A set of tunnels puzzling Singapore, sparking numerous conspiracy theories about its origins since the late 20th century, has its mystery finally cracked. Located on Admiralty Road West and Marsiling Crescent, the World War II-era tunnels have remained hidden from sight since the British left Singapore. 
Since the tunnels' discovery in the 2000s, multiple theories have been proposed about their origins. Some thought the tunnels led to Johor, or housed an underground facility for a nearby mental hospital. The most compelling theory was that the tunnel had been an underground oil storage facility built by the Asiatic Petroleum Company (APC) for a British Royal Navy base. A 1945 map showed the location of Woodlands North Depot, once operated by APC, on the exact location of the tunnels. 
At an impressive 54 square kilometers, Her Majesty’s Naval Base occupied almost 10 percent of Singapore’s land size in the 1940s and was formerly the largest British military base in Asia. The former base is now home to Sembawang Park and Woodlands Waterfront Park. 
While the evidence was compelling, the theory was slightly off. By obtaining information from disclosed documents, British Wartime Intelligence Reports, and the U.K.’s National Archives, Singapore’s National Heritage Board solved the mystery of the Marsiling Tunnels' true origin and purpose. They have been verified as a pre-WWII fuel reserve depot utilized by the Royal Air Force, not the British Royal Navy. 
During their occupation of Singapore, the Imperial Japanese Army utilized the tunnels as an oil storage facility. According to a 1944 British intelligence report, the tunnels were renovated to have five large tanks, increasing their capacity by over 5,250 tons. 
In 2014, on the 72nd anniversary of the Battle of Singapore, the tunnels opened to the public for the first time. The National Heritage Board offered guided tours to show how the British surrendered to Singapore to the Japanese. These tours also included important historical locations like Opium Hill and Tiong Bahru Air Raid Shelter. Today, most entrances have been sealed and are closed to the public, but a small entrance found by local explorers remains open.

Maryland: This morning at approximately 01:30 am, the M/V DALI struck a support pylon for the Francis Scott Key Bridge, causing a significant portion of the bridge to collapse. A mass casualty event was declared for the estimated 7 vehicles and 20 construction workers that fell into the water with the bridge, and SAR operations are ongoing as of this report.

Analyst Comments: At this time, there is no clear cause for the collision. However, observers noted that the ship appeared to lose power or be experiencing some issue in the seconds before the impact. The DALI is a Maersk-operated cargo vessel flagged in Singapore.
As the Francis Scott Key Bridge collapse occurred in one of the busiest ports on the east coast, the logistical impacts will almost certainly be significant and immediate. The bridge debris has almost completely cut off the Port of Baltimore to outside traffic for the foreseeable future. Baltimore was one of the top logistical hubs for Roll-on/Roll-off (RORO) vehicle carrying cargo ships. As no cargo vessel can reach the RORO terminal now, these vessels will be required to offload cargo at other ports on the east coast.
The unspoken elephant in the room is the question of whether or not the collision of the M/V DALI was intentional, or an accident. The immediate follow-up question is: if this was an intentional act (via a cyberattack of navigation systems, which have been increasingly vulnerable to GPS spoofing and other exploitations), was this a shadow-war retaliation for the Crocus shooting in Moscow? Or was this incident somehow linked to Chinese cyber efforts, which have crippled varying sectors of American infrastructure over the years? These questions cannot be answered at this time, nor are any substantial details expected to be made public due to the very long and in-depth maritime investigation process. However operational prudence would indicate assuming nefarious intent. As such, though the average person cannot prevent any hostile act on critical infrastructure, workers in many career fields absolutely can. Heightened situational awareness is overwhelmingly recommended for personnel working in career fields by which large industrial incidents can disrupt civilization. In a 5th Generation global war, the people that keep society functioning are often the first, and last, line of defense against major incidents like this.
For the average citizen, this is a reminder that preparing for mass casualty events at this time of exceptionally heightened international tensions would be a wise move. Bridges, tunnels, railway crossings, road junctions and interchanges, high-rise buildings that are convenient geographic landmarks, submarine cable landing points, POL storage facilities, telecom hubs, electrical substations and power generation facilities, water treatment plants…all of these facets of our society are exceptionally vulnerable to both accidents, and nefarious intent. Planning for either event is a wise move in the event that any malign actors have a “nasty surprise” in mind for the homeland.

