Eagle Produce LLC Scottsdale, AZ is initiating a voluntary recall of 6,456 cases of whole cantaloupe with the potential to be contaminated with Salmonella following a test conducted on cantaloupe in a distribution center by the FDA. Salmonella is an organism which can cause serious and sometimes fatal infections in young children, frail or elderly people, and others with weakened immune systems.

Healthy people may experience fever, nausea, vomiting, diarrhea (which may be bloody), and abdominal pain. In rare cases the organism can get into the bloodstream and producing more severe illness such as arterial infections (i.e. infected aneurysms), endocarditis and arthritis.

The cantaloupe subject to the recall include:

No other products or lot code dates are affected by this recall. The company is cooperating with the FDA regarding this recall.

There have been no reported illnesses attributed to the recalled items as of September 27th, 2023

FAQ: What You Should Know About Legal Guardianship

Legal guardianship refers to a court appointed or approved guardian who takes care of those who are unable to tend to themselves. The person that a guardian is assigned to protect is called the guardian’s ward. Wards can be children of minor age, or incapacitated adults. There are responsibility guidelines and compensation rules to consider when wondering if being a legal guardian is the right role for you.

Common Guardian Responsibilities

Guardians must act in accordance with their ward’s best interests in mind. However, there is no necessity for the guardian to respect the ward’s wishes. A guardian takes on the responsibility of managing finances, medical care and property of the ward. For example, a guardian is responsible for paying bills, choosing living arrangements, overlooking any medical treatments and providing the ward with a solid education opportunity (for wards of minor age).

Guardian Compensation

Guardians are in fact entitled to receive compensation for their duties, in addition to reimbursement for any expenses that are made on the behalf of the ward. When applicable, guardians can cover expenses by utilizing money from the ward’s income. They can liquidate a portion, or all of the ward’s assets, but in order to do must obtain permission from the court.

When it comes to legal proceedings, the guardian needs to represent their ward, unless interests of the ward conflict with a guardian.

Appointing of an Appropriate Guardian

In all cases, the courts must decide on the right guardian based on the best interest of the ward. They can take into consideration any personality or characteristic traits of a potential guardian and decide if it can negatively affect the ward. Some common attributes the courts look for is financial stability, education, health, relation to ward and level of trustworthiness. The court may or may not take into consideration the preference of the minor child prior to appointing a guardian.

Who Can Become a Guardian?

The court may decide to not appoint a guardian whose interests are conflicting with the ward. Many jurisdictions permit any competent party to submit a request to be a guardian, regardless of their relationship with the ward. Guardians can be categorized usually into three different types.

Public Guardian

Professional Guardian

An adult child can become a guardian to person who is an ill or elderly parent. Another option is a government protective agency worker can fulfill the duties associated with being a guardian, but is not officially chosen as one. Attorneys or other types of professionals can serve as guardians when other candidates are not able to, or are unwilling to provide care to the ward.
