Journalists face sedition charges under cybercrime law in Pakistan
New Post has been published on http://khalilhumam.com/journalists-face-sedition-charges-under-cybercrime-law-in-pakistan/
Journalists face sedition charges under cybercrime law in Pakistan
‘The alarming increase in such actions against journalists confirms that the government is bent on muzzling freedom of expression’
Prevention of Electronic Crimes Act (PECA) was passed by the National Assembly of Pakistan in 2016. Screenshot from the Act.
Three Pakistani journalists were charged with sedition between September 11 and 16 under Pakistan's 2016 Prevention of Electronic Crimes Act (PECA), a law that has drawn widespread criticism for impacting citizens’ rights to expression and privacy. The journalists are Asad Toor, a producer of a prime time TV show called “Sawal with Amber,” which is often critical of the government and the military; Bilal Farooqi, news editor of the Pakistani daily The Express Tribune; and Absar Alam, a former chairman at the Pakistan Electronic Media Regulatory Authority (PEMRA) and a former anchor at AAJ news channel. Toor was booked following a complaint filed by someone called Hafiz Ehtesham Ahmed, a resident of the city of Rawalpindi, who claimed that the journalist “used derogatory language to refer high-level government institutions, including the Pakistan Army.” Toor posted a copy of the complaint on social media:
Ok #Rawalpindi police charge me under PECA and registered this FIR on 12 September 2020 on the complaint of proxy Hafiz Ehtisham. Here is the copy of the FIR. This is a sad development for me being a journalist because I never wish to be a news myself.#Pakistan @ICJ_Asia @rcfp pic.twitter.com/fBVVwmTmNZ — Asad Ali Toor (@AsadAToor) September 14, 2020
Toor told Global Voices via WhatsApp that the First Information Report (FIR) was registered under sections 499 (defamation), 500 (punishment for defamation) and 505 (statements conducing to public mischief) of the Pakistan Penal Code, and sections 11 (hate speech), 20 (offences against the dignity of a person), and 37 (unlawful online content) of the 2016 Pakistan Electronic Crimes Act (PECA). On Wednesday, September 16, 2020, the Islamabad High Court (IHC) granted one-week protective bail to Toor. Farooqi was detained outside his home on the night of September 11 after a complaint was lodged by a resident of Landhi, Karachi, alleging that Farooqi shared “highly objectionable material” and “defamed” the Pakistan Army on his Twitter and Facebook accounts. Journalist Mubashir Zaidi tweeted:
FIR registered against @bilalfqi for posting anti-military and alleged sectarian social media posts pic.twitter.com/R3rob77uzc — Mubashir Zaidi (@Xadeejournalist) September 11, 2020
Farooqi was released in the early morning of September 12 on a “personal guarantee” of his lawyer Jibran Nasir. A similar FIR was filed against Alam in the city of Jhelum by Khursheed Alam, a lawyer, who claimed Alam used derogatory language against state institutions and personalities on his Twitter account and asked that he should be charged with sedition. Both Farooqi and Alam are facing charges under Section 20 (offences against the dignity of a person) of the 2016 PECA. Alam said that these charges and cases are a medal for him and he won't be pressured.
Facing a trial of treason is an honour in the struggle against a fascist regime. If Musharraf could not suppress us, my love, then what does General Bajwa think? Give Receipts #Bajwaleaks
“Show us the receipts” in this context refers to an investigation by website Fact Focus that exposed corruption in the Pakistani military. According to a report by Freedom Network, there have been more than 90 cases of attacks and violations against journalists in Pakistan between May 2019 and April 2020. Farieha Aziz, co-founder of Bolo Bhi, a local digital rights organization, tweeted:
I can't even begin to express the absurdity. Defamation sections from the PPC and Sections 11 and 20 of PECA (both non-cognisable) fit pattern in FIRs. But what's new is the addition of Section 37 which is not even an offence under PECA! What creativity.https://t.co/a3HeQd65tx — Farieha Aziz (@FariehaAziz) September 14, 2020
Similar complaints were recently registered against a Pashtoon human rights activist Ihtesham Afghan.
