Dance The Night by Dua Lipa

Stalking Daniel Matthews in a gay bar isn’t Mark’s idea of a good night out, especially when Kramer’s fostered Adam on him as well.

“He’ll blend in well.” Kramer had said, smile playing at his lips, and Mark had wanted to rip out his oxygen port and shove it somewhere the sun didn’t shine.

So now he’s sitting on an uncomfortable bar stool watching two dead boys dance. The club is dark, the music terrible. Daniel is painfully young, mascara and eyeliner smeared over his eyes, lanky body not doing what he wants. Adam dances like a old woman at a wedding – Mark’s pretty sure he’s given up on actual moves and has just started doing the macarena to Ke$ha.

Mark gestures for Adam to come over. Adam loops him with an invisible lasso and begins to dance towards him, look of unmistakable glee on his face. Mark sits there, stone faced, ignoring the glances they’re getting from the other patrons.

“You’re no fun.” Adam says, once he’s within hearing distance.

“I wish Amanda had smothered you.” Mark says, and feels bad at the flash of hurt across Adam’s face.

I'm very sorry to cut this because I shifted when the call occurred, so you're getting it.

“He’s practically asleep on your shoulder and you're using this moment to take a call?” Marius replied, reaching over to put his hand across Daniel’s cheek. “It’s my fault, I shouldn’t have let you keep him there so long.”

It was all Armand could do not to rip his hand away. “Let me?”

“You’re not ready to prioritise someone else’s needs above your own,” Marius informed him, undeterred by the iciness of his tone.

“I’ve taken care of more young than you have,” Armand snapped at him, careful to hold the phone against his chest. This was supposed to be a goodnight call, to hear his lovers voice before slipping into sleep. Not make him feel awkward or embarrassed. “I can care for my own.”

“Can you?” Marius asked. “It appears you can’t tell time.”

“And I’m out,” Daniel had stirred enough, pushing himself away from Armand’s shoulder and gripping one hand onto the wall. “You can stand here and bicker like a couple of bitter divorcees but the suns coming so I'm going."

On the other end of the call, Louis sounded mildly alarmed. If he'd heard Marius' ridiculous accusation, then he was at least gentlemanly enough not to bring it up. "Is something wrong?"

Daniel must have heard the tinny voice coming from his chest. "Take it up with Kramer Vs Kramer!" he grunted. "I can put myself to bed, for fuck sake, don't grab me."

There was a beat of silence as Armand and Marius looked at one another before the sound of Louis' voice came out of the speak. "What is a 'Kramer'?"

Armand made a mental note to add a movie night to their routine, if only so he didn't end up having to explain more pop culture references. It was just a general hazard in Daniel's vicinity.

top 5 saw movies

saw: the ultimate the eternal the unbeatable...james wan here are my keys go home and fuck my wife!!! just a genuinely good movie in every aspect (directing writing editing acting sound etc etc) and even after all my rewatches (i think i'm up to 18?) i still discover new things every time and the ending still Hits like hello zep playing up until adam's screams which continue over into the credits? oh the things i would do to experience that on the big screen. amanda adam and lawrence reshaped my brain chemistry.

saw v: honestly baffling to me that people hate this one so much because it has some of THE best traps in the franchise and the fatal five are arguably the most interesting victims post leigh's involvement. brit and mallick and luba my beloveds...also the twist is SO good and opening with the water cube and ending with glass coffin...genius. rip peter strahm you lived served thrussy and died.

saw iii: so my thing about saw iii is that i've only watched it once solely because the thought of rewatching amanda's death is too much for me to handle but. god. the amanda/john/lynn stuff is probably one of the best A plots in the series after adam and lawrence in saw...maybe even better just because the amanda and john dynamic is the most fascinating one in the whole franchise. unfortunately it loses points for subpar traps (the rack is admittedly a cool concept but it's so grotesque and the one trap in all nine movies i simply cannot stomach) and how much i fucking hate the jeff plot. booo tomato tomato.

