Secondo l’articolo II della Convenzione,
“Per genocidio si intende ciascuno degli atti seguenti, commessi con l’intenzione di distruggere, in tutto o in parte, un gruppo nazionale, etnico, razziale o religioso, come tale:
(a) uccisione di membri del gruppo;
(b) lesioni gravi all’integrità fisica o mentale di membri del gruppo;
(c) il fatto di sottoporre deliberatamente il gruppo a condizioni di vita intese a provocare la sua distruzione fisica, totale o parziale;
(d) misure miranti a impedire nascite all’interno del gruppo;
(e) trasferimento forzato di fanciulli da un gruppo ad un altro.”
Pensatela come volete, ma a me pare che almeno 4 o forse tutti e 5 i punti individuati dalle Nazioni Unite nel dopoguerra descrivano l’azione distruttiva perpetrata da Israele a Gaza. E al quinto mi pare che debba aggiunto un nuovo punto che descriva il genocidio come un’azione che tende a sterminare la prole per evitare la futura proliferazione.
D’altronde, la questione che queste considerazioni sollevano non rimane nel campo della pura speculazione teorica. Nel dicembre 2023, il Sudafrica ha formalmente presentato un caso contro Israele presso la Corte Internazionale di Giustizia (ICJ), accusando lo stato di aver commesso genocidio a Gaza.
[...] Ma aldilà della questione nominalistica e delle disquisizioni giuridiche sui termini tecnici, resta l’orrenda gravità di un crimine contro l’umanità. Indipendentemente da come venga categorizzato dal diritto internazionale, la sistematica distruzione di vite umane, la sofferenza inflitta a popolazioni civili inermi, la devastazione di intere comunità segnano una soglia oltre la quale non bisognava giungere.
Le vittime non aspettano le sentenze dei tribunali né le loro famiglie attendono le definizioni giuridiche per piangere i propri morti. L’urgenza dell’azione umanitaria e della giustizia non può essere subordinata alle lungaggini processuali, per quanto necessarie queste ultime siano per stabilire responsabilità e precedenti. Ciò che conta, in ultima analisi, è che l’umanità sappia riconoscere l’orrore quando lo vede e abbia il coraggio di chiamarlo con il suo nome, chiunque sia la vittima e il suo carnefice. Perché l’orrore non trovi più spazio nel nostro complice silenzio.

Se si prende in considerazione la Convenzione per la prevenzione e la repressione del crimine di genocidio del 1948, entrata in vigore il 12 gennaio 1951 (https://unipd-centrodirittiumani.it/it/archivi/strumenti-internazionali/convenzione-per-la-prevenzione-e-la-repressione-del-crimine-di-genocidio-1948), all’articolo II si legge: «Nella presente Convenzione, per genocidio si intende ciascuno degli atti seguenti, commessi con l’intenzione di distruggere, in tutto o in parte, un gruppo nazionale, etnico, razziale o religioso, come tale: a) uccisione di membri del gruppo; b) lesioni gravi all’integrità fisica o mentale di membri del gruppo; c) il fatto di sottoporre deliberatamente il gruppo a condizioni di vita intese a provocare la sua distruzione fisica, totale o parziale; d) misure miranti a impedire nascite all’interno del gruppo; e) trasferimento forzato di fanciulli da un gruppo ad un altro». Sarebbe difficile negare che quanto descritto (almeno) nei punti a) b) c) d) sia avvenuto regolarmente nella striscia di Gaza a partire dall’otto ottobre 2023. Quindi, il meno che si possa dire è che la faccenda se il massacro di Gaza sia o no un genocidio andrebbe considerata in modo più attento; che non la si può liquidare affermando che mancano (se mancano) i «due caratteri tipici dei genocidi» sopra indicati. Insomma, di fronte a una questione così delicata, sarebbe meglio che si facesse mezzo passo indietro e si lasciassero parlare gli esperti; sarebbe meglio che non si brandisse la parola genocidio come una clava contro Israele, ma neppure si gridasse al complotto antisemita non appena qualcuno la pronunci.

In internet manifestimo il sogno d'una conoscenza universale. Tuttavia, la quantità di risorse di cui disponiamo è tale che il sogno di conoscenza s’infrange contro ogni idea di decifrazione. Poichè è impossibile conoscere tutto. Come il talmudista (talmud significa ‘studio’) chiosa e rovista le prescrizioni della Torah fino a renderle inapplicabili, così lo studioso rimugina e sbriciola le sue possibilità di ricerca una dopo l’altra, infinitamente.Per l’internauta ( mi riferisco in primis a me) la ricerca non può trovare conclusione, poiché la quantità di materiale accumulabile oltrepassa la possibilità di rimuginarlo interamente. La conoscenza si mantiene oscura nonostante la facilità d’accesso; e proprio per via di questa facilità, siamo spinti a non abbandonare la ricerca ossessiva, di pagina in pagina, di link in link. Google, Internet Archive, Wikipedia fanno risorgere il fantasma dell’antico ermetismo, l’immensa raccolta di testi della sapienza occulta, di immagini mnemoniche, di simboli e di pratiche magiche miranti a padroneggiare tutto lo scibile. Ma cosa smarriamo in questa ricerca ossessiva, Cosa ci viene tolto? I movimenti, le carni, i sapori, gli odori, cancellati dal monoteismo di un solo mondo comunicativo lontano dai nostri sensi. Siamo diventati tutti tuttologi, senza capire ancora che Internet non è monolitico; è invece multiplo, diversificato, frammentato, contraddittorio, tutto nello stesso tempo e se non lo avessimo continuamente davanti agli occhi sapremmo rispondere a mala pena ad un decimo delle domande poste. Futuro o Inganno?
