SANTA FE – Just weeks before a bill legalizing recreational cannabis in New Mexico takes effect, one of the new law’s primary legislative sponsors has announced she is opening a “full-service” marijuana law firm.
The disclosure by Sen. Katy Duhigg, D-Albuquerque, could renew debate over the state’s citizen Legislature – New Mexico is the only state that does not pay its lawmakers a salary – and prompt conflict of interest questions.

Duhigg said Tuesday the idea of a legal practice focused on the state’s new weed industry was not on her mind during this year’s 60-day legislative session and a special session called shortly thereafter, but emerged as a possibility in recent weeks. BUY DABWOODS CART ONLINE
“Certainly, had I been planning this when the bill went through I would have disclosed it,” Duhigg told the Journal.
She also said she would disclose her legal work on cannabis-related issues if bills dealing with the fledgling industry are proposed at the Roundhouse in coming legislative sessions, and would recuse herself from voting in the possible instance of a direct financial benefit.
But the first-term senator, a licensed attorney and former Albuquerque city clerk, pointed out many lawmakers who are not retired debate bills that deal with their livelihoods, including teachers voting on annual budget bills that largely set their pay levels.
“This is the inherent tension of having a citizen Legislature,” Duhigg said. “Unless only independently wealthy and retired people serve, we’re always going to be running into these issues.”
She said the best “fix” to the situation would be paying lawmakers for their work, an idea that has gained some traction in recent legislative sessions but has not been approved.
Currently, lawmakers get a $194 per diem payment aimed at covering daily food and lodging expenses for each day of legislative work and can also participate in a legislative pension plan, but are barred by the state Constitution from receiving a salary. BUY DABWOODS CART ONLINE
Several other lawmakers have also drawn scrutiny in recent years for their legal work representing cannabis producers, namely House Speaker Brian Egolf, D-Santa Fe, and Sen. Jacob Candelaria, D-Albuquerque.
Specifically, Candelaria was the target of an ethics complaint filed in March by state Health Secretary Tracie Collins that accused the three-term senator of having a conflict of interest in his vocal opposition to a bill aimed at changing a patient definition within the state’s medical cannabis program.
Candelaria disclosed during this year’s session that he has represented Ultra Health LLC, the state’s largest medical marijuana producer, in court cases but has insisted he has followed all legal and ethical guidelines.
He said Tuesday that legislative leaders had dismissed the complaint, which was also dismissed by the state Ethics Commission in April for jurisdictional reasons.
Meanwhile, Gov. Michelle Lujan Grisham’s spokesman Tripp Stelnicki said Tuesday the governor’s administration would only raise concerns about a potential conflict of interest if a legislator, in the course of their work and legislative actions, gave reason to suspect a conflict might exist.
“Simply trying to make a living isn’t on its own something you can say is problematic, especially because we have a citizen Legislature, a point I know the speaker has made in the past,” Stelnicki told the Journal.
The bill passed by legislators during the two-day March special session called by Lujan Grisham included an amendment sponsored by Sen. Stuart Ingle, R-Portales, that bars lawmakers from seeking cannabis production or retail licenses until July 2026.
But the amendment does not prohibit legislators from working on cannabis-related issues, including as attorneys.
Duhigg, who was the top Senate sponsor of the bill during the special session, said her new law firm – she opened it along with a partner – will focus on helping smaller cannabis start-ups apply for microbusiness licenses, deal with zoning issues and more. BUY DABWOODS CART ONLINE
While commercial sales of cannabis will likely not start until next year under the legalization bill signed into law by Lujan Grisham, possession of small amounts of marijuana will become legal June 29. The 2020 elections had cannabis reform ballot initiatives in Montana. Residents of the states came out to show their support for the initiative, and the measure got over 50% support. This made Montana one of only five states in the U.S. to adopt a cannabis reform initiative during the 2020 elections.

This bill also states that a fine of up to $100 can be issued to residents found transporting cannabis products under unsafe conditions. All transported products must be in their original packaging and placed either in the trunk or in the glove compartment. Public smokers will also be issued fines of up to $50, as the bill prohibits the smoking of pot in public spaces. Although, the state promises to single out places or establishments that will be licensed for the consumption of cannabis.
HB 701 only allows marijuana plants with a THC content of no more than 35%. Edibles and capsules can contain at most 100 milligrams of THC per capsule. The total THC content in a package of capsules or edibles must not exceed 800 milligrams.
The bill touches every aspect involved in the sales of recreational cannabis, from starting a new regulatory body to stating the amount of THC content that would be permissible. Implementing this law would take time, and a lot of work would have to be done to ensure the law is implemented successfully.
What is expected in the next months?
The I-190 has already set down a system on how the revenues from legal cannabis can be handled. Just a few tweaks here and there will ensure the scheme is rigid enough to handle the huge revenues that would be pouring in as soon as sales begin. BUY DABWOODS CART ONLINE
The Department of Revenue has been tasked with the objective of regulating the newly permitted cannabis enterprises in the state. The department will issue licenses for cultivation, manufacture, sale, laboratory testing, and also transportation of cannabis products in the state.

For now, the legislature plans to allocate these funds to the cost of veterans services, a park, and maintenance of the trails. There have been talks that the funds might also cover the acquisition of conservation easements in Montana.
These plans may be changed, as sessions are still being held to discuss other strategies the finds can be saved or spent.