saw ii: possibly above saw iii honestly but my lynn loving heart is putting it here. anyway. i think saw ii gets better on a rewatch once the Layers to it are revealed and there's more of an attachment to the wider narrative that's being put into place. amanda is at her peak (oscar for her performance when she "wakes up") and her relationship with daniel is SO good. kerry is being sexy and reasonable as always rip queen. the nerve gas house victims make for such interesting dynamics and i am fond of everyone except for xavier and obi. the brutality of the traps is definitely Upped but most of them are very good even if like, needle pit is upsetting to watch because mandy :( also the safe joke still makes me laugh every time like love him or hate him you can't deny that john kramer has some comedy gold moments. eric matthews suffering <333333

saw vi: tbh i do Not Like william easton but i think he's the only victim post the amanda trilogy that rivals the fatal five in terms of how interesting he is and he's such a unique twist on learning jigsaw's message. because he DOES learn but at that point he can't change anything and...it WASN'T HIS GAME!!! god another excellent twist. love that the thing is set in a zoo where the fuck did they get an abandoned zoo. shotgun carousel top ten trap of all time and pound of flesh is the best opening game in my opinion. other great moments include the healthcare for all message, perez being sexy, hoffman being a fucking idiot and making things so much worse for himself, jill being The Player, amanda content, strahm's hand, lynnmanda rights, piranha, return of the reverse beartrap, an excellent ending, and rodrick from diary of a wimpy kid fucking losing it.

okay Art first. I genuinely wonder abt him so much, something in specific I think abt is that aside frm Amanda (+ Eric, obviously, but talkin abt disciples) Art is one of the only trap victims EVER 2 be tested twice and it’s like... what’s that abt? Why? as u’ve said b4 it rly depends on how you personally view his character: whether he’s a disciple or not. fr me, both options are equally plausible, n honestly I don’t rly confine myself to either; it sorta depends on what I’m feeling/writing. if we’re talking abt art being a disciple, then the Spinecutter not going off (one of my BIGGEST questions) makes total sense, as Hoffman’s side of the trap was never set up to work either, + Jigsaw disciples have a history (aside from Lawrence) of appearing as victims in other tests/traps. if he were not just another pawn and was in fact a disciple himself, then the Spinecutter was never meant to go off - it was there just to make Eric think it COULD go off/make it look convincing to outsiders. which brings me to ANOTHER question: what does Art know abt Eric? does he know anything? what does he think of Eric?

(lil side note: if Art is a disciple, then I kinda wonder if it’s a lil bit of a Hoffman + Lawrence situation where Hoffman didn’t know abt Art either? just bc he looks so shocked when he sees Art’s face fully fr the first time... that could’ve just been acting on Hoffman’s part but IDK. food fr thought)

personally, I feel like Art probably does know a lil bit abt Eric - at the very least, he’d know tht Eric had been previously tested + failed by John’s rules, but then I feel that he wld also know Eric didn’t rly have a chance in his second test. that is why Art trying so fucking hard to keep Eric alive is interesting 2 me: what is his motivation 2 do that? like he’s been told Eric’s basically just there to get Rigg to participate, he doesn’t have any personal obligation or anything like that. sure, the aim is to keep Eric alive + see if Rigg can pass his “test,” but nobody said anything about grabbing a man you barely know around his ankles to keep him frm hanging himself w a noose made of chains. nobody said anything abt speaking to him so softly, not even raising your voice beyond saying “hey,” and asking him do you understand? when you tell him to keep still and prevent him frm killing his counterpart (which, if Art is a disciple, he knows it won’t, but he still speaks to Eric so softly, so compassionately, doesn’t he?)

nobody said anything abt grabbing him around the waist and steadying him again after being punched by said man. but Art does that. he stabilizes Eric’s feet on the ice as best he can and he keeps his hips straight and he basically says “look, we’re all stuck here, you need to keep it together ‘til that clock counts down if you want us to live, but I’m giving you a choice,” and he presses the gun w the single bullet into Eric’s hands and tells him it’s up to him. nobody said Art had to care but he does, I think, and it’s just like. he really didn’t have to keep Eric alive over the course of Rigg’s test. he didn’t. but he did and I just,, where does it come from? why does he care? this is even going beyond the fact that we’ve talked abt them being together after their test in a scenario where they both survive - I just think that Art at his core is a very stubborn but very compassionate person, whether he wants 2 be or not. like he HAS to know that kind of involvement cld prove to be extremely detrimental but he cares. I feel like that says a lot abt him (even if he does call Eric an asshole a couple times while doing it,,).

plus I also just. I think his reason for being tested (as it seems to be in most cases) is extremely flimsy. he was doing his job. he’s a LAWYER. often times it has nothing 2 do w personal feelings; they’re there to do their job and sometimes, unfortunately, that is defending possibly reprehensible people (in cases like Rex’s & Ivan’s). + John was already upset w him regarding their argument abt the urban renewal group so like it just feels So Very Petty, y’know?? even in the scenario where he IS a disciple, testing him twice seems entirely like John having a personal vendetta against him. Amanda is the only other person to be tested twice aside from Eric, so like. what. is that abt Mr. Kramer.

like I’ve said b4 in dms one could argue that Art is grey morally, bc we never rly see anything of him outside of flashbacks + acting as a test controller in IV, esp given that he... rly doesn’t seem too bothered abt it all? which is fair. but I also feel like the concern he shows towards Eric is smth to be considered as well.

