PNGs Attorney General and Deputy PM are fugitives
Sitting in a one man Supreme Court bench, Acting Deputy Chief Justice, Justice Bernard Sakora issue a bench warrant to arrest the Deputy Prime Minister Belden Namah and Attorney General Allan Marat.Details below:

Justice Sakora sat in that building and issued the warrant to arrest Belden Namah the Deputy Prime Minister and his amigo Attorney General Allan Marat.

INTERIM ORDER
WHEREAS it was announced this evening, through the National EMTV and the Kundu Two television networks, by the Deputy Prime Minister and Acting Prime Minister the Hon Belden Namah and the Attorney -General the Hon Dr Allan Allan Marat, that the Chief Justice Sir Salamo Injia has been suspended from office based on overwhelming allegations against him ranging from police report that the " Deputy Chief Justice and the former Registrar of the National Court Ian Augerea are facing contempt charges in relation to entitlements under the estate of the late Justice Timothy Hinchliffe, misconduct and double dipping in relation to SRC entitlements on to housing and security allowances, gross mismanagement of cases in the Supreme and National Courts, and also conflict of interest in cases";
AND WHEREAS a tribunal comprising former Justice Paul Akuram as Chairman and the Hon Justices Collin Makail and George Manuhu as members, having been appointed to investigate those allegations;
AND WHEREAS the Chief Justice has not been duly informed of the allegations against him and has not been duly served with the notice of suspension;
AND WHEREAS the Chief Justice had presided over the hearing of this Reference which concluded on Friday 28th October 2011, and the decision is pending on Friday 9th December 2011;
AND WHEREAS the said decisions and actions of the National Executive Council amount to contempt of the Supreme Court;
THE COURT ORDERS THAT UNTIL FURTHER ORDERS OF THIS COURT:
1. Pending formal charges of contempt being laid by the Registrar of the Supreme Court against the Hon Belden Namah and the Hon Dr Allan Marat, that they both be arrested and detained by the police forthwith and produced to this Court on Monday 12th December 2011 at 9:30 am;
2) The Registrar of the Supreme Court shall file and serve the charges on the two alleged contemnors the Hon Belden Namah and the Hon Dr Allan Marat within seven days, such charges to be made returnable on Monday 12th December 2011 at 9:30 am;
3. The said decisions of the National Executive Council are hereby stayed, and that the National Executive Council by its servants and agents whosoever including the Hon Belden Namah and the Hon Dr Allan Marat, are restrained from implementing the said decisions; and
4. The Registrar shall file an affidavit of service and execution of these orders forthwith.

Namah suspends Injia

The Government of Papua New Guinea under Acting Prime Minister Belden Namah has suspended the Chief Justice. Sir Salamo Injia is facing contempt charges & and the Government also alleges that he double-dipped allowances and mismanaged court finances.

If its true – we are in deep shit.
If its false – we are in deep shit.
As it is – we are still in deep shit.
The allegations are serious and it is the first time such has been levelled against a serving Chief-Justice and if true, will have repercussions on the impeccability of the PNG Judiciary.If the allegations are false, then here is a Government which has acted not in good faith, especially when the Chief Justice will be handing down a landmark decision on December 9 that will virtually make or break the current Government.
The move by the Government is highly suspect.Section 179 of the Constitution of Papua New Guinea provides for the removal of the Chief Justice and states that if the National Executive Council is satisfied that the question of the removal from office of the Chief Justice should be investigated, the Head of State, acting with, and in accordance with, the advice of the National Executive Council, may appoint a appoint a quasi-judicial tribunal under Section 181 of the Constitution and refer the matter, together with a statement of the reasons for its opinion, to the tribunal for investigation and report to it.
If the tribunal reports that there are good grounds for removing the Chief Justice from office, the Head of State, acting with, and in accordance with, the advice of the National Executive Council, may, by notice in writing to the Chief Justice, remove him from office.Section 182 of the Constitution provides for the suspension of the Chief Justice and states that the Head of State, acting with, and in accordance with, the advice of the National Executive Council, in the case of the Chief Justice may suspend the person concerned from office pending the report of the tribunal, and may remove the suspension at any time.The suspension will be by default on full pay.
It appears Madang Regional MP and former Chief Justice Arnold Amet’s statements in the dailies is true. The Government denied it had a vendetta on the the Chief Justice, dismissing Amet’s claims as sensational and seeking to cause unfounded restlessness in the public.
The Government now maintains it is just carrying out its constitutional obligation. Section 182 s (3) allows Sir Salamo Injia to continue on the bench for cases of his that are still pending unless the Judicial and Legal Services otherwise orders. The decision of the legitimacy of the O’Neill Namah Government is one such pending case the decision of which is scheduled for December 9.

