The EU’s strategy for controlling irregular West African migration is not just about asking partner countries to help stop the flow of people crossing the Mediterranean – it also includes sharing data on who is trying to make the trip and identifying to which countries they can be returned.

Take Niger, a key transit country for migrants arriving in Europe via Libya.

European money and technical assistance have flowed into Niger for several years, funding beefed-up border security and supporting controversial legislation that criminalises “migrant trafficking” and has led to a sharp fall in the registered number of people travelling through the country to reach Libya – down from 298,000 in 2016 to 50,000 in 2018.

Such cooperation is justified by the “moral duty to tackle the loss of lives in the desert and in the Mediterranean”, according to the EU’s head of foreign policy, Federica Mogherini. It was also a response to the surge in arrivals of asylum seekers and migrants to European shores in 2015-16, encouraging the outsourcing of control to African governments in return for development aid.

In April, as a further deterrent to fresh arrivals, the European Parliament passed a tougher “Regulation” for Frontex – the EU border guard agency – authorising stepped-up returns of migrants without proper documentation to their countries of origin.

The regulation is expected to come into force by early December after its formal adoption by the European Council.

The proposed tougher mandate will rely in part on biometric information stored on linked databases in Africa and Europe. It is a step rights campaigners say not only jeopardises the civil liberties of asylum seekers and others in need of protection, but one that may also fall foul of EU data privacy legislation.

In reply to a request for comment, Frontex told The New Humanitarian it was “not in the position to discuss details of the draft regulation as it is an ongoing process.”

Niger on the frontline

Niger is a key country for Europe’s twin strategic goals of migration control and counter-terrorism – with better data increasingly playing a part in both objectives.

The Makalondi police station-cum-immigration post on Niger’s southern border with Burkina Faso is on the front line of this approach – one link in the ever-expanding chain that is the EU’s information-driven response to border management and security.

When TNH visited in December 2018, the hot Sunday afternoon torpor evaporated when three international buses pulled up and disgorged dozens of travellers into the parking area.

“In Niger, we are the pioneers.”

They were mostly Burkinabès and Nigeriens who travelled abroad for work and, as thousands of their fellow citizens do every week, took the 12-hour drive from the Burkina Faso capital, Ouagadougou, to the Niger capital, Niamey.

As policemen searched their bags, the passengers waited to be registered with the new biometric Migration Information and Data Analysis System, or MIDAS, which captures fingerprints and facial images for transmission to a central database in Niamey.

MIDAS has been developed by the International Organisation for Migration (IOM) as a rugged, low-cost solution to monitor migration flows. “In Niger, we are the pioneers,” said Ismael Soumana, the police commissioner of Makalondi. A thin, smiling man, Soumana proudly showed off the eight new machines installed since September at the entry and exit desks of a one-storey prefabricated building. Each workstation was equipped with fingerprint and document scanners, a small camera, and a PC.

Data sharing

The data from Makalondi is stored on the servers of the Directorate for Territorial Surveillance (DTS), Niger’s border police. After Makalondi and Gaya, on the Benin-Niger border, IOM has ambitious plans to instal MIDAS in at least eight more border posts by mid-2020 – although deteriorating security conditions due to jihadist-linked attacks could interrupt the rollout.

IOM provides MIDAS free of charge to at least 20 countries, most of them in sub-Saharan Africa. Its introduction in Niger was funded by Japan, while the EU paid for an initial assessment study and the electrical units that support the system. In addition to the border posts, two mobile MIDAS-equipped trucks, financed by Canada, will be deployed along the desert trails to Libya or Algeria in the remote north.

MIDAS is owned by the Nigerien government, which will be “the only one able to access the data,” IOM told TNH. But it is up to Niamey with whom they share that information.

MIDAS is already linked to PISCES (Personal Identification Secure Comparison and Evaluation System), a biometric registration arm of the US Department of State installed at Niamey international airport and connected to INTERPOL’s alert lists.

Niger hosts the first of eight planned “Risk Analysis Cells” in Africa set up by Frontex and based inside its border police directorate. The unit collects data on cross-border crime and security threats and, as such, will rely on systems such as PISCES and MIDAS – although Frontex insists no “personal data” is collected and used in generating its crime statistics.

A new office is being built for the Niger border police directorate by the United States to house both systems.

