I was asked by one of backers. And here’s answers I sent. 

Questions:

4) I did found your comment on Kickstarter from April 2017. Why didn't you e-mail the backers with all this info back then?

5)  Do you have actual evidence to back up your claims? Best proof might be showing the actual works that you made for this project (especially if you have some source files that Paul wouldn't have). 6) Even if the entire XShifter Kickstarter community believes you, what can we do about it? I am just wondering what are you after, over a year later? You mentioned it's not about the money, so I would guess it might be about your hurt pride (since he talks shit about your work)? But curious why you start this "e-mail campaign" quite a while later, not before?

Answers:

4) I was gagged. He refunded my pledge and my friend’s pledge so that I can’t leave any comments anymore. And yes, I didn’t take that path because of my pride. I didn’t wanna interrupt anyone for any reasons. But as you can see, I’ve been deeply traumatized by the experience Paul presented me, I couldn’t stop checking on XSHIFTER page. And, there’s few days I finally decided to act on it. Because I could convince myself it is not only serve my interest but also every backers who believed in him and his product. Yes it is my last resort, finally doing it after awful 20months.  

5) I do have the hard evidence. But I am setting up the scene for now. I want it to be as impactful as possible. On the blog, as you see I am accumulating the facts and a little evidence to fight back with Paul’s main reason not to pay me: “the campaign was a disaster.” I didn’t get paid and now I am marked as a worst marketer? That I cannot bear. It’s just like a blog. I am putting all the things out to prove ‘my point’ and defeat his claims. Then, I will represent hard document as evidence. Again, I am not asking him for anything. It is too late for that. I am here to say what he did, and wait for you guys’ verdict on it. I see as a trial.  Simple as that. I only wanna pursue the truth.

6) You’re right. the pride and the truth. He has the voice now thanks for the hard works. But I am not. I am not sure if you remember, back then everyone loves Paul, almost like an idol. I knew it wouldn’t work back then. I waited for the perfect timing. As ***** said, he suspected from Paul's unexpectedly negative response on his comments page. I waited that. I know him worked 4 months together. I knew how hard he tries to be nice, he will eventually reveal his true nature. 

Paul might think he’s already won over all the trust in the world. But the truth is not. I will present hard evidence one by one.

Correspondence

Paul messaged me via Wechat app. Last message was sent by me on 2017 January 9. However my last message couldn’t go through because he blocked me. 

I have revealed the true story. And he did reveal himself. I’d like Paul to know, whatever he has done and whatever he says to any individuals, the consequences will follow, no matter how you “feel” about it. You are who you are today because of backers and the team who helped the campaign.

I am here to tell the truth. How people might think of me is irreverent in a broad sense. I am writing all the facts and evidence for those who might be interested in learning the truth and facts about you. Nothing more and nothing less. 

By the way, “dark alley”? such an interesting solution. Are you threatening me? Should I be threaded by you, Paul? Seriously.

Paul’s email from 2016 Dec 22, The day he refused to pay the remaining.

This is the letter sent by Paul on December 22, 2016.

Let’s dive in:

break even point on the campaign was $150,000

 - There’s nowhere in the contract says, we guaranteed to raise a certain amount of funds. Period. 

I received less than $130,000

-So Paul you got the funds less than $130,000. That makes you have a right to refuse to pay your bill? 

I had to expand the product line in an attempt to increase sales.

- Do I, or does backers really need to take the responsibility for that? who’s in charge here and who’s the “inventor”?

Now I am in a situation where I am seriously underfunded to launch this product. 

- If it is the truth all along from 2016 December, He’s not being honesty with backers since the beginning. You can hide from one person but you cannot hide from people who actually support you and paid you. They are the master you need to serve. 

Additionally, I had to pay significant additional fees and costs that were completely unplanned for.

- By the way, he used the word “extortion” in other correspondence email. At this point, I am the criminal and he should have taken me to the court. But He didn’t. Because the team i worked with came out with a bunch over new strategies and plans according to the real situation. We merely presented the options so you could have more choices. It was Paul who decided on it. Common sense. 

This was clearly defined by the other marketing companies that quoted this project.

- Irreverent. 

So when you add all my costs including your 15%, I end up with more than $50,000 costs to net $110,000. This is a failure by any definition.

- I am not his accountant. Paul was down to all the plans he listed above. Again, irreverent to the contract we had. 

I contracted with you as a professional marketing agency to deliver on your promises. You did not deliver.

- So this is the part Paul keeps emphasizing. The reason he doesn’t need to pay the remaining service fee all because he “thinks” the whole campaign was a “disaster”, his word. I’’m going to say this very clearly, you pay for what you sign up for. Contract. The service was provided and the campaign was a mega hit globally.  