US and allies warn Houthis of "consequences" if attacks on ships continue

The U.S. and its allies issued a firm warning to the Houthi rebels in Yemen on January 3, telling the group to stop attacks on ships in the Red Sea or face "consequences".
“The Houthis will bear responsibility for the consequences if they continue to threaten lives, the global economy and the free flow of trade on the region's critical waterways,” said a joint statement from the U.S. and 12 other countries.
As of January 2, the Iranian-backed Houthis have carried out 24 attacks on commercial ships in the Red Sea since November 19, according to the U.S. Central Command (CENTCOM). The crew of 25 people on a ship has been held captive since November.

The U.S. wanted to "send a very clear warning to the Houthis," a senior administration official told reporters on January 3.
The Houthis began attacking Red Sea ships following the war between Israel and Hamas. The Houthis said they defend "our brothers in the Gaza Strip".

The Houthis attacked commercial ships with drones, small attacks on boats and missiles, including the "first time that anti-ship ballistic missiles were used anywhere, much less against commercial ships," according to the senior administration official.
The U.S. defended itself against Houthi attacks with Navy fighters and missile defense systems. British and French ships also shot down drones launched by the Houthis.

The U.S. military has prepared attack options against the Houthis if the Biden administration decides to use force against targets in Yemen, according to U.S. officials.
British Defense Secretary Grant Shapps said the United Kingdom is “willing to take direct action” if the attacks continue.
“I would not expect another warning” before the U.S. could take more energetic measures, added the senior U.S. administration official.

The U.S. military recently used force against the Houthis in self-defense. On December 31, four small boats fired at U.S. Navy helicopters that came to the aid of a commercial ship under attack. The helicopters responded, killing members of the group and sinking three of the boats, according to the senior administration official and CENTCOM. The Houthis said that 10 of their members were killed in this incident. The senior government official said that the Houthis could be trying to kidnap the ship or damage it in a suicide bombing.

"The ongoing Houthi attacks on the Red Sea are illegal, unacceptable and deeply destabilizing," says the statement by the governments of the United States, Australia, Bahrain, Belgium, Canada, Denmark, Germany, Italy, Japan, the Netherlands, Singapore, New Zealand and the United Kingdom warning about the case. "May our message now be clear: we call for an immediate end to these illegal attacks and the release of ships and crews detained illegally."
An emergency meeting of the United Nations Security Council was held on January 3 to discuss the Houthi threat. The president of the Joint General Staff of the Air Force, General Charles Q. Brown Jr., spoke with his UK counterpart, Admiral Sir Tony Radakin, on January 3 and "discussed the illegal Houthi attacks underway," according to a reading of the Call of the Employees Set.
"I think this demonstrates that the U.S. and its partners are trying to operate responsibly, but that there is a limit to the behavior they are willing to accept," said retired Army General Joseph L. Votel, who led the 2016-2019 CENTCOM.

The Houthis have missile and drone launchers, coastal radars and weapons storage facilities that could be targeted if the U.S. or other nations decide to use force.
The U.S. launched a limited salvo of cruise missiles at three coastal radar sites in Yemen in 2016, in response to attacks on Houthis ships during Votel's time as commander of CENTCOM.
“The message is considered, as would be expected, but it clearly highlights that there are consequences associated with continuous attacks and that these nations will hold evil actors accountable,” said Votel, an illustrious senior member of the Middle East Institute. He added that the declaration “emphasises the importance of taking advantage of all forms of national power, in this diplomatic and informative case, to put pressure on the Houthis and their Iranian supporters”.
Iran and the so-called Axis of Resistance of groups aligned with it launched attacks in the wake of the Israel-Hamas war. But some U.S. officials and regional security experts say that the Houthis are more unpredictable and hard-lined than other groups supported by Iran.