There are also fears that some residents may be pushed to the black market because of the 20 percent imposed sales tax. Due to this, some advocates have called that the percentage of tax be reduced.
Governor Gianforte in a statement showed his dedication to combating the drug epidemic in the state. His office promises to fund several programs for substance abuse prevention treatment in Montana communities. These funds will also give a chance to those Montanans who wish to quit using and get sober. Most of these programs will be non-profit.
The Governor also emphasized that House Bill 701 is the best way to implement the will of Montanans in a responsible and regulated way.
Last Words
It is the beginning of a new dawn in Montana. Although this is still the early stages and it’s still unclear if any of the counties will be willing to opt-out of these new reforms, the Department of Revenue is getting prepared to begin the management of all marijuana programs in the state, as well as integrate some workers from the department of public health and human services for the smooth running of operations.
Whichever way this unfolds, Montana is about to make a ton of money.

Marijuana isn't actually very green, it turns out. Cannabis is the most energy-intensive crop in the U.S., Politico reports — though it needn't be. Grown in warehouses, marijuana production can require 2,000 watts of electricity per square meter, versus about 50 watts for lettuce, Lawrence Berkeley National Laboratory found. But marijuana grows great outdoors — it is called "weed" for a reason — in some areas of the country, especially Northern California and Southern Oregon.
"Because cannabis remains federally illegal, and the federal government regulates interstate commerce, none of the legal cannabis grown in Oregon or California can cross state lines," Politico's Natalie Fertig and Gavin Bade write. "Instead, each new state that legalizes recreational marijuana must also grow enough to meet consumer demand in that state. Some states and cities require indoor cannabis operations to use energy-efficient LED grow lights or take other steps to mitigate carbon emissions, but "reducing the environmental impact of cannabis in state-siloed markets is not simple — or cheap," Politico says. Esther Witkos, the wife of state Sen. Kevin Witkos, R-Canton — who was the lone Republican to vote yes when the Senate voted 19-17 to approve a controversial bill to legalize recreational use of marijuana — has a job with Curaleaf, a medical marijuana grower/producer, state records show.
Witkos, a six-term senator and former police officer, made no comments early Tuesday morning before he voted along with 18 Democrats to give Senate approval to the bill, which now goes to the House — where legislative Republicans are vowing a stormy fight over it in the remaining time before midnight Wednesday, when the 2021 regular legislative session is scheduled for adjournment.
He said in a phone interview Tuesday that his wife has been an hourly worker at the Curaleaf production facility in Simsbury for more than a year. He said he had nothing to do with her getting a job there, and her employment there had no bearing on his vote.
“I didn’t think it was a conflict of interest, whatsoever,” said Witkos, so he didn’t feel he needed to check with state ethics officials — as he did a few years ago when he was on a committee that oversees energy and took a job with Eversource. (Ethics officials okayed his hiring by the utility.)
Witkos said his vote Tuesday was consistent with his position 19 years ago, when as a House member he introduced an unsuccessful bill to decriminalize marijuana.
The income that Esther Witkos received from Curaleaf — which operates one of the four state-licensed facilities where cannabis is grown and processed — appeared on a newly filed “statement of financial interests for 2020″ that state officials had to file by May 3 with the Office of State Ethics.
The state financial interest form requires no detail as to amounts of income or whether it’s derived from a full-time or part-time employment position.
All it says, in the case of Witkos, is that there was income in the form of “salary/wages” for his “spouse,” and the source was “Curaleaf.”
His vote is a situation that some would consider a conflict of interest that would require him to abstain or make a public declaration of his wife’s employment, but the state statutes known as the Code of Ethics for Public Officials leave lawmakers a lot of wiggle room in cases like this. In similar situations in the past, lawmakers who’ve voted on measures affecting their families haven’t gotten in trouble because of how much leeway is written into the law.
For example, here is what the ethics office’s guidebook for legislators says in giving an example about cases like this:
“A legislator’s spouse is employed by Company X, but is not a director, officer, owner, etc., meaning that Company X is not a business with which the legislator is ‘associated.’ Thus, the legislator may take official action on legislation that will impact the spouse’s employer, provided that there will be no direct financial impact on the legislator’s spouse, and that the employer did not improperly influence the legislator.”
The income for Esther Witkos from Curaleaf was new in 2020; on the senator’s 2019 report, he listed income for his spouse from a funeral home.
Curaleaf’s large production facility is in Simsbury, and it has four locations around the state — Hartford, Groton, Stamford and Milford — where medical marijuana can be purchased by holders of an authorized medical marijuana card, if they have registered at that location.
The cannabis bill that passed in the Senate includes a section that allows medical marijuana growers — with authorization from the state — to expand into the new recreational market. They must pay a “conversion fee” of $1.5 million or $3 million, depending on whether or not they are participating in an “equity joint venture” that is at least 50% owned by “social equity applicants” who meet income thresholds and are residents of an area with unemployment rates or drug conviction rates of more than 10%. The producers must also contribute $500,000 to a program to assist those applicants with applying for licenses.
The language from the ethics guidebook item, quoted above, was based on the ethics agency’s Advisory Opinion No. 93-4, which had to do with former state Sen. Catherine Cook’s husband, Roger Cook, who was vice president of E.G. & G. WASC, Inc. a defense subcontractor.
Cook, the senator, was a member of the legislative commerce committee, and she asked if it was permissible to vote on bills which deal with manufacturing assistance and defense diversification. She stated that she and her husband held only a small number of shares of stock in the company.
The opinion said: “E.G. & G. WASC, Inc. is not a business with which the Senator is associated, for purposes of the Code, since neither she nor her spouse hold five percent or more of the total outstanding stock and Mr. Cook is neither a director nor one of the requisite officers. In this matter, Mr. Cook’s employer may well benefit from the passage of any favorable defense or manufacturing assistance bills; but, in general, such legislation would not have any direct financial impact on either Senator Cook or her spouse.”
“The Commission has previously ruled that the Code does not specifically prohibit a public official from taking official action which would benefit one’s employer, unless the employer had improperly influenced the legislator.”

Washington is not the only U.S. state to get creative in incentivizing people to receive a COVID-19 vaccine.
