Copyright law is about to change 

For more than a year Congress has been holding hearings for the drafting of a brand new US Copyright Act. At its heart is the return of Orphan Works

What does this mean for artists? it means it will make it easier for infringers to steal artists works and harder for people who are making or trying to make a living out of art more difficult. This will effect every artist and all the artwork they have created, are creating, and will be created. Corporates, Big businesses, and publishers want this to pass to make money out off artists works without paying us artists for past, current, and future artwork. 

Basic Facts About The Law Being Proposed

 - “The Next Great Copyright Act” would replace all existing copyright law. 

 - It would void our Constitutional right to the exclusive control of our work.

 - It would “privilege” the public’s right to use our work.

   - It would “pressure” you to register your work with commercial registries.

   - It would “orphan” unregistered work.

   - It would make orphaned work available for commercial infringement by “good faith” infringers. 

 - It would allow others to alter your work and copyright these “derivative works” in their own names. 

 - It would affect all visual art: drawings, paintings, sketches, photos, etc.; past, present and future; published and unpublished; domestic and foreign.

This things really piss me off.

It’s Hoshie Mononoke. Long-time not to see you. I’m writing this because I saw what happened to Lackless this last week and I feel like sharing my opinion but also hoping to throw some reason in all what occurred to her.

To begin with I want to clarify that I DO NOT support extreme fitness neither extreme obesity. Both of them are serious psychotic illness, which can put your own life in danger. Related to this I want to point out that there is no reason at all supporting these kind of habits. You shouldn’t support something like people getting fatter and fatter to the point of madness reaching 200 pounds of weight and saying this is great or normal. No, this is not good at all, you can say heart-attack should be normal issue in the world, physical dependence, illnesses due to a bad alimentation, or height mortality risk as some kind of natural reality, or something that won’t be so bad nowadays. Think about the possibility of a world just like you imagine, who is going to trust to fly in a public vehicle whose driver could have an attack any moment, or who is going to save people from an accident or from a fire when you can’t move as fast and quick as a trained fire-fighter can, and so on. This world is not good, or possible, more over this world is dangerous. But it happened the same the other way around: extreme fitness is not an ally, you can die for so many reason and suffer many illnesses due to the lack of vitamins, proteins, and resources found in aliments. You can lost your conciseness any moment, or finding yourself so week that you can’t move any single inch of you “beautiful” skinny body. I think you can figure out what could happened in a world dominated by extreme skinny people.  Those images are worlds where I don’t want to live in. It is not that you have to go to gym every single day, it isn’t like you even have to enter in a gym. You don’t have to be one of those body-builders of the magazines or those celebrities who spend their entire life glorifying their bodies as monuments. I don’t have the time nor interest to be like them. Body is something material and now I’m going to quote something that I saw in Twitter last week “in this world people was made to be loved and things to be used, the problem of this world is that things are loved and people is been used” , so it means for me that I don’t have to love the body of someone or even my very own body, I have to love the person behind the meat and bones, as a result the rest remains to stay healthy enough for living as much years as possible by the side the one(s) you love. So it’s hard for me to understand how someone could defend a position in which you are in favour of one of those images. It’s not like all of us have to stay fat or skinny, it’s to stay healthy. It doesn’t matter if your rounded, tall, big, small, sharped as long as you stay healthy. I’m not skinny nor chubby, I’m normal people, with my weigh, my height, and my health which not respond to those tag generated by society to determine if I’m satisfied with my body or not. 

