On the 10th of June, 1976, a worker in a landfill in Tooele County, Utah, discovered a young man’s body. He had been shot twice in the head before being dumped in the landfill. He was estimated to be between 17 and 22-years-old. He had brown eyes and dark brown, wavy hair which was shoulder length. He stood at five feet nine inches and weighed 170 pounds. He had a white scar on his forehead as well as a vaccination scar on his left shoulder and one on his left wrist. Despite an extensive investigation into his identity, he remained unidentified.

In 2015, he was finally identified as 18-year-old David A. Stack, a 1975 graduate of New Milford High School. Stack had vanished after leaving his sister’s home in Broomfield. He had planned on hitchhiking to visit his siblings in Berkeley, California. When he didn’t arrive, a detective in California was assigned to the case. A detective had also been assigned to the John Doe case in Utah. However, the two cases were never linked.

In 2014, the case had been reopened and a number of facial reconstructions and composite sketches were produced in the hopes that somebody could identify him. In 2015, the breakthrough came when it was noted that Stack’s dental records were very similar to the John Doe in Utah. His body was exhumed and DNA compared to DNA of his living family members. It was a match. The body was finally identified as David Stack.

Unfortunately both of David’s parents went to the grave without ever knowing what happened to their son. Kathleen Stack, his mother, had been ravaged by Alzheimer’s which robbed her of her memories of her son. She began conjuring her missing son in the form of a grandchild who had been named after him. While David Stack has been identified, the murder still remains unsolved.

The man charged with killing a Broomfield teen and his mother in a Dec. 12 crash while drunken driving was waiting for a jail bed from a recent alcohol-related driving conviction when he crashed into the pair’s vehicle, according to the 20th Judicial District Attorney’s Office.

Jose Menjivar, who also goes by Jose Guadalupe Menjivar-Alas, had also been deported from the U.S. four times before the crash, an Immigration and Customs Enforcement spokesperson said.

He is charged with vehicular homicide and driving under the influence in the deaths of Riordan and Melissa Powell in a crash near Broomfield High School.

Court records show Menjivar had four previous alcohol-related driving offenses stemming from incidents going back to 2007 in Boulder County and had been sentenced in the most recent case just four days before the Broomfield crash.

He pleaded guilty to two charges of driving ability impaired and one charge of driving under the influence, as well as a harassment charge, District Attorney spokesperson Shannon Carbone said in an email.

Prosecutors argued Menjivar should be sentenced to a year in jail in that case, Carbone said, but the judge, Zak Malkinson according to court records, sentenced him to work release and probation and allowed Menjivar to wait for a bed out of custody.

“The prosecutor correctly believed this defendant was a danger to the community,” Carbone said. “Instead, the Judge ordered 365 days of work release. The sentence, in addition to work release, included two years of probation and other requirements. The Court allowed the defendant to wait out-of-custody for a bed in the work release program — over our office’s objection.”

In work release programs, inmates stay in jails except when authorized to leave for work.

The judge at Menjivar’s sentencing noted he had served 100 days in jail leading up to the sentencing and tested sober “for a significant period of time,” Carbone said. “Those are significant factors, but our office still fought for straight jail time to be imposed immediately.”

Online court records show Menjivar previously failed to appear in court multiple times, leading to the case being drawn out over seven years before he pled guilty to a lesser charge of driving while ability impaired in June 2023.

The sentence was 365 days work release on each case to run concurrent to each other, “over our office’s objection,” Carbone said.

Four days after the sentencing, while waiting for the work release bed, Broomfield police say Menjivar got drunk and drove twice the speed limit near a high school and crashed into Riordan and Melissa Powell’s vehicle, killing them.

Steve Kotecki, a public affairs officer with ICE’s Denver field office, said Menjivar had also been removed from the U.S. four times since 2009.

“ICE records show that (Menjivar) has been previously removed and has no regard for immigration law,” Kotecki said. “As part of its routine operations, ICE targets and arrests noncitizens who commit crimes and other individuals who have violated our nation’s immigration laws. All noncitizens in violation of U.S. immigration law may be subject to arrest, detention and, if found removable by final order, removed from the United States, regardless of nationality.”

An immigration judge issued a final order of removal for Menjivar on April 14, 2009, Kotecki said.

His removals from the U.S. were in June 2009, June 2012, November 2014 and January 2015.