Ships run a particular risk near Yemen because they have to use the Bab el-Mandeb Strait to cross between the Red Sea and the Gulf of Aden, a critical bottleneck.
“Almost 15% of global maritime trade passes through the Red Sea, including 8% of global grain trade, 12% of oil traded by sea and 8% of world trade in liquefied natural gas,” the joint statement noted.
The U.S. launched the multinational Operation Prosperity Guardian in December to help defend against the Houthi attacks. American F/A-18 fighters from the aircraft carrier USS Dwight D. Eisenhower slaughtered Houthi drones. Sometimes, U.S. Air Force fighters have been active in the Red Sea, said a senior U.S. defense official. The U.S. is also known to operate MQ-9 drones off the coast of Yemen, and the U.S. and the UK have operated P-8 maritime surveillance aircraft in the region in the past.
"Especially when it comes to awareness of the maritime domain, air power is always a significant contributor to this," said Pentagon press secretary, Major General of the Air Force, Patrick S. Ryder, on December 21.
The Red Sea and the Mediterranean Sea are connected by the Suez Canal, but commercial cargo ships have been forced to redirect their ships around the Cape of Good Hope, off the southern coast of Africa, causing significant delays and costs for the global economy.

“These attacks threaten innocent lives around the world and constitute a significant international problem that requires collective action,” the joint statement states. "We remain committed to the rules-based international order and are determined to hold evil actors responsible for illegal seizures and attacks."