Well, now that I established my position towards this theme I’m going to focus in Lackless situation. First you have to notice two things in her: first she is a human being, and second, she is an artist. Now that you realized these things I can tell you that the first word is related to the fact that SHE’S FREE to make whatever she wants to do as long as she doesn’t harm to hurt anybody with her liberty. The second term is related to her right as an artist as represent reality as she want because that’s what artist do, they create reality, or they represent it as they what to, because there are more eyes in this world, not only yours, so that means that you have to be open-minded and accept the fact that people see the world on a different way, maybe opposite to yours. And focusing on art, it’s not a matter who is right or not, it’s a matter of on the assumption that it’s not aimed to offended anybody, respect the piece of art, the artist, and his/her point of view of the world. For instance, I don’t like the way Japanese manga industry treat female body, with those super giant teats, those perfect stylized bodies, and those antiaging faces. But I understand it’s not made to harm women nor anybody but to please men and anyone who likes those images. I don’t like them, I think they are disrespectful, but this is my point of view, Japanese men have their own point of view and surely you have yours. And as these images are created not to keep women under oppression but to please Japanese men desire I can’t threat Japanese authors, telling them that they should stop drawing and taking down their own dreams and ambitions. They want girls like these and that’s fine for me, it’s way better they create fictional supergirls instead of violating real girls. I figure out that (because I’m not Lackless so I can’t say what she was really thinking about) Lackless only wanted to share her love for the series Steven Universe with its fandom on internet. She probably draw the character she most love (or maybe was for the design idk) and upload a W.I.P. in Tumblr in order to get some opinions about the way the character was being drawn.  But far from finding nice feedback she found many people telling her that “how she dared to draw that specific character “so skinny” when in the series she is the biggest chubby character”, “she should apologize for treating fat people like this”, “that she hate fat people” (lmof this one), “that she should look up for references before drawing fat people”, and many other comments that I won’t post because of their silliness. Well let me tell you, people who consider yourselves fans from Lackless’ art, that you should tags yourselves TROLLS rather than fans from nothing. How could you have done this to her? It’s not like you can’t tell someone you don’t like something they are working on, or that you can’t tell an artist that this last piece should be more elaborated because there are a few part that may don’t look so great as the rest of the picture does, or that you can’t even say simply that this time you don’t like her art. Instead of constructive critiques or nice advices you treated her like something less than human, (I was going to say shit but I remember that I’m trying to be polite even though you people do not deserve it) almost demonizing her as if you want make other believe that she hate something when it’s not true. First of all she pick up a character for whatever reason and asked for your opinion, not for your shit. Secondly, who you think you are for treating someone like this? Thirdly, SHE IS an ARTIST, but before that she is a human, so it means that she have feelings, and you ignore or slip them like nothing. Fourthly, she can do whatever she wants because she wasn’t aiming to hurt any of you, nevertheless she was hoping for some advice or critique because artist aren’t perfect and most of the time –always- they‘re so unsure about what they are drawing that need the voice of SOMEONE NICE to lead their feelings about the drawing and to enforce those weak points in it. You could say “yes, but I was helping her because I told her to look for references and studies in Google to make that character to look better” but have you even though on the possibility that she may represent character like this because is HER VISION OF THE CHARACTER AND NOT YOURS? Or maybe that she is not trying to make something so realistic and in the process of this stylization she missed the essence you liked from the character but remains the same character after all because all we have a different version/opinion of all single aspect of life giving the so many nuances that it becomes richer and more interesting? No, of course you haven’t. You were so focused on destroying her as artist that you even realised her feelings.

Maybe she was truly trying to represent that character with all her weigh and her curves and she failed. So what? Is that artist have to draw everything perfect? That they can’t make mistakes? Well in that case you should tell her that “the character doesn’t look a chubby as you like her/him to be like but it’s okay, as MAYBE it’s your first time drawing a character with this kind of anatomy”. “If you feel like representing fat people more accurately or trying to make your work more realistic I recommend you to look up for references and tutorials on the internet so NEXT TIME you draw something like this it won’t be too hard to achieve what you were maybe trying to represent”. Or “It’s not my work as a fan to tell you that you should look up for references before drawing something complicated or that you aren’t used to it but I do it because I’m YOUR FAN and I WANT YOU TO IMPROVE and to continue delighting me with your art instead of treating you like a miserable creature who mistreated fat people”. Yeah, you’re maybe right and it’s not your work to remind the artist to look for references but IT ISN’T ARTIST WORK TO DRAW WHAT YOU LIKE, because Lackess was drawing for herself to enjoy painting this character and she doesn’t earn anything by drawing that so she is doing it for fun. SHE MUSTN’T DRAW AS YOU LIKE BECAUSE YOU AREN’T PAYING ANYTHING TO HER TO FOLLOW YOU REQUIREMENTS. So you just shut up and try to find the way of helping her without being an asshole, rude, impolite or a troll. Artist aren’t perfect, they don’t know everything, THEY CAN MAKE MISTAKES and not knowing to search for references or thinking they can draw anything using only their mind but that isn’t reason for treating artist such hurtfully. Aren’t you ashamed on how you treat people? Aren’t you ashamed on how you use the mask of privacy of internet for destroying human beings? I’m sure Lackless is so smart and strong that she won’t give up for such comments but you have to realize how harmful your words can be.