+ YESS NONBINARY DANIEL I know I’ve mentioned it b4 but for reference, I read Daniel as masc nonbinary (he/they)! so I feel like Daniel wld b pretty comfortable w his identity, he’s never rly had a reason not to be (it’s rly anyone’s guess here tho bc we never see Eric + Daniel + Kate... as a family unit, for obvious reasons), so I feel like he’s vry chill abt it? and in the scenario where Eric survives n is dating Adam, I feel like Daniel wld talk 2 him abt it first (Adam is an adult they quickly come to trust + he’s vocal abt being trans himself so there’s that added layer of understanding - other than his mom maybe Adam might b the first person they come out 2). they’re just kinda like “so I wanna tell my dad I’m nonbinary but like I’ve literally never thought abt coming out what do I do” and Adam’s just like. Aha. bc he knows Eric is Also Trans so like, he doesn’t tell Daniel that bc it’s not his info to share, but he’s definitely like “oh it’ll totally be fine. trust me you have no reason to worry” so Daniel’s just like Okay. I Got This

+ I know I mentioned this in dms but Daniel wld absolutely wear those floral ripped hem skirts over jeans, so I feel like on one of his visits to his dad’s, he just. wears that combined w a completely random niche graphic tee he bought when shopping w Adam (I adore this hc n I am Holding Onto It) n is just like. not super open abt it bc he doesn’t know what to expect? he just kinda waits fr Eric to comment on it but when he doesn’t, Daniel gets nervous n is like “do I look okay?” and Eric’s rly chill abt it, like “yeah! it looks vry cool, vry alternative.” n like Daniel is relieved, of course, but also he’s just like God Pls Say Something so he just comes out w it like “okay this is not working. I’m nonbinary.”

and he’s COMPLETELY SHOCKED when Eric is just like “oh why didn’t u say so? do u have a different name u wanna go by? is Daniel still okay?” bc he wasn’t sure how much Eric knew, so he’s just like “uh no Daniel is still good, he/they pronouns though” and Eric’s just like alright cool but internally Daniel’s just like ??????

n THAT is when Eric asks him 2 come sit out on th front steps w him n is just like. “I don’t think I ever told u this but I’m trans. I transitioned during training in my early 20s” n Daniel is nodding while internally he’s like Adam I’m gonna throttle u. he worked himself up fr NOTHING. he just kinda laughs abt it and Eric is like “are u good?” ‘cause he’s a lil worried but then Daniel just smiles and is like “yeah I’m fine! just realizing I had nothing 2 be worried abt” and it’s a rly good moment fr them. they sit out there together talking abt their experiences for quite a while n at some point Adam steps outside 2 find them deep in conversation + he just smiles n goes back inside bc he cares abt them both so much and seeing them talk like that makes him so 💞💞 (Eric is SO PROUD u can see it on his face)

ohhh gosh Mallick,,, I spend a lot of time thinking abt him actually. he’s just one of those characters I feel vry connected to (me 🤝 Mallick: Ambiguous Disorder 💕) n one I got surprisingly attached to? hello (he IS one of my f/os)

I feel like Mallick is a very lonely person at his core. the way he sort of clings to Brit (w out the whole like. adrenaline of being in very very real danger w ppl trying to kill u SEVERAL TIMES) somewhat confirms this fr me. this is someone who has no reason to look out fr him, no reason to keep protecting him when their fellow captives hit him over th head w a club or attempt to push him into a bathtub to ELECTROCUTE him, but she keeps doing it and he’s just. in awe of it a little bit? ‘cause she could just let Charles knock him tf out or let Luba push him in but she fights for him, some1 she has no obligation to n met fr the first time literally when they woke up.

the moment they share b4 they stick their arms into the saws to activate the 10 Pints of Sacrifice is so very vulnerable and maybe even a little tender. yes he calls her a monster, yes she calls him one back, neither of them deny it. it’s an admission and an acceptance. they’re monsters, sure, fine, okay. but they are monsters and they are in this together. Brit tells Mallick it’s okay when he says he can’t do this alone. she says okay, okay, it’s okay, we’ll go together. and they help each other secure their tourniquets and they stick their hands in together bc it’s the two of them, literally hand in hand, fighting for their lives n for each other n they’re in so so much pain but they are doing it TOGETHER. I lose it thinking abt it!!! they even have a head bonk moment!!! I very much feel like it has some cinematic parallels to Adam & Lawrence’s moment in SAW 2004!!!!

