Once you get past the gender cult pandering at the beginning this is an important read.
A couple of things unrelated to the Russian war of aggression against Ukraine recently caught my eye, reminding me that while this conflict will eventually end, the violence visited upon women by loved ones is a war that endures.
I say “women” knowing full well that men and people with different gender identities are victims of domestic violence too. I’m using “women” as a shorthand, much the same way “men” has long stood for all of us, because women by far and away are victimized more often than men in intimate-partner relationships.
This is why the landmark legislation Joe Biden sponsored in 1994 when he was a senator and reauthorized last week as president is called the Violence Against Women Act, or VAWA.
The law lapsed under President Trump, who was hardly a champion of women’s rights. The new version expands protections for survivors of partner violence and sexual assault.
It will also fund rape treatment centers, training for law enforcement and offer new federal protections to Native American women who are assaulted by non-Native perpetrators. This is one of the law’s most important achievements; in the past, if a non-Native person assaulted a Native person on tribal lands, the suspect would be referred to federal prosecutors, who frequently declined to prosecute, according to the Justice Department. Now such cases will be handled by tribal authorities.
The law had bipartisan support but, sadly, because of pushback from Republican gun worshipers, Congress was unable to use VAWA to close the “boyfriend loophole” in federal law. The loophole allows non-married partners to possess firearms even if they have been convicted of misdemeanor domestic violence. Currently, you must be married, living together or have a child in common for the firearms ban to apply.
This is lunacy, given that so many intimate-partner killings are committed by dating partners. In one analysis, 80% of domestic violence calls to Philadelphia police in 2013 involved non-married partners.
“A growing portion of the population is not protected by federal policies designed to keep guns out of the hands of abusers,” according to two University of Pennsylvania researchers who analyzed data in 2018. “Current boyfriends and girlfriends are a risk to their intimates.”
So, those “couple of things” I mentioned above? They are reminders that while media interest in domestic violence waxes and wanes, it is an abiding problem. Whatever else is happening on the world stage at any moment, we can be sure that, behind closed doors, intimate partners are being bullied, harassed and attacked. Things only got worse during the pandemic, when families were locked up together for so many months.
On Tuesday, Trevor Noah of “The Daily Show” let up on the comedy for a moment to broadcast his fears about the way Kanye West has been treating his ex-wife, Kim Kardashian, and her current beau, Pete Davidson. What Noah did was extremely unusual, and praiseworthy.
West has engaged in an escalating war of words against Kardashian, and has been particularly nasty about “Saturday Night Live” star Davidson, releasing a video showing a Claymation version of Davidson being kidnapped, buried and decapitated.
You could chalk this behavior up to just another attention-grabbing celebrity train wreck, but Noah saw something darker.
“What we’re seeing,” said Noah, whose mother survived after being shot in the head by his stepfather in 2009, “is one of the most powerful, one of the richest women in the world, unable to get her ex to stop texting her, to stop chasing after her, to stop harassing her,” he said. “Just think about that for a moment. Think about how powerful Kim Kardashian is, and she can’t get that to happen.”
The next day, after West responded to Noah with a racial slur, Noah posted a long, compassionate message on West’s Instagram account: “I’ve woken up too many times and read headlines about men who’ve killed their exes, their kids and then, themselves,” wrote Noah. “I never want to read that headline about you.”
Two weeks before Noah’s plea to West, the New York Times Magazine published a devastating story about the overlooked brain damaged suffered by women whose partners hit them. Researchers speculate that the damage, which occurs in private and is often untreated, can be worse than what football players experience. It amounts to a kind of slow murder.
“Even slight blows to the head, when repeated often enough, could result in long-term neurodegenerative disease,” wrote journalist Christa Hillstrom, who spent two years researching the piece, and led it with an account of a woman whose boyfriend hit her in the head so much that her hearing and memory were impaired. Her face was scarred and her scalp had a bald patch, and she suffered migraines, blurred vision and confusion.
Hillstrom interviewed Eve Valera, a Harvard associate professor of psychiatry who studies traumatic brain injuries among survivors of domestic violence. “Every year,” Hillstrom writes, “hundreds of concussions occur in the N.F.L.; thousands occur in the military. Valera’s estimated number of annual brain injuries among survivors of domestic abuse: 1.6 million.”
Like war itself, that notion is almost too distressing to contemplate. But we do know that, like war, intimate-partner violence can be inflicted anywhere, on anyone.

