New Garmin Forerunner 620 arrived. Sold off my 910XT (for the second time) when I realized I was really only using it for running. It blows my mind how much a running GPS watch looks like a normal watch. I remember the old Forerunner 305 and how it looked like I had some robotic laser shooter on my wrist.

My Experience with the Puppy Lemon Law

I successfully sued someone for the first time in my life last night. Not something to really brag about as I don't want to be lumped into the BS litigation happy crowd. I figure others would get value understanding this experience/process so here's the details of what went down.
The story starts on Sunday, June 16th. While waiting for our train home, The Wife and I walk up and down Atlantic Ave in Brooklyn doing some sight seeing to pass time. We randomly walk into a pet store where she spots a King Cavalier sleeping and wants to check it out. She holds the puppy in her arms and 45 minutes later, we spontaneously buy a puppy. Classic case of the Puppy Dog Close. As The Wife was holding the dog, I did remember thinking to myself that the dogs eyes looked really watery and she had a lot of snot on her nose.
The next day, Monday, we start noticing the dog coughing heavily. We didn't think too much of it since it may have been kennel cough and figured the vet could check it out since we made an appointment on Tuesday morning to have the dog checked out during that initial 48 hour "warranty" window. The couging progressively gets worse through the day. By Monday night, the couging is clearly uncomfortable to the point that the dog is visibly shaking. If we didn't have the appointment already scheduled for Tuesday morning, we would have brought the dog into the ER anyways.
The dog is admitted and blood tests/x-rays indicate a bacterial pneumonia infection. The dog is immediately put on anti-biotics and has to stay over until further notice. All of this sounds expensive so we request an estimate on the bill and it is at least a stack ($1000). I call the pet shop and the guy who picks up says to bring the dog back to Brooklyn so they can have their own vet look at it. I tell him that's not possible since the condition of the dog would prevent it from any travel and the dog was already admitted and on IVs at the pet hospital. I ask about compensation and he says to send him the bill and he'll look at it.
The puppy gets getter (thankfully) but we were stuck with a $1200 vet bill. I wasn't sure at the time but I thought there had to have been some kind of consumer protection law for the purchase of pets. After some research, I find out that there are puppy lemon laws that differ by state. For reference:

In my specific case, New York covers the purchase of pets for 14 days where any vet fees can be recovered up to the purchase price of the pet. The pet doesn't have to be surrendered and reimbursement has to occur within 10 days.
I send a copy of the invoice with breakout of the charges, a letter signed by the vet saying the dog was sick prior to purchase and a letter requesting the pet shop reimburse me for the charges while referencing the NY law. A copy is sent via Fax and Certified Mail. I waited for a month and received no response.
I then researched what the next course of action would be and came across the NY Small Claims Court system. For $20, I could file a claim against the pet shop and have the court decide/mandate whether or not I should be reimbursed. This was filed toward the end of July and the court date was set for Nov 21st. For $1200, filing a claim for $20 and driving back to Brooklyn to pursue it was a no-brainer.
Fast forward to yesterday. I arrived at the court and go into a holding room with about 200 or so other people. A man enters the room and starts reading off the cases and names involved as a sort of roll call. If both claimant and defendant are present, they can either request a judge preside over the case rather than an arbitrator or have the hearing moved to another date. Most people went w/ the arbitrator presumably because they didn't want things to drag out. If the claimant wasn't present or both parties were not present, the case was dismissed. If the defendant was not present, the claimant was granted Inquisition which basically gives a favorable judgment as long as you made a reasonable case to the judge. It was interesting to see what people filed small claim complaints for including: bounced return deposit checks from the landlord, services not rendered for parties, damaged dry cleaning, damaged iPhones and in my case, issues with pet purchases.
As I was waiting for my case to be called, it was a bit of an adrenaline. I wasn't nervous per say but I think the "unknown" of how it would go was a bit of a rush. I could feel my heart racing and the best way to describe it was the feeling you get on a rollar coaster right before it races down the first steep descent. My case was eventually called. I yelled my name to confirm attendance and to my delight, no response from Pet Slope meaning they didn't arrive! I was sent to inquisition in another room to state my case to a judge. That whole sequence took about 5 minutes as I had a copy of all of the paperwork/dates/etc. The judge ruled in my favor and issued a judgment for the Pet Slope to reimburse me for the $1200. Winner!
Now the fun part is actually collecting the money back from the pet store. A copy of the judgement will be mailed to both myself and the pet store but I still have to get the pet store to pay. The ball is in my court for the first volley but if I run into issues, there's a number of things that can happen.
I'd rather have not gone through all of this hassle but the experience itself was extremely educational is learning how the small claims process works and getting some exposure to the court system. I will say I have even more admiration for my friends that are lawyers and do much more complex stuff.

This is crazy. Millions of people have been through medical school. Millions of surgeries on knees. Millions of books on human anatomy. Yet, somehow surgeons find a knee ligament that previously was unknown. This absolutely blows my mind and a good reminder that we should always think critically even on things that seem like an absolute truth.

One area I really need to work on this offseason is strengthening my posterior chain to help with efficiency and injury prevention. The program I'll be trying is Foundation by Eric Goodman. I'll post thoughts on it later as I get into it.
