ART 155 of the Family Code of the Philippines:
The family home shall be exempt from execution, forced sale or attachment except:
(1) For nonpayment of taxes;
(2) For debts incurred prior to the constitution of the family home;
(3) For debts secured by mortgages on the premises before or after such constitution; and
(4) For debts due to laborers, mechanics, architects, builders, materialmen and others who have rendered service or furnished material for the construction of the building.
—"The great controlling purpose and policy of the Constitution, is the protection, the preservation of the homestead, — the dwelling place. A houseless, homeless population, is a burden upon the energy and industry, and corrupting to the morals of the community, of which they may be members. No greater calamity, not tainted with crime, can befall a family, than to be expelled from the roof under which it has been gathered and sheltered. Protection of an estate or interest in lands, whatever may be its dignity or inferiority, merely because it is an estate or interest in lands, is not the purpose of the Constitution, or of the statutes. It is the house, the dwelling place, — not of necessity, an estate or interest in lands, — which must be protected and preserved.”

FACTS:
Plaintiffs-appellees filed a complaint to recover from defendants-appellants a parcel of land. The trial court rendered a decision in favor of plaintiffs-appellees which became final and executory. In lieu of a writ of execution, the Deputy Provincial Sheriff of Sorsogon delivered the land in dispute to plaintiffs-appellees. Defendants-appellants, however, failed to pay the P2,800.00 actual damages and their shares in the costs of the suit. For its satisfaction, the Provincial Sheriff levied the following properties: (1) an agricultural land, Lot No. 8275 assessed at P1,220.00; and (2) a residential land, Lot No. 360, with an area of 458 square meters, including the residential house thereon assessed at P1,830. The Provincial Sheriff issued a Sheriff's Notice of Public Auction Sale of the foregoing properties. Plaintiffs-appellees bid was P3,522.50, were the highest bidders for the properties. A Sheriff's Certificate of Sale to the above highest bidders, incorporating the statement that the sale is subject to the right of legal redemption within one year from the date of sale. After the lapse of the one-year redemption period, the Provincial Sheriff issued a Final Bill of Sale in favor of the highest bidders. Plaintiffs-appellees filed a Motion for Issuance of Writ of Possession. Defendants-appellants filed with the trial court an "Appearance and Manifestations'' taking exceptions "on the proceedings in this case from the levy on execution of the real properties owned by the defendants arguing that (1) the real properties levied on execution and later sold in the auction sale have prior and registered liens in favor of third persons, and (2) the residential house and the land (on)which the building was constructed is a family home or homestead exempt from execution. Consequently, defendants-appellants filed a Motion to Set Aside Execution Sale assailing that the property is exempt from execution. Plaintiffs-appellees filed their opposition to the above motion alleging therein that the failure to assert or claim the right to the exemption granted under Section 12 (a) of Rule 39 of the Revised Rules of Court within a reasonable time constituted an abandonment or waiver thereof, and that there is no merit to the other contentions of defendants.
ISSUE:
Whether or not claims for exemption from execution of properties under Section 12 of Rule 39 of the Rules of Court must be presented before its sale on execution by the sheriff?
RULING:
Yes. Right to claim exemption must be exercised within a reasonable period of time. Although the Rules of Court does not prescribe the period within which to claim the exemption, the rule is, nevertheless, well-settled that the right of exemption is a personal privilege granted to the judgment debtor and as such, it must be claimed not by the sheriff, but by the debtor himself at the time of the levy or within a reasonable period thereafter: "In the absence of express provision it has variously held that claim [for exemption] must be made at the time of the levy if the debtor is present, that it must be made within a reasonable time, or promptly, or before the creditor has taken any step involving further costs, or before advertisement of sale, or at any time before sale, or within a reasonable time before the sale, or before the sale has commenced, but as to the last there is contrary authority."
Reasonable time, for purposes of the law on exemption, does not mean a time after the expiration of the one-year period provided for in Section 30 of Rule 39 of the Rules of Court for judgment debtors to redeem the property sold on execution, otherwise it would render nugatory final bills of sale on execution and defeat the very purpose of execution - to put an end to litigation. Litigation must end and terminate sometime and somewhere, and it is essential to an effective administration of justice that, once a judgment has become final, the winning party be not, through a mere subterfuge, deprived of the fruits of the verdict. We now rule that claims for exemption from execution of properties under Section 12 of Rule 39 of the Rules of Court must be presented before its sale on execution by the sheriff.

