Admission & Fee Regulating Committee(AFRC) will regulate fee charged by minority educational institutions
Issue:
Whether a #minorityeducationalinstitution in the State of Madhya Pradesh is required to get the fees charged by it fixed by the #Admissionand FeeRegulatoryCommittee (#AFRC) under the provisions of the Madhya Pradesh Niji Vyavsayik Shikshan Sansthan (Pravesh Ka Viniyaman Avam Shulk Ka Nirdharan) Adhiniyam, 2007 (for short, 'the Act of 2007')?
Ruling:
Hon'ble #SupremeCourt, held that the #functionoftheAFRC is only to find out, after giving due #opportunityofhearing to the institution, whether the fees proposed by the institution is #based on the factors mentioned in #Section9(1) of the Act. Further held that Section 9(1) is only a #regulatorymeasure and it did not take away the power of the educational institutions to fix their own fees.
Facts: (a)Icon educational Society was called upon by the AFRC to submit its proposal for regulation of the fees pertaining to law courses offered by it. (b)Appellant Society submitted to AFRC that it is not empowered to regulate fee of minority Institution and requested for withdrawal of its notice. (c)The request was rejected by AFRC. (d)Aggrieved by rejection AFRC appealed before Designated Authority. (e)Designated Authority too rejected the appeal with costs. Holding procedure for fixing/regulating fee is common for both minority and nonminority institutions.(f) Appellant Society than filed #CivilAppeal before Indore Bench of MP High Court.
Prayer before Madhya Pradesh High Court at Indore:
#DeclaringSections4and9 of the Act of 2007 #ultravires as these provisions did not distinguish between minority educational institutions and other educational institutions. A further direction was sought to #exempt the appellant #society, from the application of Section 9 of the Act of 2007, thereby permitting it to #fix its own #fees.
The Division Bench of the Madhya Pradesh High Court at Indore #dismissed the #writpetition.
Observation of High Court:
The Division Bench observing that the #right under #Article30(1) of the Constitution is #notabsolute or above other provisions of law and the #essence of #Article30(1) was to #ensureequal treatment between #majority and #minorityinstitutions. Also held that the validity of the Act of 2007 had already been upheld in Modern Dental College and Research Centre (supra).
However, the Hon’ble High Court observed that the stand taken by the AFRC, that it will fix the Fee cannot be approved.
Observation of the Apex Court:
It is #notopen to the #AFRC to seek to #unilaterallyfix the #fees to be charged by the appellant society for the professional courses offered through its educational institutions. At the same time, it is #notopen to the #appellantsociety to #claim complete #immunity in undertaking this exercise and #seekexemption from any #interference #by the #AFRC.
AFRC would exercise the power of #reviewing the #proposed #fees, after giving due opportunity of hearing to the educational institution concerned.

HMCS HAIDA STILL GOING STRONG: Almost 75 years old and back from a refit, historic vessel will once again welcome visitors

She earned the title “fightingest” ship in the Royal Canadian Navy. During World War II, the vessel sank greater enemy tonnage than any other RCN warship. Her commanding officer, Commander Henry George “Hard Over Harry” DeWolf, ended the war wearing both the Distinguished Service Order and the Distinguished Service Cross. Substantially refitted, she later served two tours in theatre during the Korean War. Canada’s lone still seaworthy Tribal-class destroyer, she recently returned from a floating dry dock at Heddle Marine Services in Hamilton, Ontario, where she underwent maintenance and upgrading.
HMCS Haida is one of eight Tribal-class destroyers commissioned by the Royal Canadian Navy during the Second World War. Tribals also saw service with the Royal Navy and the Royal Australian Navy. Goaded on by the Japanese introduction of the Fubuki-class destroyers, the Tribals were super destroyers. They offered the speed and manoeuvrability of a destroyer paired with armament equivalent to a light cruiser, and on the outbreak of WWII they were the state of the art in naval design. “I want those for my navy,” Admiral P.W. Nelles, Chief of the Canadian Naval Staff, remarked after seeing a photograph of the first Tribal in 1938.
HMCS Haida’s keel was laid down on September 29, 1941 by Vickers-Armstrong at High Walker Yard, Newcastle-on-Tyne, England. Two years less a month later she was commissioned into the RCN. Her official compliment was 14 officers and 245 ratings. According to Walt Dermott, Chairman and President of Friends of HMCS Haida, her original weapons suite was comprised of three 4.7-inch/45 Mk.XII twin guns (from the bow, Turrets A, B and Y); one 4-inch/45 Mk.16 twin gun; one quad launcher with Mk.IX torpedoes (4 × 21-inch torpedo tubes); and two Mk.IV depth charge throwers. For anti-aircraft defence, it deployed one quadruple mount 2-pounder gun and six Oerlikon cannons.