The study—authored by researchers at Northwestern University and the Invisible Institute and published on Wednesday in PLOS ONE—identified approximately 160 groups of officers, referred to as "crews." The identified groups consisted of less than 4 percent of Chicago's police officers but accounted for about 25 percent of "all use of force complaints, city payouts for civil and criminal litigations, and police-involved shootings," These crews generated about 18 percent of all complaints filed by Black residents and 14 percent of all Hispanic residents, according to the researchers. 
To identify cops who intentionally group themselves into crews, the researchers used data from sources including complaints, assignments, and settlements to see which officers were involved in "alleged co-misconduct," how often recurrent co-misconduct happened within the group instead of external to it, whether officers in a crew engaged in "similar types of alleged misconduct," and whether there seemed to be well-defined membership whether by age, location, race, or other attributes.
"Explanations for police misconduct often center on a narrow notion of 'problem officers,' the proverbial 'bad apples,'" the researchers write. "Such an individualistic approach not only ignores the larger systemic problems of policing but also takes for granted the group-based nature of police work. Nearly all of police work is group-based and officers' formal and informal networks can impact behavior, including misconduct.”
For years now, conservatives and law enforcement officials have clung to the narrative of “bad apples” theory of policing: that individuals, not institutions, are to blame when police misconduct and violence happen. One might ask how departments gorging themselves on taxpayer funds to acquire surveillance technology or ostensibly train investigators and detectives might miss the bad apples, but that’s ultimately because, as sociologist Rashaw Roy has put it multiple times and the new study attempts to elucidate, “bad apples come from rotten trees.”
In 2021, the Financial Times analyzed officer complaint data in Chicago, New York, and Philadelphia and found that while thousands of officers in each city received at least one complaint since 2007, ten percent of them accounted for a third of all complaints. In their analysis, the Financial Times pointed to previous research co-authored by one of the researchers involved in Wednesday's study—Northwestern sociology professor and director of the Northwestern Neighborhood & Network Initiative Andrew Papachristos—that uncovered "large network structures" of misconduct and abuse. That study identified not only abusive officers but also "clusters" whose interactions "contribute to the emergence or diffusion of misconduct” and could be considered when creating assignments, patrols, and promotions.
Applying network analyses to police departments makes sense given this history of policing and groups of officers generally. Take two prominent examples of crew-equivalent misconduct cited in the study: the Los Angeles Rampart and the Oakland Riders scandal. 
In the former example, more than 70 officers in the LAPD were involved in "assaults, drug crimes, fabricating evidence, perjury, and, allegedly, murder," the researchers write. In the latter, four Oakland officers were "accused of actions ranging from filing false reports to assault, kidnapping, and severely beating civilians with their fists, feet, pepper spray, and metal clubs." Both crews coordinated actions amongst themselves, covered up activities, and in the case of the Rampart crew, developed into a gang with its own symbols, oaths, and language.
These aren’t isolated incidents. Reporter Cerise Castle has documented similar activity and worse in Los Angeles as part of her magisterial 15-part investigative series into the Los Angeles County Sheriff's Department and its deputy gangs. For the past 50 years, according to Castle's reporting, at least 18 gangs have terrorized communities of color in the county, killed at least 19 people (all of whom were men of color), are responsible for a disproportionate of misconduct and violence, and have cost the County just over $100 million in litigate over the past three decades.
Police misconduct has a long history in Chicago, which Thursday's study focused on. The city's police department is the second-largest in the country (14,000 officers and civilian personnel), enjoys a budget exceeding $1.7 billion, and has a history of "misconduct, abuse, and corruption" that stretches back to the late 1800s, according to the study. The team of researchers also highlight how Chicago police helped assassinate the 21-year-old Black Panther chairman Fred Hampton Sr., were enthusiastically involved in COINTELPRO, regularly engaged in illegal and unconstitutional surveillance, and enjoy "a lack of effective oversight and accountability" to this day. 
Researchers point to a 2017 Justice Department report that found "repeated and frequent instances of excessive use of force, misconduct, and derogatory language and behaviors towards civilians, especially minority civilians." The same report also found the CPD took insufficient steps and often blocked efforts to stop or investigate misconduct, and had a "pervasive cover-up culture." In 2016, before the report’s publication, Mayor Rahm Emmanuel faced calls to resign as it was revealed his lawyers tried to delay the release of video footage showing Laquan Macdonald’s murder by police officers in 2014 until after the criminal trial of the officers involved.
