Activists scored another victory against the government’s use of the controversial Anti-Terrorism Act (ATA) of 2020 as the Malolos Regional Trial Court (RTC) dismissed charges against Makabayan secretary general Nathanael Santiago and dozens others.
Malolos RTC Branch 12 Presiding Judge Julie P. Mercurio in a joint order dated September 3 dismissed the charges against the activists “for lack of probable cause.”
The Court said the evidence submitted by the government prosecution was insufficient to show that the accused were present in a New People’s Army ambush on October 8, 2023 in Laur, Nueva Ecija.
The prosecution likewise failed to show the activists were in actual possession of weapons in the firefight with elements of the 84th Infantry Battalion of the Philippine Army where a government trooper was killed, the order reads.
The National Union of Peoples’ Lawyers (NUPL) said that at least five similar charges using the ATA have earlier collapsed in court due to the State’s inability to provide sufficient evidence to support their claims.
NUPL said government’s ambition to exit the Financial Action Task Force (FATF) gray list or meet arbitrary prosecution quotas cannot, and must not, serve as a justification for the harassment and criminalization of activists and rights defenders.
“These are people who take the blows so that others may live with dignity. To brand them as terrorists is a grotesque distortion of truth,” it said.

MANILA – “Rolly” weakened into a typhoon while Tropical Storm Siony slightly intensified as it entered the Philippine Area of Responsibility (PAR), the Philippine Atmospheric, Geophysical and Astronomical Services Administration (PAGASA) said on Sunday.
In its 11 a.m. weather bulletin, PAGASA said the eye of Typhoon Rolly was located over the coastal waters of Pasacao, Camarines Sur.
It is moving westward at 25 kilometer per hour with maximum sustained winds of 215 kilometers per hour (kph) and gustiness of up to 295 kph.
The weather bureau said catastrophic violent winds and intense to torrential rainfall associated with the region of the eyewall and inner rainbands of the typhoon is expected within the next 12 hours over the western portion of Camarines Sur, Marinduque, the central and southern portions of Quezon, Laguna, the eastern portion of Batangas, and Cavite due to Typhoon Rolly.
“Rolly” is forecast to slightly weaken as it exits the mainland Luzon landmass and emerge over the Philippine Sea between Sunday night and Monday earning morning, it added.
Tropical Cyclone Wind Signal (TCWS) No. 4 is up in Camarines Norte, Camarines Sur, Catanduanes, Albay, the northern portion of Sorsogon (Donsol, Pilar, Castilla, Sorsogon City, Prieto Diaz, Gubat, Barcelona, Juban, Casiguran, Magallanes), Burias Island, Marinduque, Metro Manila, Cavite, Laguna, Batangas, Rizal, Quezon including Polillo Islands, Pampanga, Bulacan, the southern portion of Aurora (Dingalan), Bataan, the southern portion of Zambales (San Marcelino, San Felipe, San Narciso, San Antonio, Castillejos, Subic, Olongapo City, Botolan, Cabangan), the northwestern portion of Occidental Mindoro (Mamburao, Paluan) including Lubang Island, and the northern portion of Oriental Mindoro (Puerto Galera, San Teodoro, Baco, Calapan City, Naujan, Pola, Victoria, Socorro, Pinamalayan).
PAGASA said a very intense typhoon will affect the locality and winds of greater than 171 kph up to 220 kph may be expected in at least 12 hours.

On the other hand, “Siony” is forecast to move generally northwestward at 30 kph with maximum sustained winds of 75 kph near the center and gustiness of up to 90 kph. It remains less likely to affect any portion of the country over the next two to three days, the PAGASA said. (PNA)

BALER, Aurora – A total of eight villages in this province and nearby Nueva Ecija have been declared cleared of insurgency.
This was disclosed during a meeting conducted on Wednesday by the Area Clearing Evaluation Team (ACET) composed of the Armed Forces of the Philippines, Philippine National Police, and local government units of Aurora and Nueva Ecija.
Col. Joseph Norwin D. Pasamonte, Deputy Brigade Commander of the Army’s 703rd Brigade, said the villages of Diteki, Dikapinisan, Ditumabo, L. Pimentel, and Dimanay in San Luis town, this province; Sawmill and Calabasa in Gabaldon town and San Fernando in Laur town, both in Nueva Ecija, have passed the deliberation and evaluation conducted by the ACET.
Pasamonte, who is also the ACET chairman, said the Communist Party of the Philippines-New Peoples’ Army (CPP-NPA) “is losing every square inch of position and influence in their hinterland strongholds where they seek refuge“.
The ACET meeting was also attended by 91st Infantry Battalion (IB) officers led by Lt. Col. Reandrew P. Rubio, Aurora Police Provincial Office led by Police Col. Julio S. Lizardo, Major Erwin Ferry of the Nueva Ecija Police Provincial Office, Gabaldon Mayor Jobby P. Emata, the local government unit (LGU) of San Luis represented by Ariel Albertein de Jesus, and barangay and Sangguniang Kabataan (SK) officials.
Rubio said villagers in the cleared barangays have considered the presence of the 91st IB helpful in bringing the services of the government, including security, peace and stability, to their areas.
Mayor Emata, for his part, thanked the men in uniform for their unwavering support and intensified efforts that led to the successful conduct of Community Support Program (CSP) in their respective communities.
During the event, other issues were also raised by barangay officials such as road construction, flood control project, and medical, educational, employment concerns, among others.  (PNA)