The West African Police Information System, a huge criminal database covering 16 West African countries, funded by the EU and implemented by INTERPOL, could be another digital library of fingerprints linking to MIDAS.

Frontex programmes intersect with other data initiatives, such as the Free Movement of Persons and Migration in West Africa, an EU-funded project run by the IOM in all 15-member Economic Community of West African States. One of the aims of the scheme is to introduce biometric identity cards for West African citizens.

Frontex’s potential interest is clear. “If a European country has a migrant suspected to be Ivorian, they can ask the local government to match in their system the biometric data they have. In this way, they should be able to identify people,” IOM programme coordinator Frantz Celestine told TNH.

The push for returns

Only 37 percent of non-EU citizens ordered to leave the bloc in 2017 actually did so. In his 2018 State of the Union address, European Commission President Jean-Claude Juncker urged a “stronger and more effective European return policy” – although some migration analysts argue what is needed are more channels for legal migration.

Part of the problem has been that implementing a returns policy is notoriously hard – due in part to the costs of deportation and the lack of cooperation by countries of origin to identify their citizens. Europe has had difficulty in finalising formal accords with so-called third countries unwilling to lose remittances from those abroad.

The Commission is shifting to “informal arrangements [that] keep readmission deals largely out of sight” – serving to ease the domestic pressure on governments who cooperate on returns, according to European law researcher, Jonathan Slagter.

The new Frontex regulation provides a much broader mandate for border surveillance, returns, and cooperation with third countries.

It contains provisions to “significantly step up the effective and sustainable return of irregular migrants”. Among the mechanisms is the “operation and maintenance of a platform for the exchange of data”, as a tool to reinforce the return system “in cooperation with the authorities of the relevant third countries”. That includes access to MIDAS and PISCES.

Under the new Frontex policy, in order to better identify those to be deported, the agency will be able “to restrict certain rights of data subjects”, specifically related to the protection and access to personal data granted by EU legislation.

That, for example, will allow the “transfer of personal data of returnees to third countries” - even in cases where readmission agreements for deportees do not exist.

Not enough data protection

The concern is that the expanded mandate on returns is not accompanied by appropriate safeguards on data protection. The European Data Protection Supervisor – the EU’s independent data protection authority – has faulted the new regulation for not conducting an initial impact study, and has called for its provisions to be reassessed “to ensure consistency with the currently applicable EU legislation”.

Mariana Gkliati, a researcher at the University of Leiden working on Frontex human rights accountability, argues that data on the proposed centralised return management platform – shared with third countries – could prove detrimental for the safety of people seeking protection.

“Given the extent of data sharing, the regulation does not put in place the necessary human rights safeguards and could be perceived as giving a green light for a blanket sharing with the third country of all information that may be considered relevant for returns,” she told TNH.

“Frontex is turning into an information hub,” Gkliati added. “Its new powers on data processing and sharing can have a major impact on the rights of persons, beyond the protection of personal data.”

Nonetheless, the movie is not entirely unperceptive of its eponymous protagonist being an outsider, for it compensates for this through the character of Malko Netam - a weathered, local school teacher played by Anjali Patil, who delivers some sharp dialogues as the sole adivasi in the limelight. Matter of fact, everything Malko's character says, increasingly feels like tick marks on the required checklist for this movie to pass as sufficiently woke. In the end, Malko does nothing more than drive the plot forward; we see zero development in her character, and she serves no other purpose than to inspire Newton. She is saturated with her adivasi-ness; the perfect token. It's probably too much to ask for a real adivasi actress to play an adivasi woman in Bollywood... perhaps points should be given for the fact that when you try to imagine an archetype of the fetishized, dark, and exotic, adivasi woman; Patil perfectly fits the bill.

No other adivasi character in the movie is put in the forefront except for Malko. I am positive that more screen time is spent on Newton and Aatma Singh (Pankaj Tripathi) arguing than on any adivasi character. When the plot does spend time on the Gonds in the camp, it's only to show the mistreatment meted out to them and their submission to it. The film doesn't spend any time building their story or even adding nuance to their plight, they are reduced to being hapless victims sans agency. After the forced and farcical voting occurs, the camera spends a good minute or two on close-up shots of the quirkiest looking adivasis who voted, its gaze bordering on Orientalism. Evoking imperialism is not a far-fetched argument when Savarna media has called Dandakaranya the heart of darkness in some reviews.

