Good morning Ralph! I’m an attorney in the US and I saw your anon asking about the legality of vaccine requirements set by artists. I can shed some light, though probably not much and I’m going to do that annoying thing that lawyers do where we say “well it depends!” and refuse to give anyone any solid answers. But that’s really, truly, honestly, cross my heart hope to die, because in the case of the legality of vaccine requirements it does depend on a lot of different factors and we don’t have very many solid answers. This is not something anyone has ever really had to deal with before, the legal system looks to past precedent when deciding how to handle current issues, and there just isn’t much of that here. As a kind of general rule, though, the baseline we start from is the idea that private entities are free to require basically whatever they want as a prerequisite to service, and consumers are free to choose not to patronize those entities if they don’t like the requirements. An important thing to remember, that I think a lot of people tend to forget - all those handy rights the US constitution affords its citizens only apply to the government. There are limited exceptions - the Americans with Disabilities Act and Title VII of the Civil Rights Act are two of the biggest examples. But, so long as they’re complying with the guidelines provided by those limited exceptions, private entities can and always have been able to do pretty much whatever they want.
Now, vaccines are an interesting question because you start to get cross over into other issues - the right to privacy, bodily autonomy, “compulsory” disclosure of personal medical information, etc. If the question was “can an artist require me to wear a mask at his concert even though wearing a mask wasn’t required at the time I bought my ticket” the answer would unequivocally be yes. Artists and venues can (and do!) require all sorts of things for entry - you have to have a ticket, you have to submit to a bag search and go through a metal detector, you’re generally required to be wearing shoes and pants and a shirt. Masks absolutely can be added as a requirement, at any time, and whether or not it was a requirement that you reasonably could have anticipated when you bought the ticket doesn’t matter. But vaccines feel a little different, and admittedly they are. A mask is, in essence, a piece of clothing for your face. You wear it for a few hours, you take it off, you go about your life. It’s a temporary measure. Vaccines are not. A vaccine is a medical treatment, once you’ve gotten it you can’t “take it off” or decide you don’t want it anymore. It just feels like there should be a higher level of scrutiny than just “if you don’t like the requirement don’t support the entity.” But there really isn’t. That old idea that a private entity can set pretty much whatever rules and restrictions for access to and use of their private property stands. That tenant is arguably strengthened when the issue involves public health risks, because an employer has a duty to protect their employees and customers.
The EEOC ruled in May that companies can legally require their employees to be vaccinated. There are no federal laws preventing an employer from requiring employees to provide proof of vaccination, that information just has to be kept confidential. If there is a disability or sincerely held religious belief preventing an employee from being vaccinated they are entitled to a “reasonable accommodation” that does not pose an “undue burden” on the business. This isn’t a 1:1 comparison to your anon’s question about whether or not artists can require vaccination of concert attendees, but it is really useful guidance, because it’s a statement about what is and isn’t appropriate re: vaccine requirements straight from the mouth of one of the biggest federal players in the game. If, for example, a bunch of maroon five fans decided to sue the ban for their vaccine requirements, the EEOC decision is something judges and lawyers would look at in evaluating the suit.
HIPAA is the big one that a lot of people like to cite as protecting them from being asked about vaccination status by businesses or employers, but that’s just entirely untrue. HIPAA prevents a specific list of entities - doctors, hospitals, insurance companies, etc. - from disclosing medical data about a patient in their care. Event venues, artists, employers - none of them fall into the category of a “covered entity” that has to abide by HIPAA requirements. And even then, there’s an argument to be made that HIPAA still wouldn’t prevent them from asking if you’re vaccinated and refusing you entry if you’re not, just that they can’t turn around and tell someone else what your vaccination status is.
So on a high level the answer is yes, artists can absolutely require vaccination of concert attendees. Full stop.