As tempting as it may be to lay the issue at the feet of individual officers (17 percent of CPD officers generate 50 percent of all complaints, according to the study) or officers who happen to share misconduct allegations due to working together, the researchers argue it is organized groups of officers who have always coordinated, engaged in, and covered up misconduct and violence. 
"Given the group and partner-oriented nature of policing in Chicago, one of our foundational analytic tasks is to differentiate group misconduct that is a product of the organizational structure of police (e.g., two officers who receive a complaint merely as a function of working together) from those instances of more intentional crews."
In the study, researchers point to Chicago’s already  three well-known crews: the Watts Crew, The Skullcap Crew, and the Austin Seven.
The Watts Crew became an "integral part" of the drug trade in communities it policed; more than 212 convictions have been overturned because of misconduct by the crew but only two officers have been convicted. Five officers (four are still on the force) make up The Skullcap Crew, which built up 138 allegations of misconduct. Officers were regularly involved in "many reported instances of excessive and unwarranted force, sexual abuse and harassment including strip searches, planting drugs, theft, and false arrest," the researchers write. The Austin-Seven Crew was a group of seven officers "involved in cases of robbery, extortion, and drug dealing” that worked with local gang members to commit violent crimes. All seven were arrested and charged in 1995.
Still, despite the insights garnered there are limitations to the study as it doesn’t tell us how crews emerge, nor does it tell us how culpable officers are as members of crews and the larger network structure of a police organization. Finally, the researchers write, identifying organized groups of bad cops is just the start—this sort of activity has never been a mystery, and there needs to be the will to do something about it. 
"The analysis presented here demonstrates the possibility of systematically using data to identify networks within a police department that may prove, when investigated, to be criminal crews," the researchers write. "However, even the best efforts at identifying and validating such crews will only go so far without the capacity to fully investigate such cases and, when deemed necessary through due process, discipline, dismiss, or otherwise hold accountable the officers involved."

The following days passed quickly. Allison closed herself, avoiding both Dr. Carlson and Mona. She wasn’t ready to give a final answer, to any of them. Breaking up with Griffin and declining the opportunity his father was offering could be the end of her newly-started career. On other note, she couldn’t measure the consequences of breaking Mona’s heart. She’d probably go away and do something stupid out of anger. She felt guilty, as she’d act exactly like her ex, abandoning her all over again.
That morning though, she had no alternative, Mona had one last medical appointment with her.
“Well,” she grinned. “The latest results of your exams came back great. You’re officially discharged.”
“Yay, that means I’m officially kicked out of your house too?” Mona joked.
“Of course not. You’re welcome to stay as long as you need.”
“Actually, I wanted to talk to you about it, but…” she looked down at a watch on her wrist. “There’s somewhere else I have to be.”
“Oh,” Allison smiled, “where is it?”
“You’ll find out later.”
Mona blew her a kiss and left through the door. Deep down, Allison could tell she noticed how she was keeping a distance since that night. Yet, she was respecting it and giving the space she needed.
“That night…” she thought. The night she confessed her feelings, followed by the news she could be going to another continent in only a few weeks. If only she could make a decision that wouldn’t hurt anybody’s feelings.

“And full freedom, finally,” Mona waited outside the hospital for a taxi. She was supposed to be meet her lawyer again in a few minutes. On the phone, she announced she had really good news for her.
A luxury car parked near where she was standing. Though she was locked up for almost a decade, she was already familiar with that brand-new model. A well-dressed man came out from it, speaking on his cell phone. She read the sign marking the spot he parked.
“The infamous Dr. Carlson,” she thought. “Nice car, Doc. In my old days, I’d love to take it for a ride.”
He didn’t notice her. The heated argument he was involved in, didn’t allow him to.
“I told you to not call me, not on this number!” He grunted, clenching his teeth. “I know… I know… I’m finding a way. I’m gonna get rid of…” suddenly aware of Mona’s presence, he changed his expression quickly. “I’m gonna get rid of this laboratory, of course. They have been causing us a lot of harm. The quality of their products certainly dropped. The medication they’re supplying isn’t as effective as before.”
He hung up and passed by her, with a smile on his face.
“Good morning, Miss.”
“Morning, doctor.”
Mona gave him one last suspicious glance. By her experience, she couldn’t help thinking how shady was the conversation she just heard.
