In Illinois, 114,000 people are banned from owning guns because of legal tangles or mental health issues — three-quarters of them haven't surrendered their firearms, according to data the Cook County sheriff will present Thursday.
Sheriff Tom Dart is seeking $10 million from state lawmakers to tackle what he calls in naming the report “A Firearm Regulation Crisis." The money would train and equip more door-knocking officers to retrieve or ensure the safe storage of weapons from those who have had their state Firearm Owners Identification cards rescinded.
The aim would be reducing the chance potentially volatile people would exhibit the type of violence seen when a shooter who wasn't allowed to own a firearm carried out a massacre at Henry Pratt Co. in a Chicago suburb.
Otherwise, the menace of revocations of FOID cards from noncompliant gun owners will spiral beyond law enforcement’s control, the Democratic sheriff told The Associated Press in releasing the report in advance. Dart scheduled a news conference Thursday morning to release his findings.
“I wish I was making this up. I wish I had someone pull my argument apart and say, ’You’re exaggerating. You’re being dramatic,'” the Dart told the AP in an interview Wednesday. “No. Do the math. At this rate, two years from now, we’re going to have 100,000 revoked FOID card owners, and there will be no contact with them to ensure they’ve had their guns properly dealt with.”
Legislation pending in Springfield would increase fees on weapons purchases to fuel enforcement, but just two weeks remain in the spring legislative session.
There are 2.42 million FOID card holders in Illinois. They are rescinded when a gun owner is convicted of a felony, is the subject of an order of protection, is dealing with other mental health or cognitive issues, or is deemed a “clear and present danger” to themselves or others by police, school administrators, or medical professionals. Notified gun owners are required to turn over their weapons for storage or transfer them to a trusted person possessing a FOID card, an action certified with the completion of a Firearm Disposition Record.
Too many don't. Historically, the approach was for local law enforcement to repeatedly send letters informing the recipient of the obligation to do so.
Dart's report found that of nearly 114,000 repealed FOID card holders, 74% — approximately 84,000 — have never accounted for surrendering weapons.
The issue came to a bloody, devastating head in February 2019 when a man dismissed from his job at the Henry Pratt Co. in Aurora pulled and fired a gun he wasn’t allowed to have, killing five employees and wounding half-a-dozen others. The gunman bought the weapon in 2014 when a background check failed to identify a 1995 conviction for aggravated assault in Mississippi. When authorities became aware of it, they revoked the man’s FOID, but he never surrendered the weapon.
The same year, a DuPage County man whose FOID had been revoked for an aggravated battery charge but who had not turned over any weapons shot and killed his 18-month-old son, then himself, Dart's report notes.
Dart's efforts in the area predate the Aurora incident. He formed a unit in 2013 of eight officers trained to deal with tense environments, including those involving mental illnesses. His staff says the office has closed 9,200 cases, collected 4,000 FOID cards, taken 1,517 weapons for storage and allowed the safe transfer of several thousands of other weapons.
“It isn’t like trying to draw some type of conclusion and be a mind reader on who’s about to commit an offense,” Dart said. “We literally have the name and address of someone who has a gun and shouldn’t have it.”
Legislation signed in 2021 created a program for funding revocation enforcement teams. The Illinois State Police has granted local police departments — including Dart's and the Chicago city police — about $1 million a year.
Illinois State Police started tracking revocation enforcement in May 2019 and through 2022 reported bringing 4,300 people into compliance with the law.
Despite recent efforts, the backlog hasn't changed since state police reported it in the days following the Aurora disaster.
Dart has a sympathetic ear in the capital, and one particularly sensitive to the subject. Rep. Bob Morgan, a Democrat from the Chicago suburb of Deerfield, was marching with constituents in Highland Park's 2022 July 4th parade when a gunman opened fire, killing seven and wounding at least 30.
Morgan's proposal would increase the $2 fee on firearm purchases or transfers to $10, with $4 of that earmarked for the Illinois State Police's revocation enforcement fund. Morgan said the legislation has yet to be reviewed by the House task force on firearms.
Despite the steep increase in the transfer charge, Morgan said many states charge more than Illinois, from $15 in New Jersey to $25 in Nevada.
“We just have tens of thousands of these weapons that are floating out there from people who have had their FOID card legally and finally revoked,” Morgan said. “We need to do better.”