PNG Declared a Republic

Papua New Guinea has officially been declared a Banana Republic. Speaking on Independence Hill in Waigani, His Excellency Grand Chief Mr. President PROUDLY proclaimed the banana republic. The Old Constitution was handed to the Chief Justice and he was dismissed from Office.
The New Chief Justice swore in the New President of the Banana Republic under a New republican Constitution. “I President His Excellency Grand Chief Mr. President do solemnly swear to protect the banana republic against hurricanes like the one that devastated Queensland’s’ banana crops!” His Excellency Grand Chief Mr. President swore, in front of a delightful crowd of banana growers from Queensland.
When asked why the banana growers of Queensland had come to PNG to witness the creation of the republic, one banana grower said, “Mate, we’re here to show our support for Mr. Corrupt Politician who is supporting Queensland’s Tourism industry which of course buys our bananas to feed the tourists.” Mr. Corrupt Politician was unavailable for comment.
Another banana grower said he had planted some Republic of Papua New Guinea bananas on his farm in Queensland. “Mate, we Queenslanders are very proud of our relationship with corrupt Papua New Guinean mates. Each year they assist our local economy. They steal your money and come down –under for holidays or to buy property,” he added.
The Governor General, who is away in Queensland on important matters of State, has congratulated the New Banana Republic. He said he might be joining the Seasonal Workers Scheme now that a Republic has been declared.
Former Australian Prime Minister has also congratulated His Excellency Grand Chief Mr. President. In a short sms he said, “I told you so. You were going to be a failed state without ECP. I would have called but my phone said ID24”
The Queen of course has been very upset considering that the crown has been deposed for a banana. There are unconfirmed reports that Buckingham Palace is demanding compensation of 1 million Tolai tambu coils, 1 million bagi necklaces, 1 million Kina shells, 100 pigs, 100 cassowaries and 100 pythons as compensation for deposing the crown.
The matter is now being discussed by deadly serious tribal leaders still loyal to Misus Kwin, as Her Majesty is known in these parts of Her Realm. Gulf and Sepik Chiefs aren’t happy that The Palace hasn’t requested for crocodiles.
His Excellency Grand Chief Mr. President has stated that his first order of business would be to stop all logging operations and to nullify all Special Agriculture Business Leases. “By doing this I want to show all Papua New Guineans that I’ve got nothing to hide.” His Excellency Grand Chief Mr. President said.
Citizens throughout the banana republic have been celebrating this new development. “Mipla laikim divelopment. Mipla laikim goods na sevises mas kam daun long ol grassrutz pipol. His Excellency Grand Chief Mr. President em trupla lida man,” one emotional caller said on Giaman FM.
A large fireworks display sponsored by the Hanuabada Home Brewers Association, is expected this evening at Ela Beach in Port Moresby. His Excellency Grand Chief Mr. President has refused an invitation from the Home Brewers because as a faithful Seventh Day Adventist, he doesn’t drink.
Meanwhile the Speaker of Parliament has called an emergency session of Parliament to be held at Suncorp Stadium after the State of Origin match between Queensland and New South Wales. Speaking via Wikileaks the Speaker said, “All MPs opposed to the New Banana Republic must wear New South Wales jerseys because they’re all losers”.
As a NSW fan I am appalled by the Speaker’s comments but anyway that’s another story.