Dr. Moron’s behavior quickly became irrelevant, when inside a hotel room, her lawyer handed her a small package, containing money from the time she worked in prison.
“This isn’t much,” Dr. Terri Williams told her. “But it’s enough to help you to settle down, while you seek for a better job.”
“As if anybody is willing to employ me.”
“Don’t worry, I’ll be handling that too. I have some contacts, I’ll help you to find something.”
“Are you my lawyer or a fairy godmother?” Mona grinned, throwing herself at a comfortable couch, while the female lawyer typed something on her laptop. She opened the package and handed the woman some of her money. “Here, all these trips from Philadelphia to LA, they must cost you a lot. It’s the least I can do.”
“There is no need,” she answered, distracted. “The amount I was paid to take your case was more than enough.”
“Huh?! But… you said you took me as part of charity program?”
“Oh! Nevermind! I… mistook you for another client. This one I’m reading about right now.”
“Okay…”
Leaving her alone, Mona followed to her next stop. The mall.

When she arrived, carrying some bags, Mr. Wheeler was still home, for her displeasure. She rolled her eyes. He was distracted, working on an evidence board he had set on the living room.
“I have an alibi,” she announced as she entered, only to provoke him. Allison’s father looked at her and scowled in response.
“Busy this morning, huh?” He asked sarcastically, noticing the bags she was carrying.
“Yes, my money and it’s all legal. For the time I worked in prison. It’s not much, but at least I don’t have to wear Allison’s clothes anymore. And I bought myself a cell phone too.”
“Good for you. What do you plan to do with the rest? Find an apartment, I suppose?”
“It’s not enough yet. But I’ll get a job soon,” Mona sat on the couch, observing the pinned pictures of corpses on the board. “Gross!”
“This is what happens when you get involved with wrong people and drugs.”
“In case you’re implying anything, I’ve never done any drugs. I barely had any alcohol in my life. Kaneko wouldn’t allow us to drink, besides being underage, we couldn’t risk to harm the property we were supposed to deliver.”
“The property you stole, you mean.”
Mona replied with a wink, focusing her attention on her newly-acquired phone. There was a lot she wanted to find out on the internet, starting by Allison’s social network. She could spend hours admiring all those beautiful pictures she posted through the years. Then, she went to search for news from her former crew partners. With no luck. They should still be hiding under new identities.
“Do you see the link between all of them?” Mr. Wheeler asked, getting her attention.
She got up and approached, examining all the pictures closer.
“Hmmm… a bunch of rich frat boys who partied too hard?”
Detective Wheeler sighed.
“That too. But they were all brilliant students, athletes, with a bright future ahead of them. What led them to death was a synthetic drug, that promised to enhance their performance, among other things.”
“Do you have any ideas of who could be supplying them?” Mona was intrigued.
“Sadly, we haven’t found a concrete clue yet,” Detective Wheeler told. “We suspect from students, inside these universities.”
Mona grabbed a paper that was hanging in the evidence board, reading a detailed laboratory analysis of the drug found on the students’ system.
“College students aren’t capable of developing anything of this sort, Pops,” she explained. “They could be selling, but who’s creating… you need to aim higher. Someone powerful, wealth and with a big knowledge of science and chemistry. The composition here is quite complex.“
He looked at her, admired and surprised.
“How do you even know all of that?”
“Didn’t you read my files? All those scholarships I had gotten… I used to be a science whiz.”
She grinned, grabbing her bags and going to Allison’s bedroom, where she had important plans to make.

Allison got home at evening, stressed as usual. She caught herself arguing with a patient’s mother, who wanted to know more than she did, and would refuse to submit her son to any exams or procedures. It was a lot of work to convince her to do so. When she entered, an investigation board was placed in the middle of the living room, with creepy pictures of corpses. Which almost made her throw up.
“Oh dad…” she thought. Mr. Wheeler wasn’t the kind who used to bring work to home. “This case is really consuming you.”
She threw her purse on the couch and followed to the guest room. Her bedroom’s door was half-opened, suggesting Mona was inside.
“Hey you,” she opened it. Mona was finishing getting dressed, looking absolutely stunning in a black dress that valuated her body features. She had also applied a perfect make-up. “Whoa!”
“Like what you see?” She teased, smiling.
“U-uh, y-you look… great. But where are you going?”
She noticed Mona blushed a little and looked down, letting her raven black hair cover her face a little bit.
