When Imitation Isn't Flattering ~ Part II

In April of last year we discovered that a photographer in Sonoma had stolen the written content of our web site and proudly called it her own. I wrote (at length) about the impact this had on us in Part I. Here's where we left off . . .

  On Mon, Apr 9, 2012 at 5:05 PM, In Her Image Photography wrote:

"Dear Ms. ______ ,

It has come to our attention that the written content you are using on your web site contains plagiarized content illegally copied directly from our web site, www.inherimagephoto.com . . ."

  Since we first published Part I of this story, we've been contacted by several local photographers shocked that this could happen in our community. If anything good has come out of this experience, it's that we feel that much more connected and supported by industry colleagues in our area.

It's easy to feel like those around you in your trade are "competition" and you know what, they are. But dealing with "competition" is an essential part of managing your own business. How you choose to deal with competition is up to you. You can ignore them, compare yourself to them, separate yourself from them, collaborate with them, mentor or be mentored by them . . .

  "While doing our own comparison, we were astounded to see the level at which you plagiarized our copy, down to your bio section. [I kid you not, she used parts of our About Us section to describe herself] Given that this is our full-time business and our sole means of earning a living, we are fiercely protective of all of our images, business strategy and vision. To see another colleague have such flagrant disregard for our work is seriously disappointing. We will move forward with every effort to prevent the continuation of this theft . . ."

  One of the hardest things about writing Part I of this story was leaving the culprit's name out. I really struggled with that. I didn't want any other photographers in our area, ones who have built their businesses from the ground up, to be implicated or under suspicion. I wanted to protect these professionals, to let the world know it wasn't them who broke the law. I polled the team, however, and ultimately, we decided it would be best to leave her name out (even though we have every legal right to publish what is true). A big part of me struggles with the notion that women have remained silent victims for too long by being nice. But I am trying my best to let compassion rise to the forefront of this experience. Admittedly, it's not easy. 

  "We understand that there are things that are universally appropriate for a photography business and not all concepts can be copyrighted. However, we took the time to develop and implement our own pricing, session descriptions, policies, frequently asked questions, etc. and we ask that you take the time to, as well, rather than illegally copy and paste from our web site . . ."

  I give this advice to every entrepreneur who is just starting out on their own business journey: forget everything your industry is doing and be original. Build your business from the perspective of your client's needs. Go out of your way to make your competition notice you and ask themselves, how the hell did they do that? And most importantly, tell your story. Everyone has a choice to make about who they give their hard-earned money to. Make them feel good about using you as a service. Tell them who you are and what matters to you most. Your business should be made up of you. If it's not, you might tire of it sooner than you think. That's what fosters originality. Make your business uniquely YOU.

What follows is her response to my cease and desist letter (in its entirety, to be fair). It's only fitting that I add my own commentary in brackets, which I wholeheartedly admit, gets a little colorful.

  "Tara- Thank you for your email and please accept my sincerest apologies, I truly never meant to completely plagiarize your work [Is partly plagiarizing more forgivable?], only to derive inspiration from which now looking upon, I regret to say was in poor taste on my end. [Extraordinarily poor taste, yes, and also illegal.] 

In a hustle to create a website and get things moving for my own business [EIGHT YEARS it took for IHI to be where it is today], I was hoping to model my site after someone's who I have so much admiration for. [Had she come to us FIRST and said, "Hey, I love your work, I'm just starting out, can I get some advice?" we would have happily mentored her, at no cost . . .  out of the sheer goodness of our hearts and desire to encourage other female entrepreneurs . . . ] 

I merely hoped it would serve as a template for me [We paid quite a bit of money for our web site up front, and continue to pay a regular fee, it took MONTHS to create its content] to shape and create for my own as I'm attempting to build my business and find my niche in the photography world. I'm new at this and am ever growing (and ever falling on my face)...please know that I have taken down my pricing section and FAQ and checked to see if there were any other parallels. If you disagree and think anything else needs to be changed, please feel free to reach out. [She deleted her FAQs completely, as they were stolen from ours and under her Pricing section, she took down all of her packages - also ours- and replaced it with a photo of an aloe vera plant with the word "Namaste" written at the bottom, telling people to "Contact Me" for pricing.] 

Please know that none of this was done in malice [I think it was done out of laziness and inexperience, lack of creativity, dishonesty, and unprofessionalism], and that I sincerely apologize and appreciate you coming to me first [We actually went to a lawyer first, but ok.]. I so do admire and appreciate the work that you do and hope to someday have the following and the true fans that you do. [Your TRUE fans will only be so when you tell the truth of who you are, not when your business has been built on a lie.] I know it's a difficult road, and one that I must travel down alone [Which is unfortunate, because you live amongst a wealth of seasoned talent who you chose to alienate yourself from with your actions]. I know now, the seriousness of my actions [Until it happens to you, I'm not sure you can totally understand the impact] and forge forward through my own voice.

  I'll leave it up to you to measure the accountability of such an apology. Please know that she has only removed information from her web site and we have no idea what she's sending to potential clients that may or may not be our intellectual property. She has admitted nothing publicly, nor made any mention of any of this to her "true fans" on her Facebook page. The congratulatory messages about her [stolen] web site remain on her FB page . . .

      I often wonder . . . Can you be truly accountable if you wait to be caught? Does an apology hold weight if it's been forced and you have no other choice but to say you're sorry? If you've gotten away with something publicly and only been called on it privately, do you have a responsibility to inform your potential clients and community of your actions? Don’t you have a right, as a consumer, to be made aware of any illegal activity of a business that you patronize? Would knowing any of it influence your decision to use them as a service? What is justice and when is it truly served?

Clearly I have more questions than answers . . . 

This isn't an easy story to tell. If it inspires discussion, then we are thrilled. 

We will carry on with our initial vision, with you remaining nearest to our hearts and influencing our actions every step of the way. We can promise you that we will always be ourselves. We are eternally grateful to be surrounded by and existing alongside such an incredible community.