At one point in the movie, the Gonds go inside the polling booth to start voting. As the first man Sukku reaches the EVM he just stands there, not knowing what to do. Then Loknath laughs out loud and says derisively 'Electronic machine iske baap ne bhi nahin dekhi hogi, yeh aake khara ho gaya bas.' In the theatre that I was in, the audience burst out laughing. I was probably one of the few who didn't laugh, as I've never understood why making fun of the marginalised is funny. Imagine a similar situation set abroad - say an American movie shows a white man laughing at an Indian man unable to use a self-checkout machine at a grocery store, for he has simply never used one before. I wonder how many people in the same audience would laugh and how many would cry foul over the racism. Such scenes in Newton made it unclear if the laughter was to be directed at the absurdity of the situation or the inadequacies of the adivasi characters. This lack of clarity again undermined the endeavours to make the film a legitimate political statement.

So, what’s the difference between just being smart to being a genius?

There’s an immense variance between being really bright and being intellectually gifted. While geniuses do tend to be extraordinarily intelligent, they also use imagination and creativity to conceive, realize or envisage something unique. They blaze new trails instead of just trudging down the beaten path. For the genius, the ability to imagine new possibilities is as important as intelligence.

Like most tablet PCs in the market today, the LG Optimus is driven by the Android 2.2 Froyo.

The Android OS is a software stack for mobile devices that includes an operating system, middleware and key applications. Google Inc. purchased the initial developer of the software, Android Inc., in 2005. Android’s mobile operating system is based on the Linux kernel. Google and other members of the Open Handset Alliance collaborated on Android’s development and release.

The Android Open Source Project is tasked with the maintenance and further development of Android. The Android operating system is the world’s best-selling Smartphone platform. Android has a large community of developers writing applications or apps that extend the functionality of the devices. There are currently over 200,000 apps available for Android.

The Android Market is the online app store run by Google, though apps can also be downloaded from third-party sites. Developers write primarily in the Java language, controlling the device via Google-developed Java libraries.

While I was in Divisoria to buy some Naruto and Gundam action figures, I visited Jeney Tan, my favorite tablet PC vendor at 168 Mall. She is all out for the Froyo. She explained to me every conceivable feature and advantage of the OS including the accelerometer which tilts everything you see when you hold the gadget in landscape or portrait mode.

Jeney even made bida about the Android 2.3 Gingerbread that should be in the market by now. Pre-loaded with Froyo, the LG Optimus is upgradable to Gingerbread. Adding my own flawed logic, I informed her that Gingerbread is a big leap from Froyo that when the cell phone’s display is held in portrait or landscape mode, it actually tilts the user in that orientation. She then looked me straight in the eye and said the words that I will never forget, “Ser, bebele ba kayo?”

Like a bowl of frozen yogurt during hot summer nights, Froyo (short for frozen yogurt) is a refreshing approach to using tablet PCs and high-end, high performance phones like the LG Optimus.

The Way It’s Meant To Be Played

Before I got the LG Optimus, I had one of those popular media players made by a US company named after a red or green fruit (and no, it’s not a berry). The video playback and quality was okay but among my long list of peeves was that it played a limited number of video formats if not just one which is MP4.

The video format is okay for my cell phone and my computer. But my other portable player has trouble playing MP4s and only plays Windows Media Video formats. So, I had to convert videos to MP4 for my portable media player and into WMV format for my family’s other video player and for movie / video archiving.

It’s in playing various video formats that the LG Optimus shows its true awesomeness. Because it plays and supports multiple video codecs (plus DivX / XviD video support), I don’t have to convert / encode my movies or videos over and over again for viewing and archiving. That saves me time. Precious time that I can waste playing Tekken.

Beyond video support, the Optimus wows us with its display.

I remember the first time I saw the Optimus at an LG outlet glass shelf, I was really amazed at the proportions — 34-22-32. Uh, okay, that was the vital statistics of the salesgirl who look liked Megan Fox. What struck me was that the screen seemed bigger than my touch phone. Asking Megan, I mean the salesgirl, I discovered that my other phone only had a 3.5-inch (diagonal) widescreen multi-touch display while the Optimus had a 4.0 inch display (all the better to see Megan Fox with).

