Doctors at Department of Veterans Affairs (VA) hospitals nationwide could refuse to treat unmarried veterans and Democrats under new hospital guidelines imposed following an executive order by Donald Trump.
The new rules, obtained by the Guardian, also apply to psychologists, dentists and a host of other occupations. They have already gone into effect in at least some VA medical centers.
Medical staff are still required to treat veterans regardless of race, color, religion and sex, and all veterans remain entitled to treatment. But individual workers are now free to decline to care for patients based on personal characteristics not explicitly prohibited by federal law.
Language requiring healthcare professionals to care for veterans regardless of their politics and marital status has been explicitly eliminated.
Doctors and other medical staff can also be barred from working at VA hospitals based on their marital status, political party affiliation or union activity, documents reviewed by the Guardian show. The changes also affect chiropractors, certified nurse practitioners, optometrists, podiatrists, licensed clinical social workers and speech therapists.
In making the changes, VA officials cite the president’s 30 January executive order titled “Defending Women from Gender Ideology Extremism and Restoring Biological Truth to the Federal Government”. The primary purpose of the executive order was to strip most government protections from transgender people. The VA has since ceased providing most gender-affirming care and forbidden a long list of words, including “gender affirming” and “transgender”, from clinical settings.
Medical experts said the implications of rule changes uncovered by the Guardian could be far-reaching.
They “seem to open the door to discrimination on the basis of anything that is not legally protected”, said Dr Kenneth Kizer, the VA’s top healthcare official during the Clinton administration. He said the changes open up the possibility that doctors could refuse to treat veterans based on their “reason for seeking care – including allegations of rape and sexual assault – current or past political party affiliation or political activity, and personal behavior such as alcohol or marijuana use”.
The Department of Veterans Affairs is the nation’s largest integrated hospital system, with more than 170 hospitals and more than 1,000 clinics. It employs 26,000 doctors and serves 9 million patients annually.
In an emailed response to questions, the VA press secretary, Peter Kasperowicz, did not dispute that the new rules allowed doctors to refuse to treat veteran patients based on their beliefs or that physicians could be dismissed based on their marital status or political affiliation, but said “all eligible veterans will always be welcome at VA and will always receive the benefits and services they’ve earned under the law”.
He said the rule changes were nothing more than “a formality”, but confirmed that they were made to comply with Trump’s executive order. Kasperowicz also said the revisions were necessary to “ensure VA policy comports with federal law”. He did not say which federal law or laws required these changes.

A Department of Health and Human Services spokesperson said on Friday that Kennedy had not yet made a decision regarding the 16-member U.S. Preventive Services Task Force.

The Journal said Kennedy planned to dismiss all 16 panel members in what would be the latest in a series of far-reaching actions by Kennedy, a long-time vaccine skeptic, to reshape U.S. regulation of vaccines, food and medicine.
In June he fired all 17 members of the Centers for Disease Control and Prevention's Advisory Committee on Immunization Practices, a panel of vaccine experts, replacing them with seven handpicked members, including known vaccine skeptics.
The USPSTF includes medical experts serving staggered four-year terms on a volunteer basis. Its role in choosing what services will be covered by insurers was established under the 2010 Affordable Care Act, also known as Obamacare.
The 40-year-old group, whose recommendations provide guidance to doctors, looks at everything from routine breast cancer screening to drugs to prevent HIV infection.
The U.S. Supreme Court in June upheld the constitution of the task force and ruled in favor of its recommendation to cover preventive care.
Though made up of an independent group of volunteer experts, members are selected by the health secretary without Senate confirmation and it relies on support from the department's Agency for Healthcare Research and Quality.