A day ago I saw this news item that an FIR has been registered against me for being “Anti state and for propagating against the army on social media”. Very similar to the way @bilalfqi @AbsarAlamHaider @AsadAToor have been targeted. Such tactics will not silence me. pic.twitter.com/2nbsgJZ3xl — Ihtesham Afghan (@IhteshamAfghan) September 14, 2020
The Human Rights Commission of Pakistan issued a statement in solidarity.
The alarming increase in such actions against journalists confirms that the government is bent on muzzling freedom of expression. HRCP demands that the rights of citizens be respected and that both the government and state adopt course correction.
Former Supreme Court judge Justice M B Lokur stated on September 14, 2020, that “the government is using the sedition law with an iron hand to curb free speech in an overreaction to people's opinion.”
Mocking the military now a crime
On September 17, Pakistan's National Assembly passed an amendment to the penal code that criminalises attempts at ridiculing armed forces personnel. The bill was proposed by MP Amjad Ali Khan from the ruling party PTI. The bill states that “deliberately mocking, tarnishing or defaming the armed forces or its members would be considered a crime. Those who do so could face up to two years in prison and a fine of Rs 500,000 or both.” Gul Bukhari, a journalist and commentator tweeted:
The new Bill criminalizing criticism of the army is a fascist attempt by the military to transform Pakistan into North Korea, where none can question its wrongdoing/ criminality; where impunity for it is written in law. I warn ALL parliamentarians against even THINKING about it. — Gul Bukhari (@GulBukhari) September 16, 2020

Faiz Ahmad Faiz could be 20th century’s most relevant poet, here are a few shayaris that will tug at your heart strings - art and culture
Tumblr media
One of the most celebrated and popular shayars of the 20th century, Faiz Ahmad Faiz was a versatile creative mind. Faiz was also the poet’s takhallus (a pen name). He is credited with countless couplets (shers), radio plays, children’s stories, letters to his wife and children from jail apart from a number of travelogues. He was best-known for his progressive writings which were as popular in pre-Partition India as he was appreciated across the world for his ghazals and shers. In 1951, Faiz was arrested with a group of army officers under the Safety Act, and charged with a failed coup attempt that became known as the Rawalpindi Conspiracy Case. He was jailed for four years and released on amnesty. The first major translation Faiz’s work was released in 1971. It won’t be incorrect to say that Faiz’s everlasting appeal, that connects with the youth today as well, was to Urdu poetry in the 20th century, what Mirza Ghalib and Mir Taqi Mir were in the 19th and 18th centuries respectively. According to Faiz, the usage of words such as zulf, paimana and mohabbat to ensure a poem got a high reach. Some renowned writers and poets from the sub-continent namely Khushwant Singh, Shiv K Kumar, Vikram Seth, Shoaib Hashmi, among others have all translated Faiz’s impactful poetry. ALSO READ: Translating Faiz over and againHum Dekhenge written by Faiz in reference to military dictator Zia-ul-Haq in 1979, became a point of contention in the recent protests against the CAA bill. IIT-Kanpur students had taken out a peaceful march on the campus on December 17, 2019 in support of the students of Jamia Millia Islamia and during the march, the students sang the Faiz poem. The Indian Institute of Technology, Kanpur has formed a panel to decide whether the poem has an ‘anti-Hindu’ context. The complaint was based on two lines of the poem, which read: “Sab takht giraye jayenge. Bas naam rahega Allah ka. Hum dekhenge. (When thrones will vanish, only Allah’s name will remain)”, which triggered the professor who filed this complaint. Speaking to ANI about Faiz and the recent controversy, the writer told ANI, “Calling Faiz Ahmed Faiz ‘anti-Hindu’ is so absurd and funny that it’s difficult to seriously talk about it.” “He lived half his life outside Pakistan, he was called anti-Pakistan there. Hum Dekhenge he wrote against Zia ul Haq’s government which was a communal regressive and fundamentalist government,” Akhtar told ANI.This poem’s verses have also been used by Coke Studio in a song that piqued many a listeners’ interest in the legendary poet’s work. For readers who are yet to be initiated into Faiz’s poetry, his work isn’t one to leave you once you’ve read it. It might even have different meanings for every reader at the point in life when they’ve read Faiz’s work. For a die-hard romantic, his lines on matters of the heart, heartbreak and longing is sure to leave you with a feeling one can hardly describe in words. From translations to various pop culture references, there’s a lot of depth one can delve into with Faiz’s beautiful poetry. Here’s a list of some of his popular shers: 1) Aur bhi dukh haiñ zamane meñ mohabbat ke siva rahateñ aur bhi haiñ vasl ki rahat ke siva