+ as u mentioned, we both share the thought that Brit likely died since she wasn’t present at Bobby’s meetings, and. I want to touch on how fucking despondent and lost Mallick looks when we see him again in 3D. lights on but no one’s home. I feel like for Mallick, losing Brit was losing the first chance at a real connection he’s had in god knows how long - and for him, that’s just very shattering. he’s been thru hell, he’s watched three people die right in front of him, he sawed his ARM IN HALF, n the person he went through all of that with didn’t make it. but he did. and I feel like for Mallick that’s just like... he doesn’t understand it. but he feels even lonelier than he ever has b4 because the One Person who was there w him thru it all, the one person who could ever possibly understand what happened that night, is gone.

the Mallick we see in V would NEVER sit down n willingly listen to Bobby Dagen’s bullshit abt loving yr scars n taking pride in the fact u survived. he wld hate that man with a passion n I am very much sure of this. the fact that he’s sitting in that chair looking numb and glassy-eyed and silent? Mallick is trying to find some1 to connect to, find a place where maybe he belongs. trying to fill that hole that losing Brit made. why else wld he be sitting there, listening to someone he would ordinarily tell to shove his self-love bullshit up his ass? he’s lost. he’s just trying to keep his head above water and find a way to shore even though everything in him is fighting not to. he’s adrift without her.

+ ALTERNATIVELY, bc the reality of that is just. crushing n maybe not where I needed 2 go, in the scenario where Brit survived + just doesn’t want to put up w Bobby’s bullshit, I imagine them to actually move in together after a lil bit of time getting 2 know each other better w out the pressure of “oh god we’re gonna die.” she kinda helps him build up a sense of self-worth bc GOD it’s practically non-existent n thinking abt possible reasons why makes me sad. she’s definitely just like “no, you do deserve to be cared for and you deserve help when you need it, you deserve good things n to be happy.” she just kinds shuts it down while still making sure to talk 2 him abt WHY he feels that way (she’s not dismissing, but she’s trying to nip it in th bud) n Mallick is just like. huh. bc no one’s really done that fr him before. but it rly does end up helping in the long run, even if it is a very slow pace toward actually getting 2 a place where he recognizes his own worth + realizes he deserves all the things he wants Brit 2 have too. they’re there for each other thru thick n thin and if they made it thru their game, they can make it thru anything.

While he claims to not be a serial killer, Saw villain Jigsaw is one of the most effective murderers in horror, though there have been a few victims that have escaped his grasp. Of course, were one to ask John Kramer himself, back when he was alive, anyway, he would've insisted that what he did wasn't murder. Instead, John used the Jigsaw identity to help wayward and damaged people reform, learning to have a new appreciation for life by making a sacrifice of blood and flesh to survive.

In reality, Jigsaw's twisted methods are impossible to condone. His games are nothing more than a sick vigilante taking punishment into his own hands. John may have been a decent man once upon a time, but the loss of his unborn son and the dissolution of his marriage, coupled with the terminal cancer eating away at him, eventually sapped every last bit of true humanity from his heart. No decent person could do what he does to people and not go mad.

For the Saw fans, though, there's no reason to hate John, as in fiction, the normal bounds of morality don't necessarily apply. Many of the people Jigsaw targets are far from sympathetic characters, and watching them get theirs can be a form of catharsis. Sometimes though, the players of Jigsaw's games have survived to tell the tale. Here are all of the survivors of Jigsaw's games.

Amanda Young (Shawnee Smith) was the first known survivor of a Jigsaw trap, in her case the infamous reverse bear trap. To free herself, she had to kill a man and retrieve the key to the device on her face from inside his stomach. As traumatic as it was, Amanda then kicked her drug addiction and ended up joining John as his first confirmed apprentice, designed to help Jigsaw's work continue despite John's failing health. Sadly, she lost her way and began designing inescapable traps. John tested her again, and she failed, dying in the process.

