OVERVIEW OF THE ADVERTISING STANDARDS COUNCIL OF INDIA

INTRODUCTION:

In this century, India is expanding and one of the largest growing markets out there in the world. To suffice the consumer needs, there is an increase an immense competition amongst the sellers. Besides, the population growth is increasing each passing year; so are their purchasing capabilities. Thus, giving rise to a ruthless competition among the sellers as all of them want to gain profit. Hence, the seller’s often rely on advertisements to reach out to the customers. In addition, to make their product stand out and unique among the others they often make false and misleading claims about their products. 

FORMATION OF ADVERTISING STANDARDS COUNCIL OF INDIA: 

Ever since India gained independence in 1947 there has been an upsurge in the market whilst India developed economically and made global progression. The rivalry among the sellers increased this, the prominent members felt the need to ensure fair play among the sellers and manufacturers. in 1985 , the eminent personalities of a nation connected renowned men from the four sectors :

● Advertisers;

● Advertising agencies;

● Media broadcasting and the press; and 

● PR Agency and Market Research Agencies .

They came together to accept global best practices in the field of “Self Regulation in Advertising” . USA , UK, Germany has similar organisations known as “Self Regulatory Organisations” (SROs). Recently, there are more than 70 SROs working effaciously including India.  

ADVERTISING STANDARD COUNCIL OF INDIA (ASCI)

The ASCI  registered itself as self regulatory and non-profit company under section 25 of the Indian Companies Act of 1956. It is a voluntary self regulation council promoting self regulation in advertising. The consists of a board of Governor including 16 members representing the advertisers agencies media and other individual firms. It also has 21 members from the Consumer Complaints Council (CCC) , out of which 12 of them and notable personalities from fields such as medical, legal, engineering, human resources etc. The rest are from the advertisement agency. Presently there are 313 members. 

Funds are collected by the businesses undertaken by the ASCI through yearly membership subscription. The turnover of the subscriptions vary within the range of 2000 to 75000 per annum. 

OBJECTIVE OF ASCI:

The ASCI envision to do the following :

To monitor , manage and promote standards of advertising practices in India with a view to:

1. Ensure that there is truthfulness and honesty in the presentations and the claims made through the advertisement agencies against any misleading claims. 

2. Ensure that there is nothing offensive to the general mass of the nation and the standards of public agency in advertisements is followed. 

3. Ensure against any in discrimination use of advertisement for the purpose of products or services which are considered as hazardous to the general public or individuals which are unacceptable to the society as a whole.

4. Ensure that there is a fair play amongst the advertisement agencies and generally accepted competitive behaviour.

5. To codify, adopt and modify the code of advertisement from time to time and manage and control and publicize such code. 

6. To provide facilities and machinery in the form of one or more Consumer Complaint Council having such composition against advertisement in the code of advertisement practices and report thereon. 

MISSION OF ASCI:

The ASCI has a comprehensive goal to achieve and amplify the common mass’s confidence in advertising. ASCI seeks to safeguard the advertisements and uphold its code of self regulation which requires advertisements to be :

1. Truthful and honest to its customers and competitors.

2. To stay within the periphery of societal standards and public decency.

3. To not used in discrimination to promote hazardous products.

MAIN ACTIVITIES OF THE ASCI:

The ASCI  codify, adopt and modify the advertisement practices in India from time to time and implement, administer and promote, promulgate and publicize such code. Provides facilities and machinery in the form of Consumer Complaints Council having such composition and power prescribed from time to time to examine complaints against ads in terms of the code and report there on.

Give wide publicity to the code and seek adherence to it of as many as possible of those engaged in advertising. To print and publish templates, leaflets and circulars or other literature or material that may be considered desirable for the promotion or carrying out of the objectives of the company and disseminate it through any medium of communication. 

THE ASCI CODE:

The ASCI  has adopted to code for Self Regulation and Advertising. The code is framed by eminent personalities belonging to various professions and industries connected with advertising and media. The purpose of the code is to control the ingredients of advertisement not to impede the sell of offensive products for reasons what so ever the cause maybe, provided that the advertisements are themselves not offensive in nature therefore causing no objectification by this code.

The ASCI Code is now a part of cable television network rules. The rule 7(9) states that no at which violates the code of self-regulation in AD as adopted by ASCI Mumbai for public exhibition from time to time shall be carried in cable service. This recent amendment has now the immense power to the ASCI. 