I’d like to ask every backers. Paul thinks “You did not deliver” as a marketing/production team. Funny choice of word. I and my previous team delivered to you, 510 backers and $142,483, the business. And you already refused to pay the service as the contract says. Then, here comes the question:

Paul’s delivery date, March 2017 is a way passed. He did not deliver. Can 510backers ask you for the refund? Paul, Are you going to refund your backers? 

I think he should. According to your logic, The backers have a full right to ask for the refund no matter whatever Kickstarter policy says. Because Paul, you did not deliver. However though, I delivered the successful campaign. This is the fact.

Let’s dive in

In my Opinion, they were paid in full. 

- No need explain to much. Once you hear “in my opinion”, we know what’s upl. I am here to say, Paul didn’t pay me in full for the service i provided, knowing that the consequence if i’m lying. 

In fact I felt very cheated by the work they did.

- I felt. again, I am here to present all the facts happened to me, done by Paul. The feeling is not the reason or excuse not to paying the service, Paul. I am very much go deeper on this topic, because I and my ex teammates did a fantastic job. 

I had to invest many thousands of dollars into additional marketing, 

- Which Paul approved. 

and I was also working nearly 24/7 for that month because they were completely unprepared for the campaign.

- We knew what we were doing, the proof is everywhere. And also, whole team, 4 people did overtime(12+hrs everyday) for 4 months. 

He thinks I still owe him money from the contract. 

- It’s the fact.

It is a relatively small amount of money. 

- He owes the marketing company 15% of what’s raised, $21,372.45. And, 7.5% is my portion, as a company partner. Again, I am not doing this to get what’s needed to be paid. I am here to tell everyone Paul’s wrongdoing, and his nonsense. 

He had every chance to take this to Hong Kong arbitration but he did not, apparently based on legal advice. 

- There are 3 lawyers I consulted and all said, the arbitration is a long game. And the estimated cost is a much as Paul owes me, it could be more. I did 4 months of the campaign and didn’t get paid. I couldn’t afford the lawyer for the arbitration. That’s the fact. 

the contract forbids disclosing private details. They apparently have no regard for contracts.

- I can. That’s the hard evidence.

- I was very clear from the beginning and every blog I wrote. This is me taking actions on Paul. I left that company almost 15 months ago. There’s no association or whatsoever now except my ex partner also is the victim of Paul’s wrongdoing.

What happened on day 1

Here’s what happened on the day, Paul got the funds from Kickstarter.

1. He sent the email saying that the campaign is poorly managed and a disaster, therefore he refused to pay the remaining fee. He thinks even today, has all rights not to pay in full for the campaigning service.  It’s wrong.

2. He took over whole project which was on google drive cloud service. And we shared all the date and media we created. But he didn’t pay me in full. All created contents doesn’t belong to him. It is clearly a breach of contract. He’s been using all the materials on XSHIFTER homepage and indiegogo for the commercial use.  It’s wrong. 

I am here to say the truth story. I can say i was the very first backer of XSHIFTER campaign. I believed in the potential of the product and Paul himself. What’s happening to backers right now reminds me of what happened back then. I feel obligated to share my story with you guys, the backers.

I and Paul went to Interbike 2016 held in Las Vegas to get attention from media.

Yes, this photo is taken by me. I met Tyler from Bikerumor, a very nice guy. He told me he learned about XSHIFTER via his Facebook friend. Yes, It was not a magic. It was the result from the facebook ad campaign I initiated with my own credit card. 

No doubt he enjoyed very professional marketing service. He appreciated our team effort and the good results from the campaign until he got funds from Kickstarter.  

This is the fact I want you to know. He refused to pay me due to unprofessional and failed campaigning. However, he doesn’t have any ground not to pay me after the service and again, it was a successful campaign. His doing is illegal and outrageous.

Campaign success story 01

This is my paypal payment record. I initiated the facebook ad campaign to reach you guys. And ultimately made a very strong community. I paid $973.11 ads with my personal credit card. At this point, you might think I am the stupid one. But as you guys still believe in Paul and the product, so was I. 

But I am proud of what i’ve done as a marketer. And it was a necessary step. And Paul was reluctant to spend some money on it. After he saw the impact i created, he put his credit card on it. 

For me, the campaign was that important. I can say I was the very first investor of his campaign. And yet, he refused to pay me. 

He didn’t pay the bill. He deserves an acknowledgment by the people actually believed in you.

Truth or false

1. Paul fired me       -   False  (the service was successful finished and then right after he got the funds, he refused to pay me by saying “you’re fired” and not happy with the result. 

Lesson 01 - You need to pay whatever you agreed on the contract, no matter what you think, how you feel. 

