Covid vaccine mandates enforced on Queensland police and ambulance workers have been declared ‘unlawful’ in a landmark Supreme Court ruling.
Justice Glenn Martin found the Queensland Police Commissioner Katarina Carroll’s direction for mandatory Covid vaccination, issued in December 2021, to be unlawful under the Human Rights Act.
A similar Covid vaccination order issued by the Director-General of Queensland Health at the time, John Wakefield, was determined to be “of no effect,” with enforcement of both mandates and any related disciplinary actions to be banned.
In his decision handed down on Tuesday 27 February, Justice Martin held that the Police Commissioner “did not consider the human rights ramifications” before issuing the Covid workplace vaccination directive within the Queensland Police Service (QPS).
While the Covid vaccination directive to Queensland Ambulance Service (QAS) workers was found to be lawful, Justice Martin said that the Director-General had failed to “establish that the direction he made is a term of employment of the applicants.”
Justice Martin chastised the Commissioner and the Director-General for their inflexibility in the implementation of vaccination directives and suggested that their actions were not properly supported by the evidence.
“Neither the Commissioner nor Dr Wakefield gave close attention to the possible range of solutions. Each was presented with a proposal for mandatory vaccination with little in the way of well-developed critiques of alternative means of reducing illness and infection,” stated Justice Martin in the decision.

rainy windy morning F50 ½° at 7 ¾ - sent off my letter written on Thursday and vide yesterday to M- ‘Lawton hall, Lawton, Cheshire’ and my letter written last night to ‘Dr Belcombe minster yard, York’  - breakfast with my father at 8 ¾ - James Holt came - the coal very well let he would not have given so much – gives Mr. John Rawson £96 per acre for 40D.W. 30 years to get it but owns my coal is cheaper at £200 – it is all whole coal – Holt will go to Mr Parker at 9 am on Monday to give him a coal lease to look at and to explain the coal plan I shall send - and Holt will be here at 11 am on Wednesday to look at the rough draft of coal lease and to see about getting water in Wellroyde brow for Lower brea – thinks there is no doubt of getting a sufficient supply out of the 36 yards coal band – sometime with the 2 joiners in the library passage - At Lidgate on 25 minutes at 11 50 – Miss Parkhill had disappeared and staid away in the other room during my visit she had asked to see Mr Day so Miss W- thought I had better not   she thought I seemed indifferent yesterday how the thing terminated between us   whether she should be with me or not   I parried this very gallantly   saying that actions were more than words and I did not act like one who was indifferent   said her influence was sso great I could only answer myself by keeping out her way etc etc    at one I saw she got fidgetty said she could not keep Miss P- so long away    I said I would go in half hour however seeing Miss W- uneasy  I jumped up and was off Mr Sunderland called before one – found Miss W- much better - he said Mrs W. Parker and Adam respecting instructions the Wakefield road Lower brea branch road and the culvert to be driven and stone to be paid for and slopes to be planted Mr P- to bring all this forward at the meeting of the commissioners on Monday and wrote 1 page of the envelope about other matters coal lease etc instructions for the rough draft of it which I begged to have on Tuesday night - sorry the roads could not be stopped this sessions - obliged for the book and case in point he sent me to look at – then wrote the above of today till 9 ¾ - talking to my aunt till 10 35 – fine day – F51° at 10 ¾° at which hour came to my room

The most recent outrageous conviction in the January 6 psyop will send the leaders of the Proud Boys to prison for as long as twenty years. He knows about all these conspiracies.” Trump said some things that I might have said, if I was a presidential candidate.

We are supposed to believe that he sincerely thought this defender of Waco, and character witness for the FBI sharpshooter that murdered Randy Weaver’s wife at Ruby Ridge, was going to “drain the swamp.”

wild, windy, wet morning – F59° at 6 ½ am - wrote copy of letter asking Eugénie’s character - Breakfast at 8 ¼ with my father - staid down talking about the road thro’ Trough of Bolland wood etc my father taking it all now  with composure and really seeming not even the least annoyed about it at heart - just saw my aunt for a minute - read my father his letter from Marian to say she would be back between 6 and 7 this evening and came to my room at 9 40 - wrote 1 page to ‘The honourable Mrs Herbert, 84 London road Brighton’ and left this letter and my letter written last night to ‘the honourable Lady Stuart Richmond Park, Surrey’ on my desk ready for the post tonight for fear I should not happen to be at home before 6pm when John goes for my sister – out at 10 35 – went down to the hut – found Pickels and Dick there moving earth from the back of it – went with P- to see line of road he had raced out in Trough of Bolland wood – will do very well – told him to cut out a track I could get along easily, so that I might see my way before and consider of it – then back to the hut and stood over there till 1 – then home -  changed my pelisse etc a little while with my aunt and off again at 1 ¾ - a few minutes at the hut and at Lidgate at 2 25 - found Mrs Dyson of Willow field and her friends Mrs and Miss Salomon (late of Sandbach) called there - very civil to them during the 10 minutes or ¼ hour - then sat cozing with Miss W- very comfortably - she, however, not well and lay on the sofa - expressed my wish she should have Dr Belcombe’s advice to which she at last consented and we are to go over to York together for this purpose - had a beef steak at 6 ½ and afterwards tea - John came late on account of having waited in vain for my sister from Market Weighton - home in ½ hour at 10 25 - found Marian arrived ½ hour ago - had come by the Wakefield coach -  just wished her and my father goodnight - talked a little to my aunt (poorly tonight) and came to my room at 10 40 - talked to Miss W- first of her business matters and then quite as if we were really to travel together  mentioned Mrs N-’s asking me to Bath and Miss W- looked with a long face on my talking of going  in fact it is plain she likes me   she said what confidence she felt in [me]    and that she already felt attached to me  I talked of the continent in a style of observation amusing and rather exciting  she lay down and I leaned over her kissing her as usual   after tea got more affectionate but on gently putting my hand up her petticoats   she whispered  don’t and I desisted   she said I did not know how she had suffered from it the other night  had not got the better of it yet  she was very tender there    I talked soothingly and affectionately  said how gentle I would be  expressed my anxiety for her health and she said she would go with me to York this month  she always sleeps with Catharine Rawson   goes to her   I joked and wanted her to come to me  on Monday  no not then  it would not do   it would be better when we went to York to sleep at Tadcaster going and returning    oh oh thought I then we must get off  I must get my ordeal over and let her try me and see whether I can make her happy enough or not   she has really seemed better or more nicely conducted tonight than of late and her affectionate manner did make me feel in love with her  I said I only wished she had but a third of what she had and no Cliff hill and then we might have managed all without difficulty  oh no said she the difficulty would have been far greater I could not comprehend this  I will perhaps explain it said she by and by   I told her my uncle and aunt together had given me more than five hundred pounds one year and my uncle Joseph had once paid my debts but if I had not been as I was perhaps neither I nor Marian would have had the estate   mentioned having Cordingley with me in Paris    but did not say where we were told some of the queer stories and said I had always been too great a pickle but was quite different now    she is more than half in love with me already? rainy morning till after 9 then fine till about 3 or after when hail shower – gleams and showers afterwards but very fine moonlight evening F58° now at 11 20pm. having just written all but the first 7 ½ lines of today -