When the court will start gaining popularity among the general public, there will be :

● Lesser false misleading claims;

● Fewer unfair advertisements; and

● Increasing responsibility. 

CODE FOR SELF REGULATION:

The code for self regulation in advertising adopted by the members of the advertising standards Council of India is as follows :

“The purpose of the food is to control the content of advertisements not to have for the sale of products which may be found defensive for whatever reason why some people provided the advertisements for such products are not themselves offensive that will be normally no ground for objection to them in terms of the code. “

RESPONSIBILITY FOR OBSERVATION OF CODE:

The responsibility for the observation of code for self regulation it advertisement lies with the persons who are engaged in commission, creation or publication of advertisements, or assist in the creation or publication of any advertisement. None of these advertisement agencies are expected to create content of advertisements which contravene this code. This is a self imposed discipline which the code requires for self regulation in advertisement from all those who are involved in the commissioning or creation and placement or publishing of advertisements. 

Besides this code is applicable for advertisements read ,heard or viewed in India even though if they are originated in any foreign country as long as the consumers of India at exposed to those advertisements. 

THE CODE AND THE LAW:

The code rule along with various provisions of common law and statutes affecting form and content of advertisements. The rules of the court are not to upsurp the legal machinery but designated to complement legal control . 

CONSUMER COMPLAINTS COUNCIL:

The Consumer Complaints Council (CCC)  is appointed by the board of governors. There shall be no more than 21 members out of which 12 shall belong to the civil society and nine from the advertisement agency. The CCC decide upon complaints within a period of 4 to 6 weeks. the CCC examine and investigate the Complaints received from customers and the public regarding any breach of the code of conduct and or any action to be taken in this regard. 

POWERS OF CONSUMER COMPLAINTS COUNCIL:

The following are the powers of the CCC: 

1. Each Council is entitled to receive complaints from the board of Governor, the consumer and the public and members of company. 

2. Each Council must enquire, investigate and decide upon the Complaints they have received within a framework provided by the code of conduct adopted by the company. 

3. All the decision by the Council shall by simple majority in writing and specify the actions to be taken in respect of offensive advertisement.  

The ASCI encourages a common mass to file complaint against advertisements which they find to be expensive and each of these complaints received unparalleled and impartial and unbiased consideration by the CCC which considers and takes into account the viewpoint of the advertisers and consumers and check if it’s communicated well and/ or it contravenes the code of conduct. 

The role of CCC, deals with complaints relating to consumer and industry, advertisements which are false, indecent, offensive or illegal or promote unfair competition and which contravene the code of ASCI.

JURISDICTION:

The ASCI deals with cases related to infringement of intellectual property rights. In the case  of Procter and Gamble Home Products Vs Hindustan Unilever limited , the Delhi High Court had discussed at length about the jurisdiction of the Advertising Standard Council of India. It was held that the ASCI is a self regulatory body in the advertising field but not for dispute resolution or awarding damages to plaintiff. However, there is a complaint committee, but it is only to self regulate. If the ASCI find any complaint of merit, they can only recommend the advertiser but there is no mechanism to grant any relief to the plaintiff. 

Although the Delhi High Court was of a different view in the case of, Metro Tyres limited Vs ASCI , that the role of ASCI is self regulatory and in curtailing the litigation thereby providing a mechanism for amicable settlement of disputes and also function as an alternative dispute mechanism.

CONCLUSION:

The ASCI, is the non profitable self regulatory and non governmental body. The role of ASCI is now being recognised by the Supreme Court as well as a self regulatory mechanism for advertisements in India. Although till now it has only mainly made recommendations to the advertisers and they cannot grant relief at compel them to follow any orders. But as a self regulatory body through an attempt to curb the unfairness and exaggerated claims by the advertisement agencies, the ASCI has had come a long way and has a long journey ahead of it. This organisation has changed the outlook of advertising in India. And the Consumer Complaints Council has provided the common people to file complaint against offensive ads as the right guaranteed to the customer.

Bayer paying up to $10.9B to settle Monsanto weedkiller case (AP) Bayer said Wednesday that it will pay up to $10.9 billion to settle litigation over the weedkiller Roundup, which has faced thousands of lawsuits over claims it causes cancer. Bayer said it was also paying up $1.22 billion to settle two additional areas of intense litigation, one involving toxic chemical PCB in water, and one involving dicamba, another weedkiller. The company said the settlement over Roundup, which is made by its Monsanto subsidiary, involves about 125,000 filed and unfiled claims. Under the agreement, Bayer will make a payment of $8.8 billion to $9.6 billion to resolve current litigation, and $1.25 billion to address potential future litigation, even as the company continues to maintain that Roundup is safe.