“I was wondering…” she bit her lower lip nervously. “Would you give me a chance to repay everything you’ve been doing for me? There’s this new restaurant I passed in front, on the first day I left prison, and I really wanted to visit. Come with me?”
Allison stared at her in silence. She was completely torn, while she wanted desperately to accept, she knew where it could lead them.
“It’s not a date,” Mona assured. “But if you don’t want it, that’s okay. I’ll go by myself and eat until I have no strength to come back home. I’m gonna ask all the dessert available in the menu.”
“When I said you could eat normally, I didn’t mean you could exaggerate,” Allison said. “In this case, I better follow you. Only to make sure.”
“As you wish, Doc.”

When they arrived at the restaurant, Allison was surprised by the place. Mona had already made a reservation for them in a VIP area outside, surrounded by trees, with a special illumination and a band, singing live-music.
She chuckled, remembering how soft and romantic Mona could be, just like when she took her to Prom, renting a limo and giving her the night she ever dreamed about. Though she spent the entire way complaining about the fact she wasn’t allowed to drive yet, she now looked relaxed and happy.
“You shouldn’t spend so much money, Mona,” she told. “You need it.”
“Chill out, Allison. I still have some to keep until I get a job. It’s just… we never had the chance of doing something like this. I mean, go out together and chat. When we were starting having it, that stupid Brotherhood…”
She clenched both of her firsts with the memories.
“Mona, it’s over. And I completely understand what you did. You only did it to protect yourself and to protect m–… all of us.”
“Exactly.”
They placed their orders, Allison was in shock with the amount of food Mona ordered for herself.
"What?” She grinned. “After spending eight years in prison and weeks on a special diet, I’m carving real food. I’ve been dreaming about this moment for years!”
“Well, I’m your doctor,” Allison laughed, stealing small bites from her plate. “I need to make sure this food is safe.”
After some minutes in silence, she decided to enjoy Mona being so open and sociable to start a conversation. Ask things she had been wondering all along.
“Tell me more about you. About these years.”
“I was in jail?” Mona gave her a confused look.
“But… don’t you have any stories or anyone you met in there?"
Mona silenced. Allison couldn’t tell if the question had upset her or if she was attempting to remember anything interesting.
"Not really, I had some really dark days. Especially after my judgment. I even considered…” she stopped. “Anyways, I spent most of my time working and studying. As you can tell, I’m not much of a sociable person, I didn’t have many friends. But it doesn’t mean I didn’t make a few girls fall in love with me.”
A hint of jealousy involuntarily erupted in Allison’s chest. As much as she tried to control herself, she wanted to know more.
“Oh, any of them still holds a special place in your heart?”
“I never said the feeling was mutual.”
Mona took a sip of her juice, her brown eyes never leaving hers, as if she knew exactly how Allison was feeling inside.
“What about you?” She wanted to know. “Any mind-blowing stories from Langston?”
“Oh, I made some good friends but I wasn’t the partying type. I’d spend most of my time in the library.”
“Please, don’t tell me you met Cliff in the library?”
“It’s Griffin, but…” Allison blushed. “Yes.”
“How boring,” Mona rolled her eyes.
That conversation brought some painful memories to Allison’s mind. The endless days she spent at the library weren’t studying anatomy or biochemistry, but researching law books, to find a possible manner to get Mona out of jail. Being in the same classes, one day Griffin joined her and his kindness helped to ease a little of her pain. Yet, she took a long time to develop romantic feelings for him. Months, years, maybe.
She still remembered their first night of love. She didn’t felt any pleasure. She spent hours crying under the shower, wishing it was Mona that was sleeping by her side in the bed. He’d never compare to her, or make her feel the same way she felt in the night of her Prom.
“Allison?” Mona’s voice brought her back to reality. “Are you alright?”
“Yes, I just… some bad memories. That’s all.”
“Oh, I was starting to think I’d have to eat this giant bowl of ice cream all by myself.”
“Only in your wildest dreams!”

Eyeing a fast-paced, interactive marketing internship this summer, Damian Arizini had his career focus lined up just right to kick off his senior year of college.

The equal-opportunity conceptual cornerstone of American society is valid today, but not for everyone. Those that don’t always make the cut, including African Americans, women, people with disabilities, immigrants, and more, have had to fight for their rights over the course of decades and even centuries. The next battle ahead appears to center on the LGBTQ employee population, who today are still not protected by equal employment policy on the basis of gender identity and sexual orientation.  As a result, structures of law are under scrutiny after a half-century in action, and the Supreme Court must dust off old cases in order to shape new ones for a changing country fighting for liberty and justice to really apply to all.
