Who Is Harish Salve, The Lawyer Fighting To Get Vinesh Phogat Olympic Medal

Hopes of billion Indians now rests on the shoulders to lawyer Harish Salve who will today represent wrestler Vinesh Phogat in her Paris Olympics disqualification case at the Court of Arbitration for Sport (CAS).

Ms Phogat, a top contender in the 50-kg wrestling category, was disqualified from the Paris Olympics due to a weight issue just hours before the final. The Indian Olympic Association (IOA) has appealed for the Phogat to be given a joint silver medal for her stellar show at the marquee event.

The Court of Arbitration for Sport or CAS is an international body established in 1984 to settle disputes in sport through arbitration.

Harish Salve, former Solicitor General of India and King's Counsel, has confirmed that he has been engaged by the IOA to represent Phogat in the case.

Salve was the Solicitor General of India from 1999 to 2002. He is considered one of India's top lawyers, known for his exceptional expertise in constitutional, commercial, and arbitration law.

Kulbhushan Jadhav Case (2017): He represented India at the International Court of Justice (ICJ) in the case of Kulbhushan Jadhav, an Indian national sentenced to death in Pakistan. کلبھوشن کیس میں کب کیا ہوا ہے؟ تین سال سال قبل مارچ 2016 میں پاکستانی حکام نے بھارتی شہری کلبھوشن یادو کو گرفتار کرنے کا دعویٰ کیا اور اسی ماہ پاکستانی فوج کی جانب سے دعویٰ سامنے آیا کہ کلبھوشن جادھو بھارتی بحریہ کے افسر اور بھارتی خفیہ ادارے ’را‘ کے ایجنٹ ہیں۔ پاکستانی فوج کے اس دعویٰ کے ٹھیک دو روز بعد حکومت پاکستان نے بھارتی سفیر کو طلب کیا اور کلبھوشن یادو کے غیر قانونی طور پر پاکستان میں داخلے اور دہشت گردی میں ملوث ہونے پر باضابطہ احتجاج کیا۔ اس کے چند ہی روز بعد پاکستان کی جانب سے کلبھوشن یادو کا زیر حراست اعترافی بیان ویڈیو کی صورت میں جاری کیا گیا اور بلوچستان حکومت نے دہشت گردی کی دفعات کے تحت ان کے خلاف ایف آئی آر درج کروائی۔

اپریل میں کلبھوشن یادو کو فوجی عدالت نے ملک میں دہشت گردی کی سرگرمیوں میں ملوث ہونے کا مجرم قرار دیا اور 10 اپریل کو انہیں سزائے موت سنا دی۔ کلبھوشن یادو کو پھانسی کی سزا سنائے جانے پر 10 مئی کو بھارت نے عالمی عدالت انصاف میں ایک درخواست دائر کرتے ہوئے اس سـزائے موت کو رکوانے کی اپیل کی۔ 15 مئی کو عالمی عدالت میں بھارتی درخواست کی سماعت ہوئی اور دونوں جانب کا مؤقف سننے کے بعد عدالت نے فیصلہ محفوظ کر لیا۔ تین روز بعد عالمی عدالت انصاف نے نے اپنے فیصلے میں پاکستان کو مقدمے کا حتمی فیصلہ آنے تک کلبھوشن یادو کو پھانسی نہ دینے کی ہدایت کی۔

کلبھوشن یادیو کون ہے؟

حسین مبارک پٹیل کے فرضی نام سے بھارتی خفیہ جاسوس کلبھوشن سُدھیر یادیو کے پاسپورٹ کی کاپی کے مطابق وہ 30 اگست 1968 کو بھارتی ریاست مہاراشٹرا کے شہر سانگلی میں پیدا ہوا۔ کلبھوشن یادیو کو یہ فرضی نام، جس کا اس نے اپنی اعترافی ویڈیو میں انکشاف کیا، بھارتی خفیہ ایجنسیوں کی جانب سے پاکستان میں خفیہ معلومات اکٹھا کرنے کے لیے دیا گیا تھا۔ ممبئی کے مضافاتی علاقے پووائی کے رہائشی کلبھوشن یادیو کا تعلق پولیس افسران کے خاندان سے ہے۔ اپنے بیان میں بھارتی شہری نے کہا تھا کہ وہ نیوی میں حاضر سروس افسر ہے، تاہم اس کے اس دعوے کی بھارت نے تردید کی تھی۔