Coming into service in the fall of 1943, she initially served on the Murmansk Run while based at Scapa Flow. In this capacity she participated in the destruction of the German battleship Scharnhorst. In January 1944 she was transferred to the 10th Destroyer Flotilla (DF) operating out of Plymouth, England.
The 10th DF was tasked with securing the western approaches to the English Channel. As D-Day approached, the 10th DF aggressively sought out German vessels and Haida was engaged in a string of battles. In April 1944, DeWolf won the DSO when Haida ran German motor torpedo boat T-27 aground (although her sister ship HMCS Athabaskan was lost in the engagement). On June 9, three days after D-Day, along with HMCS Huron, she sank E-boats Z-32 and ZH-1, earning DeWolf a DSC. Less than three weeks later, she shared with HMS Eskimo the sinking of U-971. On her best day, in company of the Polish ship ORP Blyskawica, she sank two submarine chasers, UJ-1420 and UJ-1421, and a merchantman. Two other cargo ships were left ablaze.
When the American forces broke out of Normandy into Brittany, the 10th DF expanded its operations into the Bay of Biscay to isolate German garrisons and destroy U-boats. Haida remained with the 10th DF until September 1944. After a three-month refit in Halifax she returned to the north, ultimately joining the fleet that took custody of German U-boats in Trondheim, Norway. When the war ended Haida had sunk 14 enemy vessels.
Upon the outbreak of hostilities on the Korean Peninsula she was extensively refitted and updated before relieving HMCS Nootka in November 1952. A decade later, repeated cracking of the hull saw Haida take a farewell tour of the Great Lakes before she was paid off in September of 1963.
Slated to be scrapped the following year, the destroyer was sold to Haida Inc., a non-profit organization dedicated to restoring it. Moored at the foot of York Street in downtown Toronto, the ship was opened as an historical attraction in August 1965. When Haida Inc. proved unable to raise the funds to proceed with repairs, the Ontario government became the unwilling owner, berthing the ship adjacent to the new Ontario Place theme park.
By 2000 HMCS Haida was deteriorating, and the province was loath to invest in the needed structural repairs. Sheila Copps, MP for Hamilton East since 1984 and Liberal Minister of Canadian Heritage since June 1997, sensed an opportunity. By e-mail she explains: “The chair of Ontario Place wanted to get rid of the Haida so I had dinner with him and took possession on behalf of Parks Canada for one dollar. Parks Canada assumed responsibility for the refit and the decision to move to Hamilton.” In 2004 HMCS Haida, berthed at Pier 9 in Hamilton Harbour, once again opened to the public. It then spent a decade on the revitalized Hamilton waterfront, bearing witness to Canadian heritage and the proud history of the Royal Canadian Navy.
After a decade on display Haida again required significant refitting. According to Friends of Haida’s Walt Dermott, a wide variety of work was completed by Heddle Marine Services including:
Re-enforcing metal hull plates that have 25 per cent or more material loss or decay;
Removing the stone ballast in the fuel tanks that is currently trapping moisture, and replacing it with metal disks that can be moved from one tank to the other to help balance the ship when she’s back in the water;
Repairing five key areas where the bulkheads attach to the hull to ensure that these areas remain watertight in the case of a major leak;
Installing safety systems such as an alarm system and automated pumps that can start responding to a significant water leak in the hull immediately.
Haida was back alongside Pier 9 before Christmas and will reopen as scheduled on May 19, 2017. With the recent federal budget announcing free admission to all National Historic Sites in 2017 in recognition of Canada’s sesquicentennial, Lisa Curtis, Superintendent of National Historic Sites for Parks Canada in Southwestern Ontario, expects a boon year. “We are absolutely going to plan some special events so people have more opportunities to experience and learn and really celebrate Canada’s 150th.”

On January 18, rebelling Shiromani Akali Dal (SAD) leaders met at Delhi’s Constitution Club to stitch together a coalition to challenge Sukhbir Badal’s leadership of the party. They had already identified SAD’s Rajya Sabha MP, Sukhdev Singh Dhindsa, to anchor this coalition. Sukhdev, who for three decades had occupied the position of party secretary general, resigned in October last year from the leadership of the SAD in the Rajya Sabha. Soon after, his son, Parminder Singh Dhindsa, gave up his post as chief of the party unit in the Punjab assembly.
Politically, the SAD has been struggling to enthuse its core base — panthic voters, who are more alive to issues relating to the Sikh faith. Badal’s rivals have accused the party of mishandling the fallout of the June 2015 desecration of the Guru Granth Sahib. There were public protests and the police had opened fire on protesters in Kotkapura and Behbal Kalan in Faridkot. Punjab was governed by a BJP-SAD coalition at the time.
