Cyber Criminals Defraud Police Officers in HCP Scam

Cyber criminals are now targeting both ordinary and special individuals, including police personnel. A recent case in Noida involved cyber criminals who used a traffic police officer's name to fraudulently obtain personal loans and gold loans. Noida police have registered a report and are investigating the case.
The head constable Vikas Kumar, who is stationed in the traffic police in Sector-58 of Noida, filed a complaint that cyber criminals used his documents such as PAN card and Aadhaar card to obtain various loans such as personal loans, gold loans, currency loans, credit card loans, etc., in his name. The victim became aware of the fraud when he went to a bank to inquire about a loan. The bank informed him that his civil score was low, which prompted him to investigate further. He found out that several types of loans were running in his name, but they had not been repaid. The head constable then lodged a complaint with the police. The Sector-58 police are investigating the case.
In recent days, many such cases have emerged in NCR and surrounding states where police officers have become trapped in the cyber criminal's trap. Only a few days ago, cybercriminals withdrew Rs 4 lakhs from a police officer's account. Similarly, a retired police officer was recently cheated of over Rs 20 lakhs in the name of his pension.

A fraud syndicate made of of five Nigerian nationals have been arrested in India. The Nigerians living illegally in India, and a Bhutanese woman were arrested for duping hundreds of women in India and several other countries, of lakhs of rupees on dating applications. The suspects identified as Okolie Stephen, Okolie Prosper, Okosindhi Micheal, Umad Roland, Okolie Daniel, and Kunjgmo, were arrested by Gautam Buddha Nagar Noida Police on Sunday, March 5, 2023. The 36-year-old female suspect, Kunjgmo, from Trongsa in Bhutan, is married to a Nigerian man, who is also a part of the gang but is currently in Nigeria. The suspects created fake dating profiles by pretending to be Indian doctors living abroad, or doctors of other nationalities, on apps such as Tinder, Bumble, OkCupid, Badoo and Hinge, said investigators. The suspects then connected with women and befriended them, said officers, adding that after gaining their trust, the suspects told the women that they were coming to India on a certain date to meet them. "Then these men called the women and said they were stopped at the airport by customs officials because they were carrying large amount of foreign currency or expensive gifts. The arrested woman suspect posed as a customs official and spoke to these women. She asked the women to pay a certain amount as customs duty to secure the release of their friend,” said deputy commissioner of police (Noida) Harish Chander. The victims of the fraud, who were under the impression that the suspects were wealthy doctors, transferred money after the men assured them that they would pay them back, said investigators. “This gang has been operating for the past seven to eight years and we have come to know that they have duped hundreds of women so far, not just from India but also from other countries, including Portugal, Sweden and the Netherlands,” said assistant commissioner of police (Noida-1) Rajneesh Verma. After a more than six-hours interrogation, investigators learned that the suspects used translation software to talk to women of different nationalities in their own languages. “We seized 17 phones from the suspects and saw at least 30-35 chats with different women on every phone. This means that the group was planning to cheat 500 women in the past month alone. They have fake accounts even on dating apps that are considered very safe for women. To further establish their authenticity, they changed their VPNs so that women would believe where they are calling from,” added Verma. He said the suspects spoke to the women on phone but did not do video calls. “When the women asked to speak to the men on video, the men stuck a white paper on the camera and claimed the camera was not working,” said Verma. He said after receiving the money in bank accounts set up under false identities, they broke off contact with the women after a couple of days. Then, they got the money converted to Nigerian currency Naira before using it. The suspects came from Nigeria to India in 2021 on education and medical visa of six months but stayed back illegally. They live in Supertech Golf Country along the Yamuna Expressway. A case has been registered against them at the Sector 20 police station under Section 420 (cheating and dishonestly inducing delivery of property) and other sections of the IT Act. They were produced before a magistrate and sent to judicial custody. Police have recovered three laptops, a two-wheeler, three passports and ₹40,000 from the suspects and have also seized a bank account linked to them that has ₹1.25 lakh. “We are going to inform the Nigerian embassy about the gang and its activities. We are confirming the exact status of their passports and visas as we have still not recovered passports of two suspects,” said Chander. Read the full article