کلبھوشن یادیو نے مزید کہا کہ اس نے 1987 میں نیشنل ڈیفنس اکیڈمی اور 1991 میں بھارتی نیوی میں شمولیت اختیار کی، جہاں اس نے دسمبر 2001 تک فرائض انجام دیئے۔ بھارتی جاسوس نے کہا کہ پارلیمنٹ حملے کے بعد اس نے بھارت میں انفارمیشن اینڈ انٹیلی جنس جمع کرنے کے لیے اپنی خدمات دینے کا آغاز کیا۔ کلبھوشن کا اپنے اعترافی بیان میں کہنا تھا کہ ’میں اب بھی بھارتی نیوی کا حاضر سروس افسر ہوں اور بطور کمیشنڈ افسر میری ریٹائرمنٹ 2022 میں ہو گی۔ بھارت نے کہا کہ وہ نیوی کا سابق افسر ہے۔ کلبھوشن کے اہلخانہ نے گزشتہ سال انڈین ایکسپریس کو بتایا کہ کلبھوشن یادیو وقت سے قبل نیوی سے ریٹائرمنٹ لے کر کاروباری شخص بن گیا تھا اور اسی سلسلے میں وہ اکثر بیرون ملک بھی جاتا تھا۔

ڈی این اے انڈیا کی رپورٹ میں دعویٰ کیا گیا کہ ’کلبھوشن یادیو ایرانی بندرگاہ شہر بندر عباس سے فیریز آپریٹ کرنے کے قانونی کاروبار سے منسلک تھا۔ کلبھوشن کا کہنا تھا کہ اس نے 2003 میں انٹیلی جنس آپریشنز کا آغاز کیا اور چابہار، ایران میں کاروبار کا آغاز کیا جہاں اس کی شناخت خفیہ تھی اور اس نے 2003 اور 2004 میں کراچی کے دورے کیے۔ 2013 کے آخر میں اس نے بھارتی خفیہ ایجنسی ’را‘ کے لیے ذمہ داریاں پوری کرنا شروع کی اور کراچی اور بلوچستان میں کئی تخریبی کارروائیوں میں کردار ادا کیا۔ کلبھوشن نے کہا کہ پاکستان میں اس کے داخل ہونے کا مقصد فنڈنگ لینے والے بلوچ علیحدگی پسندوں سے ملاقات کرنا اور قتل سمیت مختلف گھناؤنی کارروائیوں میں ان سے تعاون کرنا تھا۔

کلبھوشن یادیو کا کہنا تھا کہ بلوچستان کی علیحدگی پسند تنظیموں کی متعدد کارروائیوں کے پیچھے 'را' کا ہاتھ ہے۔ کلبھوشن یادیو کو 3 مارچ 2016 کو پاکستان کے حساس اداروں نے بلوچستان کے علاقے ماشکیل سے گرفتار کیا تھا۔ تاہم انڈیا ٹوڈے کی رپورٹ کے مطابق بھارت نے الزام لگایا کہ کلبھوشن یادیو کو پاکستان نے ایران سے اغوا کیا۔ بھارتی انٹیلی جنس عہدیداروں نے شبے کا اظہار کرتے ہوئے کہا کہ پاکستانی انٹیلی جنس کلبھوشن یادیو کے فون کی نگرانی کر رہی تھی اور اس کی فون کالز سے اس کی شناخت ظاہر ہوئی۔ فیلڈ جنرل کورٹ مارشل نے پاکستان آرمی ایکٹ کے تحت کلبھوشن یادیو کا ٹرائل کیا اور سزائے موت سنائی۔

