You are truly disabled if you have to take medication and have sleeping issues. I could never keep a 9 to 5 because my body would sleep or rise on it it’s own schedule. I lost jobs because I wasn’t available for scheduled times because I needed sleep and my antipsychotics on top of having to take Klonopin in the mornings made me really difunctional for a work schedule. If social security disability comes breathing down your neck sending you to doctors to determine if your disabled or trying to take away your benefits, tell them you have sleeping issues. For me I can’t sleep sometimes but then there are times I need sleep . Antipsychotics do this to you.

How an Attorney Can Help with Your Social Security Disability Case in North Carolina
Tumblr media
If you’re reading this, chances are you’re facing the challenges of applying for Social Security Disability benefits. Whether you’re struggling with an illness, injury, or other disabling condition, we understand the stress and confusion that comes with navigating the process. It can feel overwhelming, and you might be unsure of where to turn next. You don’t have to face this alone. In North Carolina, an attorney can help you manage the complexities of your Social Security Disability case and guide you toward the best possible outcome.
The Social Security Disability Process Can Be Complicated
Applying for Social Security Disability benefits involves a multi-step process. For many people, getting approved isn’t as simple as submitting an application. The government has strict guidelines for who qualifies for benefits, and often, applicants are denied even if they truly need help. You might already be feeling discouraged if your application has been denied or delayed. The good news is that an attorney can help turn things around.
One of the most crucial things to understand about the Social Security Disability process is that it’s not a quick fix. The process can take months, or even years, depending on the circumstances of your case. Whether you’re just starting out or you’ve already been denied, an attorney can step in and ensure that you meet all the necessary requirements and deadlines. They’ll help you present your case clearly and effectively to improve your chances of approval.
How an Attorney Can Help with Your Application
When you first apply for Social Security Disability benefits, there are several steps that an attorney can assist you with. One of the key roles an attorney plays is helping you gather the necessary medical evidence to prove your disability. This is one of the most important parts of your case, as Social Security will rely heavily on your medical records to determine if you qualify for benefits. An attorney can help you organize and present this evidence in a way that makes the strongest case possible.
Additionally, an attorney can help you fill out the paperwork correctly. Many people make mistakes when completing the application or leave out important information. These mistakes can delay your case or even lead to a denial. A skilled attorney will guide you through each form, ensuring that everything is accurate and complete.
What Happens if You’re Denied
Unfortunately, many people are initially denied Social Security Disability benefits. In fact, it’s estimated that more than 60% of first-time applicants are denied. If you’re in this situation, don’t lose hope. An attorney can help you appeal the decision and increase your chances of a successful outcome.
The appeals process is a complex one, and having an attorney by your side can make all the difference. Your attorney can help you understand the reason for the denial and work with you to gather additional evidence to support your case. They will also represent you during hearings, where you may need to present your case before a judge. Having a knowledgeable attorney who understands the legal system can be the key to turning your case around.
Navigating the Legal System with Confidence
The legal system can be confusing, especially when you’re dealing with something as important as your Social Security Disability case. An attorney will help you navigate this system, making sure you don’t miss any important deadlines or procedures. They will also be able to handle all of the paperwork, phone calls, and correspondence related to your case, allowing you to focus on your health and well-being.
Having an attorney who is familiar with the ins and outs of Social Security Disability law can provide you with peace of mind. They will ensure that all the legal details are taken care of, which can help reduce the stress you might be feeling. The process can be overwhelming, but with the right support, you can feel confident that you’re doing everything you can to get the benefits you deserve.
Maximizing Your Chances of Success
While no one can guarantee a positive outcome, having an attorney can significantly increase your chances of success. Social Security Disability cases are often denied, not because the applicant isn’t deserving of benefits, but because they fail to present the case properly. A skilled attorney knows what to look for, what arguments to make, and how to present your case in the best possible light. They will ensure that every detail of your case is addressed and that you have the strongest case possible.