Not everyone who gets mixed up in Jigsaw's games is a particular target of his wrath. In some cases, they're just those close to the main test subject, such as the wife and daughter of Dr. Lawrence Gordon (Cary Elwes). Dr. Gordon, of course, famously survived his test in the first Saw movie by sawing off his own foot. Meanwhile, his wife Alison and daughter Diana survived their own captivity at the hands of Zep, a man forced into working for Jigsaw. Lawrence would go on to survive and become another Jigsaw apprentice, as revealed in Saw 7.

Jeff Ridenhour is a very minor character in Saw lore, but still a memorable one. In Jeff's case, he didn't necessarily deserve to survive his Jigsaw test, but was saved by Detectives David Tapp (Danny Glover) and Steven Sing (Ken Leung). Doing so led to dire consequences for the cops, though – so perhaps the tradeoff wasn't exactly fair.

Daniel Matthews was tested much less due to his own petty crimes, and more because he was the son of Eric Matthews (Donnie Wahlberg), an explosively violent cop who was Saw 2's primary Jigsaw target. Eric survived being placed in a group of people who had been wrongly convicted of crimes thanks to his father, but was then placed inside a safe to be used as leverage for Eric's test. Daniel survived, but Eric didn't come out intact.

Corbett Denlon and Judge Halden are two minor Saw 3 characters who were pulled into Jigsaw's games with Jeff Denlon in Saw 3. Halden was the man who gave the drunk driver that killed Jeff's son a light sentence. To save Halden, Jeff had to burn cherished mementos connected to his son. Halden later died trying to help Jeff save his son's killer from a trap. Corbett, Jeff's young daughter, was "saved" by Jigsaw apprentice Mark Hoffman after Jeff failed his test.

Easily the most dangerous and sadistic of Jigsaw's apprentices, Detective Mark Hoffman (Costas Mandylor) ended up working for John Kramer after faking a Jigsaw murder in order to kill the man who had taken his sister's life. Seeing Hoffman's potential, but not appreciating being ripped off, John offered him a chance to join the cause. Hoffman continued the games long after John's death but got tested for the first time himself via his own reverse bear trap thanks to John's widow, Jill. Hoffman survived and killed Jill, but later lost for good against Dr. Gordon.

FBI Agent Peter Strahm (Scott Patterson), along with his partner Lindsey Perez, investigated the Jigsaw case, and both ultimately died as a result, but not before escaping at least one of Jigsaw's traps. Strahm instantly suspected Hoffman was in on things, and that didn't change following his own escape from a Jigsaw trap that involved an improvised pen tracheotomy to avoid drowning in a box locked on his head. Still, his dogged pursuit of the truth cost him dearly, as he was later crushed to death by the encroaching walls of a room, while Hoffman smugly escaped the area.

Strahm's partner Agent Perez survived a nasty Jigsaw trap involving an exploding puppet sending shrapnel into her face thanks to the efforts of Strahm himself. The FBI faked her death in order to try and get one over on John's still unidentified Jigsaw accomplice, although Perez eventually resurfaced, only to get stabbed to death by Hoffman when his crimes were revealed.

Art Blank (Justin Louis) was one of the featured Jigsaw test subjects in Saw 4, and was chosen due to his profession. Art was a lawyer, and one with a habit of defending clients who were guilty as sin and helping them escape justice. Art had been John's friend and business partner, but after a falling out, was forced to kill another man in order to survive a trap. He was then forced to help Jigsaw set up another game, only to later be shot by cop Daniel Rigg. Morgan was a related survivor, the wife of an abusive husband and father that Art had gotten off. She had to kill her husband to live and to set herself free in more ways than one.

Brit Stevenson (Julie Benz) was one of the main test subjects in Saw 5, a corrupt corporate executive who hired an arsonist to burn down an apartment building so that she could buy the property it sat on, not realizing people were inside at the time. None of the victims in Saw 5 were without sin, but Brit and Mallick Scott, the arsonist, managed to survive multiple traps on their way to victory and rescue by the FBI.

Tara and Brent Abbott were a quite innocent mother and son who got roped into Jigsaw's Saw 6 game, which revolved around heartless insurance executive William Easton. Easton denied their husband/father live-saving care, and after Easton survived his own tests, his fate was left up to them. Tara couldn't bring herself to kill Easton, but Brent did it, instead, in a rage over his father's death.