SESSION 1. INTRODUCTION TO INFOCOMM TECH LAW IN SINGAPORE
OPTIONAL READING: ICT LAW IN SINGAPORE CHAPTER 1
OPTIONAL REFERENCES: LAW AND TECH IN SINGAPORE CHAPTERS 1-3
A. COURSE DESCRIPTION AND OBJECTIVE
New economies have emerged within the last two decades including digital models of transaction and disruptive innovation. Internet intermediaries generally are taking on a major role as facilitators of commercial and non-commercial transactions online. These include social networking platforms (e.g. Facebook, IG and Twitter), multimedia sharing platforms (e.g. YouTube, Apple Music and Spotify), search engines and news aggregators (e.g. Yahoo, Google), content hosts and storage facilities (e.g. Dropbox) and many others. Content generating platforms such as TikTok have also become popular even as cybersecurity concerns and other misgivings have emerged at the governmental level in some jurisdictions.
In the last few years, the use of Internet of Things (IoT) have become quite common in advanced economies, the latest being wearable devices for the 'Metaverse' and an even more immersive experience in the digital realm. Artificial Intelligence (AI) is also becoming more visible at the workplace and at home, leading to ethical concerns and a slate of guidelines globally to 'govern' its development and deployment. Most recently, interest in generative AI (GAI) emerged from the successful launch of chatGPT and other similar services.
Policies and laws have been adapted to deal with the roles and functions of Internet intermediaries, IoT and AI devices and services, and their potential effects and impact on society. Regulators in every jurisdiction are faced with the challenge to manage the new economy and players, and to balance the interest of multiple parties, in the context of areas of law including intellectual property, data protection, privacy, cloud technology and cyber-security. Different types of safe harbour laws and exceptions have emerged to protect these intermediaries and putting in place special obligations; while some forms of protections have been augmented to protect the interests of other parties including content providers and creators as well as society at large. Students taking this course will examine the legal issues and solutions arising from transactions through the creation and use of digital information, goods and services ('info') as well as the use of non-physical channels of communication and delivery ('comm').
The technological developments from Web 1.0 to 2.0 and the future of Web 3.0 with its impact on human interaction and B2B/B2C commerce as well as e-governance will be examined in the context of civil and criminal law, both in relation to the relevance of old laws and the enactment of new ones. In particular, this course examines the laws specifically arising from and relating to electronic transactions and interaction and their objectives and impact on the individual vis-à-vis other parties. Students will be taken through the policy considerations and general Singapore legislations and judicial decisions on the subject with comparisons and reference to foreign legislation where relevant.
In particular, electronic commerce and other forms of transactions will be studied with reference to the Electronic Transactions Act (2010) and the Singapore domain name framework supporting access to websites; personal data privacy and protection will be studied with reference to the Personal Data Protection Act of 2012 and the Spam Control Act; the challenges and changes to tort law to deal with online tortious conduct will be analysed (e.g. cyber-harassment under the Protection from Harassment Act (2014) and online defamation in the context of online communication); the rights and liabilities relating to personal uses of Internet content and user-generated content will be considered with reference to the Copyright Act (2021); computer security and crimes will be studied with reference to the Computer Misuse Act (2017) and the Cybersecurity Act (2018); and last, but not least, Internet regulation under the Broadcasting Act and its regulations as well as the Protection from Online Falsehoods and Manipulation Act (2019), the Foreign Interference (Countermeasures) Act (2021) and the Online Criminal Harms Bill (2021) will be critically evaluated.
You will note from the above paragraph that there have been an acceleration in the enactment of ICT laws and amendments in recent years, which shows the renewed focus of the government and policy-makers when it comes to the digital economy and society (as we move towards a SMART Nation). This is happening not online in Singapore, but abroad as well. In such an inter-connected work with porous jurisdiction when it comes to human interaction and commercial transactions, we have to be aware of global trends and, in some cases, the laws of other jurisdictions as well. When it is relevant, foreign laws will also be canvassed as a comparison or to contrast the approach to a specific problem. Projects are a good way to approach in greater depth.
B. CLASS PREPARATION FOR SESSION 1
In preparation for this session, use the online and library resources that you are familiar with to answer the following questions in the Singapore context (and for foreign/exchange students, in the context of your respective countries):
What are the relevant agencies and their policies on ICT?
What are the areas of law that are most impacted by ICT?
What is the government's position on Artificial Intelligence?
What are the latest legal developments on this field?
Also, critically consider the analysis and recommendations made in the report on Applying Ethical Principles for Artificial Intelligence in Regulatory Reform, SAL Law Reform Committee, July 2020. Evaluate it against the second version of the Model AI Governance Framework from the IMDA. Also, look at the Discussion Paper on GAI released on 6 June 2023. Take note of this even as we embark on the ‘tour’ of disparate ICT topics from Session 2 onwards, and the implications for each of those areas of law that will be covered in class.
C. ASSESSMENT METHOD AND GRADING DISTRIBUTION

Written Exam 60% (2 hour open book examination)
This course will be fully conducted in the classroom setting. Project groups will be formed by week 2, projects will be assigned from week 3, and presentations will begin from week 4 with written assignments to be due for submission a weeks after presentation. Further details and instructions will be given after the groups are formed, but before the first project assignment.
D. RECOMMENDED TEXTBOOK AND READINGS
The main textbook is: Warren B. Chik & Saw Cheng Lim, Information and Communications Technology Law in Singapore (Academy Publishing, Law Practice Series, July 2020). You can purchase the book (both physical and electronic copies) from the Singapore Academy of Law Publishing (ask for the student discount). If you prefer, there are copies available in the reserves section of the Law Library that you can use. The other useful reference will be: Chesterman, Goh & Phang, Law and Technology in Singapore (Academy Publishing, Law Practice Series, September 2021).
Due to the rapid pace of development in the law in some areas of analysis, students will also be given instructions and pre-assigned readings via this blog one week before each lesson. Students need only refer to the SMU eLearn website for administrative information such as the Project Schedule and the Grade Book as well as to share project papers and presentation materials. Students will be expected to analyse legislative provisions and/or cases that are indicated as required reading for each week.