Tumblr media
2) Dil na-umid to nahiñ nakam hi to hai lambi hai gham ki shaam magar shaam hi to hai
Tumblr media
3) Aur kya dekhne ko baaqi hai aap se dil laga ke dekh liya
Tumblr media
4) Tumhari yaad ke jab zakhm bharne lagte haiñ kisi bahane tumheñ yaad karne lagte haiñ
Tumblr media
5) Vo baat saare fasane meñ jis ka zikr na tha vo baat un ko bahut na-gavar guzri hai
Tumblr media
6) Guloñ meñ rañg bhare bad-e-nau-bahar chale chale bhi aao ki gulshan ka karobar chale
Tumblr media
7) Ye aarzu bhi badi chiiz hai magar hamdam visal-e-yar faqat aarzu ki baat nahiñ
Tumblr media

Your period-tracking app could be sharing intimate details with all of Facebook
Women’s health apps are again raising concerns of privacy as a new study finds some are sharing information without consent Privacy International has released its findings that some menstruation apps have been sharing users’ information with Facebook. Photograph: Nishat Ahmed/Associated PressSurveillance is a feminist issueWhen was the last time you had sex?For most of us, that isn’t information we’d like to share with just anybody. However, if you’re using a period-tracking app, there’s a decent chance Facebook knows all about your sex life. A new study from Privacy International, a UK-based charity, has found that some menstruation apps have been sharing their users’ intimate details with the social network – including the last time you had unprotected intercourse. These apps include Maya (more than 5m downloads) and Period Tracker MIA Fem: Ovulation Calculator (over 2m users.)This isn’t the first time women’s health apps have raised serious privacy concerns. Earlier this year, for example, it was reported that Activision Blizzard, a video game company, was encouraging its employees to use family-planning apps. These apps then shared user information with the company so it could keep track of how many of its employees were trying to get pregnant. And testing done by The Wall Street Journal in February found that Flo Period & Ovulation Tracker informed Facebook when a user was menstruating or intending to get pregnant. (It would seem, from Privacy International’s research, that Flo no longer does this.)Privacy International’s research is yet another reminder that technology companies need to be doing a lot more work to stop user data being shared without explicit and informed consent. “Consent is not just about a box to check,” stresses Eva Blum-Dumonte, a researcher at Privacy International and author of the report. “It is about being able to understand what you consent to and being able to refuse.”Maya, however, started sharing information with Facebook before a user could even agree to the privacy policy. Meanwhile many other period-tracking apps reviewed had inaccessible or opaque privacy policies, “so there would have been no way for users to meaningfully consent to the sharing of their data”.These latest revelations about period-tracking apps should also serve as a reminder that surveillance is a feminist issue. Patriarchy, after all, seeks to control and regulate women’s bodies; digital surveillance is a highly effective way of doing this. As Frederike Kaltheuner, who heads Privacy International’s work on corporate exploitation, notes: “While privacy invasions affect us all, they disproportionately affect and harm those who are already marginalized.”Ms Monopoly: Hasbro gets into the gender empowerment gameHot on the heels of releasing the much-panned Monopoly for Millennials and Monopoly for Socialists, Hasbro has come out with Ms Monopoly: “The first game where women make more than men.” Female players get more money than guys when passing Go and the mascot is a woman called Milburn Pennybags. A press release claims the game is supposed to celebrate women trailblazers; however it makes no mention of Lizzie Magie, the woman who invented Monopoly. At the turn of the 20th century Magie created the Landowner’s Game to teach people about the problems with capitalism. She then had her invention ripped off and monetized by a man: Charles Darrow. Hasbro has completely written