The Autistic Self Advocacy Network (ASAN) condemns the United States Supreme Court ruling on two combined cases, Loper Bright Enterprises v. Raimondo and Relentless v. Department of Commerce. The decision overturns a decades-old legal principle known as the Chevron Doctrine, which gives federal agencies the authority to reasonably interpret ambiguous laws when they create federal regulations. These regulations are made legally binding through a rulemaking process that is shaped by the public servants within federal agencies, the input of subject area experts across fields, and anyone who chooses to share their opinion. Instead, federal courts will now have the final say in circumstances where knowledge of highly specialized, complex, and technical issues is required. This ruling will weaken the regulatory authority of all federal agencies, including the Departments of Labor (DOL), Education (ED), Health and Human Services (HHS), the Social Security Administration (SSA), the Environmental Protection Agency (EPA), and the Food and Drug Administration (FDA).
Federal agencies create regulations or rules that fill in the gaps of laws intended to protect disability rights, civil rights laws, housing, healthcare, and more. The overturning of Chevron and the deference it gives to the courts will have devastating impacts on all marginalized people, including disabled people and particularly disabled people of color. Often, these rules concern subjects well outside of the scope of legal training, including, as Marissa Ditkowsky noted, drug safety evidentiary standards, eligibility criteria for public benefits, the threshold for disability discrimination, or guidance around worker protections. This change will lead to inconsistent and conflicting adjudication across the country, driving avoidable litigation, confusion, and decisions that do not work well for the people they affect. These harms will fall disproportionately on marginalized people, including the disability community. As the American Cancer Society explained in its amicus brief, “The resulting uncertainty would be extraordinarily destabilizing, not just to the Medicare and Medicaid programs but also – given the size of these programs – to the operational and financial stability of the country’s health care system as a whole.” The same can be said for programs within DOL, ED, SSA, and many other federal agencies. This decision is also undemocratic, moving crucial decisions out of a process where the public has an opportunity to weigh in and into the purview of the courts.
This decision invites challenges to the forty years of legal precedents relying on Chevron. While these cases and the existing Code of Federal Regulations are not automatically overturned by Loper and Relentless, many will be challenged in the months and years to come. Future regulations are also under threat. Agencies may be less ambitious in fulfilling their mandates, protecting the public, and using taxpayers’ resources well in the face of increased risk that courts will undo their work. The endangered regulations include the Home and Community Based Services (HCBS) Settings Rule, the final rule implementing Section 504 of the Rehabilitation Act, the final rule implementing Title IX of the Education Amendments, and the final rule regarding section 1557 of the Affordable Care Act (ACA).
ASAN echoes the demands of the American Federation of Teachers (AFT): “Congress should urgently enact Chevron deference into law by passing the Stop Corporate Capture Act (H.R. 1507), a comprehensive blueprint for modernizing, improving and strengthening the regulatory system. That would ensure public input into regulatory decisions, promote scientific integrity and restore our government’s ability to help the workers and consumers it is meant to serve.”

GENEVA (17 October 2023) – Continuing violent displacement and threats of further attacks on the besieged Gaza Strip pose a major public health risk and emergency, a UN expert said today after at least 12 health workers were killed and 24 Gazan health facilities were affected since the escalation of violence in the region.
“All parties to the conflict and their international partners must ensure swift and unimpeded access to essential humanitarian supplies, including food, water and medicine, fuel, and electricity,” said Tlaleng Mofokeng, the UN Special Rapporteur on the right to health. “Gaza’s medical infrastructure has been irreparably damaged and healthcare providers are working in a dire situation with limited access to medical supplies and conditions that do not allow them to provide timely and quality healthcare,” Mofokeng said.
“Humanitarian workers, physicians, civil society, human rights organisations and journalists continue to work in the region while under bombardment themselves,” the expert said.
The World Health Organization has documented more than 111 attacks on health care services in the occupied Palestinian territory, including 48 attacks on the Gaza Strip which resulted in the death of at least 12 health workers.
Mofokeng said that Israel was preventing the entry of essential supplies into Gaza, including food, water, fuel, medicines, medical disposables and equipment. “The Gaza Strip is experiencing continuous bombardment and massive devastation,” she said. “The health sector in the enclave is at a breaking point.”
Mofokeng called on the international community to intervene immediately to prevent the escalation of conflict and protect and respect the right to health of all, by demanding access through humanitarian corridors, protection of the healthcare infrastructure and health workers. Palestinian families require urgent supplies of food, water, shelter, fuel, emergency health care, psychosocial support and psychological first aid, the expert said.
The latest escalation and display of aggression in Israel and the occupied Palestinian territory must not be de-contextualized, the expert urged. It represents a crushing moment of ongoing gross structural, systemic and sustained violence experienced by Palestinians every day since the occupation, she said. “I call for an immediate ceasefire and for Member States to stop beating the drums of war,” Mofokeng said.
“The Palestinian people have been displaced for more than 75 years. The occupied Palestinian territory has been under military occupation for more than 56 years – an occupation entailing a lack of accountability, ongoing displacement and demolition, movement restrictions, and systematic racial discrimination,” she said.
The Special Rapporteur recalled that UN Member States had reaffirmed their commitment to upholding the sovereign equality of all States and respect for their territorial integrity and political independence, recognising 2019 to 2028 as the “Nelson Mandela Decade of Peace.” The declaration supports a comprehensive approach to sustaining peace by preventing conflict and addressing its root causes, she said.
“Steps to realising the right to self-determination of Palestinians is linked to their dignity and sovereignty,” Mofokeng said. “You cannot extinguish the human desire for freedom.”