But that’s only taking into account federal laws. There are state laws at play too, and those are absolute mess. It feels like each state is handling their approach to vaccine requirements differently, and a lot of them conflict with the federal laws at play. While in theory federal laws should trump state laws, that’s not really true in practice, and a lot of people who are much smarter than me are still struggling with how to navigate that maze, so I’m not going to bother adding my two cents about how I think it should go. From a fact based standpoint, though, know that state laws are an issue and add even more “it depends on ____” factors to our already uncertain analysis. Texas, Arkansas, and Florida, for example, all have laws prohibiting businesses and governmental entities from requiring digital proof of vaccination. Whether or not these laws will withstand judicial scrutiny in the places they conflict with federal law remains tbd, but as it stands now an artist playing a show in Texas couldn’t require vaccines for entry to that show. But if their tour stop is, say, Indiana, they could require vaccines there, because Indiana state law only prevents governmental and quasi-governmental entities (schools) from requiring vaccines. Private entities can do whatever they want.
The final thing I want to touch on is your anon’s concern that the vaccine requirement wasn’t in place when the tickets were originally bought. It doesn’t matter. If the question is “can an artist require vaccines” the answer is “yes” and whether or not that requirement was in place when you bought your ticket doesn’t matter. BUT! As with everything else, there are exceptions. There might be an argument that adding a vaccine requirement is a contractual violation, if we were to imagine the exchange of ticket purchase for entertainment a contract between the buyer and the artist. There’s maybe an argument that you paid for a service you’re no longer getting because the circumstances under which the service will be provided has changed so drastically. These are issues that if someone wanted answers to they’d have to hire an attorney to file a civil suit against the artist, and then see the litigation through to get a ruling from a judge. To the best of my knowledge that hasn’t been done. But even if it is is done in the future, the answer to the overarching question “can an artist require vaccines” won’t change. All that will change is the artist will be required to come up with some sort of refund scheme for those who choose not to be vaccinated.
Anyway! I didn’t mean to write an entire treatise in your inbox. I saw the anon’s question and immediately went “oh interesting! I know a little bit about that” and, as per usual, a little bit has turned into a rambling lecture that I’m not actually sure anyone will even learn anything from. At the very least it might entertain you.
Xoxo, a US attorney who really needs to go do work someone will pay her for and stop theorizing about the interplay of federal vs state laws.
Thanks anon! That's all very interesting and relevant information. It gives a really good sense of how complex the situation is and the relevant dynamics in play. And also a good sense of what the law does and doesn't cover - because there's a whole practical side of this that is largely
I'll throw in one more thought. One of my concerns about vaccine passports are the equity issues. Existing issues of access to healthcare have played out in vaccine rates and that's true of both race and class everywhere that I have looked at. I don't think vaccines can be considered meaningfullly accessible if poor people and black people aren't accessing them. In general, the best answers to that will be resourcing to take vaccines to where people are and (and the situation for native americans really undscores this) and paid sick leave. But while vaccination rates are lowest for those who face most marginalisation, restricting access to society on the basis of a vaccination is discriminatory in a serious way.

For Every Medical Malpractice Lawsuit, 7.6 Patients Are Injured by Doctor Error
Up to 440,000 people die each year because of medical mistakes. That’s the equivalent of a 747 crashing every 10 hours. Consumer watchdog fights for the right of those patients–and the thousands of others injured by medical errors–to take negligent doctors and hospitals to court. If an airliner crashed twice a day, everyday, we would have new laws protecting passengers, not limits on their legal rights. But doctors, hospitals and their insurance companies spend millions of dollars lobbying congress and state legislatures to stop us from holding them accountable. They claim that lawsuits by injured patients drive up the cost of medical malpractice insurance. We know that greedy insurance companies, not injured patients seeking justice, are to blame when premiums are excessive.

What To Know About Medical Malpractice In Arizona
Arizona does not place a cap on financial or economic damages in a medical malpractice claim. Therefore, if you are injured because of medical malpractice, the law allows you to seek full compensation for all financial losses related to the medical malpractice. Arizona is one of the few states with no damage caps in place. In fact, Arizona’s state constitution deliberately prohibits damage caps in civil cases, including medical malpractice and wrongful death. It also includes your spouse’s claim for loss of consortium.
Medical malpractice claims, just like any other claim, are subject to a limited time for filing. This time limit is known as the statute of limitations. If you don’t file your medical malpractice lawsuit on time, you may lose your right to hold the liable parties accountable and fight for your compensation. Every state regulates its own statute of limitations regarding medical malpractice cases. Arizona Revised Statutes section 12-542, states that a legal action alleging malpractice by a health care professional or care facility must be filed “within two years after the cause of action accrues, and not afterward.”