2 Koreas mark war anniversary after pause in rising tensions (AP) North and South Korea on Thursday marked the 70th anniversary of the start of the Korean War with largely subdued commemorations amid the coronavirus pandemic, a day after the North abruptly halted a pressure campaign against the South. South Korea issued a joint statement with the United States, which fought alongside it during the 1950-53 war triggered by a surprise North Korean invasion. The U.S. still stations about 28,500 soldiers in South Korea in what North Korea views as a military threat. Lebanon’s Aoun sees ‘civil war’ climate as critics boycott meeting (Reuters) President Michel Aoun warned on Thursday of an “atmosphere of civil war” during recent unrest in Lebanon and what he described as attempts to stir up sectarian tensions as a financial crisis sweeps the country. Aoun, a Maronite Christian, was speaking at a meeting that he said was called to protect civil peace but which was boycotted by opponents including Sunni Muslim leader Saad al-Hariri and other ex-prime ministers who said it a waste of time. The crisis is seen as the biggest threat to Lebanon’s stability since the 1975-90 civil war. 1.Hello, Sir! It is indeed an honour and pleasure to have you with us. To begin with, please tell us about yourself, how did you start your journey in the area of law or rather what made you interested in this field?

First, I’d like to sincerely thank you for giving me this coveted chance of sharing my experiences and insights about my, never-ending, journey in this legal profession with your dear readers.

When legal profession was not the choice at all, the last resort for people who didn’t do or opt for anything fruitful lucrative career in life, I decided to pursue it with a firm belief that I’d break the said notion which have stigmatised such a quality profession.

Hailing from a middle-class family, I started my career in the year 1983 after passing out from Meerut University, Uttar Pradesh where the way forward was uncertain and undefined but I steered my journey with the sheer belief that “I’d be the change” instead of being “Subject to a change orchestrated by someone”. I always believe that lawyers have a substantial impact in the betterment of the society in many ways. Two things which I strongly believe have formed my present are my commitment towards my work and believing in myself, which changed the modest beginnings till date

2. You have started your career in 1983. Tell us about how the field has transformed over the years and what the future holds for new generation lawyers.

Prior to the emergence of corporate legal sectors, jobs available to lawyers like me were mostly assisting to practicing advocates and that to without any payment. So, there were only two option either be employed with private or govtsector or practice as independent lawyer. The practice had only two option i.e. civil or criminal.

But from the 1990s when liberalization came in to picture under the Indian economy, demand for lawyers who provided advisory in different practice domains have taken this field to a completely new era of modernization. Now we can see tremendous advancement in the area of law with different practice areas such as Banking & Finance, Mergers & Acquisition, Investment Arbitration, Private Equity & Venture Capital etc.

The establishment of good law schools in India has completely changed the landscape of Indian legal system, bar and bench both have modernized themselves. And I believe that future of new generations lawyers will be more technologically advanced, each lawyer will have their own specialized practice domain not like it used to be in early 90s.

3. It has been more than a decade since your commencement in this field. How do you still manage to put forth so much energy and enthusiasm in the field when lot of youngsters in this profession are struggling to cope up even for couple of years?

The key to success in this field is patience and perseverance: patience to learn the craft, patience to start from zero and go up the ladder eventually, patience to imbibe the nuances of the profession while being at the nascent steps of your career, persevering while the odds are heavily stacked against you because the tides that rise up to your height now will ebb away eventually and you’d be standing tall.

No one is born big and become a brand. Everyone has passed through the litmus of time and has to carve a niche for himself. Everyone must carry its horizon which sets the bench mark for rest.

I believe unless one dreams, he cannot achieve it. So, my job is to have a dream and make it possible. Youngster are my source of energy, they challenge me in every spear of life, professional, social &emotional.Their rough quest to achieve, survive and quick strides to make big irrespective of all odds is what challenges me more and more. Though I may have suggestion for them to have baby steps today which would eventually make them stand as an adult tomorrow.

I have left nothing unattended in my life. Though I’m not very organized, but my zeal to leave nothing unattended, makes everything possibly correct and organized.

4. From Atul sharma to Atul Sharma & Associates and presently, ASA Legal, do tell us how it all came about. Noteworthy, it was 23 years in Atul Sharma & Atul Sharma & Associates and 12 years already in ASA Legal. Do tell us about the firm and its practice areas.