The corrupt exec William Easton (Peter Outerbridge) survived his own tests, although not without having to make agonizing decisions along the way, including which of his also mostly corrupt employees he would save. Easton's company had also denied John Kramer potentially life-saving treatment, thus his posthumous vendetta. William opted to save his secretary, Addy, as well as other subordinates, Shelby and Emily. He was also able to save his sister Pamela by completing his game, but couldn't survive the vengeful Abbots.

Bobby Dagen (Sean Patrick Flanery) became a successful self-help guru on the back of surviving a Jigsaw trap and then writing a book about it, or at least that's his claim. None of it is true, leading him to become the main test subject of Saw 7. Bobby has to watch his wife get roasted alive in a giant oven, although he does manage to escape with his own life. Joan is a very brief character in the franchise, a Jigsaw survivor whose story Bobby uses as inspiration for his lies.

In Saw 7, Bobby Dagen chaired a support group of Jigsaw survivors, although unlike him, their stories were real. Mallick Scott survived alongside Brit Stevenson in Saw 5, losing most of his blood in the process. Simone chopped off her own arm to survive a "pound of flesh" trap in Saw 6. Brad and Ryan had to choose between killing each other, or the girlfriend who had been cheating on them both, and they chose her. Sidney had to send her abusive boyfriend into lawnmower blades. Addy and Emily from Easton's company, were also group members, as were Dr. Lawrence Gordon, and Tara Abbott.

Logan Nelson (Matt Passmore) was an Army veteran and battlefield medic who was tested after his return to civilian life saw him mess up an X-ray and accidentally delay the diagnosis of John's cancer. Logan's trap went wrong, though, and since it was John's fault, he took pity on Logan and freed him. Grateful, Logan became an apprentice and conducted the games seen in 2017's Jigsaw.

Spiral: From the Book of Saw recently continued Jigsaw's legacy, albeit with a new killer and 100 percent less John Kramer. The only test survivor in Spiral is lead protagonist Zeke Banks (Chris Rock), seemingly the one honest cop in a corrupt department full of liars and killers. Granted, he clearly wasn't intended to die, as new killer William Schenk wanted them to join forces and clean up the city. Zeke is able to free himself from a handcuff trap similar to the one in the first Saw movie and ends up getting cut up by glass trying to save his old corrupt partner. Zeke lives, but his former police chief father isn't so lucky.

[Eugene Volokh] Lindsay Lohan, Grand Theft Auto V, the First Amendment, and the Right of Publicity

The popular Grand Theft Auto V computer game has two characters allegedly based on Lindsay Lohan and on Karen Gravano (Mob Wives). Lohan and Gravano sued the game company (Take Two Interactive Software), claiming that this violated what is generally called their "right of publicity" (but "right of privacy" in New York). That right is often labeled the exclusive right to control the use of one's name, likeness, and other attributes of identity for commercial purposes -- but that shorthand can't be entirely accurate, since that would ban a wide range of First-Amendment-protected speech, such as unauthorized biographies and even newspaper articles about people (since movie, books, and newspapers are generally commercial ventures).

The New York intermediate appellate court rejected the claim, based on New York precedents that have narrowly read the relevant New York statute; the New York high court then agreed to consider the matter for itself. Shortly before Christmas, my Scott & Cyan Banister First Amendment Clinic students -- Alexandra Gianelli and Tracy Yao -- and I, with the indispensable and generous help of our local counsel, Daniel Schmutter (Hartman & Winnicki LLP), filed an amicus brief supporting the narrow view of the right of publicity, and a broad view of free speech protections. (The brief was on behalf of fourteen law professors who are knowledgeable on First Amendment law and intellectual property law, Profs. Eric M. Freedman, Brian L. Frye, Jon M. Garon, Jim Gibson, Eric Goldman, Stacey Lantagne, Mark A. Lemley, Raizel Liebler, Barry McDonald, Tyler Ochoa, Aaron Perzanowski, Betsy Rosenblatt, Rebecca Tushnet, and David Welkowitz.) Here's a quick summary of the case, from the intermediate appellate court decision:

[E]ach plaintiff alleges that defendants violated her right to privacy under New York Civil Rights Law § 51 by misappropriating her likeness for use in the video game "Grand Theft Auto V." This video game takes place in the fictional city "Los Santos," which itself is in a fictional American state of "San Andreas." Players control one of several main characters at various points in the game, engaging in approximately 80 main story missions as well as many optional random events. Plaintiffs allege that during certain optional random events, the player encounters characters that are depictions of plaintiffs.