Beginning in 1964, Congress made waves with the passage of the Civil Rights Act, prohibiting discrimination on the basis of race, religion, color, or nationality, and, in the case of the all-important Title VII, prohibiting discrimination on the basis of sex in employment.The document explicitly states, “It shall be an unlawful employment practice for an employer … to discriminate against any individual with respect to his compensation, terms, conditions, or privileges of employment, because of such individual’s race, color, religion, sex, or national origin.” [1]
Title VII is enforced today by the Equal Employment Opportunity Commission (EEOC), a government organization established one year after the Civil Rights Act’s passage, which acts as a watchdog in every state to protect vulnerable classes and advocate against discriminatory employment practices. [2]
Today, Title VII has five protected classes: race, color, religion, sex, and national origin. [3] The definition of sex, however, has been a source of contention since its inclusion in Title VII, from debates of what constitutes discrimination on the basis of sex to what presupposes unequal treatment directly and indirectly. Over the last fifty-five years, the Supreme Court has mediated a number of groundbreaking cases that honed the scope and boundaries of Title VII to match the changing needs of a changing workplace.
In October of 2019, the Supreme Court will take the needs of the modern workplace into consideration once again, considering formally for the first time the merit of including sexual orientation and gender identityamong the protected classes of Title VII. The cases Bostock v. Clayton County, Georgia, and Altitude Express, Inc. v. Zarda will be considered together, and collectively will require the Court to decide whether sexual orientation discrimination by an employer is a violation of “basis of sex” law. The case of R.G. & G.R. Harris Funeral Homes v. EEOC will be considered separately, and invokes the question of whether transgender employees are similarly protected by Title VII. [4]
With a conservative-majority Court whose most recent addition caused national division, coupled with incredibly varied opinions from lower courts, it is unclear which way the Court will rule on what are certain to become landmark cases in and of themselves. There is simultaneously a lack of and a wealth of precedent; no case has ever directly supported LGBTQ concerns in terms of employment discrimination, however several cases have tangentially paved the way for these rulings through the analysis of gender disparity and discrimination.
Favoring the plaintiffs’ collective demand for equal treatment under the law are several precedent cases considering gender presentation and equal treatment for cisgender plaintiffs, which can be read as precedent for protecting transgender employees too. One case that the Supreme Court has noted will be the foundation ofR.G. & G.R. Harris Funeral Homes v. EEOC’s debates, Price Waterhouse v. Hopkins (1989), concerns a female employee who was denied a promotion by her male supervisors given that she, though arguably qualified on paper, did not conform to the gender stereotypes of a female employee.One coworker remarked that Hopkins needed “a course at charm school” to soften her edges and make her more approachably feminine in the work environment, despite the fact that no male employee was required to conform to set gender regulations to receive promotion. [5] The Supreme Court ruled that Hopkins was indeed discriminated against, affirming that it is a violation of Title VII for gender presentation, whether in alignment with gender roles or in juxtaposition, to bear any relevance in the workplace, including, in Hopkins’ case, inhibition to professional advancement. [6]A ruling in Harristhat aligns with this interpretation would support most directly the right of transgender individuals to present themselves in accordance with their gender identity, to use names and pronouns that affirm that identity and to ultimately exist in the workplace without fear of discrimination, termination, or loss of opportunity for advancement.
The case of Smith v City of Salem (2004) similarly appears to support transgender protection under the law, wherein male to female transgender firefighter Jimmie Smith, upon diagnosis of what today would be called gender dysphoria, was persecuted by his employers. They attempted to force Smith out of his job through humiliating psychological tests and harassment about his presentation as female, prompting legal action backed by the EEOC. The Sixth Circuit Court of Appeals ruled in Smith’s favor, given that, “Sex stereotyping based on a person's gender non-conforming behavior is impermissible discrimination…” [7]Citing Price Waterhouse as a precedent, the Court determined that gender stereotypes simply cannot be the basis of employee treatment, and as such, both Hopkins’ cisgender non-conformity to femininity and Smith’s transgender nonconformity to masculinity are both protected by Title VII. This bodes favorably then for the EEOC in their upcoming Supreme Court case, especially given that Price Waterhouse is the primary precedent basis; the upcoming ruling could cement the right to gender presentation protection, which would greatly further transgender rights in the workplace.