Fatal shooting of Karina Gonzalez once again highlights difficulty of seizing guns from spouse accused of abuse -
Two weeks before Karina Gonzalez was fatally shot in her Little Village home, she walked into the Ogden district police station and said her husband had threatened to kill her.
“You do not know who I am,” Jose Alvarez had yelled to his wife, according to her complaint, which also noted Alvarez had a gun in the home.
In the days that followed, Gonzalez was granted an order of protection against Alvarez banning him from their home. Chicago police filed a clear and present danger report on him, and Illinois State Police revoked his firearm owners identification card.
Yet Alvarez was still in the home and still had his Glock 9mm handgun on July 3 when prosecutors say he fatally shot his wife and 15-year-old daughter and wounded his 18-year-old son.
Under current state law, there is no clear process for removing a gun after an order of protection has been issued, according to domestic violence prevention advocates. The law also does not dictate how quickly it must be done.

Authorities discovered the body after they were alerted to a strong odor
Human remains found inside a box in an Illinois storage unit have been identified as a former police chief, authorities said.
A statement from Knox County Sheriff's Office confirmed the body discovered on October 7, 2022, in a storage facility in Maquon belonged to Richard R. Young. The 71-year-old was identified after DNA samples were matched with samples taken from family members.
Young was a former village police chief in Maquon, a town about 150 miles southwest of Chicago.
Police said the victim's family has been notified and the investigation into his death remains active.
The body was discovered after complaints of a strong odor coming from a unit at Roberts Self Storage, the Associated Press reported.

Marcy Oglesby, 50, faces charges related to the case and is in custody at the Knox County Jail.
Authorities had initially charged Oglesby with first-degree murder, but WQAD and KWQC reported the murder charge and other charges were dropped during a motion hearing on March 16. WGIL reports the charges were dropped because a judge found Oglesby's right to a speedy trial had been violated.
Now, Oglesby is charged with one count of concealment of a death, two counts of forgery and two counts of possession of a firearm without requisite firearm owner's identification card.
In an email to KWQC, Knox County State's Attorney Jeremy Karlin said, "This office respectfully disagrees with Judge Doyle's interpretation of Illinois law and his decision. We intend to file an immediate appeal of his ruling to the Fourth District Appellate Court in Springfield."
PEOPLE has contacted Illinois Courts to confirm her current charges.
Danny Thomas, the former mayor of Maquon, told WQAD that Young "would do anything for anybody."
"He was always there," Thomas said. "I mean, it didn't matter what time of day or night it was, if there was something happening, he was there."

Illinois lawmakers want to ‘Void the FOID’ gun license system.
New legislation introduced in Springfield would repeal the state’s Firearm Owners’ Identification card system.
According to Sen. Andrew Chesney (R-Freeport) and Rep. John Cabello (R-Machesney Park), who filed similar legislation in both the Illinois Senate and Illinois House, federal background checks and waiting periods are adequate in weeding out those who should not be able to own a gun, making Illinois FOID system redundant.
“Illinoisans have a constitutional right to possess firearms, yet the Legislature continually throws up roadblocks that interfere with that right,” said Chesney. “The legislators who bring forward and pass these kinds of bills claim they are protecting public safety, but they are ignoring the very real fact that those who purchase firearms lawfully are not the ones responsible for the violent crime epidemic in this state. The criminals ravaging the streets of Chicago are not lawful people. Illinois’ FOID card system is not preventing these criminals from getting their hands on guns.”

So this means the police. When they're going to a building and it has security, they need to know what type of weapons, the security officers carry as well.... But this should be crossed reference with their Driver's license and vehicle ownership, as well as their state ID card and their passport. Yes, they need to know this so when you go on to a plane they Do extra screening.... 🙄 So, whether it's a train or plane or even entering a public stadium, they must be able to reference this information that you have weapon ownership. So they can greater scrutinize you....