According to one study published in surgery, more than 4,000 preventable surgical errors occur every year, costing private and public healthcare providers more than $1. 3 billion annually in malpractice payouts. Mistakes range from wrong-side surgery to foreign objects left inside patients. Despite being known in medical circles as “never events” because they should never happen, a range of studies support the findings published in surgery. In 2007, research published in annals of surgery revealed shocking data taken over the course of 30 months in just one state. The report included 400 “near misses” and nearly 300 wrong-side surgery errors. In 2009, archives of surgery found that so-called “never events” happen all too frequently.
Medical Malpractice Law Is Based On Common Law In Arizona
Medical Malpractice Law Is Based On Common Law.
Medical malpractice law in the United States is derived from English common law, and was developed by rulings in various state courts. Medical malpractice lawsuits are a relatively common occurrence in the United States.
Medical malpractice liability is normally based on the laws of negligence. Although the laws of medical malpractice differ significantly between nations, as a broad general rule liability follows when a health care practitioner does not show a fair, reasonable and competent degree of skill when providing medical care to a patient. If a practitioner holds himself out as a specialist a higher degree of skill is required. Jurisdictions have also been increasingly receptive to claims based on informed consent , raised by patients who allege that they were not adequately informed of the risks of medical procedures before agreeing to treatment.
Given how complex a medical malpractice claim can be, you would do well to work with an experienced team of Arizona medical malpractice lawyers who have won impressive verdicts and settlements for many clients. We do not back down from pursuing the compensation you require to move on from your life whether the injury temporarily sidetracked you, or if it left you with permanent disabilities. When you work with Tucker Miller Law you do not just get a team of skilled litigators, you also get access to a team that is fighting for you every step of the way.

What is Medical Malpractice?
Thanks to advanced technology, most of the surgeries performed in the united states go well. However, sometimes serious mistakes occur during surgery caused by the negligence of a medical professional. When this happens, you may be entitled to file a medical malpractice claim and seek monetary compensation for your damages. Considered easy to file but challenging to win, a medical malpractice lawsuit for surgical error often needs the skill and expertise of an experienced legal team to result in compensation for the claimant.
Medical malpractice occurs when a patient is harmed by a medical professional who fails to competently perform their medical duties, typically through a negligent act or omission. In legal terms, the medical professional deviates from the recognized standard of care in treating a patient. Standard of care is what a reasonably prudent medical professional would or would not have done under the same circumstances with the same available information. This is used as a benchmark against the doctor’s work. The doctor’s defense would have to prove that another doctor would have made the same decisions under the same circumstances, and thus the doctor’s actions align with standard of care.
Nerve damage is a common injury sustained by victims of auto accidents , workplace incidents , dog bites , slip and falls , and cases of medical negligence including surgical malpractice. One of the most frequent questions asked by victims of severe nerve damage during consultations with our attorneys is, “how much my case is worth,” or “what the value of my case?” the estimated value of a personal injury case is dependent on numerous factors unique to the individual harmed. Only a qualified personal injury attorney who can investigate the facts of your case will be able to determine the estimated value of your claim.

If you have suffered an injury as a result of a surgical injury, you may be entitled to compensation. Like other types of Arizona medical malpractice cases, surgical error claims can be complex, and require the expertise of a seasoned Arizona surgical errors lawyer.
A hospital, doctor, or other health care professional is expected to provide a certain standard of care. The professional is not liable for all the harms a patient experiences. However, they are legally responsible if the patient experiences harm or injury because the health provider deviated from the quality of care that is normally expected in similar situations. According to malpractice lawyers in the u. S. , for medical malpractice to be considered, a number of factors must be involved. The injured patient must show that the physician acted negligently in rendering care, and that such negligence resulted in injury. To do so, four legal elements must be proven: (1) a professional duty owed to the patient; (2) breach of such duty; (3) injury caused by the breach; and (4) resulting damages.

How Do You Know If You Have a Medical Malpractice Case In Arizona
In Arizona, a medical malpractice lawsuit can be filed against any licensed health care provider. This includes:
Physicians
Nurses
Physical therapists
Dentists
Dental hygienists
Pharmacists
Pharmacy technician
Physician assistants
In order to establish a medical malpractice claim in Arizona, you must prove the following 2 elements:
The health care provider failed to exercise the degree of care and skill expected of a reasonable health care provider in the profession, and
Such failure was the proximate cause of your injury.