Speaking to India Today, Sukhbir insists that, politically speaking, the worst was over for the SAD, though many of his party colleagues disagree. To illustrate, they point out that in mid-January, similar unrest was witnessed when PTC Punjabi, a TV channel owned by the Badals, claimed intellectual property rights over the daily hukamnama telecast from the Golden Temple. This really angered the Sikh community. “The SAD cannot afford another religious controversy,” points out an Akali Dal legislator. With the assembly election just two years away, the party needs to plan its revival strategy soon, or risk giving ally BJP more bargaining power and, worse, strengthening the hand of the ruling Congress.
Sukhbir is aware that recent events have made reviving the party’s fortunes more difficult. His father, five-time Punjab chief minister Parkash Singh Badal, now 92, has been staying away from public appearances. Other challenges include former party stalwarts Ranjit Singh Brahmpura, Rattan Singh Ajnala and Sewa Singh Sekhwan, who, following their sacking from the SAD in late 2018, formed the Shiromani Akali Dal (Taksali) in December the same year. These leaders have influence with voters in the Majha region-which consists of the Gurdaspur, Amritsar and Tarn Taran districts in northwest Punjab. Worse, leaders of other Akali factions-such as Paramjit Singh Sarna, Manjit Singh G.K. and Ravi Inder Singh-appear to be aligning themselves with the Dhindsas. Sukhbir argues that these leaders don’t have mass appeal, but they are pulling away, and it could only weaken the party.
Sukhbir Badal is aware that the exit of top SAD leaders has made the task of reviving the party much more difficult.
In the 2019 Lok Sabha election, the SAD managed to win just two seats — Ferozepur and Bathinda, won by Sukhbir and his wife, Harsimrat Kaur Badal, respectively — despite a slight uptick in its overall vote share from 26.3 per cent to 27.5 per cent. What is especially worrying is that apart from these seats, the SAD was not a major contender in the state’s Malwa region, which accounts for 69 seats in the 117-seat assembly. While Sukhdev Dhindsa might not have a huge voter base around his pocket borough in Sangrur (in the Malwa belt), his exit will complicate matters. His understanding of religious issues made him indispensable to the SAD and his exit will mean a longer recovery period for the party among panthic voters in the region.
Sukhbir disagrees with that assessmen — but according to Parminder Dhindsa, “that is exactly the problem.” Sukhdev Dhindsa elaborates: “I requested SAD leaders to offer an apology to the Akal Takht. Initially, they agreed, but they eventually did not go.” Parminder says: “It would not have been an admission of guilt, but would have pacified the agitators.”
Worse, the SAD’s allies may also be looking to profit from its troubles. On January 17, at an event in Jalandhar to elect new state BJP chief Ashwani Sharma, many leaders spoke of abandoning the BJP-SAD alliance. Although the party leadership is treading cautiously on the issue of abandoning an ally of two decades, especially given the recent split between the BJP and its allies in Maharashtra and Jharkhand, this will not prevent BJP leaders from opening channels with the new Akali Dal (Taksali).
For over two decades, thanks to its strength in the state, the SAD managed to retain a leadership position in its alliance with the BJP. However, BJP leaders believe that recent results — such as the increase in the alliance’s vote share in the 2019 Lok Sabha election — are a result of Prime Minister Narendra Modi’s popularity. This could encourage new alliances — such as with the Dhindsa-led Akali Dal (Taksali). The first overtures in this regard appear to have come from the Centre. In January 2019, the Union government honoured Sukhdev Dhindsa with the Padma Bhushan — and in his bid to stitch together a new alliance, Dhindsa has avoided taking potshots at the BJP while training his fire on the Badals. Further, on January 20, the BJP snapped ties with the SAD for the Delhi election, and is in touch with the rebels for support in the assembly poll.
Dhindsa’s new status as an opposition leader close to the BJP could also upset the Badal family’s fortunes when it comes to the Shiromani Gurdwara Parbandhak Committee. Elections to this body, which administers gurudwaras in Punjab and Himachal Pradesh, including the Golden Temple, have been due since 2016, with the Amit Shah-led home ministry yet to decide on a date.
For the moment, the BJP appears happy to wait for the Dhindsas to build a new Akali Dal and attract panthic votes. The BJP has frequently used a combination of such voters with its own base to win key urban centres such as Jalandhar, Bathinda, Patiala and Ludhiana. “We can do it for the new [breakaway] Akali Dal as well,” says a top BJP leader.
Sukhbir dismisses the conjecture. “We have clear alliance terms,” he says. “They know their 23 assembly seats, we have our 94. Similarly, we have a 10-3 arrangement for the general election. This will continue.”
