ECNBA DISMISSES ADESINA’S PETITION, SAYS IT LACKS MERIT
• SUBMITS CERTIFIED ELECTION RESULTS FROM ELECTIONBUDDY TO NBA TRUSTEES • SAYS RESULTS AUTHENTIC. RULES OUT FOUL PLAY • ENCOURAGES ADESINA TO STUDY ITS FINAL REPORT FOR CLOSURE
On Monday 11 August 2020, the ECNBA provided a written response to the NBA Board of Trustees addressing the Election Petition written by Deacon Dele Adesina.
In its response, the ECNBA confirmed that it had four (4) months to carry out the task of preparing our 40,000+ members for the election of its new National Executives – running between March 13, 2020 and July 30, 2020, between which time it issued twenty-one guidelines in preparation for the Election.
The ECNBA noted that the election was monitored real time from all locations and has been adjudged by many as free and fair. It went on to note that compared with 2016 where only 5400+ lawyers voted and 2018 where only 12000+ lawyers voted, 2020 saw a record number of qualified and verified voters, and an all time high of 18000+ voters with participation higher than 2016 and 2018 combined.
It maintained that contrary to the claims of Deacon Adesina SAN, the election results as monitored and announced, reflected accurately the decision of all participating voters without any form of interference.
ON LIST OF VOTERS
It confirmed that it published a full list of qualified voters on July 1, 2020 in compliance with the provision of the NBA constitution, pulling additional details from NBA Branches to cover those whose details were missing from the original list. It says all qualified voters were required to verify their details ahead of the election and only 29,636 lawyers complied, a list of which it published on July 29, 2020.
ON THE ALLEGATION OF PRELOADED DATA AND WRONG NBA BRANCHES
It clarified that there was no such thing as loading of pre-determined data on the election platform as every voter is identifiable by their Supreme Court Enrolment No., and can be verified using the Certified results provided by ElectionBuddy. It went on to add that although certain names had incorrect Branches and gender assigned to them, the errors were mostly attributable to failure of such lawyers to complete their reelvant details during the verification process. It added that notwithstanding, such details had no impact on the voting procedure itself as all that was required to vote was your SC Enrolment number – which every voter must input before casting their vote.
The ECNBA confirmed that given the NBA’s track record of litigating election outcomes, it experienced difficulty in finding institutions that were willing to work with it on the election. Notwithstanding, it was able to procure the services of an international IT platform with whom a series of trials via mock elections were conducted, involving the ECNBA members and national officers (excluding the NBA President), with satisfactory result.
ON UNDELIVERABLE NOTICES
The ECNBA clarified that the failure to deliver the notices had to do with the voter’s phone number/email and not the platform. It explained that the details shown on the screen was an aggregate of the number of attempts by the Service Provider to deliver election notices to voters – being 5 notices to each voter’s phone number and email, and each failed attempt was aggregated. It noted that a good number of failed deliveries were subsequently resolved for those who were able to comply with the directions in the said ECNBA Statement and the Help desk, resulting in such voters being eventually able to cast their ballot.
CONCLUSION
In concluding, the ECNBA noted that proper data management was critical to the efficiency of the online voter system, and encouraged the NBA Secretariat and Branches to do better at this, as the work of any ECNBA can only be as good as available and well-coordinated data.

Olumide Akpata emerges NBA President, pledges transformational leadership
A former Chairman of the Nigerian Bar Association Section on Business Law, (NBA-SBl) Mr Olumide Akpata, has emerged the 30th President of the NBA.
Akpata polled 9,891 votes to defeat two senior advocates – Mr Dele Adesina and Dr Babatunde Ajibade.
Ajibade polled 4,328 votes and Adesina 3,982 votes.
The 2020 Elections into national offices of the NBA opened at 11.00p.m. on Wednesday (July 29) with a total of 29,635 accredited voters, and ended at 11.00p.m. on Thursday (July 30)
A total of 18,256 ballots was cast.
The results of the elections were announced by the Chairman of the Electoral Committee of the NBA (ECNBA) Mr Tawo.E. Tawo.
Other elected officers for the various offices include Mr John Aikpokpo-Martins as NBA First Vice President with a total of 6,010 votes.
Mr Adeyemo Kazeem emerged NBA Second Vice President with 8,794 votes, Mrs Joyce Oduah was elected NBA General Secretary with 8, 979 votes, while Mrs Uchenna Nwadialo polled 7,314 votes to emerge NBA’s Assistant General Secretary.
Mrs Mercy Agada was elected NBA Treasurer unopposed, Mr Nnamdi Anagor emerged the financial secretary unopposed while Mr Olukunle Edun was elected NBA Welfare Secretary with 9,001 votes.
Dr Rapulu Nduka emerged the NBA Publicity Secretary with 11,964 votes while Mr Naza Afam polled 6,490 votes to emerge NBA Assistant Publicity Secretary.
Akpata expressed appreciation to NBA members for electing him the President, and promised that NBA would record transformation during his administration.
Similarly, Oduah and Edun (General Secretary and Welfare Secretary) thanked God and their supporters for the election, and pledged to live up to their campaign promises
The News Agency of Nigeria (NAN) reports that Akpata is a graduate of Law from the University of Benin. He is a Senior Partner at Templars, a leading commercial law firm.
He will lead the NBA in the next two year.
The new executives will be sworn in at a later date.