An attorney can also help you understand your options and what to expect at each stage of the process. They will give you a clear picture of what needs to be done and how long things may take. This transparency helps reduce the uncertainty that often accompanies Social Security Disability cases.
Facing a Hearing with Confidence
If your case reaches the hearing stage, you may feel anxious about appearing before a judge. This is a common fear for many applicants. An attorney can help alleviate that fear by thoroughly preparing you for the hearing. They will explain what to expect and what questions may come up, so you can feel confident in your ability to present your case. Your attorney will also represent you during the hearing, ensuring that your case is heard in the best light possible. Their experience with these hearings will provide a level of comfort and assurance that you are being well-represented.
If you are struggling with a Social Security Disability case in North Carolina, know that you don’t have to face the process alone. Whether you’re applying for benefits for the first time or you’re appealing a denial, an attorney can provide you with the support and guidance you need. From gathering medical evidence to handling legal paperwork, an attorney will be with you every step of the way.
The Social Security Disability process is long and challenging, but with the right help, you can give yourself the best chance at a successful outcome. At Phillips & McCrea, PLLC, we understand the difficulties you’re facing, and we are here to help. Our team is dedicated to supporting you through this process and fighting for the benefits you deserve. Maximizing SSD Claims: The Role of Medical Records Review for Attorneys
Tumblr media
Introduction
Attorneys working on Social Security Disability (SSD) cases know that claim files are supported by a claimant’s medical records. The Social Security Administration (SSA) uses medical records to gauge the magnitude of a disability and its effects on an individual’s ability to work. Well-managed and comprehensive medical records reviews can determine whether a claim gets approved or denied.
This blog post examines ways in which attorneys can best utilize expert medical records reviews to get maximum claims.
The Importance of Medical Records in SSD Claims
Basic evidence in the SSD cases under process are medical records and primary evidence. The SSA would require papers proving the presence of a medical ailment, its gravity, and the restriction level of the claimant. Hence, the attorneys must ensure that medical records have:
Comprehensive Treatment History: There must be a record of all treatment procedures, medications, therapies, and surgeries that relate to the condition in question.
Objective Medical Evidence: Supporting documentation includes results of MRI, CT scan, x-ray exam, lab work, and other examinations.
Physician’s Notes and Opinions: Statements from treating physicians regarding the claimant’s ability to perform daily and required tasks within the work environment carry significant weight.
Consistency and Continuity of Care: Treatment gaps or treatment inconsistencies may lead to claim denials due to the lack of medical history.
Common Challenges Attorneys Face in Reviewing Medical Records
1. Incomplete or Disorganized Medical Records
It might be hard to construct a complete medical history because medical records are usually spread across different providers’ offices.
2. Lack of Supporting Evidence
The records may exist but do not have sufficiently detailed physician assessment or objective testing results that are necessary by the SSA.
3. Medical Jargon and Complexity
Without prior medical knowledge, it can be quite difficult to interpret medical language and decipher a doctor’s handwriting.
4. Time-Consuming Process
The review process is lengthy because of the extensive number of medical records that must be looked through. It can hinder the progress toward the preparation and filing of the case.
How Attorneys Can Maximize SSD Claims with Medical Records Review
1. Obtain Complete and Updated Medical Records
They must obtain full medical records of every physician and other relevant healthcare facilities who has treated the patient. Ensuring payments are filled up to date increases the chances of claims being accepted.
2. Organize and Summarize Records Efficiently
Important critical medical facts can be retrieved with the help of medical records organization. Medical records chronologies and summaries aid in the review of the medical records.
3. Identify Gaps and Request Additional Documentation
Attorneys should acquire further evidence including specialist examinations, functional capacity evaluations, or simply new tests to the claims that are bound to strengthen the argument if the records are incomplete.
4. Utilize Expert Medical Record Review Services
Calling in a professional to review the medical records ensures precise examination, efficient consolidation, and extraction of any vital medical details needed to be proven within the scope of the case.
