work with our factory to bring to the public, a product that is safe in as efficacy.

But when it comes to the disinformation presented by other sources, we have recently is studies that have come out that stated they found levels of formaldehyde in e vapor products. Unfortunately the study did not denote the levels of voltage used in the products that they found levels of formaldehyde. The study did note that in low voltage system such as Nicmaxx usage, there was no formaldehyde detected at all. They actually take a high-voltage system and bring it up to heat level outside the sample off to create a level of formaldehyde.

I and we see this quite a bit where those that don't adhere or like e vapor products, try to disparage the industry itself by making claims that well more study needs to be done or the FDA years ago found antifreeze in the product to address that they came up years ago that we found antifreeze in e vapor products that was completely disparage because what they did find was ethylene glycol which is a bi-product of propylene glycol which the FDA allows for use in food products at levels that are well below what we use.

How Does An E Vapor Product Work ?

An e vapor product or a cig alike product which are both the same product basically are shockingly simple in their design, what you have in both categories I want to says this in a second is a battery. A battery that has a switch in there. When the consumer inhales on this product, a switch goes off which then heats a liquid. A liquid is contained in a single cartridge. This liquid contains Propylene Glycol, Glycerol, Water & Nicotine at varying levels and flavors and that's it.

But the market has determined that there are two categories which I disagree with, but will address also the e vapor or e tank category as well. But these are very very similar. The vapor tank category has a battery little bit larger than a cig alike battery but it still is a battery. What they also have they keep the liquid inside of a tank with a coil that then generates a vapor, which is what our cartridges also. So, want to get away from this discussion of open source which is close source, what the vapers are looking for is an experience that's very close to their particular brand of cigarette to transition too.

Unfortunately, for the industry, when it was going from its beginning to now, most companies focused on the entire market and just putting a product out there that didn't adhere or always liked by a single cigarette brand.

Nicmaxx focused on one thing and one thing only; and that was our liquid. We focused on a single category which is the full flavored smoker. Most smokers at this point have tried e cigarette or an e vapor product. When we do events and we go out the market and talk to smokers and asked them - Have you tried an e vapor product? What they really tell us, nine times out of ten is- Yeah, but it didn't worked for me! But in Providence, Nicmaxx came to market in 2007 and we haven't raised the market, we've taken our time. What our clients were telling us back in 2007, 08, 09 & then in the 2010, that “I like your product but my dad who's a full-flavored smoker didn’t embraced that.” We thought to ourselves, well if the full flavored smoker who is very brand loyal doesn't like the product we have, we have to evolve this technology.

So, we spent about four years on our liquid determining the right throat hit, the long hit and the proper level the nicotine that a smoker would appreciate and then stay loyal to. So, when it comes to our product line we have dedicated ourselves to service one demographic the full flavored smoker but again when you're in the market looking for new e vapor products, don't get lost in open source, in close source & a tank for cig alike. We feel that this configuration a product is most convenient for smokers. Can E Vapor Products Help Me Quit Smoking?

We as an industry and we as a company do not make any claims that we are stop smoking or cessation products at all, but you look at what the e vapor product, Nicmaxx product brings to a consumer.

We have spent a lot of time and lot of effort and a lot investment, in creating a product, the Nicmaxx brands, that are designed for one individual user and that's a full-flavored smoker. Levels of Nitrosamines in E-Cigarette? What Does that Mean?

It was interesting what FDA found and again with the formaldehyde that they found. You can take any sample of anything & find anything in there you want.

I did interview, couple of years ago with a reporter at the Riverside County out here, ask me the same question. It was a prepared question he sent to me. I provided him a sample of their municipal water and showed him that there's radium, there's formaldehyde & other bi-products in their, that are not very beneficial. He said well they were traced them out. I said thank you. When you look at the FDA study and when they said they found Nitrosamines, they were traced them out.

We have a chart  that shows that in one e cig cartridge, they found 9 tobacco specific Nitrosamines, 9 and this is in the cartridges that dispenses almost two packs of cigarettes. They found in one more real cigarette 11940 Nitrosamines, 9 to 11940.

So, when people despised e vapor products and they said they found some level of something, again yet to ask them at what level was a toxin found because thats a level that the toxin is found not the determination you found something.

If E Cigs Are Beneficial Why Aren't Anti Smoking Groups Supporting Them?

That's a great question, I get there quite a bit and sadly when it comes to governments not approving the e vapor products, the path is that they need more study or if you have a health institution that will or not take a product and make it an approved product, again they realising we need more study or there's a third category which is unfortunately they are paid by big pharmaceutical companies. They have a path of money in donation because we are eroding their revenues. When it comes to this case for more study, we have been in the market going into our 8th year.