Gravano alleges that in one of the optional random events in the video game, the character Andrea Bottino is introduced, and that her image, portrait, voice, and likeness are incorporated in this character. Specifically, Gravano argues that the character uses the same phrases she uses; that the character's father mirrors Gravano's own father; that the character's story about moving out west to safe houses mirrors Gravano's fear of being ripped out of her former life and being sent to Nebraska; that the character's story about dealing with the character's father cooperating with the state government is the same as Gravano dealing with the repercussions of her father's cooperation; and that the character's father not letting the character do a reality show is the same as Gravano's father publicly decrying her doing a reality show.

Lohan alleges that defendants used a look-alike model to evoke Lohan's persona and image. Further, Lohan argues that defendants purposefully used Lohan's bikini, shoulder-length blonde hair, jewelry, cell phone, and "signature `peace sign' pose" in one image, and used Lohan's likeness in another image by appropriating facial features, body type, physical appearance, hair, hat, sunglasses, jean shorts, and loose white top. Finally, Lohan argues that defendants used her portraits and voice impersonation in a character that is introduced to the player in a "side mission."

Using characters based on real people in works of fiction is a longstanding practice protected by the First Amendment. Creators often try to make their works true to life, and a large component of that life is celebrities. That has been done in a vast range of works, such as Brave New World, Forrest Gump, Midnight in Paris, and Seinfeld. The creators of video games, which are as protected by the First Amendment as are books and films, must have the same right.

When the state legislature enacted § 51 of the New York Civil Rights Law, it did not intend to restrict this commonly used artistic technique. Section 51 of the New York Civil Rights Law provides a limited right of privacy that prohibits the nonconsensual use of a person's voice, picture, name, or portrait for "advertising" or "trade" purposes. And New York courts have generally narrowly construed the statute as applying only to commercial advertising, to avoid conflicts with the First Amend­ment.

Because videogames are constitutionally protected creative works, like books and movies, the right of privacy statute does not apply to them, or to advertisements for them. Thus, Gravano's and Lohan's claims that Take-Two impermissibly used their likeness in Grand Theft Auto V, or in material promoting Grand Theft Auto V, must fail. (We accept for purposes of our argument the plaintiffs' assertion that the characters were indeed deliberately based on Lohan and Gravano -- though they appeared under other names -- and that viewers would recognize them as such. Of course, if that assertion is incorrect, that is even more reason to reject liability in this case.)

And this historical limitation on the right of privacy has helped New York avoid the problems faced by other jurisdictions, which have interpreted the right of privacy more broadly -- and, as a result, inconsistently, unpredictably, and with unacceptable subjectivity. Different courts applying rival tests have reached widely varying results on virtually identical facts. And both the predominate purpose test (urged by Gravano) and the transformative use test (urged by Lohan) have proved vague, too speech-restrictive, and open to discrimination in favor of what judges view as "high art" and against what they view as "low art." This court should continue reading the right of privacy as limited to commercial advertising, and thus affirm the judgment below.

And here's Part I, which argues that authors have long based characters on real people, and have a constitutional right to do so:

Creators have long worked real famous people into their fictional stories, and they have a First Amendment right to do so. "Fiction writers may be able to more persuasively, more accurately express themselves by weaving into the tale persons or events familiar to their readers.... No author should be forced into creating mythological worlds or characters wholly divorced from reality.... Surely, the range of free expression would be meaningfully reduced if prominent persons in the present and recent past were forbidden topics for the imaginations of authors of fiction." (Guglielmi v Spelling-Goldberg Productions, 25 Cal 3d 860, 869, 603 P2d 454, 460 [1979] (Bird, C.J., concurring) (concurrence endorsed by four of seven Justices).)

Thus, for instance, the creators of Seinfeld often introduced storylines where the main characters interacted with New York cultural icons to make the show's New York setting more realistic. The character "George Steinbrenner" repeatedly appears as George's boss; in one episode, Steinbrenner asks George to go to Cuba to recruit some of the country's best baseball players. In other episodes, "John F. Kennedy, Jr." meets Elaine at a fitness club and almost goes on a date with her, and "Calvin Klein" asks Kramer to model underwear for him. Similarly, the Tony-Award-winning musical Avenue Q includes Gary Coleman, the 1980s child actor, as a character. (All these characters were played by actors, not by themselves.)

