In light of the recent PostPlus nonsense tumblr is trying to pull, here's a reminder that monetization of fanfiction can lead you to legal trouble. On Ao3 it's against the TOS to even mention any money-sending site at all because of the conditonal protection they offer.

Putting your entire fanfiction blog behind a paywall is like pointing a neon sign saying "please sue me". I bring this up specifically because tumblr mentioned fanfiction in the post that they made and that is going to leave a lot of people misinformed.

Remember: Do NOT paywall your fanworks.

And rest assured, my blog will never be pay-to-read, even if this weren't a fanfiction blog. I think the whole thing is ridiculous.

some very important info re: paid accounts~

I am not a lawyer, but I can decently interpret legalese and, being as I also suffer from tl;dr syndrome and assume others may as well, I took one for the team and went through the updated TOS for the post+ accounts and highlighted (what I understand to be) the most pertinent information, which ultimately comes down to this:

You cannot monetize copyrighted works (aka charge and earn money from fanfic, fanworks, etc) and if you do decide to put your fanworks behind a paywall via Tumblr, when you are inevitably sued, Tumblr will not protect you and will not defend you and you alone, personally, will be responsible for whatever monetary damages said lawsuit results in.

If anyone is a lawyer and knows I've gotten any of this wrong, please do not hesitate to correct me/this post.

1. Your paid account will not be hosted by tumblr; it is routed through a 3rd party.

2. By signing up for a paid account, you're entering into an agreement with Stripe, so in addition to Tumblr's TOS, you are also bound to Stripe's TOS.

3. Stripe, like Tumblr, will not defend you or protect you against any lawsuits.

4. Furthermore, you may end up owing Stripe money (indemnify = compensate)

5. Tumblr's TOS specifically states that you can't put any content on your post+ account that violates any laws, including laws that protect intellectual property rights of others. This is super important, because Tumblr's post+ FAQ also states that you can post anything that you would regularly post on tumblr, which I'm sure many will take to mean that gifsets, fanworks, etc are fair game, since all of that stuff can be posted on tumblr now. However, the difference is, you're not making money from the fanworks you're posting or reblogging now. Once money enters the equation, the game changes.

Tumblr is making it seem like any and all content goes for post+ accounts, knowing 90% of this site is fanworks. This is not true and you'll be opening yourself up for lawsuits if you charge for fanworks.

6. Tumblr further disclaims any and all liability in any legal issues.

tl;dr: Please do not make a post+ account, bc you will be opening yourself to lawsuits and if that happens, Tumblr's response will be not our problem, you agreed to all the terms which said you couldn't do that, sorry not sorry. Please protect yourself.

El grupo de estudiantes estaba reunido en torno a una fogata que se apagaría en cualquier momento. La noche había llegado con niebla y una considerable baja de temperatura, pero eso no impedía que siguieran al aire libre un rato más.

—¿Eres una gallina, Parker?

Cacareos llegaron a sus oídos a modo de burlas, y eso fue lo que colmó su paciencia.

—¡De acuerdo, iré!

Cuando aceptó la apuesta de Quentin no había tenido en mente perderla. Por eso él fue el encargado de poner la prenda, por eso él eligió pasar una hora dentro de la casa abandonada en medio del bosque. El grupo de amigos de Quentin siempre la pasaba ahí, y tardaban no más de cinco minutos en llegar hasta sus puertas desde el lugar en el que estaban.

—Yo iré contigo —le dijo—. No confío en que estés ahí por más de diez minutos.

Peter lo miró con desconfianza, pero debía decir que tenía razón. De alguna manera haría todo lo posible por escapar de ahí. Esa era la desventaja de que Quentin lo conociera de pequeño. Ambos llegaron en medio de la niebla a la casa abandonada.

—¿Quieres abrir la puerta?

Quentin pudo sentir que Peter estaba agarrando la parte inferior de su buzo, y sonrió de lado. Quizás no estaba en sus planes hablarle con voz temblorosa pero también estaba haciendo eso. La puerta se abrió haciendo un ruido que hizo que hasta Quentin sintiera escalofríos recorriéndole la espina dorsal. Su mirada se posó unos segundos sobre Peter que se asomaba por un costado para espiar dentro de la casa. Entraron al largo y estrecho pasillo. En medio había una bicicleta que Quentin hizo a un lado con el pie.