The Electoral Committee of the Nigerian Bar Association has declared Olumide Akpata winner of the NBA presidential poll, which held electronically between 11pm on Wednesday and 11pm on Thursday.
The Chairman of the ECNBA, Chief Tawo Tawo (SAN), announced at the end of the poll late last night that Akpata polled 9,891 votes to defeat Dr Babatunde Ajibade (SAN) and Mr Dele Adesina (SAN).
Ajibade emerged first runner-up with 4,328 votes while Adesina picked the rear with 3,982 votes.
Though a total of 29,636 lawyers were accredited to vote in the e-election, only 18,256 succeeded in casting their ballots. Akpata scored 54.3 per cent of the cast votes to emerge winner.
The PUNCH had earlier reported that Adesina, on Thursday, described the association’s national officers’ election as a sham and called on the electoral committee to cancel it.
The call is contained in his petition which he personally signed and addressed to the electoral committee chairman on Thursday.
He alleged in the petition that the voter register used for the election contained “grave errors” which violated the provisions of the NBA constitution.
“I  call on you  Mr  Chairman and members of the  Electoral  Committee of the Nigerian  Bar  Association to cancel this sham Election.
“It is needless to say that if the process is bad,  the product cannot be good. Thank you,” he stated.

Adesina prepared to fail. Ask me why? He strongly believed he’s entitled to be handed the Bar Presidency since he served with Chief Olanipekun, SAN as General Secretary and Olanipekun and the Egbe Amofin endorsed him. Adesina didn’t realise that Egbe’s influence had limitations and it was actually counterproductive in the preceding circumstances of the endorsement.
My friends, endorsement doesn’t win elections, preparation does. In the 21st century, nobody has power, influence to you. You go for it. You’ll be shocked to know that some junior lawyers in DASAN’s law firm and probably Chief Olanipekun’s law firm too, actually voted Akpata. The junior lawyers (age 21-33 yrs) don’t understand tribal sentiments,which our seniors are preaching on Egbe’s platforms, what they understand is Instagram and Tiktok and that is the language Olu spoke to them.
Pointers to Adesina’s preparation to fail:
On Wednesday 29th when the election was about to commence, ECNBA officials addresed candidates’ representatives btw 10:50pm-11:05pm. They explained the reason why they froze candidates from knowing ahead of time, the cyber platform to be utilised for the election. They basically guarded against likely direct interference by candidates with the platform/server providers (US company called Election Buddy). Interestingly, Adesina’s representatives were absent. At 1am, we (Ajibade’s agent and myself) were invited to ECNBA’s local tech room at the NBA house. They wanted to show us round in order to assure us that the ongoing election back up tech installation was free from manipulation. You know what’s shocking? Adesina’s rep/agent was still nowhere to be found.
At about 1:30 am when the live result monitoring platform temporarily froze, I agitatedly rushed up to the ECNBA server room and the officials put a call through to the Americans hosting the main computation server, who later assured us that the link will come back on. They had to quickly re-configure the refreshing timing, since there was more traffic on the result link than voting link. They were overwhelmed by the number of lawyers and non-lawyers following up on the results even at 1:30am.
By 7:30am, I enquired from the ECNBA officials whether they had independent officials and they informed me that they had sent the link to nothing less than 7 Judges/Justices of different courts amongst other observers for monitoring.
The first time we had a glimpse of Adesina’s representatives was when they arrived in the afternoon of 30th July with the sole purpose of submitting their petition and this was well over 14 hours into the election.
Please, let no one fool us because we are a very intelligent people and we shouldn’t be swayed by Adesina’s pre-planned reaction. The fellow doesn’t wish to go into oblivion without some noise. My inclination is that he either overestimated his chances or he knew he would lose. How do you explain his inability to present a situation room representative as required by the ECNBA?

Akpata, Newly Elected NBA Executive Receive Certificate of Return from ECNBA
The Electoral Committee of the Nigerian Bar Association (ECNBA) on Sunday presented Certificates of Return to the newly elected NBA president, Olumide Akpata, and other newly elected officials of the Nigerian Bar Association (NBA).
The presentation took place on Sunday, 2nd day of August, 2020 at the NBA National Secretariat, Abuja in anticipation of the forthcoming inauguration to hold on August 27.
Meanwhile, the Chairman of ECNBA, Mr. Tawo E. Tawo, SAN in his opening remarks restated that over 29,000 Lawyers were verified voters and noted that the election result was declared barely few hours after the conclusion of the process at about 11 PM on 30th day of July, 2020.
However, the Chairman expressed concerns over the disunity in the Bar. He also charged all members to embrace unity noting that a house divided against itself is bound to fall.