I started my carrier in 1983 from Patiala House District Court, as a criminal lawyer. I was assisting to few senior lawyers in trials and bail matters. With a short span of one year I was able to establish my small practice in criminal field. However, very soon realised that my interest lies somewhere else, so stared trying on the civil side, MACT, Matrimonial, Banking and so forth other commercial practice areas. Especially, practice in banking lawsgave lot of knowledge of litigation and corporate work. With the increase in the work as well as number of lawyers associated, Atul Sharma & Associates become ASA Legal, a full service law firm having its operations in India with offices located at New Delhi, Mumbai, Bengaluru and Ahmedabad having two senior partners, eight partners and additional lawyer’s at different levels who look after the clients and their requirement, most of the lawyers at ASA Legal are home grown talents. But I would specially mention Mr. Anil Kumar Sharma and Mr. M.L. Rajora, two senior partners in ASA Legal who have supported and helped me in building this organization from the grass root level.

The Firm represents clients across a spectrum of sectors comprising of government and non-governmental organizations, international entities, multinationals, Indian and foreign corporate bodies, banks, financial institutions and individuals in an array of matters. Our main areas of focus are litigation, dispute resolution, arbitration, insolvency and bankruptcy, corporate law, banking and finance, employment, labour and industrial law, real estate, corporate restructuring and due diligences.

5. Bankruptcy and Insolvency, recovery related matters is one of the core areas you and the firm specializes at. What are your viewsabout the Insolvency and Bankruptcy Code, 2016 (“I&B Code”)keeping in view the present market scenario?

Around a year back I was going through the World Bank’s report on how other countries are handling their insolvencies, while reading the report I found that global ranking of India under the insolvency regime is above 100.

Before the I&B Code came into application the whole procedure of insolvency and liquidation has dependably been in the hands of the shareholders and debt holders. By and large, when the whole procedure was finished, the benefits were dissolved with very small portion left for the creditors. Or on the other hand the promoters took an interest in the offering procedure and reacquired similar resources however with a very steep haircut, leaving the lenders vulnerable.

The I&BCode has been made for a noteworthy power move from the hands of the shareholders, management and the promoters to the lenders. Presently a

creditor with a default of Rs 1 lakh, can take the organization into liquidation. But still the Code has many grey areas which from time to time will be refined by absorbing the nature of Indian economy sector wise.

There is no doubt about the phenomena I&B Code is doing. But at the same time, I must say, that the I&B Code as on date is a double-edged sword. With the ever-dynamic approaches, every day, there is a new interpretation a new approach. For certain businesses it’s a boon, whereas for others it appears to be a cause for failing business models. We are still experimenting; indeed, we have grown and have grown for good, but the experiment is on. One must understand, that insolvency is an underlying state and merely with none payment of pending amounts that state cannot be reached, the underlying condition of reaching insolvency is no-capacity to pay and not the no-desire to pay. For the no-desire situation I believe, the right forums are the civil ones, whereas for no-capacity it is the NCLT as Adjudicating Authority.

One must understand the difference, if that is achieved, I believe the object of the code will be achieved. We cannot equate horses and mules, similarly we cannot equate a Solvent Financial Figures with the none-solvent ones only on the basis, that there is a delay in the payment or there is no desire to pay, a very thin line difference indeed.

I would again say as of now I&B Code is in its initial phase, we are still experimenting, the results will become better in the coming time, especially, when the application would be made in right direction.

6. What were the challenges faced while building up your own law firm as it stands today?

Nothing delivers without pain. The journey with new challenges, failures and pain has been wonderful. If I see back in time, I feel happy for all my failures, unsuccessful attempts because they lay the foundation stone of success.

 Building up your own law firm requires lots of perseverance, handling the client, convincing the clients, turnaround time of ongoing assignment, infrastructure and most important thing flexibility of your family and employee towards you.

The biggest challenge is to give commercially viable solution to your client and to implement it to the satisfaction of the client.

7. Any advice for our readers?

Simple advice for the readers would be to stick to this one liner which I, personally, have always found very valuable in this profession, i.e. Rome wasn’t built in a day. The simple mantra of being willing to start from zero is nothing but learning the tricks of this trade now because all the knowledge that you imbibe today will help you rake up the sums later. Your tangible dreams can only be fulfilled if your intangible knowledge is strengthened, polished and founded corrected.