In a medical malpractice case, the main focus of the lawsuit will generally be on what the health care provider should have done in a specific set of circumstances. The standard by which the health care professional is judged is called the “medical standard of care.”
If you are the victim of a surgical error, physician negligence or another form of medical malpractice, you may not know where to turn to for help. You may have had to undergo further surgical operations or other painful treatments as a result of a physician’s mistake. A personal injury attorney in Arizona may be helpful in answering any questions you may have regarding your case and could help point you in the right direction.
Colon Cancer Failure To Diagnose Colon Cancer
Damages in a Medical Malpractice Case
Once the duty of care has been established, the victim must next prove that it was breached by careless conduct, such as a surgical error.
Examples of common surgical errors include:
removing the wrong organ;
operating on the wrong side;
performing a procedure on the wrong patient;
failing to promptly recognize complications, such as excessive bleeding or infection;
leaving a sponge or a piece of medical equipment inside a patient’s body; or using unsanitary equipment.
The last two elements of a medical malpractice claim require showing that the surgical error or other breach led directly to the patient’s injuries and that actual damages arose as a result. Compensation in surgical error cases can consist of both economic and non-economic damages. Economic damages include objective costs such as medical expenses and lost wages.
Medical malpractice exists in cases where a patient sustains some level of damages from a medical professional during his or her official medical duties. Damages are a legal term, but ultimately, include a number of harms that the patient sustains as the result of medical treatment, which can include exacerbated medical issues, unnecessary medical costs, untreated but otherwise treatable conditions, as well as a whole host of other issues relating to income earning capacity, costs of medical care, as well as psychological and emotional duress.

Damages in a Medical Malpractice Case
Once the duty of care has been established, the victim must next prove that it was breached by careless conduct, such as a surgical error.
Examples of common surgical errors include:
removing the wrong organ;
operating on the wrong side;
performing a procedure on the wrong patient;
failing to promptly recognize complications, such as excessive bleeding or infection;
leaving a sponge or a piece of medical equipment inside a patient’s body; or using unsanitary equipment.

Can you get insurance if your spouse doesn't have a license?
Can you get insurance if your spouse doesn't have a license in the state of Texas? My husband has been trying to get quotes for insurance but keeps being told I, his wife, need to have a license. At the time that I was living in Florida, you did not need a vehicle license to drive a vespa (moped, scooter, etc.), just a permit. After moving here to Texas and getting married, the DMV denied me a license even though it had been a year of having both a drivers permit and permit to drive my moped, saying I needed to take the Texas Adult Drivers Course, then pass the driving test to receive my Drivers License. Why are there no good health insurance companies?
While thinking about the idea of an altruistic, fair public option for health insurance, I started trying to figure out why something like it doesn't already exist. (Or maybe it does?) The assumption seems to be that health insurance companies are causing problems through systematic greed, and the public option would help keep them honest. But, if this is the case, why isn't there an organization doing this already? Why don't the good, people, such as the ones that take less-pay than they could in other sectors to run major charitable organizations, start a good health insurance company that doesn't do any of the bad things that the other insurance companies do. If such an organization were to exist, it seems that everyone would switch to it, and even the most greedy of insurance companies would have to become like it in order to compete. There are obviously enough qualified and caring people out there to make such an organization happen without any government involvement. So why dont such organizations exist? I have a few ideas, but they dont explain the whole story. Maybe the fact that people dont usually shop around for health insurance because its chosen by their employers prevents new good insurance companies from gaining the market share required to make the bad ones change? Maybe health insurance companies are already as good as they can be, despite a few heartless employees, and the primary problems in health care come from somewhere else? Maybe protectionist legal policies prevent altruistic organizations from freely forming? Any thoughts?""

I was looking at the calculator for the new Obamacare (google Obamacare calculator) and I noticed that there is not an option for someone under 19 getting insurance for themselves...and I am still considered a child. My family does not have insurance but I despereately need it, and was just wondering how some like me, a full time student and 19 years old with a part time job, gets insurance...or am I not allowed to have insurance because I am 19? I have never been able to afford insurance before, but now will it be more affordable? Sorry, this Obamcare thing confuses me but if this is a chance for me to get insurance I want to know all I can about it! Bt so far all i can gather is you have to be 21 or over to get your own insurance. And please don't tell me to get a full time job and get company provided health care...someone has told me that on an answer before and I stuggle just having a part time job and going to school full time...a full time job is just not plausible right now and NO I am NOT LAZY thank you very much.""