There are millions & millions of Americans that are using e vapor products today. There've been billions & billions of users, when not without a single instance of harm when they are used as intended. So, we asked these institutions to look at the body of study that's available to them and the amount of users in the millions that have been using e vapor products for these years without a single instance of harm and then make that determination.

But unfortunately in 2015, there is no institution at all that is making the e vapor product a recommended item. We have a lot of work to do!

Is Nicotine Dangerous?

Nicotine, unfortunately has been grouped together with the tobacco cigarettes as being a danger. We will link to you a study that was done, a number of years ago, but it took nicotine on its own and study 3500 people for a series of years and there was no detriment to the health using nicotine only.

Nicotine and Caffeine are the same alkaloids. I know this is hard for people to understand because nicotine has put in such a bad category, but again these both are categorized as secondary stimulants.

The litigation that we brought with the FDA, we made the case here and in Europe that nicotine is not a drug, it is not therapeutic, it does not treat or cure any disease. It is simply a secondary stimulant. But to get it from a tobacco cigarette, the research we showed you before, it contains about 6,000 chemicals which are 66 carcinogenic and the e vapor  products that we create to Nicmaxx brands, we are getting varying levels of nicotine but only with five ingredients, all approved by the EPA and the FDA.

Do The Cartridges Contain AntiFreeze & Other Dangerous Chemicals?

This is probably one of the most asked questions by those searching e vapor products & media and their legislative bodies.

When I have said for the city council's unbearably the city attorney, when he's asked to do some research on e vapor products and their efficacy, whether safety first thing they punch in a Google as, are e-cigarettes/e vapor products safe? What they invariably come across is back in July 22nd 2009, the FDA released a press release and what they stated in that press release, said that they took a sample of an e-cigarette cartridge and what they found was certain levels of nitrosamines and they found ingredients using antifreeze.

When we address this and protests that press with a part towards the very end to the press release it also said that if anybody has been harmed by an e vapor product or an e cigarette product, please report that to the FDA and they put a phone number, fax number & an email address to do this.

In the litigation that was brought up by my partner in 2010, the court stated that, they noted that the FDA had two years but did not state that they have found anybody that has been harmed by electronic cigarette. Also we have been on the market since 2007, there are now six million Americans using e vapor products and they have used them billions and billions and billions of times, without a single instance of harm when used properly.

When you talk about the e liquid which is what everybody is vaporizing, I'm not talking about the Nicmaxx brands. Again we have spend years, developing our e liquid but all of our products are assembled in an FDA registered laboratory. But when I don’t have them approved, that were filled in an FDA registered laboratory. All of our ingredients are of pharmaceutical grade. Our manufacturing practices are of high standard.

Will the Government Ban E Vapor Products?

This is mostly asked by a lot of retailers and a lot of distributors about the disposition of the e vapor industry or the e-cig industry itself.

Nicmaxx products with one of the first market brands in 2007 and since that time we've got series of hurdles to keep our products on the market. The first such hurdle was back in 2009, when the FDA seize my partner's products in our association and claim that these products were indeed a drug delivery device improperly. We made the case, said no our products are tobacco products because we derive our nicotine from the leaf and stem of tobacco. So, my partner brought litigation with the FDA in 2009 and was successful. The FDA then appeal that decision that these products were to be a drug device combination and not tobacco product.

In December 10th, 2010, the DC appellate court made the termination agree with the industry that we are indeed a tobacco product and the FDA agreed that they will regulate us as a tobacco product under the Family Tobacco Smoking Act of 2008. So, when it comes to all these products legal, yes they are, when we say that the cities and the appellees in the states is what is the most responsible way to regulate the products now that they're regulated as a tobacco product. When this come to us and asked us, if they should be regulated as tobacco products and how do we do that, we typically say that any place that tobacco products are not to be used then e vapor product should not be used also.

We hope that with time the people will understand that the products are vastly less harmful and stand a social utility but at this point of time that's not the case. So, when you answer the question- Are they legal products? Yes, they are regulated as a tobacco product.

Are E Vapor Products Approved by the FDA?

E Vapor products are regulated by the FDA under the Family Tobacco Control Act as a tobacco product.

Now, when it comes to the approval by the FDA on the e vapor products, no they do not approve or not approve any tobacco product. We are regulated as a tobacco product but would like to speak about the constituents of the e vapor product, Nicmaxx Products. All the Nicmaxx ingredients have been approved by the FDA and EPA. Propylene glycol has been used for decades in consumer products. Nicotine is an ingredient in the electronic cigarette, but nicotine and caffeine, both are alkaloids and are very similar in form and structure.