If this words doesn’t mean anything to you try to put in Lackless’ feet: you post your art on line hoping to get some feedback and surprisingly –I mean it a pleasant surprise finding someone who actually tell you that he/she likes your work which encourage you to continue posting your work online because it means that there is someone out there who wait to hear news from you, who actually care about what is going on within your mind- you find someone who like your work, you put a lot of effort –find someone who actually like it and you feel confident enough to continue like this till the day you post a W.I.P. online expecting to hear people saying “you are doing just fine” or “maybe you should point out a little bit more chubby checks so it will look more chubby” and that kind of nice feedback but what you see is trolls in which you trusted because they seemed nice people at first who now not only discourage you to continue the picture but also they are trying you to stop what you most like which is draw and share. How do you feel then? Does it feel nice? Does it hurt when people try to humiliate you to the point that you lose totally your confidence? If you don’t believe she hasn’t even tried to accomplish the right image of the character, please, do us a favour and try to draw everything she has drawn, and then, try to tell us that it was “so easy” to draw many different things and you master every single aspect of art. She isn’t maybe perfect on portraying fatness or roundness, but she has tried and also she is very talented and she’s many other skills, you people have ignored only focusing on her non-perfect representation of fat people. It’s hard to open your mind to critiques and even harder to receive them in a positive way without consider them as a personal attack. But with people like you there is no point in showing artwork or any kind of creation because you’ll de-value the hard work it takes but also preventing the artist to share his/her work again. With that kind of reaction no you but the artist, respectful fans and the entire world may will lose one of those points of view that I told you about before. It’s a shame, really a shame that people like you who treat artist like this have the right of even posting your opinion/shit online so that other can read it. Pity you, you will never know the satisfaction of someone thanking your dedication to something because you lack the value of hard work and the concept of value itself. Pity of you, because you are no longer humans, you are creatures who devalue the concept of humanity to the point of not knowing yourselves but also preventing other to know as human.

I’m sorry if something I wrote may offend you, I was trying to be polite but I imagine that someone did this to me and I get really mad. I consider myself a nice person, but this kind of things do piss me off so don’t expect me to be made of stone, I also have feeling and temper.

What is the point of stopping someone who give something he/she made to share with the rest of the people? It doesn’t hurt you, it’s just for fun, to share love among others. If you try to help someone please think about how he/she’d feel about it, how you’d like to be treated, how you should say things so they won’t hurt anyone. Please try to be nice, it’s just that. If all of us will be nice to each other none of this’d ever happened. If you want to help someone because you love his/her work and you’d like you favourite artist (or friend) to become a better artist you should put on his/her feet and trying to critic his/her art as nicely as possible but telling the truth. I have wrote about what NOT TO DO WHEN CRITIQUING AN ARTIST. If you really want to help artist try to share their work RESPETCFULLY (keeping name, comments, watermarks, signatures, linking to artist site, etc.) as much as you can. I wrote a post last year about difficulties and help to the artist, if you feel like read it and tell me your opinion about it, if you like it I can post further information, methods and so on. It was a pleasure sharing this with you and with the very few who have read this large thing till the end. Thank you so much for reading, I hope you have learned something positive. Sorry for making it so long but I have to write about many things and there is also the fact that I don’t know how to express myself in less words.

I'm on my first step to semirealism, so I wanted to start from easy to difficult by drawing a head in first place. It's just a skecth. It's Gareki, from Tōya Mikanagi [カーニヴァル]. His you-are-bothering-me face is a really tough work. I wonder if I could be able to finish these glasses...