So I understand about self-protection, but also, what is the. Requirement for disclosure with the drivers carrying, say pepper spray.... Now, I believe in dog repellents with mailmen. Lake County prosecutors Friday charged Robert Crimo Jr., father of alleged Highland Park Fourth of July parade shooter Robert “Bobby” Crimo III, with felony reckless conduct for sponsoring his son’s firearm owner’s identification card.
State’s Attorney Eric Rinehart would not say explicitly why Crimo Jr.’s sponsorship amounted to a crime, but hinted it was due to the father’s possible knowledge of his son’s troubled background.
“He knew what he knew and he signed the form anyway,” Rinehart said at a news conference at the Lake County courthouse in Waukegan. “This was criminally reckless and a contributing cause to the bodily harm suffered by the victims on July 4.”
Crimo Jr. faces seven counts of the charge — one for each person killed in the attack. Felony reckless conduct has maximum penalty of three years in prison, but probation is also an option.
Rinehart said Crimo Jr. turned himself in to Highland Park Police Friday, and faces a bond hearing Saturday.
Crimo Jr.’s lawyer, George Gomez, who said in the past that his client hadn’t been aware Crimo III was a danger to anyone when he sponsored the FOID card, blasted the charges as baseless and unprecedented.
“On the eve of the statute of limitations for reckless conduct related to the sponsorship of Crimo III’s FOID application, the Lake County state’s attorney hastily made a decision to charge my client,” Gomez said in a statement.
“This decision should alarm every single parent in the United States of America who according to the Lake County state’s attorney knows exactly what is going on with their 19-year-old adult children and can be held criminally liable for actions taken nearly three years later. These charges are absurd and we will fight them every step of the way. Mr. Crimo Jr. continues to sympathize and feel terrible for the individuals and families who were injured and lost loved ones this past July Fourth, but these charges are politically motivated and a distraction from the real change that needs to happen in this country.”
Prosecutors say Crimo III fired dozens of shots from a rooftop perch into the crowd gathered for a Fourth of July parade in Highland Park. Seven people were killed and 48 wounded.
Crimo III has been charged with seven counts of first-degree murder in what Rinehart called a “premeditated and calculated attack.” His next court hearing is scheduled for Jan. 31.
Meanwhile, police reports show officers were called to the Crimo home nine times between 2010 and 2014 in response to domestic altercations involving the parents, Robert Crimo Jr. and Denise Pesina. Records showed neither had been charged with domestic violence in Lake County.
In 2019, Highland Park Police reports stated officers were called to domestic cases involving the family, and were told Crimo III had tried to kill himself with a machete and threatened to kill “everyone.”
Crimo III denied it, and no charges were filed.
Local police reported Crimo III to Illinois State Police as a “clear and present danger,” but state police approved his application for a FOID card with his father’s sponsorship, in December 2019.
Crimo III was 19 at the time, which made him unable to get a FOID card — required to buy a firearm legally — without his father’s assistance, Rinehart said.
Crimo Jr. told ABC News he was shocked and felt “horrible” about the shooting, but had “no regret” over helping his son get access to guns.
The clear and present danger request was not retained in state police records, per the rules at the time. Meanwhile, there was no record that anyone — family or police — filed a firearms restraining order, or FRO, related to Crimo, something that would have allowed a judge to bar him from purchasing firearms based on evidence that he posed a threat to himself or others.
State Police officials last month announced changes to both clear and present danger and FRO. Officials said they had developed a new FRO policy that includes specific guidance for law enforcement on how to use the laws. In addition, clear and present danger requests will now be retained for longer periods of time.
Highland Park resident Dr. Emily Lieberman, who fled the Fourth of July gunfire with her family, said she thought Crimo Jr. should indeed be held responsible for helping his son secure a FOID card. But she added that there is a larger issue to face.
“These assault weapons should not be available,” she said when reached by phone Friday night. “They are made to kill the (largest) amount of people in the shortest amount of time. Had that weapon not been available, this horrible event would not have occurred.”
Rinehart echoed that sentiment while announcing the charges, urging the General Assembly to adopt new gun laws.
“For too long we have allowed a vocal minority to drown out the will of the majority and stall common sense legislation about gun safety,” he said. “In my role as state’s attorney of Lake County and as a father, I am once again asking legislators to make the decision that this will never happen again by banning assault weapons and large capacity magazines.”