her out of Monopoly’s creation story and insist on giving credit entirely to Darrow.Justice for Iran’s ‘Blue Girl’Women aren’t allowed to attend football games in Iran. This didn’t stop Sahar Khodayari, who tried to enter a football stadium in Tehran dressed as a man earlier this year. Khodayari, who has been nicknamed “Blue Girl” after her favourite team’s colours, was quickly arrested for “appearing in public without a hijab.” Last week, after appearing in court, Khodayari set herself on fire and died. Activists are now demanding FIFA do more to challenge Iran’s football ban.Female migrants lack access to menstrual productsLawmakers from the Congressional Hispanic Caucus are demanding that America’s detention camps are properly stocked with sanitary products after reports that women are “visibly” bleeding through their clothes. Teenage girls are reportedly only given one sanitary pad a day. Meanwhile Ivanka Trump continues to ignore what her dad’s up to and bangs on about how she’s empowering women.Afghan women want to be heard, not savedAn Afghan woman shows her inked finger after in the parliamentary elections in 2018. A right-wing group called the Alliance Defending Freedom (‘Freedom’ being shorthand for ‘bigotry’) has challenged a 2017 New York City measure banning the selling of “services intended to change a person’s sexual orientation or gender identity”. If the lawsuit goes all the way to the supreme court, which has become a lot more regressive of late, then a legal precedent could be set protecting the barbaric practice.Women’s share of public-company board seats rises to 20%That’s up from 19% last quarter, and 15% in late 2016. The increase is partly thanks to a recent California law which requires companies to put female directors on their boards or face fines. So far, “68% of the 94 public companies in the state with all-male boards when the law passed have added at least one woman”, the Wall Street Journal reports.Woman wins sheepdog training competition for first timePeta Bauer, winner of the Australian competition, hopes this will inspire other women to consider farming: “It’s not just for the boys anymore.” (Thanks to Helen for this reader submission!)Ad exec brings emotional support clown to redundancy meetingApparently the clown blew up balloons throughout the meeting and “mimed crying when the redundancy paperwork was handed over”. #BlackLivesMatter resonates in South Asia: Unilever drops ‘Fair’ from cosmetic line

#BlackLivesMatter resonates in South Asia: Unilever drops ‘Fair’ from cosmetic line
“This war of complexion has created a huge problem for our women”

On 25 June, global cosmetic conglomerate Unilever announced a decision to re-brand its leading skin-lightening product ‘Fair & Lovely’ to ‘Glow & Lovely’. The major decision comes in the wake of the recent Black Lives Matter protests that erupted around the world following the police killing of George Floyd in the US. In South Asia, where discrimination based on skin color permeates the beauty industry, ‘Fair & Lovely’ has been popular for nearly five decades. As celebrities raised their voice against racism using hashtags like #BlackLivesMatter and #JusticeForGeorgeFloyd, others were quick to point out the hypocrisy of those that have long endorsed skin-lightening products. While Unilever claims that the brand change aims to “celebrate all skin tones”, anti-colourist activists and social media users are questioning whether the brand's name change tackles the real issue.
South Asian standards of beauty
Although the “Black Lives Matter” movement exists in a specific context, its calls for racial justice have resonated with justice movements around the world. In South Asian countries — like India and Pakistan — skin color is seen as an indirect marker of social class and status. This issue has been prevalent since colonial times, with many women facing problems in getting marriage proposals or landing better work opportunities due to discrimination based on their complexion. The product, Fair and Lovely, has been used by many women across South Asia since the late '70s. Its marketing techniques, with before and after images of dark to light coloured skin, works indirectly to equate fairer or lighter skin colours with beauty. Indian Journalist Barkha Dutt compares skin lightening creams to another marker for racism in South Asia. She takes a jibe at Unilever's ‘Fair and Lovely’ commenting on how the brand has normalized racism in India and created wrong notions of beauty for millions of Indian boys and girls for five decades.
