The federal judge presiding over the Oath Keepers seditious conspiracy case is considering whether to suppress audio recordings of Zello chats from evidence at the request of the defendants.

The chats were recorded by Micah Loewinger, a reporter at New York Public Radio's "On the Media," from an open channel named “Stop the Steal J6” that was created by a user named “1%Watchdog.” The chats capture defendant Jessica Watkins narrating her experience as she and other Oath Keepers stormed the Capitol as other participants provide encouragement and real-time information gleaned from news reports. Loewinger and co-author Hampton Stall reported on the chats in a story published by the Guardian seven days after the Jan. 6, 2021 attack, and the recordings were aired on “On the Media” on Jan. 15.

Watkins, along with defendants Stewart Rhodes, Kelly Meggs and Kenneth Harrelson, are seeking to prevent the government from introducing the Zello chats into evidence at the upcoming trial, claiming that they’re inadmissible hearsay and are likely to prejudice the jury.

During a pretrial conference on Wednesday, Judge Amit Mehta indicated he isn’t sure the jury should be allowed to hear statements of the other chat participants, expressing doubt about whether they influenced Watkins’ actions. He said he wouldn’t make an immediate decision, adding that the arguments from counsel for the defendants and the government had given him “a lot to think about.”

The chats provide an example of how Oath Keepers and other rioters discussed taking lawmakers hostage when they reached the Capitol. Shortly after “1%Watchdog” opened the channel at 1:48 p.m., a transcript of the recording shows him discussing Vice President Mike Pence’s decision to stand up to pressure to set aside electors from a handful of states narrowly won by Democrat Joe Biden.

“Everybody can hear and talk, so their barricades in the national Capitol are being challenged, and — yeah.” “1%Watchdog said. “It looks like Pence is doing his traitorous bullshit, and the election stealing progress — it looks to me, at this point, that that’s a felony high-crime and treason in process inside the national Capitol building, headed by the president of the Senate, Vice President Pence, at this point.”

Judge Mehta said on Wednesday he is troubled that more isn’t known about the identity and relevance of “1%Watchdog.”

“1%Watchdog is someone who’s howling at the moon, saying outrageous things, sitting at home watching television,” Mehta said. “I would feel much better about this if the government could demonstrate that this was someone she knew or someone she was taking direction from. I’m not sure he’s anything more than a guy spouting off on a Zello chat.”

Assistant US Attorney Jeffrey Nestler said the government believes the jury should have the opportunity to hear the recordings because they shed light on Watkins’ state of mind at the time she invaded the Capitol.

“Ms. Watkins gets into the Capitol and she goes into the Zello channel and celebrates what she had done,” Nestler said. “It was obviously important to her…. Our point is that the other individuals’ statements are probative of Ms. Watkins’ state of mind, which is why they should be admitted. And we believe it should be a jury question as to how much weight to ascribe them.”

At 1:49 p.m., according to a transcript of the chats, “1%Watchdog” denigrated Senate Majority Leader Mitch McConnell as “Bitch McConnell,” complaining that he had “rebuked those who are challenging the Electoral College votes that constitute the f***ing communist revolution election steal of 2020 by these treasonous f***ing bastards.”

How Zello keeps people in the loop during South Africa’s unrest

On June 29, former South African president Jacob Zuma was sentenced to 15 months in prison for corruption during his presidency. Zuma—the first ethnic Zulu to hold the country’s highest office—has a loyal following. He also has many detractors, who blame his administration’s corruption for a stagnant economy and weakened democracy.

Zuma didn’t turn himself in until July 7, saying he was innocent and that jail could kill him at 79 years old. Within hours, protests and widespread looting, particularly in his home city of Durban, were reported as supporters stationed themselves around his compound and challenged police. That violence has led to at least 215 deaths and more than 2,500 arrests.

For South Africans like Amith Gosai, keeping track of what was happening on the ground was hard. His WhatsApp chats were flooded and confusing. Then he saw a note on his community WhatsApp group urging neighbors to join a sort of neighborhood watch channel on Zello, a “walkie-talkie” app that is fast becoming a tool for protest communication.

“This helped us tremendously to create awareness around the community as well as to quell fears,” Gosai told me via Twitter DM.

Gosai, who is also from Durban, was among 180,000 people who downloaded Zello in the wake of Zuma’s arrest. Users subscribe to channels to talk to each other, sending live audio files that are accessible to anyone listening in on the channel.

Zello was originally designed to help people communicate and organize after natural disasters. With Wi-Fi or a data connection, people can use it to broadcast their location, share tips, and communicate with rescuers or survivors in the aftermath of a hurricane, flood, or other emergency. In the US, Zello found traction in 2017’s Hurricane Harvey rescue efforts. The app is also used by taxi drivers, ambulance workers, and delivery personnel who want to send hands-free voice messages, according to Raphael Varieras, Zello’s vice president of operations, says. Because Zello is a voice-first platform, it’s faster than typing and requires no literacy skills.

But recent events suggest that use of Zello is increasingly being used to connect people in areas of unrest as well. Within hours of the most recent Israeli-Palestinian conflict, downloads skyrocketed to 100 times their usual rate, for example. And Cuba also saw a spike in downloads amid protests over shortages of food and medicine. Unsurprisingly, this development has prompted some countries to ban the app, including China, Venezuela, and Syria.