—¿Te doy la mano o estás bien?

—Estoy perfectamente bien.

Peter mencionó cada palabra con énfasis. Quentin agarró su mano y la metió dentro de su bolsillo.

—Camina al lado mío.

Lo único que oían era el sonido de sus pasos y el viento que hacía raspar las ramas de los árboles sobre el piso superior.

—No soy una gallina —murmuró Peter de la nada.

—No dije que lo fueras. Pero también sé el terror que te dan estas cosas. Te hace recordar cosas feas, ¿no? —su amigo lo miró, pero no dijo nada al respecto—. Quedémonos un rato. Hay una salida en la parte de atrás. Podremos regresar cuando se haya cumplido la hora.

El plan de Quentin siempre había sido en realidad: quedarse un rato recorriendo la casa, escapar, y después volver al punto de encuentro. Estaban caminando por el segundo piso cuando a Peter le pareció oír algo a sus espaldas.

—¿Oíste eso?

Quentin notó qué la mano que sostenía sudaba.

—¿Qué cosa?

—Suena como un piano...

—Hay uno en alguna de estas habitaciones...

—Pero, no hay nadie más en la casa, ¿o sí?

—Si estas tratando de preguntar si les dije a alguno de los chicos que vinieran a jugarte una mala pasada, me ofende que pienses eso de mí.

—Entonces, ¿quién está tocando?

—Mejor vayamos yendo —dijo Quentin mientras le sonreía con una calma que no sentía. Sin darse cuenta, su mano había apretado la de Peter con fuerza. Sin haberse quedado mucho tiempo, salieron de la casa y tomaron el camino que los llevaría sin ser vistos a su casa. Cuando las luces del pueblo estaban lo suficientemente cerca como para sentirse a salvo, Quentin terminó con el silencio que se había formado entre ambos—. Hay una leyenda sobre esa casa. Se dice que su dueño perdió a la persona que amaba por una enfermedad y él perdió la razón. Cada día tocaba el piano a la misma hora, hasta que en una ocasión usó ese mismo piano para llegar al techo y colgar una soga que terminó con su vida.

—¿A qué hora fue eso?

Quentin detuvo sus pasos y soltó la mano de Peter para ver su reloj de muñeca. Soltó una risa y una gota de sudor bajó por su rostro. Se giró para que su acompañante pudiera ver lo que marcaba el reloj digital.

—¿Qué hora tienes tú?

Quentin closes his eyes. “Oh, Peter, baby,” he says. “Good answer,” and Peter shivers.

I wrote this text in English class for creative writing and my teacher loved it, so I decided to post it here

"Happy Birthday"

Quentin had already told his boyfriend Peter that there would be a night event in the museum today. He figured it might be some kind of Gala or some important event Quentin wanted to take him to. The tickets for the event had been hanging in their flat for weeks and Peter had grown more and more impatient, since it was a special day for another reason aswell. When it was finally time to go, he couldn't hold back his excitement, couldn't hide it from the man "You really are excited, huh?" He said and chuckled, stroking through the boys caramel curls. Peter nodded "Yes, I am, I can't wait to see it" Even though he didn't know what It really was.

After they had eaten something and dressed themselves, they finally drove to the museum with the car. And when Peter realized it was a show about the stars and the universe, he was even happier. But the happiness didn't last long. When they arrived at the museum, they were informed that the show wouldn't happen. There had been some kind of leak and half of the museum was full with water now. Peter seemed pretty sad about it, so the older man decided to take him into his favorite fancy restaurant. Peter was still a bit disappointed, but the atmosphere in the restaurant was nice and the soft music lifted his mood aswell. When he saw outside the window, he saw the night sky full with stars, and he also spotted the church tower with the big golden bell. They ordered their food and drinks, and it didn't take long until the bell rang. Quentin looked at his watch and smiled "Happy Birthday, Peter" The man softly said and Peter smiled. It still felt like a great birthday to him, even though it was just starting. They had planned to spend a beautiful evening a while ago, before Peters Birthday, celebrate into midnight, and then take time for themselves with cuddling, watching a movie, baking, and other cute activities for Peters real birthday, so he'd have two events in one, but could take time for himself. And he realized that concept worked pretty well. He hadn't felt happier before. He really did love Quentin.