The Optimus is equipped with a 16M-color capacitive IPS LCD touch-screen of WVGA resolution (480 x 800 pixels). It has a HDMI port which you can use for HDMI mirroring. Just connect it to a wider screen or an HD TV and experience the most vivid and life-like videos this side of Cybertron.

Because the phone is able to play in full HD through any monitor, you see every detail of Jennifer’s Body in astonishing clarity and sexiness.

I usually watch videos and movies over large monitors when I’m with my family. Most of the time though, I’m using the LG Optimus to catch up on the latest movies while waiting for the FX or the van at the terminal. The viewing experience is just as good as the big screen which can sometimes make you feel that your head is going to be eaten by a giant 3D piranha.

But the best place to watch is in bed – relaxed and alone. And with the Optimus phone’s superior theater-like sound and HD video, I feel like I will have to save Bella again in the upcoming Twilight XXV: Vampire Sequels Without End.

The LG Optimus possesses an 8 MP autofocus camera with an LED flash for insufficiently lighted areas like bars, discotheques, concerts and internet cafes / Counterstrike fragging rooms. It prioritizes people over things and stuff with that Photoshop-friendly face detection feature.

I could stop ranting about the phone’s super astig camera right here and you’d be convinced by its performance. But since I like listening to myself talk, let me continue.

Just for the camera phone, I’d sell my other touch screen phone made by a company named after a pomaceous fruit of the species Malus domestica. Compared with LG Optimus phone’s 8 MP camera, my other phone has a measly 5-megapixel still camera (boy, is it cool — NOT!).

Hands down, pants down – the LG Optimus takes the matrix of leadership in still camera shooting.

When the folks at LG designed the Optimus, they had the young Spielbergs and fledgling George Lucases in their mind. Empowering the YouTube generation, they imbued the phone with the ability to do 1080p video recording at 24fps and 720p at 30fps. I have a JVC Everio HD camcorder that does the same – and it’s a full-fledged video recorder! How the LG people managed to cram a lufet video recorder inside the Optimus phone’s sleek frame is beyond my comprehension. But that’s why they’re geniuses, you see.

And if you’re in a Miley Cyrus or Katy Perry concert and want to record the whole thing, there’s plenty of internal storage (8 GB) and a micro SD slot for 32 GB cards.

Even with just a video recorder match-up, the LG Optimus slaughters the leading, popular competitor which can only record VGA-quality videos at 30 frames per second with the front camera.

For me, dinner time at the mall is always a constant battle. Whether I’m having meals at Gumbo, Tokyo Café, Banana Leaf, Bacolod Chicken Inasal, Koryo or Gerry’s Grill (all located at SM City The Block), I’m always wishing that my cell phone would successfully find and connect to the free WiFi available at the mall. Most of the time, I’m victorious as the Azkals and in rare occasions it’s like The Battle of Bull Run, Masada, Pearl Harbor and the Fall of Bataan all rolled into one.

But these days, with the LG Optimus, my WiFi struggles are like a walk in the park – the Sandara Park. Its WiFi is at 802.11 b/g/n which means it decently performs whenever you need to update your Twitter account while feasting on that plate of spicy Jambalaya or Garlic Potato.

One of the best innovations of the LG Optimus Black is the enhancement and the durability of its LCD display. The LCD screen’s contrast and backlight strengths are indispensable for any cell phone. Ironically, it isn’t the darkness of the night that makes images or text unreadable – it’s the bright glare of sunlight which makes thing harder to peruse.

I usually ride shotgun in the FX or van which makes sunlight shine directly on my lap – the exact area where I would be reading an e-book (currently it’s Star Wars: Knights of The Old Republic — Deceived). The brightness of the morning sun defeats the LCD screen making the e-book unreadable. It’s the same problem when I watch episodes of Gunny’s Lock and Load – the video is too bomalabs.

That’s the reason why I scored a cell phone capable of counter-acting the brightness factor. The Black’s 4” NOVA display has 700 nits of brightness, 16M-color WVGA capacitive IPS LCD unit. It’s the brightest cell phone screen in the world making outdoor viewing in broad daylight friendlier to the eyes.

Is It Safe?

In the movie, The Marathon Man, the Nazi operative Szell (Laurence Olivier) repeatedly asked Babe (Dustin Hoffman) “Is it safe?” He was referring to the bag of diamonds Szell had procured at the height of the Third Reich. Of course Babe had no idea what it was all about and he got tortured severely for it.