CEBU CITY, Philippines — Cebu City Councilor Rey Gealon is seeking police assistance in getting justice for “Bonbon,” a stray dog that survived animal cruelty.
Gealon, on Thursday, Nov. 10, 2022, wrote a letter to Police Col. Ireneo Dalogdog, Cebu City Police Office (CCPO) director, urging the CCPO personnel to track down and build up a case against the culprits behind the stabbing of “Bonbon.”
A photo of the signed letter was sent to CDN Digital on Thursday by Councilor Gealon.

“While the dog is now safe, the culprit of such animal cruelty is still at large,” read a portion of Cebu City councilor’s letter.
“I humbly and sincerely urge your personnel to track down the culprit and build up a case for animal cruelty as defined in RA 8485, otherwise known as the Animal Welfare Act,” it added.
Bonbon, who apparently went missing last week, was spotted wandering roaming the streets of Brgy. Bonbon in Cebu City, with a knife stuck in his head.
Veterinarians successfully removed the object from the dog on Monday.
According to a post by netizen Theresa Marie Vidal, Bonbon will stay in the veterinary clinic for a few more days to aid in his recovery.

CEBU CITY – A hotel operator offered two of its inns in this city as temporary facilities for mild symptomatic patients following a spike in coronavirus disease 2019 (Covid-19) cases which resulted in a lockdown of Barangay Guadalupe.
The city's Emergency Operations Center (EOC), in a statement on Tuesday, said Travelbee offers two of its hotels to accommodate mild symptomatic residents from Cebu City as a “temporary treatment and monitoring facilities to help relieve and expand critical care capacity”.
“The Travelbee Management Corporation offers their inns at Don Gil Garcia Street, Capitol and J. Llorente Streets, Fuente Circle, across the HP Diagnostics Center, both with a capacity of 54 beds,” it said.
Travelbee inns are located less than a kilometer from Barangay Guadalupe which was locked down by village officials last Sunday because of an increasing number of Covid-19 cases.
The village’s own Covid-19 tracker said 48 of their residents from 25 sub-villages are now treated in a patient care facility.
Lawyer Rey Gealon, head of the City Legal Office and Mayor Edgardo Labella’s spokesperson, in a video message posted on social media urged city residents to respect the health safety protocols in place to address the Covid-19.
“We have recorded more than 2,000 quarantine violators,” he said in Cebuano.
Gealon reminded city residents that Covid-19 “is still very much around,” urging them to avoid crowding in events and other activities that may cause transmission.
As of Monday night, this city has 955 active coronavirus cases after it reported 70 new cases and 19 recoveries.
At least 86 percent or 10,275 out of a total of 11,931 Covid-19 cases here have already recovered from the coronavirus disease.
The 955 cases in Cebu City represents 37 percent of the 2,594 active cases recorded in the entire Central Visayas region.
The cities of Mandaue and Lapu-Lapu have 235 and 119 active cases, respectively.
Negros Oriental leads other provinces in Central Visayas in terms of the number of active Covid-19 cases as it logged 723 on Monday because of four new infections, followed by Cebu province with 537 due to 11 new cases. Bohol has 22 and Siquijor has three, without new cases reported.
There were nine new recoveries on Monday in Cebu province while two were recorded in Negros Oriental. Bohol and Siquijor have no new recoveries. (PNA)
