The inquest jury came up with only one recommendation after hearing that continued cocaine use likely played a significant role in the death of James Kiteley.
However, the coroner’s inquest heard earlier Tuesday from forensic pathologist Dr. John Fernandes that without the cocaine use that probably caused Kiteley’s hardened arteries and enlarged heart, the 36-year-old should have lived through a fight he had with two men over the theft of their TV.
Acquaintances Jurgen Porkristl and son Leif pinned Kiteley and held him face-down on the sidewalk near their Brighton Street home until police arrived, after they caught him walking down the street with their TV on Feb. 13, 2011.
“If you subtract heart disease and cocaine … I would have expected him to survive in that short a time (that he was restrained),” Fernandes said. The inquest heard Monday Porkristl’s friend called 911 immediately after the duo pinned Kiteley down and police arrived in three minutes. An ambulance was called within a minute after Constable Ken Breitenbach handcuffed Kiteley, then turned him onto his back and discovered him lifeless.
Kiteley’s heart disease likely resulted from cocaine use, Fernandes said. “In a 36-year-old, that amount of heart disease is unusual … he had significant hardening of the arteries for someone his age.”
King did suggest the jury rule the death an accident, which it did. Although the Porkristls may have contributed to Kiteley’s death, King said they had no foresight, thought or intention that he would die. They also called police right away, and Porkristl was within his rights as a property owner to hold Kiteley for police, King added.

The cops did not kill her brother in law. The homeowner choked the life out of him as he was running down the street with a TV under his arms. He was dead when the cops rolled him over. He was a mental case, stealing for his next fix.