The other driver did have insurance and I wanted to know even though I had no insurance, when the drivers' insurance company gives me the compensating cash amount would I be able to use the hospital bills as part of the compensating amount? This Poisoned Montana Town Is Now At The Mercy Of The GOP Health Care Plan
WASHINGTON — Jim Devlin has fond memories of growing up in the picturesque Rocky Mountain town of Libby, Montana, playing baseball and scampering across piles of shimmering ore mined from a nearby mountaintop.
But that harmless childhood fun ― the simple act of breathing Libby’s air ― has left him with an incurable, potentially fatal lung disease.
It wasn’t until decades later that Libby, a town of fewer than 3,000 people near the Canadian border, learned the truth: that the shiny vermiculite ore that helped drive their economy was laden with toxic asbestos; that the community ball fields where Devlin played catcher were covered with the poisoned mineral; that for decades, miners had been bringing home deadly dust on their clothes, exposing their spouses and children.
“We didn’t know anything was wrong,” Devlin, who now lives in Great Falls, told The Huffington Post. “It was dusty. That was about it.”
The 52-year-old father of three is among the many victims of one of America’s worst environmental health disasters. The asbestos fibers contained in the vermiculite mined here have been linked to more than 400 deaths and thousands of diagnoses of asbestos-related illnesses, including lung cancer and mesothelioma, in and around this town of less than 3,000.
Devlin learned in 2011 that he has asbestosis, a scarring in the lungs caused by inhaling asbestos fibers. He suffers from coughing fits, shortness of breath and lung irritations. He has to make sure his inhaler is never out from reach.
Devlin and hundreds of other Libby residents were granted health insurance via a unique package of Libby-specific provisions championed by former Sen. Max Baucus (D-Mont.) and written into the Affordable Care Act when it was being constructed in 2009. In an unprecedented move, Baucus expanded Medicare to cover “individuals exposed to environmental health hazards,” specifically the people of Libby.
Now, as Republicans in Congress forge ahead with plans to repeal and replace the ACA, better known as Obamacare, the Libby community can’t help but worry if it will soon be left fending for itself. The provisions were preserved in the GOP proposal released Monday night — a bit of good news for a community that rarely receives any. But it’s early, and there are already a number of conservatives voicing opposition to Speaker of the House Paul Ryan’s proposed reform.
Losing those provisions would be yet another devastating blow for Libby — one that would further jeopardize the community’s health.
“I just hope that the provision remains, because it’s going to mean life or death for a lot of people,” Baucus told The Huffington Post by phone Thursday.
Libby is a story of government inaction and corporate greed. In the 1920s, the Zonolite Co. began mining vermiculite just outside of town. In 1963, W.R. Grace purchased the mine, which remained in operation until 1990.
At its peak, it is thought that the Libby mine was producing 80 percent of the world’s supply of vermiculite, a mica-like mineral that when heated expands into a lightweight, fire-resistant material that’s been used primarily in insulation and fertilizer. On its own, vermiculite is not known to be harmful to human health. The vermiculite from Libby, however, was tainted with tremolite, an extremely toxic form of asbestos.
As two-time Pulitzer Prize winner Andrew Schneider first revealed in a Seattle Post-Intelligencer series in 1999, W.R. Grace had long known how dangerous its product was — and covered it up. He later documented the Libby asbestos poisoning in a 2004 book, An Air That Kills: How the Asbestos Poisoning of Libby, Montana Uncovered a National Scandal.
“As we dug deeper we found that not only did W.R. Grace know about the situation, but the government did as well,” Schneider recalled in a 2007 interview with PBS. “They clearly knew in the ’70s. They may well have known in the ’60s. There are references going back to the ’60s and late-’50s, before Grace bought the plant, about tremolite being present here. Did Grace know their workers were being harmed by it? Yeah, I’m positive they did.”