Likewise, Aldous Huxley used Henry Ford's name as a deity-like reference in his 1931 novel Brave New World. The fictional society in that book reveres Ford as its creator: They celebrate Ford's Day and use his name in swearing (e.g., "Oh, for Ford's sake!"). When the book was published, Ford was a celebrity famous for revolutionizing mass production; in the late 1920s, he even tried to build his own utopian city, Fordlândia. By invoking Ford's name, Huxley instantly conveyed to his readers the principles underlying his fictional world -- efficiency, mass production, and consumerism.

Similarly, in one scene in Forrest Gump (Paramount Pictures 1994), Elvis Presley watches as Forrest begins dancing unusually because of his leg braces, and this ends up being the inspiration for Presley's signature gyrating dance moves. In other scenes, Forrest gets the Medal of Honor from Lyndon B. Johnson, and meets Richard Nixon and uncovers the Watergate scandal. [Footnote: Though New York does not recognize a post-mortem right of privacy, many other states do....]

In Midnight in Paris (Sony Pictures Classics 2011), the hero is an aspiring novelist who is transported to 1920s Paris, where he meets Zelda Fitzgerald, Ernest Hemingway, Pablo Picasso, and Salvador Dalí. These characters make the setting more realistic, and also advance the plot as they offer the hero advice and help him finish his novel.

The creators of the HBO show Silicon Valley similarly based a quirky character on Silicon Valley mogul Peter Thiel, co-founder of Paypal. Both the character and Thiel started fellowships to support young geniuses to leave school and start businesses; both built islands; and both are said to have similar speech patterns and personalities. The show also often mentions Mark Zuckerberg and other tech industry leaders to bring the culture of the modern computer business to life.

It is possible that the creators of some of these works could have gotten licenses from the people to whom they were referring -- or, what could be more difficult, from those people's scattered heirs. But they should not have to, and do not have to, get such permission (which in any event may be unavailable if the portrayal is not entirely flattering, or if the work is likely to prove controversial). Unauthorized biographies are as constitutionally protected as the authorized ones; likewise for unauthorized references to celebrities within broader works.

This case appears to involve the same literary trope as in the works discussed above: A video game set in contemporary Los Angeles may include characters based on actual celebrities -- Karen Gravano, a mob boss's daughter turned reality television star, and Lindsay Lohan, a child actress whom many grew up with -- to realistically evoke Los Angeles celebrity culture. These artistic choices shape the message that creators are trying to convey, and broadly construing the right of privacy would unduly limit First Amendment expression.

As courts have repeatedly recognized, the First Amendment must protect the right of creators to incorporate celebrity images in their creative works -- and thus must protect Take-Two's right to create a vivid, realistic portrayal of Los Angeles celebrity culture:

[*] "Because celebrities are an important part of our public vocabulary," "[r]estricting the use of celebrity identities restricts the communication of ideas" (Cardtoons, L.C. v Major League Baseball Players Assn, 95 F3d 959, 972 [10th Cir 1996] (upholding the right to use celebrity baseball player images in parody trading cards)).

[*] Celebrities "are widely used -- far more than are institutionally anchored elites -- to symbolize individual aspirations, group identities, and cultural values. Their images are thus important expressive and communicative resources: the peculiar, yet familiar idiom in which we conduct a fair portion of our cultural business and everyday conversation." (ETW Corp. v Jireh Pub., Inc., 332 F3d 915, 935 [6th Cir 2003] (upholding the right to use Tiger Woods' image in prints).)

[*] "Because celebrities take on public meaning, the appropriation of their likenesses may have important uses in uninhibited debate on public issues, particularly debates about culture and values. And because celebrities take on personal meanings to many individuals in the society, the creative appropriation of celebrity images can be an important avenue of individual expression." (Comedy III Productions, Inc. v Gary Saderup, Inc., 25 Cal 4th 387, 397, 21 P3d 797, 803 [2001].)

The right of publicity thus "has the potential of censoring significant expression by suppressing alternative versions of celebrity images that are iconoclastic, irreverent, or otherwise attempt to redefine the celebrity's meaning" (id.). And this Court should avoid this consequence by narrowly construing the right of privacy statute in a way that leaves creators free to build characters based on celebrities.

Later parts argue that

video games are as protected by the First Amendment as other expressive works,

New York state cases have largely (with some exceptions not relevant here) read the relevant state statute as limited to commercial advertising,

New York cases have read the statute as limited to explicit use of a person's name or likeness, and

the court should continue to narrowly construe the statute to avoid First Amendment problems -- problems that have amply manifested themselves in those jurisdictions that have used less speech-protective tests for the right of publicity.
