Our client had been going through an extremely tough period in the lead up to the offence experience severe bouts of depression, anxiety & suicidal thoughts 〰〰〰〰〰〰〰〰〰〰〰〰〰 Our client recorded a very high Blood Alcohol Reading of (0.196) and to further aggravate the incident he crashed into a parked car causing significant damage to both vehicles. #BoormanLawyers appeared today (24.01.19) at #Penrith Local Court on a High Range #DUI. Our client attended the 1st Court appearance where the Magistrate ordered a sentencing assessment report with a view of ordering a Community Service Order. We were recently instructed to appear at the Sentence hearing. We were able to persuade the sitting Magistrate to not order any Community Service Order but instead reduce the licence Disqualification to the minimum period with a significantly reduced Fine. Too much? 🤔🥴 #BoormanLawyers at #SouthportCourt this week on a serious High Range #DUI which carried over from January following the #Covid delays. FACTS: ⚡️High Range DUI (0.234) ⚡️Involved minor crash ⚡️3 #DrinkDriving offence in 3yrs ⚡️Also charged with failing to have an interlock device fitted RESULT: 💥Lucky to avoid a term of imprisonment 💥12 months Probation Order 💥12 months licence disqualification for DUI 💥3 months licence DQN for failing to have interlock (to be run concurrently) 💥No Fine 💥Further interlock restrictions will apply. Our client had significant mental health issues which saw him use alcohol to cope. We got him in to see a very good psychologist & for the very first time ever he began receiving treatment for previously undiagnosed mental health problems. #BoormanLawyers recently appeared at Southport Magistrates Court where our client was “remarkably” charged with going in public whilst attempting to commit suicide at a well known #CatholicChurch on the Gold Coast on Christmas Eve late last year. There is a long & disturbing history between our client & the Church which is ongoing & has sadly left our client mentally unwell. Whilst the #QldPolice were just doing their job & technically our client was #Guilty of the offence, saner & more reasonable minds prevailed when the matter was before the Court & Her Honour decided to accept the early plea of Guilty however Absolute Discharge our client & dismiss the charges absolutely. It was the beat possible out come our client could have received by the court for the early plea of Guilty. RESULT: 👉 Absolute Discharge 👉 No Fine 👉 No Conviction 👉 No other penalties The Presiding Magistrate uses discretion of the bench to show a high level of understanding, sympathy & #compassion for this very unusual & extenuating set of circumstances which led to the charge. ➖➖➖➖➖➖➖➖➖➖➖➖➖➖➖ In more positive news I can report that our client is now doing much better from a mental health point of view. #BoormanLawyers along with Mr Buckland of #Counsel achieved what was initially thought of as the unachievable today in #BrisbaneMagistratesCourt 〰〰〰〰〰〰〰〰〰〰〰〰〰 FACTS: ▪️Assault Occasioning Actual Bodily Harm (OHB) ▪️This matter has been on foot for 9 months now due to a variety of reason including negotiating with Police to an agreed & watered down set of facts ▪️Time was also granted by the Courts to allow our client to obtain professional #psychological intervention & Anger management treatment ▪️Client had an atrocious criminal history ▪️Clients Parole from prior similar offence finished 2 hours prior to the current offence occurring which meant full time #imprisonment was almost inevitable ▪️Due to a lot of hard work by @BoormanLawyers & Counsel our client was just able to avoid full time #incarceration 〰〰〰〰〰〰〰〰〰〰〰〰〰〰 RESULT: ▪️12 months imprisonment ▪️Immediate Parole granted ▪️$4000 in restitution & compensation 〰〰〰〰〰〰〰〰〰〰〰〰〰 Our client was prepared to enter into the jail system for the first time prior to attending Court today.