In connection to the Broomfield crash, ICE Denver lodged an immigration detainer with Broomfield County on Dec. 18, 2023, Kotecki said.

The Two Generals Problem

After last week's barnstorming series opener (specially selected from the list of potential episodes for maximum barnstoming-ness), Aberdeen and Birmingham had a lot to live up to.

Anyway, Aberdeen were making their first appearance on the show in ten years, despite the fact I could have sworn I'd reviewed multiple episodes with them in over the past five series. RGU were on last year, and they're from Aberdeen too, but that's not (as alumni of both would be wont to say) the same. They've not made it past the second round since Paxman's first series in 1995 - perhaps they'll use Rajan's debut as a similar springboard.

Remarkably, Birmingham vs Aberdeen was the first match of that series, twenty-eight years ago. The Scots won 205-170 on their way to the semis, while Birmingham would make it through to the quarters, as high-scoring losers. They lost on a tiebreak to New College, Oxford, while Aberdeen were beaten by Trinity, Cam, also on a tiebreak. Is that interesting? I feel like it is, in the way that looking at statistics sometimes can be. Just me?

But that's enough horsing around.

I was also going to say that Rogers, the Birmingham skipper, had got away with one here because he's studying History of Warfare (so should surely have been the first to buzz). But it turns out that it doesn't really have anything to do with armies at all, so I'm glad I didn't go down that route. It also turns out that it's an unsolvable problem, which is pretty fun.

The first picture round, on the Brothers Grimm, goes to Aberdeen, who take the lead despite mixing up Sleeping Beauty and Rapunzel. A mistake from Eisler allows Bennett to steal the advantage back for the Midlanders, but he makes up for it with the Mitford sisters next time out. This match has been a real tug-of-war so far, with neither side able to get a foothold.

Another pair from the Brummies edge them clear, but this is the final time that they will lead, as Aberdeen put the hammer down for the last five minutes, crushing their opponents 80-0 to close out the game. Osbourne defers to her teammates a bit too much in this period, nominating them on a lot of the bonuses, but they got the job done so it doesn't matter that much in the end.Aberdeen 190 - 125 Birmingham

Not quite as barnstorming as last week, but a good ep nonetheless. With Rajan's increased pace of delivery there's no chance that Birmingham will be back with that score, but they can leave with their heads held high. The husband suspected of killing his wife and then himself outside a Jehovah’s Witnesses worship hall on Christmas Day previously pledged to kill his wife and shoot a union representative after he was fired from his job as an electrician in 2021, his former employer alleged in court filings.

Thornton police say either Enoch Apodaca, 46, or his wife, Melissa Martinez, 44, threw three pipe bomb-style devices through a window of the Thornton worship building Sunday before Apodaca fatally shot his wife and then himself.

The Adams County Sheriff’s Office bomb squad also responded that day to the IBEW Local Union 68 building in North Washington as well as to an address that matched Apodaca’s home in the High View Mobile Home Community mobile home park in Westminster to check for explosive devices, an agency spokesperson, Sgt. Adam Sherman, said.

It was not immediately clear what was found. A Local 68 union representative declined comment when contacted Tuesday, and Thornton police did not return requests for more information.

In 2021, Apodaca told a union representative at the “Local 68” that he would shoot the representative, Apodaca’s wife, and then “will come after the people responsible” for firing him, according to an application for a civil protection order filed in December 2021 by a representative of Apodaca’s former employer, Sturgeon Electric Company Inc.

A company representative at the time wrote that Apodaca had been fired in June 2021. The temporary protection order application does not say why Apodaca was fired.

It was not clear from court records whether the request for a protection order was granted, but the incident raises questions about Apodaca’s behavior before Christmas Day, when authorities believe he and Martinez went to Kingdom Hall at 951 Milky Way and one of them threw the pipe bomb-style devices into the building, which was empty but for one person. The devices did not explode, police said.

The married couple were former members of the Jehovah Witnesses’ congregation, Thornton police have said.

Sturgeon representatives could not immediately be reached. Family members of Apodaca and Martinez either could not be reached or declined to comment. The dead couple were identified Wednesday by the Office of the Coroner of Adams and Broomfield Counties.

Colorado Bureau of Investigation records show Apodaca was arrested in 2003 on a felony theft charge. The case was ultimately dismissed by the district attorney’s office. Court records detailing the case were not immediately available.
