Is It Possible To Work In Australia While My Partner Visa Application Is Still Processing?

Bridging visa is granted upon the lodgement of Partner visa application whilst the applicant is present in Australia. Immigration to Australia as a partner of an Australian Citizen or PR is only possible following the conditions.

If a Partner visa is lodged while outside Australia, Can I get a Bridging Visa to stay with my partner?

No. A bridging visa application can only be approved and come into effect whilst you are Onshore (physically present in Australia) This Bridging visa for Australia works like a bridge between the already existing visa you hold, and the pending decision on your partner’s visa that’s applied for. 

However, if you are out of Australia and you can choose to lodge a 309/100 (Offshore) Partner visa application or a 300 (Offshore) Prospective Partner visa application, you would be eligible to enter Australia only once it’s granted. 

To enter Australia before being granted an offshore Partner visa, you should meet all the requirements of other visa types like visitor visa.

Does bridging visa start immediately after lodging Partner visa?

No. Once you lodge the Onshore Partner visa application and once that application gets acknowledged, the Bridging Visa A (BVA) is issued by immigration. However, this BVA will not be in effective until the current visa expires.

If I have applied Partner visa, can I work for over 6 months on my existing 417 Working Holiday visa?

No. You have to obtain permission for extended work right to do so. If you’ve already lodged your Partner visa but you still have a few months left on your 462 or 417 visa, a requested for extended work right can help you to remain with the employer until your Partner visa is decided. 

But, if the visa expired within a few days or weeks post 820 Partner visa lodging, the 6-month limitation resets on your BVA. 

However, because most 820 Partner visas take 12 to 15 months for processing, your migration agent Perth would always suggest obtaining permission for extended work rights anyway.

Permission to work beyond 6 months on 462 or 417– What is it?

This permission helps when you want to lift the existing work restrictions on the current visa you hold. You can lodge a specific form to the immigration and get it. However, you can only apply for it when you have already lodged another visa like onshore Partner visa. For approval, it takes between 2-3 weeks. But, ensure that you meet all the conditions of the existing visa until your waiver is accepted and approved.

Whilst on student visa, if I lodge a Partner visa, can I start working full time?

You have to meet all the conditions of the effective student visa. Once the student visa expires, you can be on BVA associated with the lodged Partner visa. You can then work full time. However, whilst your student visa is in effect and if you don’t attend your classes, your student visa may be cancelled.

In case your student visa is cancelled while your 820 onshore Partner visa is still processing, you would go on a Bridging Visa E (BVE).

I hold 457 visa and applied for 820 onshore Partner visa. Can I work for someone else other than my sponsor?

No. You must stay on 457 visa until expiry or until the Partner visa is decided. If the 457 visa is cancelled whilst the 820 onshore Partner visa is processing, you would be on BVE. 

As a result, you will not have travel rights on BVE and the same doesn’t grant work rights. You may try to make an application to waive the “No Work Rights” by expressing severe financial hardships you may incur by not being allowed to work. 

Additionally, once on BVE, the citizenship value resets – it means that the time you spent in Australia before BVE doesn’t count towards the 4 years that are required for living in Australia continually.

If I hold a visitor visa and I lodge a Partner visa, can I still work?

You have to meet all conditions of the visitor visa while effective. Once the visitor visa expires, you can be on BVA associated with lodged Partner visa, and work full time. You can also choose your employer, work full time or part time, or contractual basis.