If Skin Lightening creams are going to be racism by another name that is neither fair nor lovely. — barkha dutt (@BDUTT) June 26, 2020
Speaking to Global Voices on the phone, Pakistani psychologist Mirat Gul said:
This war of complexion has created a huge problem for our women. Even our religion has said that no one is superior to another on the basis of colour yet these creams, advertisements, and mindset have effected women. South Asians are coloured people and we need to accept them as they are instead of opting for these products. It's good that the word ‘Fair’ will be dropped but people too have to stop worrying and harassing people on the complexion.
Same product, different name: Does Unilever's decision pack any punch?
A number of people in both India and Pakistan have been working to change the skin lightening industry, asking manufacturers to remove whitening creams from the market. Indian actress Nandita Das, who has been running the Dark is Beautiful campaign since 1994, celebrated Unilever's decision as an indication that mindset's are slowing starting to change.
Wow! Words impact notions & they, the mindset. I want to believe that the campaign Dark is Beautiful & India’s Got Colour played a tiny role. Many of you have too. Long way to go before things are truly ‘fair’, but we are on our way! #IndiasGotColour #AllShadesAreLovely https://t.co/lra7mlwqwq — Nandita Das (@nanditadas) June 25, 2020
While in Pakistan, anti-colourism and diversity advocate Fatima Lodhi has been running the Dark is Divine campaign for the past seven years. Dark is Divine issued a statement on about Unilever's decision pushing for more messaging aimed at “re-humanizing” dark skin tones:
Rebranding of products to recognize multiple shades, shapes, and sizes of beauty should be followed by behavior change programs to re-humanize the dark skin. Promoting lighter skin tone is not only colorist but a racist act as well and further, giving pedestal to the fairer skin tones while treating dark skin as a disease is also a clear attempt at enhancing most people’s feelings of insufficiency.
[youtube https://www.youtube.com/watch?v=XLF9GBPfv4E?feature=oembed&w=650&h=366] Social media users are also questioning whether Unilever's new product, ‘Glow and Lovely’ pays lip service to the real issues of colourism in South Asia:
So… @unilever is still going to sell skin lightening cream in South Asia and will just call it “Lovely” from now on? https://t.co/6R5LrhHIn9 — fatima bhutto (@fbhutto) June 25, 2020
‘Fair & lovely’ to be rebranded dropping the word ‘fair’. While the attempt is fair (no pun intended), is it really enough? Using the words glow and brighten doesn't really change what the product was built for. ”…a rose by any other name……” — Avni Raja (@avniraja) June 25, 2020
So Fair and Lovely will now be called Glow and Lovely? C’mon Hindustan Lever. For years you’ve been profiting by destroying our nation’s young girl’s self worth by making rude comments about dark skin. Now prove your ‘intentions’ by having a dark skinned girl on your packaging. — Shekhar Kapur (@shekharkapur) July 2, 2020
Is a change coming?
Along with building toxic psychological pressure, whitening creams contain the ingredient, mercury, which is said to be carcinogenic in nature. Pakistan's Minister of State for Climate Change, Zartaj Gul Wazir, made an official statement in July 2019 regarding the government's promise to crackdown on whitening creams that contain more than 1 percent mercury — citing the ministry's finding that 56 of 59 samples of fairness products contained more than 1 percent mercury. On July 4, 2020, in a Dark is Divine Facebook message Zartaj Gul Wazir reiterated her commitment to cracking down on mecury in whitening creams once the Minamata Convention on Mercury is ratified. Anum Chandani, Hira Hashmi, and Marvi Ahmed from Pakistan started the petition to ban Fair and Lovely and are also running an Instagram account to create awareness among masses.
This is a petition I wish no one had to make because Fair and Lovely is a cream that shouldn't exist. Nevertheless, @Unilever please stop making it and selling it. https://t.co/6lqH2LPHtD — fatima bhutto (@fbhutto) June 11, 2020
Another win came when Indian matrimonial website Shaadi.com, known for keeping a skin tone filter, has dropped it from its website after the recent uproar by many users. While changes are slowing being made, Ipsita Chakravarty notes that there may still be a ways to go:
The packaging of the creams may have changed but not their substance. And while Shaadi.com will no longer ask for your skin tone, you can still search for prospective partners by caste, which is what skin colour stands for in India.