Two Nigerian nationals, Akuchie Ifeanyi Franklin and Fidel Ndubuisi, have been arrested in India for alleged involvement in online fraud.
The cyber police in Kerala arrested Akuchie, from Bengaluru on Monday, January 23, 2023, following a complaint by a Nallalam resident who had reportedly lost around N11m in the fraud operated by the suspect and his two aides.
The accused, who expressed interest in purchasing the products, allegedly forged the domain of Wells Fargo, an American bank, and convinced the complainant that he could complete the transaction provided that the complainant made a temporary payment of ?20 lakh to his account.
The accused had also allegedly forged a WhatsApp account and sent messages in the names of Reserve Bank of India officials to mislead the seller. Later, he claimed that he would return the amount to the seller once the formalities were over.
It was in March 2022 that the complaint was registered at the cyber police station. The police had earlier arrested two of Franklin’s Nigerian partners — Emmanuel James Legbeti and Daniel Oyewale Olayinka.
Police sources said the three accused were nabbed and charged under various sections of the Information Technology Act and the Indian Penal Code after tracing phone calls and social media accounts.
The investigation team had also managed to seize a few electronic devices that were used by the suspects.
Similarly, Cyber Crime Police Station of Avadi Police Commissionerate in Chennai arrested Ndubuisi and sent him to Central Puzal Prison.
According to the police, Ndubuisi was previously arrested by the Tuthukodi Cyber Crime Police for an online fraudulent cheating case.

Man flees Hotel Leela Palace without paying Rs 23 L bill

A man, impersonating as the United Arab Emirates (UAE) government functionary, stayed at Hotel Leela Palace in the Sarojini Nagar area for three months and fled without settling his outstanding bill of more than Rs 23 lakh.
Mahamed Sharif stayed at the hotel from August 1, 2022, till November 20, and fled without settling a bill of Rs 23,46,413, as per hotel staff.
According to an FIR accessed by IANS, the man checked into the hotel with a fake business card and posed as an important functionary of the government of UAE office of His Highness Sheikh Falah Bin Zayed AL Nahyan.
"He also gave a resident card of the United Arab Emirates on arrival. It seems the guest purposely gave these cards to create a false image and garner extra trust with an intent to cheat/deceive the hotel at a later stage," stated the FIR.

Make us to invest on the infrastructure and employment and introduced fake person.
We never thought someone could down themselves for the sake of money. She defrauded us with a project. In return she is mailing do whatever you want.

2. Kewal Ahuja remains as Key management in both the company. Both are related parties; spice is a sister concern of SGF.
3. The sister concern- spice’s reported turnover for last 3 years is as follows:

It is clear from the reports that huge funds were abruptly collected from the franchisees and the fee collected by SGF, was not reported to regulators such as Income Tax Department and GST Council under regulatory filings. SGF is non-compliant in MCA filings as well. This report highlights the compliance irregularities and potential financial fraud. SGF in all these 3 years have reported NIL returns in GST and Income tax. However, the sister concern’s reported top line is mentioned above. This shows a potential angle of fund misappropriation by Kewal Ahuja. SGF has a track record of statutory non-compliance as well. The details are as follows:
· SGF was formed in year 2019 and first auditor was appointed on February 25th, 2019, however till march 2019, there was no available record with MCA for financial and annual filing.
· Second auditor was appointed in SGF on 31/12/2020 for the period from 1st April 2019 till 31st March 2024, there is again no available record with MCA for financial and annual filing. The first auditor resigned in just few months and second auditor was appointed in extra ordinary general meeting, which raise an alarm.
· SGF has not filed annual returns and financial statements with MCA for last 2 years which is a mandator exercise for every PVT. Ltd company in India. If there is a further non-compliance for third year, MCA may start the process of striking off suo moto. SGF has not initiated any e forms to correct the non-compliance which highlights the intent to no follow the going concern.
· SGF has filed no returns the income tax returns for the last three years. If the company is collecting franchise fee, the company should be filing the profit and loss account with the income tax department even if the net profit is NIL. This may highlight malicious intent.
· SGF has applied for 3 GST numbers. Out of these 3 GST numbers’ 2 are registered in Delhi and Haryana state and the status is INACTIVE. These GST numbers are cancelled by GST council suo moto. GST number of Mumbai is active however, there is no return filed by company since September 2021. SGF has inactive GST registration. So, the objective of collecting GST from franchisees indicates a malicious intent.

How Does a Consumer Court Handle Complaints?
 You can file a case in consumer court when:

4.    Fair trade practices are not followed by the service provider.

How much does it cost to file a complaint with the Consumer Court?
There are different slabs of consumer court fees, depending on the value of the claim amount.
1. District Consumer Disputes Redressal Forum
·       Claims up to five lakhs are not subject to a fee.
·       For claims between Rs. 5 lakh and Rs. 10 lakh, there will be a Rs. 200 fee
·       From ₹10 lakhs to ₹20 lakhs-₹400
·       From ₹20 lakhs to ₹50 lakhs- ₹1,000
·       Above ₹50 lakhs to ₹1 crore- ₹2,000
2. State Consumer Disputes Redressal Commission
·       For claims worth between 1 crore and 2 crores, you must pay 2,500.
·       For claims between $2 crores and $4 crores, there is a fee of $3000
·       From ₹4 crores to ₹6 crores-₹4,000
·       From ₹6 crores to ₹8 crores- ₹5,000
·       Above ₹8 crores to ₹10 crores- ₹6,000
3. National Consumer Disputes Redressal Commission
·       A claim worth more than ten crores is subject to a fee of 7,500.
How to Pay the Consumer Court Fee?
Fees for the consumer court must be paid when you file the complaint. Consumer Disputes Redressal Forum (location) should be credited with a duly crossed demand draft from a nationalized bank.
What is an Unfair Contract?
Consumers' rights are significantly altered by contracts between service providers, traders, or manufacturers. The following are examples of unfair contracts:

Complaints can be filed in person. Alternatively, you can register an online complaint or hire a legal advisor to represent you. After receiving goods or services from the party, file a complaint within two years. 
Here are the procedures you should follow to file a complaint.
1. Send notice to the opposite party.
Registered mail should be used to notify the party. It is important to include the reasons for dissatisfaction. Within a specified period of time, consumers can resolve their grievances outside of the consumer forum. If the opposite party fails to comply, you will file a complaint with the consumer court.
2.  Draft the consumer complaint with the help of a legal advisor.
The consumer court can be contacted if the opposite party fails to respond to the notice. 
The complaint should include the following details.
·       The name and address of the complainant and the opposite party
·       The facts and reasons of the complaint, along with the date and time of the complaint
·       The relief or compensation you are seeking
·       Your signature and your legal advisor's verification
3.  Attach the supporting documents and evidence.
If the goods were purchased online, a copy of the invoice, the delivery receipt, and a record of the booking
A copy of the notice sent to the party with an acknowledgment of receipt
Providing an affidavit stating that the facts presented and the statements made are true.
 
4.  Deposit the court fee through a demand draft.
In order to file a lawsuit in the state forum, you and the parties must pay a statutory deposit of $25,000 or 50% of the compensation, whichever is less. After the hearing closes, the consumer forum returns the deposit. District or national consumer forums do not require such a deposit.

·       Once you have registered, you will need to create a username and password.

Also, if the builder does not fulfil any obligation or uses some unfair practice during the duration of the agreement the buyer can approach the civil court and pray for a refund of the money which is already paid to the builder. The buyer will get quick relief under the Code of Civil Procedure. District courts have the jurisdiction of the cases with the amount of 2 crores and below and the High court deals with matters above 2 crores. The fee charged by the lawyers is according to their expertise and the nature of the case and the court fees are charged as stated in the Act of the state.
CONSUMER FORUM-
Under the Consumer Protection Act 1986 Section 12 the buyer can file a complaint within two years of the dispute taking place with the builder if there is any ‘deficiency’ in the service from the builder's side according to the agreement. It should be noted here that a home buyer is regarded as a ‘Consumer’ according to the Consumer Protection Act, which implies that the property should be for the consumer’s personal use and not for any resale purpose. For example, if the builder does not allott the proper on time as stated in the agreement this would be covered under ‘ deficiency ‘ in service and the consumer can reach out to the consumer forum. The fees charged by the consumer forums are very nominal and are cheaper than the civil remedy. Claims less than 20 lakhs are dealt with by the District Consumer Forum, claims more than 20 lakhs and less than 1crore  are dealt with by the State Consumer Commission and lastly if the claim exceeds the amount of 1 crore the following cases are dealt with by the National  Disputes Redressal Commission. The jurisdictions are given to the forums according to the amount of the claims and compensation. 
ARBITRATION-
According to the Arbitration and Conciliation Act, 1996 if any ‘Arbitration’ clause is stated in the agreement then the buyer can go for Arbitration. The cost of the case generally depends on the nature of the case and there is no fixed amount. Also, it is not necessary to hire a lawyer for the claim in Arbitration. It is less time-consuming as it takes merely 3 to 6 months to get the reward.
CONSUMER COMMISSION OF INDIA (CCI)-
According to the Competition Act 2002, if the buyer-builder has misused his dominant position leading to a disadvantage to the buyer, he/she can file a complaint in the Consumer Commission of India against the builder for the abuse of the dominant position. If after the investigation is done and the builder is found to be guilty of any anti-competitive practice he shall be fined huge penalties by the CIC. The CIC is very active in taking action against such builders and fining them. It amounts to approx. 5000 to file a complaint in CIC.
REGULATORY FORUMS-
Regulatory forums like Real Estate Regulatory Authority are true of great help to the aggrieved buyers as a consumer can file a complaint against the builder for not fulfilling the statuary obligations made by him in the builder buyer agreement. Under Section 31 of the Real Estate Act, 2016 the complaint can be filed against the builder or the buyer can file a criminal case in the criminal court along with the consumer complaint In the Consumer Forum. RERA is the new initiative by the Union of India and this ensures that the buyer gets the ownership on time as stated in the agreement. For this to happen in practicality, it is mandatory for the Real State Agency owner to get their company registered under this regulation and to have a separate bank account for the project initiated by the builders. The real usefulness of this initiative is yet to be ascertained.
CRIMINAL COURTS-
Under the Indian Penal Code, 1860 a buyer can file a criminal case against the builder for the breach of contract, cheating the buyer or for not responding to the problems, poor quality of work, etc. Before this, the buyer has to send a notice to the builder and if no response is given the grieved buyer can approach the criminal court. This trial process works fast in court and if the builder shows no appearance non-bailable warrant can be issued against him. The filing fee of such cases depends entirely on the lawyer and the case but as such, no court fee is taken.
Smart consumers should always know what all remedies are present to help him/her in the time of difficulty. Bad times never come up with warnings. For every fraud there is a remedy, awareness is key in such matters.