Schneider died of heart failure last month at age 74. But he will forever be credited with shining a spotlight on Libby and ultimately forcing the Environmental Protection Agency to take action. In October 2002, the federal agency placed Libby on the Superfund program’s National Priorities List. And in 2009, the EPA declared the site a “public health emergency” — a first for the agency.
That cleanup — the “largest, longest-running asbestos cleanup project in American history,” according Flathead Beacon reporter Tristan Scott — is nearing completion. Over the years, the EPA has spent nearly $600 million on the effort, according to The Western News. That figure includes $250 million that W.R. Grace paid as part of a 2008 settlement.
Meanwhile, Libby’s residents continue to suffer from the effects of a lifetime of exposure to lethal asbestos fibers. And because it can take decades for many asbestos-related diseases to develop, more people are being diagnosed each year.
When lawmakers began crafting a health care reform bill in 2009, Baucus was chairman of the powerful Senate Finance Committee. The bill that moved out of his committee in October of that year essentially became the foundation of the Affordable Care Act.
In the process, Baucus went to bat for the poisoned Montana town, writing into the law special provisions to ensure its residents could get health care.
“I really cared. My heart went out for the people of Libby,” Baucus told HuffPost on Thursday. “I decided I need to everything possible to get them justice. It was just a tragedy what W.R. Grace did to those people. It was an abomination.”
First, the provisions allow for Libby’s Center for Asbestos Related Disease to provide free asbestos health and lung cancer screenings to anyone who lived, worked or spent at least six months in Libby at least 10 years prior. The clinic reported screening 4,500 individuals as of last November and has diagnosed 2,025 with asbestos-related pulmonary disease.
The law also extended Medicare, which for the most part covers only the elderly and disabled, to any individual diagnosed with an asbestos-related disease, regardless of age. As of last November, 1,846 people under age 65 in and around Libby had received health coverage through Medicare as a result of their asbestos-related diagnoses.
The ACA also established a pilot program that provides Libby asbestos victims with access to health care benefits not typically covered by Medicare, including at-home assistance, travel and special counseling. That program currently covers 1,301 people, providing services that the clinic said can sometimes mean the difference between whether someone can stay at home or has to move into a nursing facility.
Dr. Brad Black, the CEO and medical director of the Center for Asbestos Related Disease, said thousands of people have received “critical health care” through these programs.
“The loss of these services will decrease access to care, decrease quality of life for many and likely result in increased mortality and morbidity rates,” he wrote in an email.
If those programs were to vanish, Devlin said, he doesn’t know what he and others like him would do. He said he’s been “waiting with bated breath” to see what Republicans decide to do.
Sen. Steve Daines (R-Mont.) railed against Obamacare in a letter to Ryan (R-Wis.) and Senate Majority Leader Mitch McConnell (R-Ky.) this week, calling it a “disastrous law” that has “caused severe hardships on countless Montanans.”
But then he pleaded with his fellow Republicans to preserve the law’s Libby provisions, which he said are “unrelated to the heart of Obamacare but were included in that law.”
A spokesman for Daines told The Daily Inter Lake newspaper on Tuesday that it’s unlikely the provisions would be discarded in amendments to the Ryan proposal.
A spokesman for Sen. Jon Tester (D-Mont.) said Tuesday that he was pleased to see the Libby programs maintained in the GOP’s new health care proposal, though his office will continue to monitor what happens.
Losing those provisions, Tester recently told HuffPost, would be “catastrophic.”
“Look, if it’s repealed it’ll have huge impacts all over the country,” Tester said of Obamacare. “And I don’t want to overstate this, but it may affect Libby more than any other place in the world.”
For now, Devlin and other Lincoln County residents are left waiting to see what Congress decides to do to a law that has given many of them care, comfort and hope.
Tanis Hernandez, administrative director of the Center for Asbestos Related Disease, told HuffPost that the clinic very much appreciates the continued support of Sens. Tester and Daines.
“We realize that it is early and far from over regarding what the final health care bill will be,” she wrote in an email. “We are hopeful that the Libby provision programs will remain alive of course; so we are closely watching the news regarding how things are progressing.”
“We’re not asking for a handout,” Devlin said. “We’re just looking for a fair shake.”