کلبھوشن کیس : پاکستان کے لیے نادر موقع

اس بارے میں احمر بلال صوفی نے کہا کہ ’پاکستان کے وزیرِ اعظم کا بیان بین الاقوامی قانون کے مطابق ایک متوازن بیان ہے جبکہ انڈیا کی طرف سے پلوامہ حملے کی تحقیقات ہوئے بغیر الزام لگانا بین الاقوامی قانون میں بھی دھمکی دینے کے مترادف ہے۔‘ انھوں نے کہا کہ پاکستان کو کلبھوشن جادھو کی سماعت کا ایک بین الاقوامی عدالت میں ہونے سے کافی فائدہ ہوا ہے۔ ’پاکستان اور انڈیا کے درمیان ساری باتیں اب بین الاقوامی عدالت میں بمع ثبوت ریکارڈ ہو گئی ہیں۔‘ انھوں نے کہا کہ اسی طرح پاکستان کو ایک موقع انڈیا کی طرف سے کشمیر کے مسئلے کو لے کر اقوامِ متحدہ جانے پر ملا تھا۔ ’انڈیا آج بھی اس بات پر پچھتاتا ہے کیونکہ اس طرح پاکستان کا بیانیہ زور پکڑتا ہے کہ انڈیا کشمیر کے ساتھ ساتھ پاکستان میں بھی مداخلت کرتا رہا ہے۔ لیکن یہ بات دونوں ملکوں میں ہونے کے باوجود ایک بین الاقوامی فورم پر ریکارڈ کی جارہی ہے۔‘

انٹرنیشنل کمیشن آف جیورسٹس کی ساؤتھ ایشیا لیگل ایڈوائزر، ریما عمر کے مطابق، اس طرح کے کیسز میں بیان بازی سے زیادہ قانون کی شق پر بات ہو تو اچھا ہے۔ ’اس کیس میں کچھ باتیں ایسی ہوئیں جو نہیں ہونی چاہیے تھیں، جیسے نواز شریف نے ممبئی حملے کے بارے میں کہا، یا افضل گرو نے کیا کیا، ان دونوں باتوں کا اس کیس سے کوئی تعلق نہیں ہے۔‘ انھوں نے کہا کہ اتنے بڑے کیس کی سماعت کے دوران مختلف باتوں پر بات کرنے سے آپ اپنی عوام کو بھی گمراہ کر رہے ہیں۔ ’جب فیصلہ آئے گا اور وہ بیانیے سے مختلف ہو گا توعوام تو کہے گی کہ یہ کیا ہوا؟ ہم تو جیت رہے تھے؟ کیونکہ ہمارے وکیل نے تو انڈیا کو ہر بات کا جواب دے دیا تھا۔ پھر فیصلہ اس کے برعکس کیوں آیا؟‘

ریما نے کہا کہ انڈیا نے پہلی ڈیمانڈ رکھی تھی کہ ’جادھو کو رہا کریں، اگر رہا نہیں کر سکتے تو پھر سزائے موت کے فیصلے کو کالعدم قرار دیں۔ اور اگر آپ یہ بھی نہیں کر سکتے تو صرف ریویو کرنا کافی نہیں ہے، آپ پھر سے ٹرائل کا آرڈر سیویلین عدالت میں دیں کیونکہ ملٹری عدالت ایک منصفانہ فیصلہ نہیں کر سکتی۔‘ پاکستان کا اس کیس میں موقف ہے کہ پاکستان کی سپریم کورٹ اور ہائی کورٹ ملٹری عدالتوں میں ہونے والے فیصلے پر نطرثانی کر سکتی ہیں۔ انڈیا اس بات کو نہیں مانتا۔ انھوں نے کہا کہ جادھو کے کیس میں سوال یہ اٹھے گا کہ اگر انھیں سفارتی رسائی دی جاتی تو کیا وہ اپنا دفاع بہتر طریقے سے کرسکتے تھے۔
