I had a short article published in the Dallas Bar Association Headnotes entitled Enforcing the Affidavit of Support in Texas Courts. The article looks enforcement of the I-864 Affidavit of Support, which creates a legally binding obligation on certain immigration sponsors to support immigration beneficiaries at 125% of the Federal Poverty Guidelines, Texas courts hold that the I-864 creates a binding contract which can be enforced and does create a support obligation after divorce when timely plead and where the obligation remains in effect because the beneficiary alien has not worked or been credited with 40 qualifying quarters under the SSA or become a United States citizen. I wish I could have discussed more about the history of court cases enforcing the Affidavit of Support because they involve an interesting combination of contract law and statutory interpretation, but unfortunately there wasn't enough space. #immigration #law (at Arts District Mansion) https://www.instagram.com/p/ClhbGREONNo/?igshid=NGJjMDIxMWI=

On March 31, 2017, USCIS issued a memorandum rescinding a 2000 memorandum finding that the occupational classification of Computer Programmer was a Specialty Occupation. A position must be a specialty occupation, or occupation requiring a four year degree in a field related to the occupation, in order to qualify under the H-1B program. The determination that not all Computer Programmer positions are specialty occupations could have a significant impact on the H-1B eligibility for entry-level computer occupations.

On March 31, 2017, USCIS announced there would be delays in the receipting of H-1B petitions filed under the Premium Processing Program at the Nebraska Service Center. The delays are a result of data entry problems occurring because of increased H-1B petitions received. Receipting of cases is expected to take 10 days.

On April 3, 2017, USCIS announced a program to deter and detect H-1B fraud and abuse. In the announcement, USCIS stated that too many American workers are ignored or unfairly disadvantaged as a result of the H‑1B visa program.