Part-Timers Getting Full-Timer Benefits
Due to the ACCA regulations surrounding FTE calculations, there can be some issues when determining how to treat part-time employees when it comes to benefits offerings. Many companies offer some form of coverage to part-timers but, as this article shows, sometimes a case can be made for investing in part-time employees from a benefits perspective.
Why more employers are offering part-time employees full benefits
by Cheryl Smolkin
Paul Tanguay began his career with UPS 32 years ago, loading trucks part-time. Today, he is UPS’s global director of recruitment strategies.
This is not unusual in an organization that hires from within and where, on average, six out seven full-time drivers have been promoted from the ranks of part-timers who make up about 60% of the UPS workforce.
“What attracted me to UPS at the time was that even though the location where I worked didn’t have a tuition assistance program, they paid competitively and had a great benefits package,” Tanguay says. “Although I was a college student, at a very young age I was also engaged to be married, so I was looking for somewhere very stable to start my career.”
UPS is not alone in providing great perks to part-time employees. Other companies such as Penguin Random House, financial services firm Baird and law firm Perkins Coie give remarkably consistent responses when asked why their companies provide comprehensive benefits for part-time employees. They are betting that offering full-time benefits to part-time workers will build employee loyalty, boost presentism and stem the tide of job hopping among their workforce. And it’s not just part-timers asking for the benefits: full-time workers who want to shift to part-time work also are asking for the benefit coverages in order to achieve a positive work-life balance.
“In today’s tough labor climate, we want to make sure our workforce represents the community and is able to function on a day-to-day basis and be successful,” Tanguay says. “By offering these benefits in addition to fair hourly compensation, we differentiate UPS and attract a greater variety of applicants.
About half of UPS’s part-time hires each year are students, but the company’s 24/7 operation also attracts parents who choose to work off hours, independent business people interested in supplementing their income and retirees looking to earn additional cash.
Part-time employees must work for the company for one year to become eligible for benefits, and must work at least 225 hours in each subsequent three-month period to remain eligible. “Our typical part-timer works between 20 to 22 hours a week, so obtaining the hours needed to be benefits eligible is very achievable,” Tanguay says.
Most employees are unionized, and part-time union employees are eligible for healthcare, short-term disability, life and AD+D coverage under whatever multi-employer health and welfare fund pays their benefits. About 65 funds in the U.S. provide coverage to UPS union employees, and both full and part-time benefits are paid for via UPS contributions.
“We pay the contributions to Teamsters and they administer the program. As a result, the out-of-pocket costs for our employees tend to be limited to deductibles or co-pays,” Tanguay explains.
In addition, part-time employees are eligible for profit sharing and a stock purchase plan. The retirement plan for non-union employees is closed, but the UPS defined benefit pension plan covers part-time union members and remains open to new participants.
Among the other programs that are attractive to both part- and full-time employees is the “earn and learn” and tuition assistance program, which offers a $25,000 lifetime benefit to employees taking courses toward a degree at an accredited brick-and-mortar or online college or university. “We don’t require that the classes they take or the degree that they are working on be directly related to their job or our business at UPS,” Tanguay says.
By the numbers
ERISA attorney Carol Buckman says that though a repeal of the Affordable Care Act by the Republican-led Congress may be imminent, the ACA currently defines full-time employment as 30 or more hours per week and requires that employers with 50 or more full-time-equivalent employees provide health insurance to at least 95% of their full-time employees and their dependents up to age 26.
And when it comes to ERISA-qualified programs like 401(k) plans, Buckman notes that companies must cover employees who complete 1,000 hours of employment in a 12-month period. Employees cannot be excluded simply because they are part-time and not expected to meet the threshold in the eligibility period. However, she says, “This does not necessarily mean that any employer matching has to be at the same levels for full- and part-time employees.”
Data from the 2016 Mercer National Survey of Employer-Sponsored Health Plans reveals that 51% of large employers (500+ employees) offer health insurance coverage to part-time employees who work an average of 21 hours a week. Sixty-three percent begin coverage for newly hired employees at the date of hire, while 37% have a median waiting period of 60 days.
“Some part-timers are always going to fall somewhere below 30 hours,” says David Frazzini, a partner in Mercer’s San Francisco office. “I think 20 hours is a pretty common threshold that is used by employers.”