The first call, in April 2019, was a report that Crimo had attempted suicide.Then, in September 2019, a family member called Highland Park police to report that Crimo "said he was going to kill everyone" and that he had a collection of knives, Sgt. Christopher Covelli of the Lake County Sheriff's Office said at a press conference Tuesday.
Highland Park police confiscated 16 knives, a dagger and a sword from Crimo's home – but ultimately did not arrest Crimo, Covelli said, in part because none of his family were willing to sign complaints.Afterward, Highland Park police notified Illinois State Police of the incident in a "clear and present danger" report.
But because Crimo did not then have a FOID card – a firearm owner's identification card that is issued by Illinois State Police and required for gun ownership – nor an application to deny, the state police said, their "involvement with the matter was concluded.
Three months later, Crimo, then 19, applied for a FOID card. His application was sponsored by his father, and was approved by state police in January 2020.Later that year, Crimo passed three background checks to purchase guns, authorities said. He passed a fourth check on Sept. 20, 2021, his 21st birthday.

The suspect in the Highland Park, Illinois, Fourth of July mass shooting was flagged by police as a "clear and present danger" in 2019, authorities said Tuesday.
Robert "Bobby" E. Crimo III, 21, the suspect in the mass shooting that killed seven people and wounded dozens of others at a Fourth of July parade, was still able to clear state-required background checks to purchase firearms on at least four separate occasions between 2020 and 2021, the Illinois State Police said.
"In September 2019, ISP received a Clear and Present Danger report on the subject from the Highland Park Police Department. The report was related to threats the subject made against his family," Illinois State Police said in a statement posted to Twitter by a staff member for Illinois Gov. JB Pritzker.
The report said that when Highland Park officers went to the family's home and asked Crimo if he felt like harming himself of others, he said no. Police said Crimo's father claimed knives in the home belonged to him and they were being kept in Crimo's closet for safekeeping. Based on that information, Highland Park Police returned the knives to the father that day. 
The statement said police did not make any arrests at the time and that members of the family were "not willing to move forward on a complaint."
Members of the family also did not "provide information on threats or mental health that would have allowed law enforcement to take additional action," the ISP statement added.
"Additionally, no Firearms Restraining Order was filed, nor any order of protection," ISP said.
Such action police could have taken included revoking a licensed-gun owner's Firearm Owners Identification card (FOID), which is required in the state to own or purchase a firearm.
Illinois State Police said at the time of the September 2019 incident the suspect "did not have a FOID card to revoke or a pending FOID application to deny."
Three months later, Crimo did apply and successfully obtained an FOID card, police said.
"The subject was under 21 and the application was sponsored by the subject’s father. Therefore, at the time of the FOID application review in January of 2020, there was an insufficient basis to establish a clear and present danger and deny the FOID application," police said.
The suspect went on to clear four background checks when purchasing firearms on June 9, 2020; on July 18 and July 31, 2020; and on September 20, 2021.
Illinois State Police said the suspect did not have mental health prohibitor reports on his record and his only criminal offense was a possession of tobacco charge in January 2016.
Police said before the Sept. 2019 incident, they responded to an attempted suicide in April that same year. These also did not prevent the suspect from legally purchasing a high-powered rifle that he is believed to have used to kill seven people during the July Fourth parade.

After terror attacks, civil unrest or the threat of gun-buying restrictions it is common for more Americans to exercise their right to bear arms. But top law enforcement officials and firearm experts said there has never been a rush for weapons as we have seen in Illinois since the start of the COVID-19 lockdown. Gun dealers are making changes to meet demands as "essential businesses," as regular customers and newcomers alike want new firearms, ammunition and training.
At Maxon Shooter's Supplies and Indoor Range in Des Plaines, the changes since COVID-19 are evident starting at the front door. Customers enter one by one and are required to produce their Firearm Owners Identification card, also known as a FOID card. Patrons must also pull down their face coverings so a camera can capture their picture for security to prove they are who they say they are. There is yellow tape to emphasize social distancing, through the sales area and at the indoor shooting range where only every other lane is now used. Owner Dan Eldridge said they've had to restock supplies and business is brisk. "The elevated gun buying is across the board," he said. Eldridge also said during the past nine weeks they have been barely able to keep up with demand for guns, ammunition and training, with the majority of buyers being first time gun owners. Hand guns are the top sellers.
