A Toronto-area woman is facing an eviction hearing after she aired her concerns about her building's maintenance publicly to CBC Toronto.
Last October, CBC News told the story of April Johnston and the complaints she and several of her neighbours had about their apartment complex on Rathburn Road East in Mississauga, west of Toronto. They spoke about routine repairs that they said were left undone for weeks or months at a time, piles of garbage and pests like mice and roaches.
Just before Christmas, Johnston received a notice from the Ontario Landlord and Tenant Board (LTB) warning that she could be subject to an eviction application because, according to the complex's owners, her accusations were untrue.
The notice said airing the complaints publicly hindered the landlord's reasonable enjoyment of the residential complex.
Then, on Feb. 23, she received a letter informing her that the landlord was applying for an eviction order.
Johnston and other tenants in the low-rise complex, located near Central Parkway East and Highway 403, told CBC Toronto the problems had existed since the beginning of 2020 when the first superintendent and property manager took over.
In the CBC story, several tenants complained about plumbing problems, repairs that hadn't been carried out by the owners, Toronto-based Solmor Builders Ltd., for weeks at a time, as well as ongoing battles with mice and insects.
Hawkes emailed a statement about the ongoing eviction battle in response to questions from CBC Toronto.
A date for a hearing has been set, according to the LTB said the complaints she and other tenants aired in October were legitimate, and some have still not been resolved.
Johnston also says she's worried about the chilling effect that threats of eviction can have on tenants who might otherwise speak out against landlords who neglect their properties.
Geordie Dent, of the Federation of Metro Tenants' Associations, who's not involved in the Johnston case, told CBC Toronto that it's not at all uncommon for landlords to initiate eviction proceedings when tenants speak out, and the practice seems to be on the rise.
He said with such high rents, it's in a landlord's interests to get current tenants out and bring new tenants in, so more rent can be charged.
Paralegal Barrington Lue Sang, who specializes in landlord-tenant cases, said it's not uncommon for tenants to accuse landlords of shoddy maintenance. But it's unlikely a landlord could win an eviction based on those complaints.

Meanwhile, hinges that make grinding noises should be replaced, but only after unplugging the unit and must be handled by a technician. If it's squeaky hinges, then it just needs oiling. Another cause for noisy garages is the bearings in the pulley or the rollers. Again these should be replaced by an expert.

My Progress- Week # 7
What is working?
So far my business has been pretty successful. Last month I would stop buying furniture when I had $50 worth of merchandise in stock and my set goal was to sell 2-3 items a month. This month I’ve been able to re-invest my profits and move my purchasing cap to $75. My goal is to sell 5 items by the end of the month. My repair skills have improved quite a bit. I bought a set of nesting tables recently for $15 because one of the tables in the set was dented. Using some restoring wax, I filled the dent and the table was as good as new. I sold the entire set for $50.
What is not working?
I did run into a bad buy recently. Well, to be fair it wasn’t a bad buy because I got the item for free, but I did have to drive to the person's house in Mississauga and pick it up. To make a long story short, I thought the repair to some warped drawers on a dresser was just a normal wear and tear issue but it turned out to be water damage. When I took the drawer apart to repair it, it had mold so I had to throw the whole dresser. I know the item was free but it would’ve been nice if the seller mentioned that the item was water damaged and not just “A little wonky” as they said to me. My main issue is dishonest sellers of furniture. They cause a huge waste of time. As well, I’ve had customers bail on me. Even customers who email transfer me money in advance to hold an item for a few days and then have them change the date a few times before asking for their money back. This is frustrating because I have missed out on sales trying to honor my deals with customers. However, because of this, I’ve instituted a policy of no holds on items. While this may alienate some customers it prevents me from missing opportunities.
How do you feel the project is coming?
I think it’s coming along great. I may continue doing this after the course ends. I’m making a lot of money.
 What are you learning about running a business?
The main thing I’ve learned is the amount of time and attention a start-up needs. Picking the furniture only takes anywhere from 30 minutes to an hour, but to sell a piece of furniture I’m on my phone constantly talking with customers trying to secure a pickup. As well, when scouting for furniture, I could spend all day on Kijiji and not find a good buy sometimes. Before starting this project I didn’t realize how much dedication a start-up takes. 
 What are you learning about yourself?
I’m learning that the customer service skills and my outgoing personality is a real asset to making sales. Not so much when talking with customers online, but when I meet them face to face my customer service skills and confidence have helped me secure customers who were almost willing to walk away or try to ask for a discount. I’ve noticed that customers who are picky and try to ask for discounts on pick-up days are just fishing. I’ve learned that I have to stand firm on my price but use my upbeat attitude to soften the blow of the rejection of their offer.