While it has been suggested that the 30-hour ACA threshold has been an incentive for certain employers to reduce part-time working hours so they don’t have to offer health insurance coverage, Frazzini says this has not been the case in his practice. But, he notes, “I think there is a lot more discipline now about getting the classifications right to make sure part-time employees are really part-time and full-time employees actually meet the definition.”
It is not surprising that UPS — where more than half of the workforce started out as part-timers — provides rich benefits to employees working less than full-time hours. Nevertheless, there are many notable employers with relatively few part-timers who extend similar or the same benefits to people who meet their minimum hours criteria.
Penguin Random House builds community
One example is publishing company Penguin Random House, which has approximately 5,000 employees in the U.S., excluding temporary workers. Only 1.1% of the company’s employees are part-time benefits eligible. Depending upon the facility, 35 or 40 hours per week are deemed to be full-time employment.
Page McInerney, Penguin’s vice president of HR, explains that benefit-eligible part-timers get all the benefits and perks that full-time employees enjoy, including comprehensive medical, prescription drugs, dental and vision coverage, life insurance, 401(k) match, short-term and long-term disability benefits, and voluntary benefits.
Employee contributions toward health benefits are based on salary tiers, so employees pay more or less depending on how much they earn. Other “soft” benefits, such as personal days, holidays and various other leaves, are pro-rated based on each individual’s scheduled hours.
Why does Penguin Random House provide such robust benefits for its small contingent of part-timers? “At PRH we are a community, and offering comprehensive benefits to our part-time colleagues is another way we can nurture a community feeling and team culture across the country,” McInerney says.
Best companies to work for
The list of 2016 Fortune 100 Best Companies To Work For reveals that most of the companies ranked in the top 40 that employ part-time workers offer them a benefits package. That said, eligibility and program details vary significantly.
Take law firm Perkins Coie, which is ranked 39th on the list. Though its headquarters are in Seattle, the law firm’s 2,180 employees work in 16 offices across the country. Eighty-seven percent of lawyers and support staff are full-time. “The reality is that we don’t generally hire people part time. They request a move to part time,” says Darrin Emerick, chief personnel officer. “It’s a way to retain our highly valued people, whether it be new moms who want to spend more time with their babies or older workers who want to slow down.”
The company pays 100% of healthcare coverage for employees who work 25 hours a week or more. Eighty percent of premiums are covered for people working 18.75 to 24 hours per week.
Part-timers also are eligible for a host of other perks and programs, including 401(k) matching at the same level as full-time employees, tuition reimbursement, paid maternity leave, back up child care and sabbaticals.
Emerick says the part-time benefits program helps the firm attract and retain the attorneys and staff it need to support its clients. “Specifically on the attorney side, allowing people to retain benefits when they work part-time has been truly valuable,” he says. “Otherwise we would have lost them.”
Financial services firm Baird is ranked sixth on Fortune’s list. Headquartered in Milwaukee, the company has offices in 30 states, plus satellite offices in the U.K., Germany and Asia. Ninety-seven percent of the company’s staff of 3,200 is full time.
To be eligible for healthcare benefits, employees must work 24 hours per week. Baird associates’ health insurance premiums are based on their compensation level, so associates who earn less pay lower premiums. Depending on the tier, Baird pays from 57% to 97% of each associate’s health plan premium.
Part-timers also are eligible for a 401(k) match, profit-sharing up to 4% of salary, college tuition reimbursement of up to $5,250, long-term care insurance and 16 hours of paid time off to volunteer. Other perks to make life easier for all employees include everything from fitness classes, a hair salon and a personal concierge service to Weight Watchers’ meetings.
But what really sets Baird apart is its program for paid interns. Interns who work only in the summer are classified as short-term interns. However interns who work full-time in the summer and part-time during the school year are viewed as long-term interns and get enriched benefits as a result.
Lisa Mrozinski, Baird’s director of total rewards, explains that long-term interns do not receive health insurance. However, she says, “they get paid holidays, and they can participate in our Baird Cares Day, where employees go into their communities to volunteer. They also get a $1,000 tuition reimbursement benefit, are considered for small year-end bonuses and become eligible for the 401(k) plan, plus employer matching if they work 20 hours a week.”
Why is Baird so progressive? “If employees are working part-time and adding value to the organization, we view them in the same way as any of our full-time associates,” Mrozinski says.