In contrast, the rights of sexual orientation minority groups are at a legislative disadvantage at present. In a reversal of Obama-era accordance with EEOC policy, the Trump administration ruled in 2017 that sexual orientation is not protected under the category of sex as classifiedby Title VII. [8] The EEOC maintains that sex and sexual orientation are inextricably linked, given that sexual orientation discrimination against an employee stems directly from the employer, “treating him or her differently for associating with a person of the same sex.” [9] Time and time again, however, cases involving discrimination against a member of a sexual orientation minority group have largely ruled in the plaintiffs’ favors only when that discrimination is on the basis of sexual stereotyping or gender role nonconformity, such as a well-manicured male employee or a female employee who eschews makeup and jewelry, rather than on the basis of that person’s sexual orientation, thereby sidestepping discussion of sexuality factors in the discrimination or harassment altogether. [10]
At present, one of the only cases to truly address same-sex discrimination is Oncale v. Sundowner Offshore Services (1998) in which the plaintiff, a heterosexual male, was sexually harassed by fellow heterosexual men on the oil rig where they were employed. This harassment include verbal and physical advances that were not inherently desirous in nature but nonetheless confirmed that same-sex harassment and discrimination are protected against by Title VII. [11] This opened up the possibility for conclusive protection of minority sexual orientations under the law, by means of a ruling that took the interpretation of discrimination on the basis of sex to include not only a disadvantageous working environment formed from a libertine harassment coded to sex, but also a hostile workplace still coded to sex but without the desirous motivation. The latter environment was and is largely experienced by LGBTQ employees facing discrimination: their harassers are not necessarily working from a licentious intent, but nonetheless are discriminating on the basis of sex, namely the sex of the LGBTQ employee’s partner or spouse relative to the abused employee’s own sex.
In 2000, Bibby v. Philadelphia Coca-Cola Bottling Co. restricted the potential for an all-inclusive ruling. John Bibby, a gay male employee of Coca-Cola Bottling Co., was subject to assault, verbal abuse, harassment, and preventable occupational hazards all with direct indication that his sexual orientation was the motivating factor behind the discrimination. The Third Circuit Court of Appeals adapted a concept from Oncale by ruling that Bibby had no grounds to claim a Title VII violation because a) he could not prove his coworkers were sexually harassing him from a sexually licentious angle, b) he could not prove there was an attitude of hostility towards males in general at the company, and c) he could not prove that the discrimination was due to a conflict between his self-presentation and male stereotypes. [12] As such, the Court shut down this direct claim to protection for LGBTQ employees through what is effectively a loophole in the Title VII legislation that remains open today. The scope of possibility for Supreme Court rulings on this matter has hence been limited, and leaves the Supreme Court with limited precedent options in consideration of the upcoming cases.

At present, there is certainly a wealth of national support for protecting LGBTQ employees, given that approximately 69% of Americans support the idea of protective clauses for the LGBTQ community, across party, religious, gender, and state lines. [13] As of 2018, 22 states plus Washington D.C. offer equal protection against discrimination for sexual and gender minorities, and many counties and cities have similar protective policies for their LGBTQ residents despite the lack of a nationally recognized protection. [14] These regulations are not new, but their patchy enforcement and the lack of a national rule in place leave vulnerable groups exposed to hurt. In recognition of this, and despite the tenuous state of the upcoming Supreme Court rulings, the 116th Congressional House of Representatives introduced a bill on March 13, 2019 known as the Equality Act, which would amend several pieces of legislature including the Civil Rights Act of 1964 to include explicit mention of sexual orientation and gender identity groups as protected classes in terms of employment, public spaces, housing, legal representation, and more. [15] If it passes, this will be the confirmed protection that the Supreme Court cannot currently guarantee from precedent or possible future outcomes.
The future of equal rights employment policy hangs in the balance, with as few as nine votes ultimately determining the workplace safety and dignity of LGBTQ employees around the country for, potentially, decades to come. There is legal backing, logic, and abstracted precedent to support rulings in favor of expanding protective rights, but in the same breath there is substantial precedent to counter such expansions. With the Equality Act of 2019 on the horizon as well, the United States government has ample opportunity to update the laws to match the workforce, just as was done with the original passage of the Civil Rights Act and its subsequent rulings. America must now wait to see who among them are considered equal with “liberty and justice for all,” not only in theory, but in concrete legislative dignity as well.