5. Correlate Medical Findings with SSA Disability Criteria
Attorneys must respect the medical evaluation of the claimant against SSA’s Blue Book to determine if the claimant qualifies.
6. Obtain Physician’s Medical Opinions
A properly supported RFC by a treating physician has a favorable impact on the chances of the claim being sanctioned.
7. Ensure Consistency in Medical Documentation
Information in the medical records ought not to be divergent from the expectations of the claim, as that could cause denial.
The Role of Expert Medical Record Review Services
A medical record review service helps lawyers break down complicated medical files, extract essential data, and check if any supportive documentation is missing. Such services offer:
Consolidated Medical Summaries
Chronological Order of Events
Failure to Provide Evidence or the Evidence Provided is in Discrepancy
Assessment of Functional Limitations Supported by Medical Evidence
Conclusion
Submitting Social Security Disability claims is best made when the medical information provided is comprehensive and well analyzed. Attorneys that take best practice approaches with managing claims through complete documentation and supporting medical evidence with expert testimony will get higher claim approval odds. The use of professional medical records review services will reduce time spent on the claims process while improving the outcome of the cases.
With these best practices in place, attorneys can effectively fight on behalf of their clients to put their clients in a good position to win the disability claim.

The Social Security Disability Application Process
Applying for Social Security Disability benefits can be a complex and lengthy process, often requiring the assistance of a qualified social security attorney. This article will guide you through the key steps of the Social Security Disability application process, offering insights into how a social security attorney can help you navigate this often challenging journey.
Tumblr media
Initial Considerations
Before diving into the application process, it's essential to take a few initial considerations into account:
Eligibility Assessment: Determine whether you meet the eligibility criteria for SSDI. A social security attorney can help you understand the requirements and evaluate your chances of success.
Medical Documentation: Collect all medical records, test results, and doctor's notes related to your disability. Thorough documentation is crucial for a successful application.
Work History: Ensure you have the necessary work credits by reviewing your earnings history. If you don't meet this requirement, you won't be eligible for SSDI.
Applying for SSDI
The Social Security Disability application process involves several crucial steps:
Initial Application: You can start the application process online, by phone, or by visiting your local Social Security office. During this stage, you will provide information about your disability and medical condition.
Review and Decision: After submitting your application, it will be reviewed by the Social Security Administration (SSA). This evaluation can take several months, during which the SSA will assess the severity of your disability, your work history, and your financial eligibility.
Reconsideration: If your initial application is denied, you have the option to request some reconsideration. At this point, you can submit additional medical evidence to strengthen your case.
Hearing Before an Administrative Law Judge: If the claim is denied again after reconsideration, you have the right to a hearing before the ALJ or the Administrative Law Judge. This is a crucial stage where in having a social security attorney by your side can be particularly advantageous.
Tumblr media
The Role of a Social Security Attorney
A social security attorney plays a vital role in helping applicants navigate the complexities of the SSDI application process:
Expertise in SSDI Law: A social security attorney is well-versed in the intricacies of SSDI law and regulations. They can ensure that your application meets all the necessary criteria and is free from errors that might lead to a denial.
Gathering Evidence: Attorneys can assist in gathering and organizing medical and vocational evidence to support your claim.
Preparing You for the Hearing: If your application reaches the hearing stage, an attorney will prepare you for the proceedings, ensuring you know what to expect and how to present your case effectively.
Cross-Examination: Attorneys can cross-examine witnesses and vocational experts, challenging their testimony if necessary. This can be a critical factor in the success of your claim.
Appeals and Further Action: In the event of a denial, your attorney can help you with the appeals process, ensuring your case is as strong as possible for reconsideration or further hearings.
Conclusion
Navigating the Social Security Disability application process can be a daunting task. Understanding the eligibility requirements, collecting necessary documentation, and seeking the assistance of a qualified social security attorney are crucial steps in your journey. With the right guidance and determination, you can increase your chances of securing the benefits you need to support yourself in the face of a disabling condition.