2.The XSHIFTER campaign was a disaster.  - False

Lesson 02 -  Alternative fact that fabricated in your mind is very unhealthy and poisonous to everyone. 

3. Paul has all the right to refuse to pay the service fee.  - False

 Lesson 03 - If you’re a backer, you know how it feels when the promised product is almost 2years behind. No exact date or anything. Well, Imagine how I feel. Be cautious, don’t be a victim. See things through. And nobody can get away from his wrong doing.

Yes, My team made him #1 rank on google search(the keyword”wireless shifter”) at one point. And until today, it is ranked #2 in my search. Unbelievable marketing work!

You think that’s what the worst marketer be able to do ? I am not here to be exaggerate or deceive anyone. It’s a fact. And he thinks I don’t have the proof. Then he’s being childish. 

I really wanna ask Paul in front of everyone. Paul, you didn’t pay me because you think it was a terrible marketing? You believe you don’t need to pay the bill if you think it was bad?

Hypocrisy

If he actually a honest small startup/business owner, he should’ve paid my service. I did 4months of campaign work. From coming up with product name to video production and marketing, I did my job very well. 

He keeps saying “he fired me for being a worst marketer”. But he only said that right after he got funds from Kickstarter. He refused to pay the 15% of fund as we agreed on. 

For 4months, I and my team literally spent more than 10+hrs a day to work on this project. His initial service fee is only enough to cover the video production and two assistances i hired. I was even put my money on facebook ads to maximize my pie. That was a fair deal and the good decision at that time. 

But he refused to pay me, and refused to acknowledge the fact that it was a good campaign, a good marketing. Whatever he believes or whatever he says, it doesn’t not change a fact that Paul did not pay for the service. His campaign is at my expense. I lost 4 months worth of time and energy. And Paul is calling me a worst marketer, the fired one. Paul, you don’t get to fire somebody who already made your project successful. You didn’t pay for the service in full. It is a straight up scam.

I am not here to ask Paul to pay me. I don’t even know where he is. But he cannot get away from his wrong doing. I can sleep without that money. But I cannot put my mind at ease when i know you are out there playing everyone for a fool. 

I want everybody to learn about him. That’s it.

Back in 2017 early April, I wrote the message on KS project comment section. Right after, Paul took me out of the community by giving me the refund. so that you can shut me out. 

He keeps saying he fired us. what he really did is refusing to pay the remaining as the contract says. 

He has his own version of facts. I guess It is a trendy thing to do like Trump. But the truth remains. He used the service and refused to pay the service right after he got funds from Kickstarter. 

I spent 4months day and night to achieve the successful campaign. And my team made it. And he also used to say that, verbally and via email. I have the proof. 

I didn’t mean to bring this up in the internet. It is not my style and looks very weak. But now, I can admit that i am weak . I cannot afford to hire a lawyer in China, or in Hong Kong. It takes time and money. 

So I am here to say this, hoping you guys listen and learn the truth about what really happened and who he really is.

That will makes me feel better. It has been 20months. It really hit me time to time. I cannot live without exposing the truth to you guys, the community I helped build.

The copyright issue

Paul refused to pay the remaining service fee. Therefore, he doesn’t have the copyright on all the contents. What his doing is illegally monetizing by using all the created contents: photos, videos, company logo and the product name itself. It is clearly the breach of copyright.

Paul’s Email sent August 6, 2018 

 Paul didn’t fire me. By saying“you fired” after enjoying all the service and refuse to pay the remaining doesn’t make his doing legal. He applauded for the service me and the team provided before the funds came into his bank account.  The fact is: It was a successful campaign. And he has no legal ground to refuse to pay the service after a successful campaign. What he did is illegal. I believe the backers think the same way.

The moment he got the funds from Kickstarter, he refused to pay the service in full. You guys will be thinking why i didn’t take the legal action. Here’s why:

I and Paul both works in Shenzhen, China. Now he’s American, and myself is Korean. It is a way harder for me to pursue the legal justice, not to mention the time and legal fee. And I don’t wanna get involved in any sort of mess while i’m in china. You get the picture. 

He is threatening me by saying he’s gonna sue me. I am not sure what’s stopping him. Hope you can prove himself that he has “more than enough cash to pay my attorney for a defamation suit.” I am not here defame him. I am here expose what he really is. The goal is not getting paid. What I want is stopping him from ripping people off like me, and stop him taking advantage of my efforts. 

He keeps saying the campaign is failed one.That is the only reason he refused to pay me after all the service i provided. I know it’s ridiculous. So I am asking everyone, If any KS backers think the campaign was a disaster as he thinks .please DM me. or leave the comments below. Thanks.