Aug 08, 2022 12:08 IST New Delhi , August 8 (Always First): A Special CBI Court of Delhi on Monday awarded three years imprisonment to former Coal Secretary HC Gupta in a coal scam case after finding irregularities in the allocation of a Maharashtra coal block. The court also awarded two years imprisonment to former joint-Secretary K S. Kropha and four years to director Mukesh Gupta of Nagpur-based firm M/s Grace Industries Ltd in the coal scam case. The Special judge Arun Bhardwaj (Coal Scam) Rouse Avenue Court on Monday while pronouncing the Judgement on sentencing also imposed a fine of Rs one lakh on HC Gupta, 50,000 Rs on KS Kropha, two lakhs on Mukesh Gupta and 2 lakhs on Nagpur based firm M/s Grace Industries Ltd. The same court last week convicted H C Gupta Under section - 120B and section - 13(2) r/w 13(1)(d) of the Prevention of Corruption Act, 1988, K S. Kropha, Under section - 120B and section - 13(2) r/w 13(1)(d) of the Prevention of Corruption Act, 1988, Mukesh Gupta, Director of M/s Grace Industries Ltd. under section - 120B and section - 420 IPC and M/s Grace Industries Ltd. under section - 120B and section - 420 IPC. The court convicted them in the Coal Scam case related to the allocation of the Lohara East Coal block situated in Maharashtra. CBI had registered on September 20, 2012 under section - 120B r/w 420 IPC r/w 13(2) r/w 13(1)(d) of the PC Act, 1988. On completion of the investigation, a charge sheet under section - 420 IPC was filed by CBI against M/s Grace Industries Ltd. and Mukesh Gupta, Director of the company in the Court on October 28, 2014. Special Judge while discussing the role of Public Servants of Ministry of Coal, Govt. of India and government of Maharashtra in the alleged crime on January 19, 2015, ordered further investigation into the matter with a direction that the evidence collected during further investigation, may be placed before the Competent Authority for the consideration of the issue of sanction to prosecute the public servants namely K. S. Kropha, the then Joint Secretary, Ministry of Coal and V. S. Sawakhande, the then Director, Directorate of Geology and Mining, Nagpur, Govt. of Maharashtra under section - 19 of the P.C. Act, 1988. The Court on August 10, 2015, took cognizance of the offences punishable under section - 120B r/w 409/420 IPC r/w 13(2) r/w 13(1)(c) & (d) of the PC Act, 1988 and substantive offences. Accordingly, the summons was issued to the accused persons for their appearance before the Court. During the course of the trial total of 34 witnesses had been examined by the prosecution/CBI to prove its case. According to the CBI, allegations against the convicts M/s Grace Industries Ltd. and Mukesh Gupta during the period between years 2005 to 2011 in New Delhi, Maharashtra and other places, in furtherance of the common object of the criminal conspiracy hatched with other co-accused persons i.e. H.C. Gupta, K. S. Kropha and cheated Ministry of Coal, Government of India by dishonestly and fraudulently inducing the Ministry of Coal to allocate "Lohara East Coal Block" situated in the state of Maharashtra in favour of M/s GIL on the basis of false information about net worth, capacity, equipment and status of procurement and installation of the plant. CBI also stated that the said company in its application claimed its net worth as Rs. 120 Crores whereas its own network was 3.3 crores only Company falsified its existing capacity as 1,20,000 TPA against 30,000 TPA. In a video order dated August 25, 2014, the Supreme Court of India cancelled the entire allocations of Coal Blocks. Vide order dated: January 19, 2015, Special Judge of the trial court had observed that the working of the officers of the Prime Minister's office also does not appear to be above Board.
