More Countries (including India) soon to face EB-5 Visa Retrogression

April 23, 2018, at the IIUSA Annual Conference in Washington DC, Charlie Oppenheim, Chief of the Visa Controls Office at the US Department of State delivered the breaking news that more countries would face final action dates, leading to visa retrogression. Interestingly, EB-5 funding was not originally intended for real estate. EB-5 is a job creation program; however, the most prevalent use of EB-5 financing has been in real estate projects of various types: from hotels to condominiums to large mixed-use developments, with projects all over the United States. There has been an alarming trend, first by the consular officers in Asia and now through Department of Homeland Security/USCIS (USCIS) to suspect and deny cases merely because the foreign worker applicant has engaged the services of a migration agent involved in the Employment-based immigration process.

As of this afternoon, the members of the Board of IIUSA, EB-5’s main trade association and advocacy group, voted unanimously in favor of draft reform legislation for the program. With the blessings of the EB-5 industry’s key players conveyed to Capitol Hill, it is safe to say that long-awaited changes to EB-5 are finally imminent. While the bill is not perfect, it is unrealistic to assume that a compromise that would have satisfied all of EB-5’s diverse players would have ever been reached.
