Before we start today's episode of ranting, let me tell you a story. A few days ago, I went to a friend's house to ask her mom for sleepover permission, which took me a long time. During that time, my friend and her mother started to argue. At some point, my friend yelled at her mother, "Why does my younger brother get to leave the house whenever he wants to, but I have to get permission for the exact same thing?" to which her mother replied, "Woh, ek larka hai.". 

For some reason, parents think that girls are the only ones unsafe at night. There was a case about a man in Punjab, and the headline was like this:

And now let me ask: shouldn't boys too say at home at night?

The world is unsafe for everyone and anyone. A guy being raped by a girl was not really considered a crime for some people. They went even further by saying that guy should have "enjoyed." This guy is now complaining because he wants attention from the public.

Sordid, huh? The case was little known, and those who were aware of it seemed unsure of how to proceed or what to say. You know, that makes it even more pitiful. Examples include instances where a gang of "men" sexually molested a male and when a young girl was sexually raped by her "girl friends" before they brutally murdered her. As I mentioned earlier, nobody feels safe here, and gender has no bearing on safety.

We've all thought that everything awful that happens is solely for the girl to deal with. We are such hypocrites, saving our daughters like delicate and fragile glass. At the same time, worship the goddess Durga for protection, strength, and motherhood.

The media also plays a significant role in this scenario; they only show select crimes that benefit them. However, as the fourth pillar of democracy, they must give each case a fair hearing. Chance of being shown, of receiving justice, or simply of being heard.

The candle march and strikes are excellent ways to bring to light incidents that the media has chosen to ignore. But that also just lasts a day or two. After that, everyone gets busy with their own lives and problems. Far gone is their pledge to get justice for the victim and their family.

At the end, the only thing that remains is the pain of the victim waiting for their justification. While criminals roam freely without any hesitation.

Criminal Jurisprudence: Bail is a rule and jail is an exception

#Regular Bail is applied for by the Petitioner-Mother of the deceased minor daughter, Bharti aged about 9 years. The story of the prosecution is that the mother along with his husband-Narinder Pal, who is step father of the deceased hatched #criminalconspiracy for the # minor to make balance payment due towards the plot purchased by them out of the Life Insurance Policy of the #daughter. As per the post mortem repot the cause of #death was #strangulation with the help of Dupatta.

However, the #prosecution #failed to #substantiate their #version so as to #instill #confidence in the Court for #denying #bail. Moreso, #getting #bail is a matter of rule and courts grant bail to accused persons unless there are #compelling #reasons to # accused in #custody.

Story of the Prosecution

As per the prosecution the motive behind the murder was the couple purchased a plot for Rs. 3,00,000/- on installment and paid Rs.1,49,000/-, but thereafter they found it difficult to make the balance payments. As such they thought of utilizing the amount due of her Life Insurance Policy amounting to Rs.90,000/-, so they conspired to kill minor daughter, another motive was Step father-Narinder Pal didn’t like her step daughter Bharti.

As per post mortem report the cause of death was asphyxia due to smothering which is ante mortem and sufficient to cause death in ordinary course of nature. Earlier it was taken as a case under section 174* CrPC

It was submitted by the prosecution to hide their guilt parents misguided the police by giving false statements whereas they had committed an offence u/s 302/120-B/182/34 IPC. Thus, proceeding under Section 174 CrPC was proceeding under section 174 CrPC was converted into FIR.  

174*CrPC provides for preparation of inquest report** in case a person has committed suicide, or has been murdered or killed by an animal, machinery or in an accident, or has died under suspicious circumstances.

Inquest Report** Report prepared by the police in cases involving unnatural deaths or deaths under suspicious circumstances.

Submission of the Defense Counsel

As per the defense counsel the petitioner is a biological mother of deceased and has been nominated as an accused without any incriminating material against her.

The story put forth by the prosecution for committing murder of her own real minor daughter by strangulation out of greed for Rs.90,000/-, which is the amount to become due out of her Life Insurance Policy. This story of the prosecution is highly improbable, keeping in view the relationship of mother and daughter, who is also having a son aged 6 years from Narinder Pal.

Merely on the basis of the confession statement made before the police by the petitioner and co-accused Narinder Pal, the petitioner has been roped in the commissioning of offence and except the postmortem*** report, which has recorded the cause of death to be a Asphyxia, which is anti-mortem**** and sufficient to cause death in the ordinary course.

Court asked about the Forensic Science Laboratory Report (FSL)from the State counsel but State Counsel had no answer regarding FSL report except the fact that the said report is inconclusive, as it does not reflect any kind of impression of finger prints of the accused-petitioner or ingredients of saliva of deceased, if at all her mouth was gagged with 'Chunni'.

Anti mortem**** injuries occur before death

Postmortem***injuries occur after death. 

Observation of the Court

Petitioner mother is in custody from 2 years 2 months and 21 days.

The trial is almost at the end as all the material witnesses stands examined.

Court also cannot ignore the fact that the petitioner is a biological mother of the deceased.

And is also having another minor child aged 6 years.

The story put forth by the prosecution is not sufficient enough to inspire confidence of this Court at least for the purpose of considering the instant petition for regular bail.

The principle of criminal jurisprudence has to be borne in mind along with the right to life as enshrined under Article 21 of the Constitution of India.

The petitioner is a lady of clean antecedents and thus it is highly improbable that merely for Rs.90,000/-, a biological mother would kill her own daughter and over and above had to use 2 'chunnis' to strangulate a minor girl.

Order of the Court

The court directed trial court for the release of the petitioner on regular bail on her furnishing bail and surety bonds to the satisfaction of the trial Court/Duty Magistrate, concerned.

However, it is made clear that anything stated hereinabove shall not be construed as an expression of opinion on the merits of the case.

Death of Moosewala killers: Seven gangsters hurt in jail clashes 

The Punjab Police has registered a case of murder and attempt to murder besides Arms Act against seven of them.

CHANDIGARH: A total of seven gangsters were injured, two of them seriously, in the clash that broke out between two groups of inmates in Goindwal Sahib Jail in Punjab’s Tarn Taran district on Saturday in which two men accused in the murder case of Punjabi singer Sidhu Moosewala were killed.

The Punjab Police has registered a case of murder and attempt to murder besides Arms Act against seven. Also, the Assistant Jail Superintendent has been suspended by the Prisons Department. In another move, 18 men accused in the case who were lodged in jail have been shifted to five different state jails.

Sources said that a case had been registered against Manpreet Singh, Sachin Bhiwani, Ankit Lati, Kashish, Rajinder, Arshad Khan and Malkit Singh on charges of murder, attempt to murder and under the Arms Act. As per the complaint made by the Jail Superintendent, Mandeep Singh alias Toofan hailing from Batala, Manmohan Singh alias Mohna of Budhlana and Keshaw of Bathinda were attacked with irons rods, leaving them seriously injured.

Speaking on the condition of anonymity, an officer said that 25 gangsters named in the Sidhu Moosewala murder case were lodged in three sets of cells in the high-security zone of the Goindwal Sahib Jail. “The Prisons Department has suspended Assistant Superintendent of Jails Harish Kumar in view of the incident and a judicial inquiry would be ordered,” said the officer.

Sources said that at the time of Sidhu Moosewala’s murder, gangsters Lawrence Bishnoi and Jaggu Bhagwanpuria had good relations and now, reports of differences between them have surfaced. Senior Superintendent of Police of Tarn Taran Gurmeet Singh Chauhan said that a case of murder and attempt to murder has been registered against the seven gangsters who were involved in the clash.