The Long Covid Groups say patients are being abandoned as dedicated clinics close despite a rise in UK cases - Published Sept 8, 2024
As the UK Covid-19 Inquiry resumes with a focus on healthcare systems in each of the four nations, the Long Covid Groups (comprising Long Covid Support, Long Covid SOS, Long Covid Physio and Long Covid Kids) are shocked and deeply concerned to learn that Long Covid clinics are being closed at a time when reported cases are continuing to rise.
Charities and many medical experts have long maintained we are in the midst of a global health crisis. Without a concerted effort to address this issue, the closures will only add to the significant burdens already being faced by healthcare systems and economies.
Recent data from the US has suggested that Long Covid may affect up to 7% of the population and prevalence could rise further. The latest ONS updates have shown that incidence of long-term sickness is at record levels and has been on an upward trajectory since early 2020. Staff shortages and high levels of school absenteeism are frequently reported across the UK. The annual productivity loss in the UK resulting from Long Covid is currently estimated to be £1.5 billion.
This stark picture contrasts with the lack of support Long Covid patients are receiving. At the start of the year, there were close to 100 Long Covid clinics for adults and 13 hubs for children and young people (CYP) in England. Earlier this year however, the highly regarded NHS England national programme was stood down with responsibility for Long Covid services being delegated to each of the Integrated Care Boards (ICBs). In recent months, patients and staff have reported the closure and a severe scaling back of clinics including Devon, Hampshire, Hertfordshire, Lancashire and Surrey. Key personnel and resources are being subsumed into other NHS services and, in some cases, staff are leaving the NHS altogether. Some CYP hubs are being forced to take on patients from those that have already closed with no extra funding.
In the other UK nations, the provision of Long Covid services is individual to each health board with no centrally agreed model on what Long Covid clinics should look like. They mostly focus on therapies designed to help patients manage their conditions rather than being clinician led. There is only one service dedicated to paediatrics in Scotland with none in Northern Ireland and Wales.
The Long Covid Groups urge all governments and healthcare providers to adopt a service model that prioritises dedicated clinics supported by experienced clinician-led, multidisciplinary teams. Given the complexity and multi-faceted nature of the condition, the Long Covid Groups stress that specialists from each of the relevant disciplines should work collaboratively. In partnership with patients, they call for a healthcare framework that is dedicated to successfully diagnosing, treating and preventing Long Covid; this will contribute towards relieving the operational and financial pressures on the NHS.

In recent years, U.S. politicians have selectively framed European healthcare policies to justify restrictions on transgender care, seizing on a handful of conservative policies to claim that “Europe is pulling back.” The most extreme example, the United Kingdom’s Cass Review, has been wielded to justify a near-total ban on puberty blockers and even cited in U.S. Supreme Court arguments. But new medical guidelines from Germany, Austria, and Switzerland tell a different story. These countries have reaffirmed the importance of gender-affirming care for transgender youth and issued sharp critiques of the Cass Review, calling out its severe methodological flaws and misrepresentations.
The guidelines, released Friday in German, span more than 400 pages and represent the collective expertise of 26 medical and psychotherapeutic professional organizations, along with two self-representation organizations from Germany, Austria, and Switzerland. Their stated goal is "to provide guidance to all professionals in the healthcare system who deal with young transgender and non-binary people for the best possible professionally informed care based on the current state of medical knowledge." From the outset, the guidelines explain the importance of gender affirming care, stating that there are “no proven effective treatment alternative without body-modifying medical measures for a [person with] permanently persistent gender incongruence.” Importantly, the guidelines were developed with those who are experts in the fields of gender affirming care having a voice at the table, unlike the Cass Review: “Current guidelines, which are published by medical societies, were predominantly developed by clinical experts for the field of application and are based on an integrated synthesis of the assessment of available evidence and the broadest possible expert consensus.” The guidelines directly recommend puberty blockers and individualized, prioritized care for transgender youth undergoing physical changes. In the section on puberty blockers, the guidelines state with a strong recommendation: “If, in individual cases, the progressive pubertal maturation development creates a time pressure in which health damage would be expected due to longer waiting times to avert irreversible bodily changes (e.g. male voice change), access to child and adolescent psychiatric or psychotherapeutic clarification and medical treatment options should be granted as quickly as possible.” The guidelines also deliver a strong critique of the Cass Review, the report currently being used to justify bans on gender-affirming care in the United Kingdom and leveraged in other countries to further restrictions. German medical societies deem the Cass Review largely inapplicable to their own guidelines due to its numerous methodological shortcomings. One of their sharpest criticisms focuses on the lack of transparency regarding those who advised and produced the review, as well as the limited expertise of those involved. [...] The new German, Austrian, and Swiss guidelines mark a significant advancement for transgender healthcare in those countries, reinforcing a growing trend in Europe toward expanding, not restricting, access to gender-affirming care. They join the ranks of nations like Spain and France, which have taken more progressive stances on transgender rights, including medical care.
In a marked contrast to the US and UK’s war on trans rights and existence (see: Donald Trump [US] and Cass Review [UK]), the DACH countries of Germany, Austria, and Switzerland released guidelines on gender-affirming care that expand it for trans youths.