Without a formal emergency response system like the US’s 911, South Africans have been increasingly turning to Zello to coordinate ad hoc ambulances and neighborhood patrols. One channel, South Africa Community Action Network, boasts 11,600 paying members who donate for emergency services like ambulances, along with more than 33,000 non-paying members, according to a blog post on the site.

One Twitter user in South Africa I spoke to (who requested anonymity in light of the current dangerous situation) said that some people were using Zello to figure out which houses and storefronts were ripe for looting, while others were tuning in to gauge whether they should flee or stay where they are.

Another user, Javhar Singh, said via Twitter DM that he was using it as “live communication among community members to notify us about the whereabouts of looters,” adding: “It is way faster than the news.”

Crucially in such a tense situation, Zello is anonymous. “People don’t have access to your personal number like in WhatsApp,” says Gosai.

The speed, anonymity, and intimacy created by voice make Zello feel urgent. But those same characteristics could breed misinformation, which Zello does not currently monitor—anyone can use the app at any time to say whatever they want. In fact, Zello was used in planning and carrying out the January 6 insurrection at the US Capitol.

Zello’s popularity in South Africa also proves that online audio isn’t just a 2020 trend. Audio chat rooms on Clubhouse and Discord are built on the idea that people want to talk about common interests, and Facebook and Twitter are actively testing live audio on their platforms. Zello’s general audience, however, isn’t sticking around long enough to get to know people: they’re looking for news, fast and unfiltered.

“There’s a long history of Zello as a go-to app in times of crisis,” says Zello’s CEO, Bill Moore. In South Africa and elsewhere, that increasingly means more than just natural disasters.

Prosecutors say ‘strong evidence’ shows Capitol rioters wanted to ‘capture and assassinate’ officials

Federal prosecutors in a document filed Thursday said that they believe the pro-Trump mob that stormed the U.S. Capitol aimed to “capture and assassinate” elected officials and argued that the man who was seen wearing a horned headdress and face paint should be denied bail.

The man, Jacob Chansley, was arrested and charged in Arizona on Saturday, according to the Justice Department. Chansley, a believer in the QAnon conspiracy theory and a Trump supporter, was charged with knowingly breaking into the Capitol building and its grounds, along with violent entry and disorderly conduct.

Ahead of a detention hearing for Chansley that is scheduled for Friday afternoon, prosecutors filed an 18-page document outlining why they believe Chansley shouldn’t be released ahead of his trial. Among their reasons, prosecutors say, is the severe nature of what they are accusing Chansley of.

“The crimes charged in the indictment involve active participation in an insurrection attempting to violently overthrow the United States Government. By Chansley’s own admissions to the FBI and news media, the insurrection is still in progress and he intends to continue participating,” the filing reads.

“Strong evidence, including Chansley’s own words and actions at the Capitol, supports that the intent of the Capitol rioters was to capture and assassinate elected officials in the United States Government. Chansley left a note on the Senate Chamber dais, where Vice President Mike Pence had been presiding over the session just minutes before, warning ‘it’s only a matter of time, justice is coming,'” the document continued.

“When questioned as to the meaning of that statement, Chansley went on a lengthy diatribe describing current and past United States political leaders as infiltrators, specifically naming Vice President Mike Pence, former President Barack Obama, former Senator Hillary Clinton and U.S. President-elect Joe Biden as infiltrators involved in various types of wrongdoing,” prosecutors added. “Although he stated his note was not a threat, the Government strongly disagrees.”

A lawyer for Chansley did not immediately respond to a request for comment from Fox News.

The claims by the government that rioters wanted to “capture and assassinate” officials are not necessarily surprising. Some who stormed the Capitol did so while chanting, “Hang Mike Pence.”

But what is being alleged by the government itself in a court document makes clear the danger of what amounted to an insurrection aimed at stopping the certification of President-elect Joe Biden’s victory. It also brings into focus the fact that the results of the riot that killed multiple people could have been much worse.

Underscoring fears of further unrest during Biden’s inauguration next Wednesday – and why prosecutors don’t want Chansley released – Chansley said he would return to D.C. on Jan. 20 if he could. “I’ll still go, you better believe it,” he told the FBI, according to the filing. “For sure I’d want to be there, as a protestor, as a protestor, f—–’ a.”

“Some say the riots were caused by Antifa,” House Minority Leader Kevin McCarthy, R-Calif., said on the House floor Wednesday. “There’s absolutely no evidence of that, and conservatives should be the first to say so.”

McCarthy’s been one of the Republicans who lays the blame for the storming of the Capitol at President Trump’s feet.

At least one left-wing activist, John Sullivan, was arrested in the wake of the riots after egging on pro-Trump rioters. He told Fox News he was at the riot to “document” it. But almost all of those arrested for storming the Capitol were public supporters of Trump, like Chansley.

“In an interview with NBC News before his arrest, Chansley boasted about his involvement in the mob that infiltrated the Capitol, driving Congress people and staffers to flee in fear of their lives,” the government filing against Chansley reads.

“‘The fact that we had a bunch of our traitors in office hunker down, put on their gas masks and retreat into their underground bunker, I consider that a win,'” it quotes Chansley as saying. “Chansley stated that he drove to Washington, D.C. as a part of a group effort, with other ‘patriots’ from Arizona, at the request of the President that all ‘patriots’ come to D.C. on January 6, 2021.”
