Brent Renaud and his colleague were reportedly filming refugees fleeing Irpin when they were caught by gunshots at a checkpoint. Renaud was shot in the neck and died instantly while his colleague was transferred to a hospital. 51-years-old Brent Renaud was, along with his brother Craig Renaud, a documentary director, and television producer. They had produced, among others, "Surviving Haitìs Earthquake: Children", winner of the duPont-Columbia Award 2012. Brent has spent the past twenty years producing movies and television shows with his brother. hkladyliberty 【士不可以不弘毅，任重而道遠】 近日一位(?)香港法官罕見地打破常規，匿名接受了VICE World News 訪問，並坦率地批判唐英傑案令人擔憂的結果。之所以在“一位”後面會加上問號，是因為在原文不時會將 "they" 與 "the judge" 交替使用，令民女忽發奇想，到底哩位”法官“是反映緊一眾同事的共同意見，或是真的只有一個人，實在令人耐人尋味。 相比起同等資歷出去private practice 的收入，法官人工唔算高，但做法官可以服務社稷，曾幾何時是一種光榮。現在卻淪落到要匿名對外媒講每一位香港人早已知道，"阿媽係女人"級的說話，實在令人感慨。 🟡 “私底下，我覺得唐英傑案不公平。法律唔應該係咁運作” “Privately, I felt this case was unfair. This is not how the law should work,” 🟡 …法院以“令人質疑”的方式解䆁刑事法概念，對唐英傑的判刑過重。 ...the court relied on a “questionable” understanding of criminal law concepts and sentenced Tong too harshly. 🟡 “唐英傑咩都無做過——無殺人無縱火…是世界上最和善的恐怖分子。” “[Tong] didn’t do much of anything—he didn’t commit murder or arson...He is the most benevolent terrorist in the world.” 🟡 高等法院刑事審判從來未試過無陪審團。就算案件涉及黑社會大佬或暴力反社會人士，審判中都一定會有陪審團。如果政府想保護陪審員…除了廢除整個制度以外，肯定還有其他辦法。 they had never heard of jury-less criminal trials at the High Court. It was standard to have a jury even in cases involving triad bosses or violent sociopaths. If the government wanted to protect jurors...There must be some other way apart from abolishing the whole system. 🟡 這[政治口號]正是最適合以陪審團從“常識”角度理解的問題，而不應單靠法官以法律條文角度自行理解。但唐英傑案沒有陪審團，這就變得不可能。 This [political slogans] is precisely the kind of question best left to a jury’s “common-sense approach”, as opposed to judges thinking in an overly legalistic way, the judge said. But with the removal of the jury in Tong’s case, this became impossible. 🟡 ……對於實質上只是違反了交通法的唐英傑，案件判刑太重了。如果唐英傑被控危險駕駛，最多只會被判三年有期徒刑。 ...Tong’s penalty was too severe for what was essentially a traffic offence. hkladyliberty:【支聯會何以企硬？｜認識“自然公義原則” #法律知識 #長文】 #支聯會 近日居然敢於在國安法年代，公然違背政權旨意，這個聞所未聞的“原則” 到底是什麼？ 在香港法律制度下，任何公職人員在作出任何影響公眾權利、利益或合理期望的決定時，都 #有責任遵守“自然公義原則” (Rules of Natural Justice, 下稱"原則")。原則沒有明文規定，但立法機關授予酌情決定權（“discretion”）時，已預期公職人員會遵守原則。因此法庭在詮釋法規時，都會考慮到原則納入考慮。 原則要求公職人員在作出可能對某人有不利影響的決定時，須符合程序上的保障。這些保障包括： 1️⃣ 針對偏頗的原則（“Rule against bias”）； 2️⃣ 保障合理期望原則（“Protection of legitimate expectation”）；及 3️⃣ 獲得公平聆訊的權利（“Right to a fair hearing”） 以人話表達的話，就是規範公職人員作出決時，不可有利益衝突、突然改變既定慣常做法或承諾構成不公等情況，並須給予受影響人一個適當的作出陳述的機會； 是確保公職人員秉公行事，保障合公眾利益、#法治 和 #程序公義 重要一環。 🟡 今次支聯會拒絕提供資料的原因，就是針對第三點“獲得公平聆訊的權利”。所謂獲得公平聆訊的權利，是指公職人員要讓受影響一方知道要答辯的案件，並有合理機會進行申述。其中包括需要向受影響一方披露對其不利的報告及文件，就算在機密情況下，亦需要披露資料內容要點。 換言之，就是保障受影響人能夠了解情況，不會在不知就裏的情況下“被決定”。 支聯會就是認為，國安處懷疑支聯會為外國代理人，但沒有提出具體合理理由、實際案件、資料對調查的關連性，便要求以"一籃子"方式交出資料，不是乎合原則的合法要求，進而沒有拘捕多名常委的理由，所以敢於企硬 目前支聯會拒絕提供任何資料，常委徐漢光更入稟高院提司法覆核。案件會否將港共政權推向#憲政危機，在法庭公開揭穿“外國勢力”指控空洞無力，成為限制國安處權力的先例，或公然放棄規範所有公職人員的基本法律原則，同時破壞法治和公務員制度？大家儘管拭目以待。 #支持加速 立場報道：【拒交資料】支聯會常委徐漢光覆核警方決定　要求法庭宣告支聯會非外國代理人 https://bit.ly/2WVnNbz . . .
